Dear Mr. Cron:
The following action was taken by the $outhold Town Planning Board
at a regular meeting, Monday, February 8, 1982:
RESOLVED that whereas, a formal application for the approval of a
subdivision plat entitled Minor Subdivision of Little Bay Estates
(formerly David Brawner) was submitted to the Planning Board on
June 17, 1981, and an application fee of $100.00 was paid on October
13, 1981, and
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on February 8, 1982
at 7:45 p.m., and
WHEREAS, tha requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of Little Bay
Estates for approval of said subdivision plat prepared by Young &
Young, dated January 8, 1981, amended April 10, 1981, June 3, 1981
and November 25, 1981 be approved and the chairman be authorized to
endorse approval on said subdivision plat and the Southold Town Plan-
ning Board override Suffolk County Planning recommendations number
five (5) and number six (6). This approval is subject to the follow-
ing condition:
Receipt of the filed covenants and restrictions
as approved by the Town Attorney, within six
months of the date of resolution
Upon receipt of the above mentioned covenants and restrictions
and three (3) copies of the approved maps, the chairman will en-
dorse his approval.

the file seems to indicate that the necessary covenants were not
received by you and therefore the map was never signed.
I understand that building permits have been issued in regard to
this property. We are representing someone who is about to
purchase lot number 4 and the open space-natural reserve area.
Our client plans on building within a reasonably short period of
time and therefore we wish to be sure that the subdivision
process was completed and the appropriate and necessary building
permit can be issued upon submission of application, plan, etc.

MINOR SUBDIVISION - ACCESS ROAD
COMMENTS:
I made an inspection of the above access road on April 14th with
Mr. E. Wysocki, owner's contractor for the the road work. The
addition of loam on the gravel surface had not been spread evenly.
The contractor will bring equipment to the site to correct this
condition and will notify me when the work is completed.
After notification by contractor that the road surface had been
corrected, I made another inspection on April 22, 1983. The loam'
had been leveled on the gravel course and the access road is now
in a satisfactory condition.

COMMENTS:
I made an inspection of the above access road today° Mro Edward
Wysocki, owner's contractor for the work, was present°
The material brought in for the road section is coarse and fine
gravel with asmall percentage of sand. It is dredged material
from nearby ferry slips and is satisfactory for road construction°
However, it does require the addition of loam on the top surface
to consolidate the gravel°
Otherwise the roadwork is satisfactory as to topsoil stripping,
width~ depth of gravel (6" to 8"), etCo

1his might present a drainage problem for t~e road. Providing the irrigation pond at
Lot No. 3 is to be kept, a low point in +Sue road pxoz~le could be established there
wi*~ ~*lat plus grades to *due north and south ends of ~e road. A pipe could be
olaced under the road at the l~ point to carry runoff to +he oond. Some field
elew*ions are necessary to show if this procedure would be workable.
kuouher way to t~ke care of road drainage using tbs existing ground proCile would
be to excavate a trench at say 3 ft. in width at bh~ sides of the rc~d down to sand
and gravel. Backt'~ll trenches with sand and gravel to act as s.~nd drains.
O+her recommendations:
1. Strip topsoil and replace ssms volume with suitable material.
2. ."he road width to be 16 ft. in ~ddth.
3. ~ 16ft. width to be bank n]n with ,:0;~ of gravel for 6" in deoth on top of
~he topsoil reolacement material.
4. The road profile should be above the adjacent ground level.

The Suffolk County Department of Health Services has
indicated its agreement with the lead agency designation.
Prior to approval of sanitary facilities, we would normally
request a satisfactory test well and test hole.
The project will meet all the requirements of the Code of
the Town of Southold Subdivision of Land Regulations.

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on January 6,
1982, revi~yed the pre~ subdivision plat entitled, "Minor Subdivision -
Little Bay ~states', referred to it pursuant to Section 1333 of the Suffolk
County Charter. After due study and deliberation it resolved to approve said
map subject to the following seven conditions deemed necessary to ~lp preserve
the traffic safety and carrying capacity of Main Road, a~t~-ro~d; to alert
prospective owners of lots within the subdivision that they are in close prox-
imity to Charles Rose Airport and may be subjected to noise resulting from air-
port activities and aircraft; and to help avoid pressures from these future
residents to close the airport or to curtail its activities because of noise
resulting from the use of the facility:
1. No lot line shell be changed in any manner at any future date unless
authorized by the Town of Southold Planning Board.
All stormwater runoff resulting from the development and improvement
of this subdivision or any of its lots shall be retained on the site
by adequate drainage structures so that it will not flow out into the
right-of-way of Main Road.
3. No sanitary disposal facility shall be installed or constructed with-
in 100 feet of the irrigation pond.
Approval of this subdivision shall be made subject to the subdivi-
sion's meeting the requirements and standards of the Suffolk County
Department of Health Services.

The recording in the office of the County Clerk of covenants and
restrictions advising all prospective purchasers that this sub-
division is located within one mile of Charles Rose Airport and
maybe subjected to noise from the operation of that facility and
noise from aircraft flying overhead or nearby.
Ail residential structures that are erected within this subdivision
shall be constructed using materials and techniques that will re-
duce interior noise levels in accordance with the recommendations
of the Department of Housing and Urban Development or other author-
ity that has promulgated standards for reduction of noise levels.
The above conditions shall be filed as covenants and restrictions in
the office of the County Clerk on or prior to the granting of appro-
al to this subdivision.

In connection with the above captioned, I am enclosing
herewith a duly executed duplicate original of Declaration of
Covenants and Restrictions, which hopefully, will be eliminate
the objections set forth by the Suffolk County Department of
Planning in their Letter to ypu dated August 11, 1981. ~.
I trust that the Declaration restricting the open space-
natural preserve area to such a natural and perpetual use, will
be sufficient for the Suffolk County Planning Board to reconsider
its position with respect to the proposed four lot minor sub-
division. In this regard, it is respectfully submitted that only

I trust that we might also eliminate the need for furnish-
