COMMENTS: I inspected the above subdivision site today to determine the amount of construction work, as shown in the bond estimate, that has been dine to date. 1. Tbpsoil was strivped under the road sections. 2. Roads were rough graded. 3. Some sand and gravel (small amount) was brought in for pavement subbase. 4. The recharge basin was excavated (no final trimming). No other work of any kind was accomplished. I verified the above notations ( 1. to 4.) with Mr. Tkrry Latham whose firm started construction work on this project. Also, I made a report, No. 147 dated 9/16/80, on the status of bond estimate work on 4 subdivisions. Soundview Estates was included. Notes at that time indicated that roads were rough graded only and the recharge basin was roughed out,. Also, as of the present, time, +he area is grown over so much that it is difficult to see where any work, with exception of the recharge basin excavation, was done. �XJac-rd." Davis DATE: January 8, 1983 RE: SOUNDVIW ACRES AT ORIENT RELEASE OF BOND, ETC. COMMENT5: I inspected the above subdivision site today to determine the amount of construction work, as shown in the bond estimate., that has been done to date. 1. Tbpsoil was stripped under the road sections. 2. Roads were rough graded. 3. Some sand and gravel (small amount) was brought in for pavement subbase. 4. the recharge basin was excavated (no final trimming). No other work of any kind was accomplished. I verified the above notations ( 1. to 4.) with Mr. Terry Latham whose firm started construction work on this project. Also, I made a report, No. 147 dated 9/16/802 on the status of bond estimate work on 4 subdivisions. Soundview Estates was included. Notes at that time indicated that roads were rough graded only and the recharge basin was roughed out. Also, as of the present time, the area is grown over so much that it, is difficult to see where any work, with exception of the recharge basin excavation, was done. The first inquiry is what the Planning Board will allow as to the sale. The filing of a subdivision map and the posting of a bond to make improvements within a specified period of time does not prevent the sale of the property. Your next question is the status of the passbook held by the Town. When the Planning Board approved this subdivision, it did so on the condition that the ''applicant" make the specified improvements within the time limit set by the Planning Board. Unless relieved of this responsibility by the Town, the "applicant" is bound to make the improvements required and, in default thereof, the Town has the right to determine that the "applicant" has defaulted and may use the proceeds of the passbook to complete the improvements. "Applicant" cannot relieve himself of this responsibility by merely conveying the property within the subdivision. I hope that this answers the questions posed. Yours very truly, ROBERT W. Brush, Secretary Re: Soundview Acres at Orient Dear Muriel: After we communicated with Mr. Carl Hornwood relative to securing a 4% inspection fee in the sum of $3, 080. 00, we received a letter from Mr. Hornwood questioning the imposition of the 4% fee on both the administrative cost of $3, 210. 00 and increase cost due to inflation over a three year period of $9, 700. 00. In other words, Mr. Hornwood feels that the 4% inspection fee on the roads should not cover those two items . It would seem that after reviewing the engineer' s report of September 18, 1975, that a great deal of merit exists with respect to Mr. Hornwood' s claim. Since the sole purpose of the inspection fee is to examine the roads during the course of their construction, it would certainly seem that the administrative cost and inflation- ary expectations should not enter into such charges.
