The following action was taken by the Southold Town Planning
Board at a regular meeting July 28, 1980.
RESOLVED, that whereas, a formal application for the approval
of a subdivision plat, entitled Minor Subdivision of Lloyd E. Terry
~as submitted to the Planning Board on May 13, 1980, and au
application fee of $100.00 paid on May 13, 1980, and
WHEREAS, a public hearing was held on the said subdivision
application and plat at the Town Hall, Southold, New York, on
June 30, 1980 at 7:30 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been m~ by said subdivision plat and
application,
Now, therefore, be it RESOLVED that the application of Lloyd
E. Terry for approval of said subdivision plat prepared by Roderick
Van Tuyl, P. C. and dated April 16, 1980 and amended May 15, 1980
be approved and the chairman of the Planning Board be authorized
to endorse approval on said subdivision plat subject to the
following:
1. Receipt of covenants signed by the applicant and in
recordable form stating that the property to the south owned by
Mr. Terry will be developed as a major subdivision if it should
come before this board in the future.

COMMENTS~
I made an inspection today of the road improvements in the 25 ft.
R.O.W.
My recommendations for updating the existing farm road (Report 197
dated 10/9/81) were 6" of 30% gravel bankrun, a 2" top course
of stone blend and a road width of 12 ft.
The road as built is 16 ft. in width. The gravel used was not
bankrun. It came from dredging operations at the Orient Ferry
and was mixed with sand and loam on the site. The gravel content
is probably around 50% or more. Also, the gravel mixture depths
are considerably more than the 6" thickness called for. Some of
the road sections are 12" ± in depth.
The side road (also 16 ft. wide) and a turnaround with a 90 ft.
diameter have also been completed.
No stone blend top course was placed.
The surface of the roads are in good condition. With the additional
depth of the road section, the stone blend would not be necessary.
I recommend approval of road as now constructed.

Mr. Terry accompanied me on the. inspection.
No improvements have been made on this existing road to date which consists of a
one way (9~ ft. width) of consolidated original ground. Eventually, ~ir. Terry
intends to improve the road by addition of gravel. ~he easterly spur road
and turning area would als0 have a gravel cotmse. The additioml reserved 25 ft~
width adjacent to the R.O.W. and additional widths on the spur rced are shown
in case a major subdivision were to be cousidered.

Dear Mr. Raynor:
We have received a letter from the Suffolk County Depa=tment
of Planning, dated October 3, 1980, setting forth therein a number
of conditions to be imposed relative to the above-captioned minor
subdivision.
With the exception of Condition #6, we find no objection to
the conditions set forth in that letter. However, we do strongly
object to Condition #6 which provides for the elimination of lot
#4 from the above captioned minor subdivision, approval of which
had been heretofore secured from the Southold Town Planning Board.
In accord with the Board's request, we had prepared and had
executed by our client a covenant not to further subdivide the
remaining large acreage unless same was done with approval of the
Southold Town Plan~ing Board. The original of the executed cove-
nant was forwarded to the Planning Board.
In the light of the fact that it is in the interest of the
Town of Southold to maintain as much open land as reasonably
possible, we would respectfully submit that the four lot minor
subdivision as proposed by our client achieves that purpose in
the light of the fact that the remaining large acreage will re-
main open land and only subject to further development upon
approval of the Southold Town Planning Board. Surely, one would
not argue that it would be better to cause a major subdivision
of the entire land to be filed as against that which has been
proposed, and approved by the Southold Town Planning Board. In

the light of the foregoing, we would respectfully request that
the Southold Town Planning Board override the condition numbered
6 as set forth by the Suffolk County Planning Commission in the
letter of the Suffolk County Department of Planning dated

617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that Southold Town Planning Board as lead agency
for the action described below has determined that the project will
not have a significant effect on the environment.

DESCRIPTION OF ACTION
The minor subdivision of Lloyd Terry is a four-lot residential
subdivision of 7.39 acres located at Orient in the Town of Southold.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental Assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned.
The New York State Department of Environmental
Conservation has indicated that because the subdivision
is within 300 feet of tidal wetlands and waters a permit
will be required from the NYSDEC pursuant to ECL Article
25 N6NYCRR Part 661, Section 661.5 Item #57.
The Suffolk County Department of Health Services has
indicated that a precursory review indicates that
conditions are adequate for installation of individual
sewerage facilities; however, the quantity and quality
of the water supply is questionable.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

The SuffolkCounty Planning Commission will not review the
minor subdivision of Lloyd Terry until it has a satisfactory
explanation as to why it is not considered a major subdivision
as it contains five lots.
In conversation between myself and Charles Lind, Chief
Planner, Mr. Lind indicated that a declaration that the
remainder of the property will only come in asa major subdivision
might be acceptable to the Commission.
It will be Mr. Terry's decision as to whether he would like
to provide such a covenant or eliminate a lot.

The Suffolk County Planning Commission at its regular meeting on December 7,
1977, reviewed the proposed subdivision plat, entitled, "Minor Subdivision - Lloyd
E. Terry", referred to it pursuant to Section 1333 of the Suffolk County Charter.
After due study and deliberation it resolved to approve said map subject to the
following conditions which are deemed necessary for the protection of the shoreline:
1. No clearing, except that required for ordinary maintenance, or grading
is to be done within the setback area along the top of the bluff and on the face
of the bluff in order to help prevent the erosion of the bluff.
2. No stormwater resulting from the development and improvement of the sub-
division or any of its lots is to be discharged over the top edge of the bluff or
down its face in any manner.
3. Access to the beach is to be restricted to a single location on each
lot and then only by a suitable structure designed and constructed so as not to
disturb the stability of the bluff.
4. No sanitary disposal facilities shall be located within 100 feet of the
top of the bluff.
5. There shall not be any further subdivision of this property without the
review and approval of the Town Planning Board.
The Commission also offers the following cormnents on the map for your
use and consideration.
Consideration should be given at this time, if it has not already been done
to the placement and reservation of the proposed right-of-way for the proposed
Town collector road that will run parallel to and about 500-600 feet south of the
bluff in this vicinity.
