Dear Mr. Glickman:
The following action was taken by the Southold Town Planning Board,
Monday, December 22, 1986.
RESOLVED that whereas a formal application for the approval of a
subdivision plat entitled "Howard Hoey" located at Orient was submitted
to the Planning Board on April 24, 1985 and, filing fee was paid
on April 24, 1985, and
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on December 8, 1986
at 7:45 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of the
Town of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of Howard Hoey
for approval of said subdivision plat prepared by Rod Van Tuyl dated
as las revised October 23, 1986 be approved and the Chairman
be authorized to endorse approval on said subdivision plat, subject
to the following:
1. Consideration of the comments of the Suffolk County Planning
Commission.

WITNESSETH
WHEREAS, Howard J. ~{oey, is the ~ner in fee simple of certain
pr~nises situate in the Town of Southold, Suffolk County, New York, described
on the Suffolk County Tax Map as District 1000, Section 019, Block 01.00
Lot 014.001, and in annexed Schedule "A", and
WHEREAS, the Southold Town Planning Board, by Resolution made on
March 24, 1986, approved a minor subdivision of said parcel in three(3)lots,
as shown on map of Roderick Van Tuyl, P.C. dated September, 1982 and last
amended October 23, 1986, and
WHEREAS, the Southold Town Planning Board approved said minor
Subdivision subject to certain Covenants and Restrictions, to be filed in
the Office of the Clerk of the County of Suffolk,
NOW, THEREFORE, in ccmpliance with the Resolution of said Southold
Town Planning Board, Declarant herein declares that the aforesaid land is
held and shall be conveyed subject to the following covenants and restrictions,
which shall run with the land.
1. No lot shall be subdivided or its lot lines changed in any manner
at any future date unless authorized by the Town of Southold Planning Board.
2. Any subdivision of any part of this tract in the future shall have
a map of the ~ubdivision filed in the office of the County Clerk.
3. All new driveways on Main Road shall made an angle of at least
70~. and preferable 90° with the state road.
4. All new driveways for lots having frontage on Main Road shall
have a turnaround provision, such as a T-shaped shunt, so that a vehicle
leaving a lot will not have to back out into the traffic stream on the read.

as follows:
BEGIR~ING at a point on the southerly line of Main Road at the north-
easterly corner of land of Koroleski and the northwesterly corner of the
premises herein described: RU~qING THENCE easterly along said southerly
line of Main Road, 659 f~et, more or less, to land of D~m~rest;

(1) Southerly about 2250 feet; thence

be constructed or otherwise located within 100 feet of the upland edge of
Tom Browns Creek and the wetlands adjacent thereto.
7. No storm~ater runoff resulting frcm the development and im-
prcwment of the subdivision or any of its lots shall be discharged into
the adjoining body of water or into the tidal wetlands Within the parcel.
8. A conservation or scenic easement having a minimum width of
50 feet landward frc~ the upland edge of the tidal wetlands within the
parcel shall be required to insure that no development adverse to the
aesthetic quality of the'shoreline will take place along the shoreline.
9. The oa,~%on lot line for Lots 1 and 2 shall be modified so ~that
if a road .i§ constructed within the panhandle of Lots 1 it will intersect
the State road at a right angle, as it is evident that the 50 foot wide
panhandle of Lot 1 has been laid out to accuL~odate a future road.

WHEREAS, the party of the second part is the owner of
certain lands situate at Orient in the Town of Southold, County
of Suffolk, State of New York, as described in Schedule A
attached, and
WHEREAS, in compliance with a Resolution of the Planning
Board of the party of the first part dated March 24, 1986, the
party of the second part has previously made a Declaration of
Covenants and Restrictions relating to the subdivision,
development and conservation of the premises described in
Schedule A,
which Declaration was recorded in Suffolk County on
April 27, 1987 in Liber 10303 cp 561; and
WHEREAS, the party of the second part has entered
into an
agreement to convey to The People of the State of New York a
portion of the above-described land as more particularly
described in Schedule B, attached, for purposes and in a manner

Dear Ms. Zielenski,
The Planning Board has received and reviewed your
correspondence of April 19, 1989 regarding the above-referenced
property.
The purpose behind the request for a partial release of the
covenants and restrictions on the Hoe¥ property appears to be
based on an assumption that the purchase of a portion of the
subject property by the State constitutes a subdivision of land
which must be sanctioned or approved by the Town Planning Board.
The proposed acquisition of a portion of Mr. Hoey's
property by the State of New York is not considered to be a
subdivision by this Board. Therefore, the Board sees no reason
for a partial release on the covenants and restrictions that
were placed on the Hoey property in 1987.
If the attorneys representing the State feel otherwise,
please have them provide this office with the appropriate legal
doct~mentation to support the State's request for a partial
release as stated in your letter of April 19, 1989.

NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review Act and 6NYCRR Part
617, Section 617.10 and Chapter 44 of the Code of the Town
of Southold, notice is hereby given that Southold Town Planning
Board as lead agency for the action described below has determined
that the project will not have a significant effect on the
environment.
DESCRIPTION OF ACTION
The minor subdivision of Howard Hoey is for 4 lot son
38 acres located at Main /Road, Orient.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effects to the environment
were likely to occur should the project be implemented
as planned.
Because there has been no correspondence from the Suffolk
County Department of Health Services, in the alotted time,
it is assumed that there are no comments or objections
from that agency.
Because there has been no corresondence from the NYS Department
of Environmental Conservation in the alotted time, it is
assumed that there are no comments or objections from that
agency.
The project will meet all the requirements of the Code of
the Town of Southold Subdivision of Land Regulations.

Southwesterly side of Main Road, a state road, opposite
the intersection of Old Main Road, Orient, New York.
Dear Mr. Orlowski:
The Suffolk County Planning ComMission at its regular meeting on April 1,
1987 reviewed the proposed subdivision plat, entitled, "Minor Subdivision -
Howard Hoey" referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to approve said map
subject to the following eleven conditions deemed necessary to help preserve the
traffic safety and carrying capacity of Main Road, a state road and to help
preserve the natural and aesthetic attributes of the shoreline of Tom Browns
Creek and the tidal wetland adjacent thereto.
It is evident that the 50 foot wide panhandle of Lot 1 has been laid out
to accommodate a future road. The angle that this road will make with the
State road is totally unsatisfactory as it does not intersect the State
road as close to a right angle as possible. Therefore, the common lot
line for Lots 1 and 2 shall be modified so that if a road is constructed
within the panhandle of Lot 1 it will intersect the State road at a right
angle.
No lot shall be subdivided or its lot lines changed in any manner at any
future date unless authorized by the Town of Southold Planning Board.
Since this tract has the potential to be further subdivided, any
subdivision of any part of this tract in the future shall have a map
of the subdivision filed in the office of the County Clerk.

6. Ail stormwater runoff resulting from the development and improvement of
this subdivision or any of its lots shall be retained on the site by
adequate drainage structures so that it will not flow out onto the
right-of-way of Main Road.
No new residential structure or sanitary disposal facility shall be
constructed or otherwise located within 100 feet of the upland edge of
Tom Browns Creek and the wetlands adjacent thereto.
No stormwater runoff resulting from the development and improvement of
the subdivision or any of its lots shall be discharged into the adjoining
body of water or into the tidal wetlands within the parcel.
A conservation or scenic easement having a minimum width of 50 feet
landward from the upland edge of the tidal wetlands within the parcel
shall be required to insure that no development adverse to the aesthetic
quality of the shoreline will take place along the shoreline.

Conditions 1-9, inclusive, shall be filed as covenants and restrictions
in the office of the County Clerk on or prior to the granting of approval
to this subdivision.
These covenants and restrictions can be modified only at the request
of the then owner of the premises with the approval of a majority plus
one of the Town Board and/or Planning Board of the Town of Southold
after a public hearing. Adjoining property owners shall be entitled
to notice of such public hearing but their consent to such
modification shall not be required.

The final map shall bear the following note: A Declaration of Covenants
and Restrictions has been filed in the Suffolk County Clerk's office
which affects lots in this subdivision.
The Commission also offers the following comments on the map for your use
and consideration:
It is suggested that before approval is granted to this subdivision
that the subdivider be required to submit this proposal to the Suffolk
County Department of Health Services for review to insure that the
proposed subdivision will meet the requirements and standards of that
agency.
Conditional approval of this subdivision does not in any way imply
approval of the layout of future subdivision of this tract that may be
presently under consideration.
The future subdivision of Lot 1 should be coordinated with the
proposed subdivision "Orient Park Estates" on the easterly side of
this tract.
The map of this minor subdivision should be filed in the office of the
County Clerk. This is to insure the validity of the subdivision map and
that the subdivision map will be available to the general public in a
central office of official records.

5. It appears that Charles Rose Airport is still functional as there are
two light planes parked on the site and the strip appears to be
maintained and useable. Our list of airports from the Federal
Aviation Administration does not list this facility. Therefore, it is
suggested that the following two statements be imposed upon this
subdivision as conditions of approval to avoid any future problem for
the Town of Southold should the airstrip be still active:
Ail prospective owners of lots within this subdivision shall be
advised that this subdivision is located within one mile of Charles
Rose Airport and, therefore, may be subjected to noise emanating
from the facility and from aircraft flying overhead or nearby.
Ail residential structures that are erected within this subdivision
shall be constructed using materials and techniques that will reduce
interior noise levels in accordance with the recormmendations of the
Department of Housing and Urban Development or other authority that
has promulgated standards for reduction of interior noise levels.

The Health Department's primary environmental concern pertaining
to development is that the applicant comply with the requirements of the
Suffolk County Sanitary Code especially Article V and VI, and relevant
construction standards for water supply and sanitary sewage disposal.
These considerations are to be reviewed completely at the time of
application. Full consideration in placement of water supply wells
and disposal systems is given to state and town wetland requirements.
The Health Department maintains Jurisdiction over final location of
disposal and well systems and the applicant should not undertake to
construct any water supply or disposal system without Health Department
approval.
