Ayes: Mr. Orlowski, Mr. Edwards, Mr. McDonald, Mr. Ward. Mr. Ward: Motion carried. PUBLIC HEARINGS Subdivisions - Final: 7: 30 p.m. Fred L. Terry Estate - This minor subdivision is a clustered subdivision of two lots on 33 acres located on the south side of Main Road, 2678 feet east of Narrow River Road in Orient. SCTM $1000-19-1-8. Is there anyone present that would have an objection to this subdivision? Is there anyone here that is in favor of this subdivision? Pete Danowski: I 'm representing the Terry family and obviously I am in support of the application. You are well- SOUTHOLD TOWN PLANWG BOARD 2 MARCH 1993 aware of this split off of one lot for Mr. Terry to deed out to his daughter that lives in the existing home on site. The one where the agricultural buildings surround the house that have been included in the lot and we have put a note on the map and given you a filed covenant in regard to the amount of acreage that is to be subtracted from Section Two, Lot Two in the future. Mr. Ward: Thank you. Are there any others out there that have any comments regarding this subdivision? If not, what is the pleasure of the Board. Mr. McDonald: Mr. Chairman, I would like to make a motion to close the hearing. Mr. Orlowski: Second. Mr. Ward: Motion made and seconded. All those in favor? Ayes: Mr. McDonald, Mr. Orlowski, Mr. Edwards, Mr. Ward. Mr. Ward: Motion carried. Mr. McDonald: Mr. Chairman, I would like to make a further motion. WHEREAS, Fred L. Terry is the owner of the property known and designated as SCTM #1000-19-1-8, located at the south side of Main Road, 2, 678 feet east of Narrow River Road in Orient; and WHEREAS, this cluster subdivision, to be known as Minor Subdivision, Section 1 for Fred L. Terry, Estate, is for two lots on 47. 554 acres; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8) , Part 617, declared itself Lead Agency and issued a Negative Declaration on March 6 , 1990; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on March 1, 1993 ; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; and be it therefore, RESOLVED, that the Southold Town Planning Board grant conditional final approval on the surveys dated November 10, 1992, and authorize the Chairman to endorse the final surveys subject to fulfillment of the following conditions. All conditions must be met within six ( 6) months of the date of this resolution. SOUTHOLD TOWN PLANWG BOARD 3 MARCH 1993 1 . Submission of a copy of the recorded Declaration of Covenants and Restrictions, and notation of the Liber and Page number of the recorded Declaration on the final plans ( 2 mylars and 5 paper prints) . 2. Submission of a deed (for the newly created Lot 2) which notes that Lot #2 contains 33,000 square feet of the clustered open space for Section One, Lot No.l of the subdivision. In addition, please note that the building envelope shown for Lot No. 1 excludes an existing greenhouse and part of an existing shed. These structures should have been included within the building envelope for the lot. This omission is noted for the record, however, the Planning Board is not requiring that the map be amended to show this. Mr. Edwards: Second. Mr. Ward: All in favor? Mr. Danowski: May I interrupt just for a second? Mr. Danowski: When Mr. McDonald read that and the question about deeding to myself, I think I had raised once before. I think we had resolved that by saying we all clearly understand that I am filing and recording a covenant saying that section two, lot two, if it ever does become subdivided will have to loose the square footage that has been used up for lot one. But, it makes no sense to deed to myself, Mr. Terry owns it and I don' t know what the County Clerk will look at when he sees this deed, Mr. Terry to Mr. Terry with the next described subdivision will definitely deed out lot one from Mr. Terry to Mary Ellen Stevens, the daughter. But, the reference of the resolution now moving on I think should say, should delete out the requirement of Mr. Terry deeding to himself lot two. It never made much sense when it was first discussed before this Board and I think it has been over looked in preparing the resolution tonight. That requirement I thought, would not be necessary and my thought for that was that you certainly wanted to protect in the future section two, lot two and the subtraction of acreage and have a recorded covenant and I agree to that and we've got the forms signed and we will record it and bring it back. But as far as requiring me to deed Mr. Terry' s land to himself again doesn' t create anything. Mr. McDonald: You will have to help me. You are going to create two new lots where there is one. It will have to be described some how or another. Mr. Danowski: Yes, you have got on file with yourself, the subdivision map which contains section one and section two. The County Clerk will have recorded and filed section one of that t SOUTHOLD TOWN PLANOG BOARD 4 MARCH 10993 map. Section one, lot one, it is the whole section and they will also have a recorded covenant which says, the minor subdivision has been created, there is a section two and on that section two, we have used up so many square feet of land. That will be a recorded covenant, recorded with reference to a described area or section but it is not a deed that is all I am saying. Ms. Scopaz: Would that be attached to the deed? Mr. Danowski: We can do anything you want. It is going to be a recorded covenant that covers your conditions. It is just that you recited that we were going to prepare a deed to lot two, that the large tract of land, that would make no sense. Once we subtract out lot number one, what is left is section two, call it lot two. Mr. McDonald: O.K. , you are going to record a covenant and restriction, file it with the liber and page number? Mr. Danowski: Yes. Mr. McDonald: That is all we need then. Mr. Danowski: Yes, right. Mr. McDonald: Any disagreements? I amend the statement to reflect my resolution to reflect that condition. Number two is eliminated. Mr. McDonald: Amended and seconded. All those in favor? Ayes: Mr. McDonald, Mr. Ward, Mr. Orlowski, Mr. Edwards. Mr. Ward: Opposed? Motion carried. Mr. Danowski: Thank you and good evening. I appreciate you doing that tonight. Hearings Held Over From Previous Meetings: Mr. Ward: Hillcrest Estates Section 2 - This major subdivision is for 20 lots on 22. 9 acres located in Orient. SCTM #100013-2-8. 2. Mr. McDonald: I move that we hold this open. Mr. Orlowski: Second. Mr. Ward: All those in favor? Ayes: Mr. Orlowski, Mr. McDonald, Mr. Edwards, Mr. Ward. WHEREAS, as a condition of approval of a two lot minor subdivision plan, the Southold Town Planning Board has required the within covenant to be recorded at the Suffolk County Clerk 's Office; and WHEREAS, Lot No. 1, Section One shall be filed with the County Clerk; and WHEREAS, the total area of Lot No. 1 is 47, 000 square feet; THEREFORE, it is hereby covenanted and agreed that when Section Two is subdivided, the yield shall be determined after first subtracting 33, 000 square feet in area from the land within the R-80 Residential Zoning District, because said land represents the clustered open space for Section One, Lot No. 1, of the subdivision map being approved by the Southold Town Planning Board. Terry Estate - Minor Subdivision Dear Sir or Madam: I am forwarding this letter just to advise the Board that, although we have carried the name on the subdivision map "The Fred L. Terry Estate", the correct owner of the property is Lloyd E. Terry. Therefore, at the time we deliver the mylar and paper- prints, we will have Lloyd E. Terry 's name indicated as the owner of the property on the maps. This is done to avoid any confusion, inasmuch as Lloyd E. Terry ' s father was Fred L. Terry, and his son is also Fred Terry. In the beginning of the subdivision process prior to my involvement, the name "Fred L. Terry Estate" was put on maps because Fred L. Terry had originally been the owner of the property and his name appeared on old maps. I will soon be delivering back to the Planning Board proof` of the fact that I have recorded a covenant with the County Clerk. Very truly yours, PETER S. DANOWSKI, JR. Orient SCTM# 1000-19-1-8 Dear Mr. Dowling: In response to your telephone conversation of this morning with Melissa Spiro, please find the additional information in regard to the above mentioned subdivision. 1• There are no future plans for Lot Number 2 of the subdivision. The purpose of this two lot subdivision is to create a separate lot for the existing house so that it can be deeded to a family member. The remaining parcel, an active farm, will remain in family ownership. 2 • As per the Town Code, on lots of ten ( 10) or more acres in the R-80 and R-200 Districts, clustering is required. Therefore, any future subdivision of Lot Number 2 would be clustered subdivision. 3 • As per the Real Property Tax Map, the "Taking Area" is owned by the State of New York. But, the area shown as the Open Space Conservation Easement" is part of the Fred L. Terry, Est. Therefore, if in the future a subdivision is proposed for the larger parcel, such Taking Area would not be included in the subdivision. The final public hearing will be scheduled upon receipt of five ( 5) paper maps and two ( 2) mylar maps all containing the Health Department' s stamp of approval. The revised maps have been forwarded to the Suffolk County Planning Commission for review. You will be notified when the Planning Board receives the Commission' s comments and if any covenants and restrictions will be required. The following information must also be submitted before the final hearing: 1 . Documentation that the N.Y.S.D.E.C. Taking Area has been finalized, including a metes and bounds description of the area. 2 . Clarification as to whether the area designated as Open Space Conservation Easement is part of the taking area, or remains under the ownership of the Fred L. Terry Estate. 3 . Clarification as to whether the existing right-of-way shown on the eastern property line continues to the southern end of the property, or terminates as shown. 4. The final maps must be revised as follows: A. The map must state that the subdivision is a cluster subdivision in accordance with Section 281a of the New York State Town Law. B. The total area of Lot 1 as shown is 47,000 square feet. Therefore, the amount of land to be subtracted when determining the yield for Lot 2 is 33,000 square feet. The notation on Lot 2 should be revised accordingly. C. A building envelope for each lot must be indicated on the final map. I have been visited by Mary Ellen Stevens, Mr. Terry' s daughter, who, along with her husband, would be the recipient of Lot No. 1 should the Planning Board approve the variable lot size subdivision. I recognize there may have been prior discussions with regard to this map, which I was not privy to. The family would like to transfer Lot No. 1 as proposed as soon as possible. They would also like to keep all the agricultural buildings with the large lot identified as No. 2. As a result of their desire to segregate the residential home from the remaining farmland, they have drawn the lot line as proposed. I would like an opportunity to discuss this proposed map with the Planning Board, either at a work session or at the end of a Planning Board meeting. T.P.I.N. 1000-019-01-8 Dear Mr. Orlowski: The Suffolk County Planning Commission at its regular meeting on February 7, 1990, reviewed the proposed subdivision plat, entitled, "Minor Subdivision - Fred L. Terry, Est." referred to it pursuant to Section A14-24, Article XIV of the Suffolk County Administrative Code. After due study and deliberation it resolved to disapprove said map for the following reasons: The proposed subdivision will result in the creation of a landlocked parcel; that is, a parcel that does not have frontage on an existing or proposed public road. The creation of such a lot is contrary to good subdivision layout principles and creates problems as far as access by emergency and service equipment is concerned. This lack of access could result in health, safety and welfare problems for the future residents of landlocked lot(s) , not to mention potential disputes over the use and maintenance of any right-of-way over an adjacent parcel that may be created for the purpose of access. The Commission also offers the following comments on the map for your use and consideration: 1. It is suggested that before any application for subdivision of this tract is considered it be submitted to the Suffolk County Department of Health Services for review to insure that the proposed subdivision will meet the requirements and standards of that agency. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially- large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the impact is actually important. The reviewer is not expected to be an expert environmental analyst. • Identifying that an impact will be potentially large (column 2) does not mean that it is also necessarily significan Any large impact must be evaluated in PART 3 to determine significance. Identifying an impact in column 2 sim asks that it be looked at further. • The Examples provided are to assist the reviewer by showing types of impacts and wherever possible the threshold magnitude that would trigger a response in column 2. The examples are generally applicable throughout the State a for most situations. But, for any specific project or site other examples and/or lower thresholds may be appropri. for a Potential Large Impact response, thus requiring evaluation in Part 3. • The impacts of each project, on each site, in each locality, will vary. Therefore, the examples are illustrative a. have been offered as guidance. They do not constitute an exhaustive list of impacts and thresholds to answer each questic • The number of examples per question does not indicate the importance of each question. • In identifying impacts, consider long term, short term and cure ative effects. Instructions (Read carefully) a. Answer each of the 19 questions in PART 2. Answer Yes if there will be any impact. b. Maybe answers should be considered as Yes answers. c. If answering Yes to a question then check the appropriate box (column 1 or 2) to indicate the potential size of ti impact. If impact threshold equals or exceeds any example provided, check column 2. If impact will occur but thresho. is lower than example, check column 1. d. If reviewer has doubt about size of the impact then consider the impact as potentially large and proceed to PART - e. If a potentially large impact checked in column 2 can be mitigated by change(s) in the project to a small to moderat impact, also check the Yes box in column 3. A No response indicates that such a reduction is not possible. Th must be explained in Part 3. 1 2 3 Small to Potential Can Impact Be IMPACT ON LAND Moderate Large Mitigated By 1 .
