Dear Gentlemen,
Enclosed is a copy of a letter I wrote to the Southold
Planning Board last July. The letter explains a problem I've
had with the Planning Board in regard to property that lawn.
Before I ask you to examine that letter I.would like to say
a few words that may help you understand the situation.
In the spring of 1981 I purchased 6~ acres of property
in Orient. That purchase was the culmination of years of
looking at property and years of saving money. I love the
property and love the community of Orient. It is my desire
to build a homestead on the property and raise a family there.
i-Iy problem with the }Clanning Board arose somewhat by
accident. As you can see on the enclosed map, I own three
2-acre parcels of a minor subdivision and j,lr. David Horton
owns the remaining 2-acre parcel. I also own a three-quarter
interest in the subdivision's 50-foot right-of-way and j'lr.
Horton owns a one-quarter interest. (All of the property is
unimproved and the right-of-way exists only on paper.) Since
[.:r. i-:orton does not need access via the right-of-wa~ we mu-
tually decided that it would be better if I solely wned the
right-of-way. ',Ie also agreed that it was unnecessar for the
right-of-way to be 50 feet. '.
This matter was routinely brought up at the Flanning
Board's ''i.ay 11, 1981 meeting. The results of that meeting
gave me quite a shock. It was disclosed (in a very unclear
manner) that the rlanninG Board might want the right-of-way
for a town road. Since then, my dealings with the rlanning
Board have centered on this town road issue. It has cost me
alot of time, it has caused me alot of apprehension, and this
past spring I canceled plans to build because of it. To be
plain, I do not want a town road through my property and
certainly would do everything in my power to fight it.
I think this serves as sufficient explanation to the
rlanning Board letter enclosed.
As a postscript to the letter: The }'lanning Board intro-
duced the fact that they had received correspondence from me
at their Aug. 2, 1982 meeting. [',r. Raynor asked for any dis-
cussion. One board member muttered, "we may need it soon."
~r. Raynor then called for a vote and the board voted to have
the right-of-way remain 50 feet.

I would like to make it clear that it is not so much the
Planning Board's refusal to change the right-of-way status
that disturbs me but that their reason for not changing it
hinges on their prerogative to claim it for a town road.
One final note. My attorney has been in touch with
the town attorney, Robert Tasker, about this matter. Mr.
Tasker indicated that Southold Town would have to prove
public need in order to condemn the right-of-way and one of
the conditions of that public need would be if the Demarest
property had no access to a public road. (As I pointed out
in my July 19 letter, the Demarest property has more than
adequate access.) Inlight of this, perhaps the Planning
Board would be well advised to confer with legal counsel
before they suggest to a property owner that they may want
to take his land. I hope the Planning Board's arrogant and
misinformed cond"c1. in this matter does not reflect the
attitudes of Southold government as a whole. I would very
much welcome any thoughts the Town Board might offer me in
this concern.

Mr. Horton has approximately 275 feet
of road frontage on Platt Road and there-
fore does not need further access.
It is my desire (with Mr. Horton in

Persuant to our meeting with you on April 9th and in accordance
with your request, I am enclosing six additional prints of the
above minor subdivision as modified. This letter will also
serve to advise you that upon final signature by your Board and
upon completion of the necessary filings of the map and any
other procedures required by law, the previous four-lot minor
subdivision of this property shall be deemed abandoned by the
applicant, the present three-lot subdivision to take the place
thereof.
Please provide me with a signed copy of the map and advise me of

Dear Board Members:
Enclosed herewith please find a further proposed modification
of the above four-lot minor subdivision resulting in a reduc-
tion in density to three lots while retaining the 50 foot right-
of-way which has been relocated to the northwesterly portion of
the property.
My client does not plan to improve such right-of-way prior to
the issuance of a building permit upon parcel number 2 and the
enclosed proposal is made with such specific understanding.
Needless to say, neither proposed parcel 1 nor proposed parcel 3
nears such right-of-way since each of such parcels has frontage
on Platt Road. We understand that access to parcel 2 must meet
the standards of Town Law ~280-a at such time as it is improved.
I would appreciate your letting me know if the above proposal
would be acceptable and whether or not we should make formal
application therefor.
