Re: Your letter of January 20, 2000 concerning residential-use access
over SCTM #1000-018-06-014.9
Dear Mr. Latham:
Members of the Committee and Planning Department staff visited the site,
in order to better understand the condition of the site and the purpose
of your request. This matter was then discussed at length during the
regular Committee meeting of February 7, 2000. I regret to advise you
that the Committee has determined they are not able to honor your
request for a residential use right-of-way over the above noted parcel
in order to access the parcel identified as SCTM #1000-018-06-014.8.
Such an approval-action would constitute an alienation of the existing
town-owned Development Rights Easement terms and is therefore, not
favored.
Alternatively, the Committee' suggests you attempt to negotiate a right-
of-way access over the easterly adjacent lands of John Tuthill, to achieve
the same desired result.
I trust you are aware of the requirement that you need to receive a sub-
division approval from the Town Planning Board prior to closing your
contract of sale to Whitmore Nursery. This requirement itself will need
to address the matter of access to the 4-acre parcel you wish to retain
in your ownership.
I wish you success as you may decide to approach your neighbor to secure
an acceptable (alternate) route of access to the parcel,

State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an order['/ manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the enwronment or may be technicall~"expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader cc~ncerns affecting
the question of significance. '
The full EAF is intended to provide a method whereby applicants and agencies can be assured that thb determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a prolect or action.
Full EAF Components: The full EAF is comprised of three parts:
Pa;t 1: Provides obiective data and information about a given project and its site. By idenl~ifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2,and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a proiect or action. It provides
guidance as to whether an impact is likelv to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

Attached please find a request the Planning Board received from Edward
Latham for reimbursement of the application fee for the above mentioned
proposal.
Edward Latham submitted a $250.00 application fee for the set-off on
September 30, 1994 (Minor Subdivision #858). In addition to staff meeting
numerous times with Mr. Latham, the proposal was reviewed by the
Planning Board, the Town Trustees and the Suffolk County Planning
Commission. A coordinated environmental review was conducted and sketch
approval was granted by the Planning Board. The last action on the
proposal was in July 1995, at which time the Planning Board was awaiting
the submission of final maps with Health Department approval and the
preparation of a Declaration of Covenants and Restrictions prior to taking
action on the final map.
Due to the fact that the proposal was at the final stages and as mentioned
above, much time was spent on reviewing the proposal, the Planning Board
does not recommend that the application fee be reimbursed.

I have discussed the Notice of Incomplete Application you received from
the Health Department with both the Planning Board members and Roy
Reynolds of the Health Department. As you know, the Planning Board
required that you designate the areas of the subject property where the
development rights have been sold and where development rights have
been retained. However, since your property has multiple tax map
numbers, the Health Department is viewing the proposal as a six lot
subdivision.
In order to proceed with the set-off as proposed, you must obtain Health
Department approval. Therefore, to satisfy the Health Department. the
map must be amended to remove the above mentioned designation, and to
show the entire property as one parcel.

at a meeting held on Monday, February 6, 1995:
BE IT RESOLVED to adopt the January 5, 1995 Sur;'olk County Planning
Commission report.
Condition Number I of the Planning Board's conditional sketch approval
contained the following terms:
I. The 2.975 acre area shown on the set off: map shall not be
considered a building lot. This area Is located within the R-200
Zoning District. Thus the buildable area (2.975 acres) does not
meet the minimum lot area requirements of the R-200 District.
Although the 2.975 acre area is shown as a separate tax parcel, It is part of
Lot #I. The development rights have been sold on parts of: Lot #I. The
development rights were not sold on the 2.975 acre part of Lot #I.
Condition Number 1 of the conditional sketch approval and the ~:ollowing
paragraph, must be presented in a Declaration of Covenants and
Restrictions in proper legal form.

your letter dated November 21, 1994, concerning the above-referenced project. The Department
has no objection to your designation as lead agency.
Based on a review of the subject coordination, the Department offers the following
comments. However, the Department wishes to reserve its right to provide more detailed
information within the comment period(s) established for this action. These comments should
not be construed as an implicit SCDHS approval or rejection of the project. All applications are
reviewed thoroughly with respect to Suffolk County Sanitary Code concerns by appropriate
departmental personnel when SCDHS applications are completed.
Article VI Application Status;
Future development of the 5.0 acre parcel will require submittal of an application to the
Suffolk County Department of Health Services as required by Article VI of the Suffolk County
Sanitary Code (SCSC).
SCDHS Compliance Requirements and Jurisdiction:
The applicant must comply with the requirements of the Suffolk County Sanitary Code
and relevant construction standards for water supply and sewage disposal. Design and flow
specifications, subsurface soil conditions, and complete site plan details are essential to the
review of this project. These considerations are reviewed completely at the time of SCDHS

SCDHS maintains jurisdiction over the final location of sewage disposal and water
