Dear Mr. Cuddy:
The following action was taken by the Southold Town Planning Board,
Monday, September 16, 1985.
RESOLVED that whereas a formal application for the approval of a
subdivision plat entitled "Barbara D. Schriever"located at Orient
was submitted to the Planning Board on June 1, 1984, and filing
fee of $100 was paid on June 1, 1984, and,
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on August 26, 1985
at 7:30 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of the
Town of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of "Barbara
D. Schriever" for approval of said subdivision plat prepared by
Rod Van Tuyl dated as amended June 25, 1985 be approved and the
Chairman be authorized to endorse approval on said subdivision plat,
subject to the following conditions:
1. 'Receipt of a park and playground fee, the amount to
be determined by the Town Board.

Southeasterly corner of Main Road, New
York State Route 25, and Tabor Road, Orient.
Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on April 3,
1985, reviewed the proposed subdivision plat entitled, "Minor Subdivision _
Barbara D. Schriever", referred to it pursuant to Section 1333 of the Suffolk
County Charter. After due study and deliberation it resolved to disapprove said
map for the following reasons:
1. The proposed subdivision will result in the creation of a landlocked
parcel; that is, a parcel that does not have frontage on an existing
or proposed public road. The creation of such a lot is contrary to
good subdivision layout principles and creates problems as far as
access by emergency and service equipment is concerned. This lack
of adequate access could result in health, safety and welfare prob-
lems for the future residents of this lot. Creation of a landlocked
lot also places the Zoning Board of Appeals in the awkward position
of having to grant a building permit for the lot under Section 280-a
of the Town Law as the future owner of the lot cannot be held respon-
sible for the landlocked nature of the parcel.
2. It is not indicated on the map whether the right-of-way across the
parcel is existing or proposed. It is felt that if this right-of-way
is to be a road in the future it may result in a conflict with the
entrance to Orient Central Cemetery as the entrance to the cemetery
is at the proposed intersection of the proposed road and Tabor Road.

Dear Mr. Bryer:
This is to confirm our recent telephone conversation wherein I
advised that the change proposed by the Planning Board to the
above subdivision would work a hardship and might well create a
hazardous situation.
In this four lot subdivision, two lots face Tabor Road and the
remaining two lots are interior lots, each serviced by a separate
access way or road which connects to Tabor Road. As indicated to
the Board, Mrs. Schriever proposes to sell the northerly two lots
to the Orient Fire Department. (The sale is subject to a
permissive referendum and if it is not approved, she does not wish
to return for further subdivision approval; the last time she held
an appliccation in abeyance the property was upzoned, therefore,
he is submitting the entire four lot subdivision for approval at
this time.)
In the event the Fire Department purchases the northerly lots then
a road serving the two rear interior lots will have its entrance
to Tabor Road only a few feet from the entrance to the Fire
Department parking area. We submit this is neither in the
interest of the prospective owners of those parcels nor of the
Fire Department.

Based upon a sale ot the Fire Department we believe that a road or
access way serving the interior southeasterly lot, as currently
proposed, is more appropriate and would be safe. In the event the
Fire Department purchase was not consummated, the applicant would
be willing to covenant that one road would serve the two rear lots
as has been proposed by the Planning Board. We, however,

THIS DECLARATION made the day of November, 1984,
by BARBARA D. SCHRIEVER, Main Road, Orient, New York, hereinafter
referred to as the declarant.
WITNESSETH:
WHEREAS, BARBARA D. SCHRIEVER is the owner in fee simple of
certain lands at Orient, Town of Southold, County of Suffolk and state
of New York, known and designated on a certain map entitled, -Map of .
Minor Subdivision on Land of Barbara D. Schriever prepared by Roderick
Van Tuyl, P.C..dated May 31,1984, which property is more particularly
described on Schedule -A- annexed hereto, and
WHEREAS, for and in consideration of granting approval of
the subdivision plot, the Planning Board of the Town of Southold has
deemed it to be for the best interests of the Town of Southold and the
owner and prospective owners of said parcels that the within covenants
and restrictions be imposed on said parcels, and as a condition of
said approval the Planning Board has required that the within
Declaration be recorded in the Suffolk County Clerk's Office, and

in connection with the above four lot minor subdivision located
at Orient, New York. As indicated to you, the Schrievers wish
to proceed to obtain approval of this subdivision as promptly
as possible. We, therefore, reiterate our request to schedule
a public hearing.
We submit that the subdivision meets all of the requirements
set forth in the Planning Board's rules. and regulations and
complies with the requi~ements of the Town Code. We also point
out in response to a ques'tion raised at your meeting that while
the flag lots show frontage of fifty (50) feet along the road,
the code does not set forth a specific road frontage require-
ment but rather the lot width requirement is measured at the
set back line.
