The following resolution was adopted: WHEREAS, this proposed site plan, to be known as site plan for The Shady Lady, is for a 12,281 square foot renovation to an existing restaurant and eight room hotel on the second floor; and WHEREAS, Bobbi Zorn is the owner of the property known and designated as The Shady Lady, Route 25, Greenport, SCTM#1000-35-1-21 & 22; and WHEREAS, a formal application for the approval of this site plan was submitted on March 8, 1999; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on October 18, 1999; and WHEREAS, this site plan, last revised September 29, 1999 was certified by the Building Inspector on February 14, 2000; and WHEREAS, the Architectural Review Committee has approved the elevation drawings on January 18, 2000; and The Shady Lady - 3/21/00 ~ Paqe Two WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, ail the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the final survey, dated February 24, 2000, with Suffolk County Department of Health Services approval stamp and later revision of March 13, 2000, subject to a one year review from date of building permit. Enclosed please find 2 copies of the approved site plan; one for your records and one to be submitted to the Building Department when you apply for your building permit. Purpose. The purpose of the Limited Business (LB) District is to provide an opportunity to accommodate limited business activity along highway confdors, but in areas outside the hamlet central business areas, that is consistent with the rural and historic character of surrounding areas and uses. Emphasis will be placed on review of design features so that existing and future uses will not detract from surrounding uses. The additional uses must generate low amounts of traffic and be designed to protect the residential and rural character of the area. § 100-81. Use regulations. In the LB District, no building or premises shall be used and no building or part of a building shall be erected or altered which is arranged, intended or designed to be used, in whole or in part, for any uses except the following: A. Permitted uses. The following uses are permitted uses. All permitted uses except single-family and owner-occupied two-family residences require site plan approval. 0) Any permitted use as set forth in and regulated by § 100-3 lA of the Agricultural-Conservation District except wineries, which shall be as set forth in Subsection A(9) below. (2) Retail businesses complementary to the rural and historic character of the surrounding area, limited to the following: (a) Custom workshops and machine shops. (b) Wholesale or retail sale and accessory storage and display of garden materials and plants, including nursery operations, provided that the outdoor storage or display of plants and materials does not obstruct pedestrian flow or vehicular traffic and does not occur within three feet of the property line. (c) Libraries or museums. (3) Professional and business offices. (4) Funeral homes. (5) (6) Restaurants, except drive-in restaurants or formula restaurants. Repair shops for household, business or personal appliances, including cabinet shops, carpenter shops, electrical shops, plumbing shops, furniture repair shops and bicycle and motorcycle shops, landscaping and other service businesses. (7) Hotels. (8) Retail uses supplemental to the service business establishment. (9) Wineries which meet the following standards: (a) Wineries shall be a farm winery licensed under New York State law from which wine made from primarily Long Island grapes is produced and sold. (b) Wineries shall obtain site plan approval. (c) Wineries shall have retail sales on site. (10) Bed-and-breakfast uses as set forth in and as regulated by § 100-31B(14). (11) Private warehousing. B. Uses permitted by special exception by the Board of Appeals. The following uses are permitted as a special exception by the Board of Appeals as hereinafter provided and are subject to site plan approval by the Planning Board: (1) Any special exception use as set forth in and regulated by § 100-31B of the Agricultural-Conservation District, except that wineries are not required to be in connection with a vineyard, and except bed-and-breakfasts. (2) Contractors' businesses or yards, including but not limited to building, electrical and plumbing yards. (3) Telephone exchanges. (4) Antique, art and craft shops and galleries. C. Accessory uses. The following uses are permitted as accessory uses and, except for residential accessory uses and signs, which are govemed by Article XX, are subject to site plan review: 0) Any accessory use as set forth in and regulated by § 100-31C(1) through (8) and (10) of the Agricultural-Conservation District, and subject to the conditions set forth in § 100-33 thereof (2) Outside storage of equipment, supplies and materials associated with any of the normal operations of the principal use, provided that the storage is adequately screened along the road frontage and contiguous residential lots with natural vegetation, landscaping, fencing and/or as shall be deemed appropriate by the Planning Board. § 100-82. Bulk, area and parking regulations. A. Except as otherwise provided herein, no buildings or premises shall be used and no building or part thereof shall be erected or altered in the LB District unless the same conforms to the Bulk Schedule and Parking and Loading Schedules incorporated into this chapter by reference, with the same force and effect as if such regulations were set forth herein in full. EN(l) B. The Planning Board may grant a limited waiver from the applicable bulk requirement for minimum lot size to a minimum of 40,000 square feet where it can be clearly demonstrated that the subject parcel has been held in single and separate ownership since January 10, 1989, or earlier, based on competent evidence thereof pursuant to: (1) Chain of title certified by a title or abstract company or duly licensed attorney-at-law; and (2) A survey prepared by a licensed surveyor describing the subject premises and all contiguous property. § 100-83. Front yard setbacks. A. Structures shall be set back at least 100 feet from the right-of-way. B. There shall be an exception to Subsection A if the adjacent parcels are developed, in which case the minimum front yard setback shall be the average of the setbacks of the adjacent parcels. C. A project shall be divided into separate structures so that no single structure shall have more than 60 linear feet of frontage on one street. The setbacks of multiple structures on a parcel may vary, provided that the average setback of the structures meets the setback required above and all buildings are at least 75 feet from the right-of-way. 100-80. Purpose. The purpose of the Limited Business (LB) District is to provide an opportunity to accommodate limited business activity along highway corridors, but in areas outside the hamlet central business areas, that is consistent with the rural and historic character of surrounding areas and uses. Emphasis will be placed on review of design features so that existing and future uses will not detract from surrounding uses. (6) Repair shops for household, business or personal appliances, including cabinet shops, carpenter shops, electrical shops, plumbing shops, furniture repair shops and bicycle and motomycle shops, landscaping and other service businesses. (7) Hotels. (8) Retail uses supplemental to the service business establishment. (9) Wineries which meet the following standards: (a) Wineries shall be a farm winery licensed under New York State law from which wine made from primarily Long Island grapes is produced and sold. (b) Wineries shall obtain site plan approval. (c) Wineries shall have retail sales on site. (10) Bed-and-breakfast uses as set forth in and as regulated by § 100-31B(14). (11) Private warehousing. B. Uses permitted by special exception by the Board of Appeals. The following uses are permitted as a special exception by the Board of Appeals as hereinafter provided and are subject to site plan approval by the Planning Board: (1) Any special exception use as set forth in and regulated by § 100-3lB of the Agricultural-Conservation District, except that wineries are not required to be in connection with a vineyard, and except bed-and-breakfasts. (2) Contractors' businesses or yards, including but not limited to building, electrical and plumbing yards. (3) Telephone exchanges. (4) Antique, art and craft shops and galleries. C. Accessory uses. The following uses are permitted as accessory uses and, except for residential accessory uses and signs, which are governed by Article XX, are subject to site plan review: (1) Any accessory use as set forth in and regulated by § 100-31C(1) through (8) and (10) of the Agricultural-Conservation District, and subject to the conditions set forth in § 100-33 thereof (2) Outside storage of equipment, supplies and materials associated with any of the normal operations of the principal use, provided that the storage is adequately screened along the road frontage and contiguous residential lots with natural vegetation, landscaping, fencing and/or as shall be deemed appropriate by the Planning Board. 2 § 100-82. Bulk, area and parking regulations. A. Except as otherwise provided herein, no buildings or premises shall be used and no building or part thereof shall be erected or altered in thc LB District unless the same conforms to the Bulk Schedule and Parking and Loading Schedules incorporated into this chapter by reference, with the same force and effect as if such regulations were set forth herein in full. EN(1) B. The Planning Board may grant a limited waiver from the applicable bulk requirement for minimum lot size to a minimum of 40,000 square feet where it can be clearly demonstrated that the subject parcel has been held in single and separate ownership since January 10, 1989, or earlier, based on competent evidence thereof pursuant to: (1) Chain of title certified by a title or abstract company or duly licensed attorney-at-law; and (2) A survey prepared by a licensed surveyor describing the subject premises and all contiguous property. § 100-83. Front yard setbacks. A. Structures shall be set back at least 100 feet from the right-of-way. B. There shall be an exception to Subsection A if the adjacent parcels are developed, in which case the minimum front yard setback shall be the average of the setbacks of the adjacent parcels. C. A project shall be divided into separate structures so that no single structure shall have more than 60 linear feet of frontage on one street. Reduce the width of the existing shoulder across the front of the building (see attached plan) and install concrete curb at the back of the new curb line. Concrete sidewalk will be required full frontage of property. Relocate the utility pole at the comer of Sound Drive and Route 25 to provide clearance for a standard radius. Remove the asphalt gutter located west of the west driveway. Grinding will be permitted if it done to the satisfaction of the State Engineer. Note on plans will be sufficient. 4. Provide for onsite drainage to contain onsite water from entering the State highway. 5. Curb installation shall be in accordance with the enclosed plan. 6. Installation of standard drop curb will be required. 7. Provide item numbers and details for sidewalk, curb and shoulder installations. Sleeves shall be jacked under the highway for all highway crossings, unless permission to cross in any other manner is given in writing by the Oepartment of Transportation; and jacking and receiving pits must be kept a minimm~ of 5 feet fr~,, the edge of pavement. As a general rule, the "open cut" method for crossing a highway will not. be permitted; the need for any such open_ cut . must be substantiated by the-Permittee and permission granted from the uapart merit of Transportation on the basis of satisfactory sheeting, maintenance and protection of traffic,' c~action edui~t, etc. Any excavation in excess of 5 feet in depth must be sheeted in accordance with Code Rule 23 and OSHA. Any excavation closer than 5 feet to the edge of pave- merit must be sheeted as directed by the Oepartme~t of Transportation. All backfill must be compacted in a manner satisfactory to the Oepartment of Transportation. Adequate signs, barricades, and lights, in acoorda~ce with the standards of the Nee York State Manual of Uniform Traffic Control Oevicos, Subchapter G, shall be provided. Barricades, whether in sidewalk or roadway area, shall have prominently displayed, for police convenience, the address and telephone number of Z4-hour availabilit~ of someone who can reset the lights and barricades if it should become necessary. Pedestrian and vehicular traf~'ic is to be maintained and protected at all times. There shall be no unprotected or unlighted drop-offs or obstacles. No pavement openings will be permitted to remain open overnight. They must be backfilled or plated at the end of the workday. Open holes outside the pavement shall be fenced or guarded. The permittae agr~s to pay all costs incurred by the State, including, man-hours and equipment use, necessary to correct any unsafe conditions on a Permit site. In the event that the permittee has permission from the 0epartment of Transpor- tation to open the pavement, only one lane at a time my be opened provided · safe two-way traffic is maintained at a11 times, with adequate signs and barricades to warn the public whenever work is performed on the highway. As stated above, no paveaent area may be left open overnight or on weekends. Adequate access to adjacent properties must be provided. Pavement and Paved Shoulders - Minimum size replaname~ts in finished concrete or asphalt on concrete base shall be 10 feet X width of panel. In all cases, if the replacement is within five feet of a.joint, or five feet of a major crack, the replacement must extend to the joint or crack. Any opening in con- crete pavement shall be saw cut and final restoration must be done with High Early Class F concrete mix. In the case of an opening in'asphalt, the minimum size replacement shall be 4 feet X 4 'feet or at l-sst 18 inch cutback beyond the size of the hole. ~Asphalt restoration shall be made by cutting, with a wheel or jackhamer the existing ~djacent asphalt square, painting the exposed face with hot asphalt, placing the new asphalt, and compacting with a ten-ton roller. Surface variations in excess of 1/4 inch shall be elimineted or the pavement relaid. Unless otherwise directed by the 0epartment of Transportation, asphalt shoulder restoration shall be 4 inches Item 403 {Z 1/2 inch Binder and 1 1/2 inch Top) on a sound base. Sidewalk, where disturbed, shaft be replaced to full panels of a minimum size 4 feet X 4 feet or as marked when found.
