Northwesterly side of New York State Route 25 (Main Road)
approximately 1,139 feet northeasterly from Sound Road,
near Greenport, New York.
Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on March 5,
1986, reviewed the proposed subdivision plat, entitled, "Map of The Breakers at
Land's End (Condominium", referred to it pursuant to Section 1333 of the Suffolk
County Charter. After due study and deliberation it resolved to return said
subdivision as incomplete for the following reasons:
1. No information was provided as to how the parcel zoned "Business will
be developed and what controls this area will be subject to. This
area is crucial to the overall plan for the development of the area;
therefore, the parcel should not be left out and should be
incorporated in some manner into the overall development.
2. No information was provided to show that the traffic generated by this
development has been addressed. Information should be provided to
show that consideration has been given to the impact of this
development upon Main Road. This information should also show that
the New York State Department of Transportation was consulted and what
recommendations were made by that agency.
3. The development of the man-made ponds is vague. Information should be
provided to show that measures will be taken to prevent eutrophication
and that to maintain the water levels of these ponds the aquifer will
not be overburdened.
The Commission also offers the following comments on the map for your use
and consideration:
1. It is felt that the gatehouse should be set back further from the road
and the business parcel should not be using the same roads as the
residential parcel.

the Southold Town Planning Board and the Suffolk County Planning
Commission. I believe all areas of concern have been addressed
and we are proceeding to have the map completed per the require-
ments stated. We are presuming this is the correct course of
action and if we do not get a negative response within 15 days
we will press to complete the site plan this month, based on
the information herein submitted.

Pursuant to our meeting of yesterday at Steve Hyman's office, I've reviewed
the comments of the Suffolk County Planning Commission and am in the nrocess
of revising the plans as noted below.
1) No Comment.
2) land Design Associates is preparing a standard subdivision yield map.
3) We have eliminated all cross streets within the property layout.
4) The site grading has been very carefully analyzed, and where practical,
major areas of tree preservation shall be considered. Other areas are
graded to balance cut and fill quantities on the property. Much of the
site is open field or primary growth vegetation which should be removed
during the construction process.
5) The split entry road is a regulation of the Town of Southold.
6) We are changing drainage flows in this location in order to conform with
this comment.
7) legal Definition.
a) We are reviewing and in many cases, are revising our plans to accomodate
this comment.
9) We are making changes as requested.
10) The "Road to the Beach" is being eliminated and a pedestrian walkway is being
indicated.
11) Vehicular design controls (signage) will 'be'installed as necessary and in
accordance, the community is to have its own internal private security force,
one of whose responsibilities will be to enforce regulations of this type.

14) This comment is assumed to refer to the "emergency access road" on the
western property line. This road is actually to be a constructed stabilized
surface (gravel, paving block, etc.) that will not n(~cp.ssitate drainage

15) There will be a guard house constructed at the main entry (eastern) as
indicated on the plans and a crash gate will be constructed as per the
Town of Southold specifications at the property line seperating the
condominium from the commercial zone.

AMENDED GRANT OF SCENIC EASEMENT

THIS INDENTURE, made this 13th day of December, 1983,
by and between BRECKNOCK ASSOCIATES, a co-partnership, with
offices c/o Gus Schad, 690 Deer Park Avenue, Dix Hills, New
York, hereinafter called the Grantor, and THE TOWN OF
SOUTHOLD, a municipal corporation having its principal place
of business at 53095 Main Road, Southold, New York,
hereinafter called the Grantee.

WHEREAS, there exists a Grant of Scenic Easement
agreement covering portions of the Grantor's land, dated
July 15, 1971, and recorded in the Suffolk County Clerk's
Office on December 13, 1971 in Liber 7066, page 386; and
WHEREAS, the parties desire to modify the aforesaid
Grant of Scenic Easement by cancelling same and placing in
its stead the following Grant of Scenic Easement on other
property of the Grantor, more particularly described in
Schedule A herein; and
WHEREAS, said premises constitute an area of natural
scenic beauty and whose existing openness, natural con-
dition, or present state of use, if retained, would enhance
the present or potential value of abutting and surrounding
properties and would maintain or enhance the conservation of
natural or scenic resoursesl and
WHEREAS, the Grantor wishes tQ grant a scenic easement
to the Grantee affecting the premises described in Schedule

WHEREAS, the Grantee deems it to be in the public

interest to acquire interest or rights in real property for
the preservation of open space and areas to preserve the
beauty and natural conditions of lands in the Town of
Southold; and
WHEREAS, Section 247 of the General Municipal Law of
the State of New York provides that municipalities,
. including Towns, may acquire the fee or any lesser interest,
development right, easement, covenant or other contractual
right necessary to achieve the aforementioned purposes to
land within the Town; and
WHEREAS, the Grantee in furtherance of the above policy
and in accordance with Section 247 of the General Municipal
Law, accepts the scenic easement affecting the premises
described in Schedule A.
NOW, THEREFORE, in consideration of ONE ($1.001 DOLLAR
and other good and valuable consideration to the Grantor,
receipt of which is hereby acknowledged, this agreement wit-
nesseth that:
1. The Grant of Scenic Easement agreement dated July
15, 1971 and recorded in the Suffolk County Clerk's Office
on December 13, 1971 in Liber 7066, page 386, is hereby
terminated and cancelled.
2. The Grantor does hereby donate, grant, transfer an4
convey unto the Town of Southold, a scenic easement in
gross, of the nature, character and to the extent
hereinafter set forth, over and upon all those certain

plots, pieces or parcels of land as set forth and described
in Schedule A annexed hereto and made a part hereof.
3. The nature, character and extent of the easement
hereby granted is as follows:
(a) No buildings or structures shall be erected on
the premises, except fencing, utility structures and out-
buildings which might be required by municipal agencies for
. the construction and maintenance of communal utilities,
water or sewage systems, consisting of a treatment plant,
pumping and lift stations and collection system, and other
such appurtenances.
(b) No lumbering operations shall be conducted on
the premises and no trees shall be cut unless dead, diseased
or decayed or for the better landscaping of the area or
improvement of existing growth or as may be reasonably
required in the constrqction of roads, equestrian trails,
recharge areas or commqnal utility, water or sewage systems,
(c) The land ~hall remain essentially in its
natural state, except for landscaping and maintenance such
as mowing of grass, the cleaning and removing of debris fro~
the pond areas.
(d) No topsoil shall be removed from the premises
nor shall sand, gravel or other minerals be excavated
therefrom for purposes of sale or use off the premises; nor
shall sand, gravel or other minerals be stored upon the
premises;

(e) The Grantee and its authorized agent shall have
the right of inspection of the premises for the purpose of
assuring itself that the Grantor is not in violation of any
of the terms and conditions of this scenic easement, at any
time.
4. The nature, character and extent of limitations on
the within grant of scenic easement are as follows:
(a) The premises shall not be open or available to
. the public for general or park use, but shall remain at all
times in the exclusive possession of the Grantor, its suc-
cessors and assigns in interest, and subject to its or their
unqualified right to exclude others therefrom by any and all
lawful means, except as indicated in paragraph 3(e);
(b) Roads with necessary recharge basins for road
drainage may be constructed to provide access to and from
surrounding properties of the Grantor, as well as the
construction of jogging paths and equestrian trails.
(c) The within grant of scenic easement shall in no
way affect the right of the Grantor to use the premises, for
the uses herein permitted, and to do all such things
thereon, not expressly forbidden herein, as a similarly
situated landowner might do;
(d) All right, interests and privileges of the
Grantor in the premises not herein specifically donated,
granted, transferred and conveyed, remain and reside with
the Grantor, its successors and assigns.

5. The waiver or acquiescence in any variation from
any part of the restrictions and covenants herein by the
grantee shall be effective only for the particular instance
involved and shall not be deemed to limit the continuing
force and effect of the restrictions and covenants.
6. If the whole or any part of the premises shall be
condemned or taken by eminent domain, then this easement
snaIl forthwith cease without need of any further writing
from the date of title vesting in such proceeding. In such
event the Grantor shall not be required to repay to any real
property taxing authority any taxes reduced or abated as a
result of this scenic easement; nor shall the value of the
premises be limited by this easement; nor shall any part of
any award belong to the Grantee.
7. The grantee hereby undertakes to cooperate to the
extent legally permissible in having the valuation placed
upon the premises for purposes of real estate taxation taken
into account and limited by the restrictions imposed by this
scenic easement, all in accordance with State ot 'iew York
General Municipal Law 5247.
8. This agreement shall be ,;erpetual and s Ll be a
covenant running with the land and shall be binding upon the
parties hereto, their successors and assigns.
9. This Grant of Scenic Easement is subject to the
adoption of a resolution by the Town Board of the Town of

TBIS INDENTURE, made this 13th day of December, 1983,
by and between BRECKNOCl ASSOCIATES, a co-partnership, with
offices c/o GU8 Schad, 690 Deer Park Avenue, Dix Hills, New
York, hereinafter called the Grantor, and THE TOWN OF
SOUTHOLD, a municipal corporation having its principal place

the preservation of open space and areas to preserve the
beauty and natural conditions of lands in the Town of

WHEREAS, Section 247 of the General Municipal Law of
the State of Hew York provides that municipalities,
~ncluding Towns, may acquire the fee or any lesser interest,
development right, easement, covenant or other contractual
right neCeasary. to achieve the aforementioned purposes to
land within the Town, and
WHBREAS, the Grantee in furtherance of the above policy
and in accordance with Section 247 of the General Municipal
Law, accepts the scenic easement affecting the premises
described in Schedule A.
NOW, THEREPORE, in consideration of ONE ($1.00) DOLLAR
and other good and valuable consideration to the Grantor,
receipt of_which is hereby acknowledged, this agreement wit-
nesseth that:
1. The Grant of Scenic Easement agreement dated JUly
15, 1971 and recorded in the Suffolk County Clerk's Office
on December 13, 1971 in Liber 7066, page 386, is hereby
terminated and cancelled.
2. Tb. Grantor does hereby donate, grant, transfer and
convey unto the Town of Southold, a scenic easement in
gross, ~f the ,nature, character and to the extent
hereinafter set forth, over and upon all those certain

plots, pieces or parcels of land as set forth and described
in Schedule A annexed hereto and made a part hereof.
3. The nature, character and extent of the easement
hereby granted is as follows:
(a) No buildings or structures shall be erected on
the premises, except fencing, utility structures and out-
buildings which might be required by municipal agencies for
the construction and maintenance of communal utilities,
water or sewage systems, consisting of a treatment plant,
pumping and lift stations and collection system, and other
such appurtenances.
(b) No lumbering operations shall be conducted on
the premises and no trees shall be cut unless dead, diseased
or decayed or for the better landscaping of the area or
improvement of existing growth or as may be reasonably
required in the construction of roads, equestrian trails,
recharge areas or. communal utility, water or sewage systems,
(e) The land shall remsin essentially in its
natural state, except for landscaping and maintenance such
as mowing of grass, the cleaning and removing of debris from
the pond areas.
(d) No topsoil shall be removed from the premises
nor shall sand, gravel or other minerals be excavated
therefrom for purposes of sale or use off the premises, nor
shall sand, gravel or other minerals be stored upon the
premises,

(e) The Grantee and its authorized agent shall have
the right of inspection of the premises for the purpose of
assuring itself that the Grantor is not in violation of any
of the terms and conditions of this scenic easement, at any
time.
4. The nature, character and extent of limitations on
the within grant of scenic easement are as follows:
(a) The premises shall not be open or available to
the public for general or park use, but shall remain at all
times in the exclusive possession of the Grantor, its suc-
cessors and assigns in interest, and subject to its or their
unqualified right to exclude others therefrom by any and all
lawful means, except as indicated in paragraph )(e),
(b) Roads with necessary recharge basins for road
drainage may be constructed to provide access to and from
. surrounding properties of the Grantor, as well as the
construction of jogging paths and equestrian trails.
(c) The within grant of scenic easement shall in no
way affect the right of the Grantor to use the premises, for
the uses herein permitted, and to do all such things
thereon, not expressly forbidden herein, as a similarly
situated landowner might do,
(d) All right, interests and privileges of the
Grantor in the premises not herein specifically donated,
granted, transferred and conveyed, remain and reside with
the Grantor, its successors and assigns.

5. The waiver or acquiescence in any variation from
any part of the restrictions and covenants herein by the
grantee shall be effective only for the particular instance
involved and shall not be deemed to limit the continuing
force and effect of the restrictions and covenants.
6. If the whole or any part of the premises shall be
condemned or taken by eminent domain, then this easement
shall forthwith cease without need of any further writing
from the date of title vesting in such proceeding. In such
event the Grantor shall not be required to repay to any real
property taxing authority any taxes reduced or abated as a
result of this scenic easement, nor shall the value of the
premises be limited by this easement, nor shall any part of
any award belong to the Grantee.
7. The grantee hereby undertakes to cooperate to the
. extent legally permissible in having the valuation placed
upon the premises for purposes of real estate taxation taken
into account and limited by the restrictions imposed by this
scenic easement, all in accordance with State of New York
General Municipal Law 5247.
8. This agreement shall be perpetual and shall be a
covenant running with the land and shall be binding upon the
parties hereto, their successors and assigns.
9. This Grant of Scenic Easement is subject to the
adoption of a resolution by the Town Board of the Town of

Southold, subject to a permissive referendum authorizing the
execution of this amended Grant of Scenic Easement.
This document is recorded in order to correct an error
in the Amended Grant of Scenic Easement recorded in Liber
9506 cp 268, wherein the third course following the
beginnlllg point in Parcel II was incorrectly described as
~outh 290 32' 27- East 250.54 feet instead of South 390 32'
27- East 250.54 feet.

Dear Mr. Orlowski:
In accordance with your request the staff has examined the proposed sub-
division layout for a 148.506 acre tract reputedly owned by The Wolowitz
Organization and offer the following comments on the map for your use.
1. The staff is of the opinion that the Suffolk County Planning Commission
may disapprove this layout.
2. Final referral must contain yield map and complete information on how
open space will be controlled.
3. There should not be any cross streets within a residential subdivision.
4. It appears that there will be considerable site disturbance by grading.
5. Why is the split entrance road with bus turnaround necessary?
6. Plan shows stormwater runoff entering State road. This is unacceptable.
7. The statement "scenic easement" should be defined.
8. Spacing of interior street intersections should be reviewed. Some are
too close to each other.
9. A road should intersect other roads at right angles.
10. Why is a road to the beach being proposed? Why isn't the grade of this
road shown? Where are the drainage structures to control and dispose of
stormwater runoff?
11. From a practical point of view how will one-way street use be enforced.

A meeting was held at the office of the Superintendent of Highways to go
over revised preliminary plans of the above project and other matters.
Present at the meeting:

The following items were discussed as follows:
I. The roads within the project will be kept private in perpetuity. This
to be included in Covenants and Restrictions for the project property.
2. Main road widths to be 28 ft. within a 40 ft. R.O.W.
3. Main road typical section, 6" crushed stone base with a l~" asphalt
binder and a II' asphalt wearing course.
4. Drainage computations .and pipe sizes to be submitted.
5. Profiles with some revisions will be submitted.
6. There will be one way traffic on all loops.
7. Ponds not to be fenced. It was requested that an agreement or appro-
priate liability policy be set up to hold the Town harmless in case
of accidents due to unfenced ponds.
8. Granite curbs will be used throughout.
9. It was proposed to have the developers arrange an escrow account of
$5000 for inspection by the Town.

ity Committee has recommended that
negotiations begin on supplying water
for ten projects outside the village
limits:
The recommendation, which was dis-
cussed at length at the Village Board's
meeting Thursday night (see separate
story), was formulated after the com-
mittee determined that ofa total instal-
led-plant capacity of 3.1 million gallons
per day, the water system has 350,000
gallons per day to provide to new cus-
tomers. '
The available capacity was arrived
at by subtracting current and projected
usage from the system's total capabil-
ity. The peak load was estimated at two
million gallons per day (peak day in
1984 was 1. 7 million gallons); a 20 per-
cent cushion for fire protection, break~
down and maintenance, 600,000 gpd;
projects in construction (Stirling Cove
condominiums, Founders Village con.
dos in Southold, St. Peter's Church re-
tirement community), 65,000 gpd; ap-
proved projects (Port of Egypt motel
proposal, Oyster Factory condos,
Stephen Shilowitz' condos at the foot of
Sixth Street, Lakeside Apartments sub-
sidized rental units, Homestead Acres
in unincorporated Greenport), 27,800
gpd; and future projects (Mitchell's re-
novation, the potential addition of a fish
processing plant and the residential
usage in an "affordable housing" prop-
osal oft'Moores Lane in unincorporated
Greenport), 57,200 gpd.
What's left is 350,000 gallons per day,
which will more than cover the ten pro-
jects that have water applications pend-
ing. In order to secure water service,
the applicants must pay a fee equal to
the cost of replacing the water used by
the project. Village engineers have set
that fee at $2,000 per dwelling unit.
The Utilties Committee recom-
mended beginning negotiations on the
following projects:
*Brecknock Hall (The Breakers).
This project, now planned for 350 condo
units, has been before the village in
various forms since 1970. Current talks
center around developers Leo Wolowitz
and Gus Schad providing two wells on

Among the drawbacks of th prop-

The Chamber had a few suggestions
of its own to alleviate congestion in the
downtown area:
*Mark Moores Lane with signage in-
dicating "Alternate Route 25" or "non-
business Route 25." That way, Mr.
Henry said, "all traffic without business
in Greenport or enroute to the Cross
Sound Ferry" could bypass the village.
Southold Town could "also help by at-
tempting to divert through traffic and
ferry traffic to Route 48 by signs and
markers at the approach to the town in
Laurel," Mr. Henry wrote.

completed project is estimated at 75,000

provide more water than it uses -- are
estimated to require a total service of

Although the Village Board has re-
cently been reticent about extending
water service to new customers outside ,
the incorporated village, Greenport has \
been feeling some pressure from the 1
county Health Department to take
steps to serve its entire franchise area.
The 15-mile square franchise runs from
the east side of Shipyard Lane in East
Marion to Peconic Lane in Peconic, in-
cluding the Bayview peninsula in
Southold.
This week, Paul Ponturo of the
county Department of Health said,
"Basically, it's our position that Green-
port has a designated franchise they're
required to serve .- but not for nothing.
They have every right to make develop-
ers pay their fair share."
The Health Department feels that
14properly managed, new developments
can take Greenport out of its problems,"
Mr. Ponturo said. Those problems can
be addressed by gathering the funds
necessary to find additional water
sources, he said.

In other news on the utility front,
Superintendent Jim Monsell said this
week that the chances for a new con-
tract for hydroelectric power from the
state Power Authority are looking good.
The only rub, Mr. Monsell said, is a
clause asked by PASNY allowing the
agreement to be terminated on six
month's notice. The Municipal Electric
Utilities Association is fighting the
clause, he added.
The current P ASNY pact runs out
June 30; the new contract is expected
to run through Dec. 31, 1989, Mr. Mon-
sell said.

A Meeting was held to discuss the above mentioned project on February I, 1985
in the office of Mr. Raymond C. Dean.

Mr. Larry Tuthill
The following comments and recommendations were made:
I. The road cross-section should be approved except the road width to be 28'
and a possible 50' right-of-way. -loop r=d..1oo
2. The drainage computations should be submitted along with pipe sizes on
plans.
3. All unnatural drainage ponds should be fenced. (The town requires all
swimming pools to be fenced.)
4. The subdivision regulations of Southold Town require a second access road
if there are over 20 lots in a subdivision; similarly Road "T" and East
Loop should have a second entrance.
5. It is recommended that at the entrance to Route 25 (North Road) a 200'
loop road in and out of development be required. This section of the
road to be turned over to the Town of Southold. The reason for the
loop is for the pickup and discharge of school children. The North Road
at this location is the only road for traffic to the New London Ferry,
Plum Island Lab and two villages. This loop would help ease a difficult
traffic situation.
6. The high point of the Main Road should be moved to Sta. 2-00 so as to
reduce surface runoff into Route 25.
7. Eliminate the drainage pool near Route 25 as it creates a dangerous
hazard unnecessarily.
8. Loops lA, IB, IC, 2D, 2E, 2F, 3A, 3D, Loops adjacent to East Loop at
Sta 9-00 and 33-00 should be one-way.
9. Re-alignment of intersections so as not to coincide within 50'
a. at sta 14-00 on Main Road

Dear Stan:
I have reviewed the bluff stabilizatioo. plan for the Breakers at Island's End
in Greenport, New York at your request. Based upoo. a site investigation and
review of these doctm1ents I submit the following CaIIlEllts for the Town of
Southold.
First the plan shows that the bluff and vegetatioo. will remain undisturbed.
While 11I.ICh of the bluff face is well stabilized with a native stand of American
Beachgrass, there are large areas where erosioo. is severe. I would estimate
that there is 300-400 feet of bluff experiencing gully, sheet, and rill ero-
sion. Ch me such area, Miere the bluff extends furthest toward Long Island
Sound, the top of the bluff has been undercut. This is caused by wave action
eroding amy the toe of the slope. As this occurs the top of the bluff face
eventually will slough off, taking with it all vegetation and creating a very
critical erosioo. problem for the proposed hanes. Therefore, the bluff carmot
be ignored in these eroding areas. The toe of the slope tlUSt be stabilized
by some form of structural measure such as bulkheading. The exposed face
should then be planted to American Beachgrass to protect it fran further ero-
sion. If this is not done, structures on top of the bluff may be in danger of
falling into Long Island Sound in future years, depending upon the severity of
winter storms.
The plan shows that the top of the bluff will be cleared and then replanted to
a variety of grasses and shrubs. While the plants selected are suitable for
this area, I question M1y this area is being cleared and replanted. The top
of the bluff is currently well stabilized with a variety of native grasses and
shrubs. I would re<'....-Ild maintaining the existing vegetation within the 100
foot setback. By lIDWing and selectively pruning existing Bayberry and other
native shrubs the desired natural effect could be achieved with a mininun of
disturbance. If desired, the additional shrubs listed could be added to further
enhance the area.
The cost to stabilize the bluff would be approximately $68,000.00. This would
include bulkheading and planting beachgrass along the face of the bluff. There
would be little or no costs incurred if the top of the bluff is left in it's
native state.

Upon the Planning Board's review of the Breaker's at Island
End, map dated February 17, 1984, we have noted discrepancies
such as: no calculations on the drainage as requested at
our previous meeting, 14 units are still under the 100'
set-back, no correspondence as to the water and sewage
from the Greenport Water Company.
It was noted that you have now indicated the tree lines on
the survey, but it is still felt that the lay-out as shown
is not sympathetic to the natural tree groupings and terrain.
We would also like to see some preliminary grading on the
maps.
Due to the environmental concerns and the impact of this
project, the Board requests that you address these concerns.

Pursuant to your Board's meeting with the applicant last Friday, June 8th
and your subsequent letter of June 11, 1984, attached please find 12 copies
of certain plans which indicate additional information as requested.
Specifically the plans show the following:
1. revised pond and retention area sites to conform more accurately with
existing tree masses.
2. roadway cross-sections indicating street widths and construction specs.
3. preliminary roadway grading indicating high points, low points and
conceptual drainage design.
At this time and with the inclusion of this material we would like to re-
quest that the Board now forward the site plan to the Building Department
for certification.
We are most anxious to begin detailed engineering design which we 5elieve will
both clarify and resolve many of the questions which have been raised to date.

Dear Henry:
I would like to take this opportunity to thank you and the Board for a most
constructive and informative meeting the other evening. I believe we now
have both the information and direction necessary to proceed rapidly towards
getting all the approvals required to begin actual construction of my client's
project as proposed.
As per the Board's direction we are now completing the architecture and site
plans for both the recreation building and the five unit model building.
We are also finalizing the contract and our negotiations with the Village
of Greenport with respect to both water and sewer service.
At this time we would like to formally request, pursuant to Section 100-133
of the Zoning Code of the Town of Southold, that the Planning Board submit to
the Building Inspector sheets 1 through 4 as previously submitted for his
review and certification.
We are aware that we are requesting a bluff setback modification and have
enclosed for your information certain correspondence from Mr. Charles Lind of
the Suffolk County Planning Commission which states the county's position and
the lead agency's (Town Planning Board, in this case) prerogatives.
We are most anxious to receive a copy of the certification once it is granted
so that we may proceed into the site development plan ohase.

Dear Charlie,
With reference to the above matter presently before the Town of Southold
Planning Board, the applicant is requesting by virtue of Site Plan Approval
that he be allowed, in certain defined cases, to construct condominium
dwellings closer than the prescribed one hundred foot setback from edge of
bluff.
It is our understanding that the 100' setback minimum is a county standard,
but the municioality has ultimate jurisdiction.
We are attempting to provide engineering and environ~ental backup to
substantiate our request for a modification. Could you please provide us
with a letter indicating that the County, although it reco~mends certain
criteria and standards, yields to the town authorities who have ultimate
jurisdiction in matters of this nature.
I spoke with Arthur Kunz regarding this ~atter and he suggested I contact you
in written form in order to document any request. If vou have any ouestions

Dear Jim:
In accordance with our recent discussions, we have re-
viewed the feasibility of placing one or two small capacity,
public supply wells on "The Breakers" property. We have no
test well information in the area but have been advised by
Mr. Maniello that we may proceed to implement a test well,
and the Developer is willing to provide the Village with a
water well site in an area we would designate on their property.
We are confident that a good well can be constructed at a
depth of about 100 feet and then developed and equipped for a
capacity of 150 to 260 gallons per minute. We also believe it
would be prudent to plan such a project to include a second
well which would normally be used as a reserve or spare but
which could be used in an emergency or for a short duration
for the Village.
We expect the test well to confirm our belief. We assume
the cost of developing the well site would be creditable toward
the "key" or backbone plant.
As you remember, we had estimated water use on the maximum
day at 175 gallons per minute (252,000 gallons per day) which
would be supplied by the on site wells with any excess available
for use in the Village system.

To date we have had numerous meetinGs and discussions with both tk. James

engineering firm of Holzmacher, McLendon and Murrell, consultants to the
Village.
These conversations and meetinGs have resulted in the followinG:
1. The Village of Greenport has expressed an interest in"providing
both water and sewer as well as electric service for the project.
2. ~le have been informed by ~1r. Monsell sorle tillle aoo that the
Village can service us regarding both sevier and water.
3. The nature of our desiqn would include provielinq the Villaqe with
2 - 200 qallon per minutes wells located on the site, which would
serve the normal demands of the rroject.
4. The applicant is prerared to contribute siqnificant funds to
the Village for capital improvement of both the water and sewer
systems. These imnrovements vloul d rresumab 1 y include ilia ior water
trunk lines, better village and area wiele distribution systems,
improvement of well and pump facilities and other illlprovements which
would generally benefit the entire Villa~e of Greennort.
5. It is not anticipated that the average daily consumptional needs
of the planned community would impact any level of existing water
service presently being provided to Village or franchise consumers.
