WHEREAS, Stanley Rutkowski, residing at (No #) Main
Road, East Marion, New York, has made formal application to the
Planning Board of the Town of Southold for approval of a minor
subdivision plat entitled, Mi~or Subdivision of Golf View at East
Marion, Town of Southold, Suffolk County, New York~ and ~/c
WHEREAS the application for subdivision approval was
granted by the Planning Board of the Town of Southold on November
25, 1986 subject to certain conditions, and
WHEREAS one of the conditions was that the applicant
execute and file with the Town of Southold and with the County
Clerk of the County of Suffolk a declaration of covenants and
restrictions stipulated by the Planning Board of the Town of
$outhold in its said resolution of approval of Minor Subdivision
of Golf View at East Marion, Town of Southold, Suffolk County,
New York.
NOW, THEREFORE, parties herein declare that the
property shown on the aforesaid map is held and shall be conveyed
subject to the restrictions and covenants set forth in this
declaration, to wit:
1. No lot shall be subdivided or its lot lines changed

Ail new driveways on Main (State) Road, shall make
at least 70 degrees and preferably 90 degrees8 with

4. Each lot having frontage on Main (State) Road shall
have a turnaround provision, such as a T-shaped shunt, so that a
vehicle leaving a lot will not have to back out into the traffic
stream on the road.
5. A short radius curve, preferably with a radius no
greater than 20 feet, shall be provided at the southeasterly
corner of Parcel No. I to insure that if a road is created over
Parcel No. 2, it will meet modern design standards.
6. All stormwater runoff resulting from the
development and improvement of'this subdivision or any of its
lots shall be ~ined on the site by adequate drainage

The following action was taken by the Southold Town Planning Board
on Monday, December 14, 1987.
WHEREAS, a formal application for the approval of a subdivision plat entitled
"Golf View Estates" was submitted to the Planning Board on February 19, 1987
and the filing fee was paid, and
WHEREAS, a final public hearing was held on said subdivision and plat at the
Southold Town Hall, Main Road, Southold, New York, on Monday, November 23,
1987 at 7:30p.m., and
WHEREAS, the requirement of the Subdivision Regulations of the Town of Southold
have been met by said subdivision plat and application,
NOW, therefore, be it resolved that the application of Golf View Associates for
approval of said subdivision plat prepared by Peconic Surveyors John Metzger,
and dated as last revised November 5, 1987, be approved and the Chairman be
authorized to endorse approval on said subdivision subject to the following:
1. Receipt and accept of a bond, passbook, or letter of credit, for
the road improvements, in the amount of the bond estimate.
Receipt of revised surveys indicating a cul-de-sac at the end of
the right-of-way as well as a 22' improved road with drainage and
profiles, as per the Town of Southold Highway Specifications.

An inspection was conducted of the above referenced subdivision on
March 25, 1989. All the outstanding items of work have been completed
except that due to weather conditions, the grass seed has not
germinated.
We would suggest that the bond could be reduced to $500.00 to
cover the seeding in case it fails to germinate.

Dear Ms. Scopaz:
I would like to take this opportunity to thank you and your
staff for your cooperation and courtesies in the last week of
January, 1989, in completing all of the required review and
processing on the above map. This map - a minor subdivision
has been in the application and approval stages since late
1986; almost two and one-half years. That is why I was most
anxious that it be approved and finalized, and the coopera-
tion of yourself and your staff was most efficacious in
establishing the final approval.
Accordingly, you might recall that I have a $5,000 bond posted
with the Town for the completion of all improvements. It is
my understanding that the $5,000 was required because the
final monumentation was not completed by the surveyors, and
also, the seeding was done, and due to the weather, no one
could determine that the seed had been placed on the ground,
although it was obviously raked and prepared for seeding.
I have forwarded to the Town engineers, Sidney Bowne, certifi-
cation by the surveyor that he has completed the monumentation
work, and I have also forwarded to him, the contract I signed
and the statement I received from the landscaper who did the
seeding.

Enclosed please find correspondence from the Village
of Greenport regarding water service to the Golf View sub-
division.
Mr. Breslin has not been released from his bond. On
Monday, December 19th, the Board will probably consider the
reduction of his bond to $5,000. to run until completion
of the installation of concrete markers, and the successful
sprouting of the seeding that was recently done.

Gentlemen:
A final inspection was conducted on 12/7/88 and we find that the
roadway has been installed satisfactorily and the landscape work is in
progress. However, the following items have not been completed:
1)
Topsoil and Seedin9 Due to the time of the year, seed
germination will not be evident until the Spring of 1989.
This portion of the bond estimate could be re-bonded until
approval is determined.
2)
Street S!gns - The bond estimate calls for three signs (1
street sign; I stop sign; i dead end sign). Mr. Breslin has
ordered the street sign through the Southold Highway Depart-
ment (see letter attached), however, the other 2 signs have
not been installed, as of this date.
3) Concrete Monuments An as-built map, signed and sealed by a
licensed surveyor, showing locations of the five required
concrete monuments, must be submitted.
We concur that these items shown above could be bonded separately
and the project as a whole be accepted. The total value of this work
is approximately $2,000.00.

Gentlemen:
We have completed our review of the sketch plan of the proposed Minor
Subdivision "Golf View" at East Marion and have found it to be
acceptable A brief summary of our review and comments is as follows:
All lots meet the zoning requirement for A-80, 80,000
square feet minimum lot area, and 175 feet minimum lot
width;
Since the access roao into the proposed subdivision is to
be private as indicated on the plan (50' R.O.W.), nota-
tions of restrictions and easements shall be listed on
the Final Plat to guarantee all property owners access.
3. The school district in which the property lies is not
indicated.
The boundary distinguishing the Village of Greenport
shall be shown on the key map of the Final Plat together
with the surrounding zoning classifications.

The design of the drainage system is adequate based on
the information provided and the type of pavement (stone
blend) proposed. If the road is paved with asphalt and

Gentlemen:
We have completed our review of the sketch plan of the proposed Minor
Subdivision "Golf View" at East Marion and have found it to be
acceptabl~ A brief summary of our review and comments is as follows:
1. All lots meet the zoning requirement for A-80, 80,000
square feet minimum lot area, and 175 feet minimum lot
width;
Since the access roao into the proposed subdivision is to
be private as indicated on the plan (50' R.O.~), nota-
tions of restrictions and easements shall be listed on
the Final Plat to guarantee all property owners access.
3. The school district in which the property lies is not
indicated.
4. The boundary distinguishing the Village of Greenport
shall be shown on the key map of the Final Plat together
with the surrounding zoning classifications.
The design of the drainage system is adequate based on
the information provided and the type of pavement (stone
blend) proposed. If the road is paved with asphalt and
widened at a later date, the additional storm water
runoff from these improvements may overburden the
currently proposed drainage syste~

Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on August 5,
1987 reviewed the proposed subdivision plat, entitled, "Minor Subdivision - Golf
View" referred to it pursuant to Section A14-24, Article XIV of the Suffolk County
Administrative Code. After due study and deliberation it resolved to disapprove said
map subject to the following two reasons:
The proposed subdivision will result in the creation of landlocked parcels;
that is, parcels that do not have frontage on an existing or proposed
public road. The creation of such lots is contrary to good subdivision
layout principles and creates problems as far as access by emergency and
service equipment is concerned. This lack of access could result in
health, safety and welfare problems for the future residents of
landlocked lots, not to mention potential disputes over the use and
maintenance of any right-of-way over an adjacent parcel that may be created
for the purpose of access.
Creation of landlocked lots also places the Zoning Board of Appeals in the
awkward position of having to grant a building permit for lots under
Section 280-a of the Town Law as the future owners of landlocked lots
cannot be held responsible for the landlocked nature of their parcels.

The proposed right-of-way should be developed as a public road to provide
access for the lots. However, the setting aside of the right-of-way for a
public road will reduce the lot areas of the lots below that required.

Creation of a subdivision with substandard lots, that is, lots whose areas
are less than the minimum required by the zoning classification of the
property, constitutes an overintensification of land use in a groundwater
sensitive area in what is meant to be a low density area. Such action
could establish a precedent for future subdivision of this kind which would
essentially be a circumvention of the Town Board's action taken over the
past years to upzone these groundwater sensitive areas.

RESPONSIBILITIES OF PERMITTEE
1. PROTECTIVE LIABILITY INSURANCE COVERAGE
Permittee must have protective liabi ity nsurance coverage in accordance with Department requirements. (See
Certificate of Protective Liability Insurance for Permits onState Highways Form PERM 17)
Expiration of or lack of, liability insurance automatically terminates the permit. Insurance coverage may be provided
by furnishing the Department with one of the following:
a. A Certificate of Protective Liability Insurance for Permits on State Highways (Form PERM 17, NYSDOT).
b. A $2.§0 remittance (check drawn on a New York State Bank or Certified) for coverage under the Departmental
Blanket Policy.
c. Undertakings are limited to Public Service Corporations and government units. They must be executed through
an insurance/bonding company and are subject to approval ~Oy NYSDOT Office of Legal Affiars.
2. COMPENSATION INSURANCE AND DISABILITY COV£RA~E
The ap.,plicant is required to have compensation insnr:~r ~= ~ d disability coverage as noted in the provisions of the
Worker s Compensation Law and Acts amendatory thereof for the entire period of the permit, or Ihs permit is invalid.
3. NOTIFICATIONS
Notify Commissioner through Regional Office, one week pr or to commencing work, except emergency work by public
service utilities which should be reported the next work day.
Work must start within 30 days from date of permit.
Notify area gas distributors 72 hours prior to any basting.
Notify utility companies with facilities in work areas (permission must be obtained before doing work affecting
utilities' facilities}before starting work n accordance with Industrial Code §3.

4. SITE CARE AND RESTORATION
An Undertaking a bond or certified check n an amoJJnt des gnated by the Department Of Transportation may be
required by the Regional Office, before a perm t s ssued, to guarantee restoration of the site to ~ts original condi-
tion. If the Department is obliged to restore the site to its original condition the costs to the Department will be
deducted from the amount 0f~he permittee's guarantee deposit at the conc us on of the work.
The permittee is responsible for traffic protection and maintenance including adequate use of signs and barriers
during work and evening hours. Anyone working within the R.O.W. will wear an orange vest and hard hat.
No unneccessary obstruction is to be left on the pavement or the right-of-way or in such a position as to block warn-
ing signs or between work hours.
No work shall be done to obstruct drainage or divert creeks, water courses or sluices onto the right-of-way.
All falsework must be removed and all excavations must be filled in and restored to the satisfaction of the Regional
Maintenance Engineer.
5. COSTS INCURRED BY ISSUANCE OF THIS PERMIT
All costs beyond the limits of the protective liability insurance, surety deposits, etc., are the responsibility of lhe
permittee.
The State shall be hetd free of any costs incurred by the issuance of this permits, direct or indirect.
6. SUBMITTING WORK PLANS
The applicanl will submit work plans and/or a map as required by the Department. This shall include such delails
as measuremenls of driveways with relation to nearest property corner, positions of guys supporting poles and a
schedule of the number of poles and feet of excavation necessary for completion of Ihs work on the State right-of-
way. A description of the proposed method of construction will be included.
Plan work with future adjustments in mind, as any relocation, replacement or removal of the installation authorized
by this permit and made necessary by future highway ma ntenance, reconstruction or new construction, will be the
responsibility of the permittee.
Driveway plans Should be prepared in accordance with the POLICY AND STANDARDS FOR ENTRANCES TO STATE
HIGHWAYS.
The permittee must coordinate his work with any state construction being conducted.
7. TRAFFIC MAINTENANCE
A plan detailing how the permittee intends to mainta n and protect traffic shall be submitted with work plans. Traffic
shall be maintained on the highway in a safe manner during working and non-working hours until construction is
completed. The permittee is responsible for traffic protection and maintenance including adequate use of signs,
barriers, and flag persons during working and non-working hours unt construction is completed.
All sketches will be stamped with "MAINTENANCE OF TRAFFIC SHA,,LL BE IN CONFORMANCE WITH THE NEW
YORK STATE MANUAL OF UNIFORM TRAFFIC CONTROL DEVICES.
8. COST OF INSPECTION AND SUPERVISION
Prior to issuance of the Highway Work Permit, the f3erm tree will be required to sign a SUPERVISION AND INSPEC
TION PAYMENT AGREEMENT FOR HIGHWAY WORK PERMITS (FORM PERM 50) agreeing to the payment of inspec
tion and supervision charges for Department employees. Supervision and inspection charges will be based on number
of work days.
NOTE: Work day is determined on basis of minimum of four (4) hours of inspection.
9. SCOPE

Permits issued are for highwaYs, bridges and cu verts over which the New York State Department of Transporta
tion has jurisdiction. (Local governments issue permits for their oWn jurisdiction.)
b. Legal .
The privilege granted by the permit does not author ze any nfr ngement of federal~ state or local laws or regula
tlons is limited to the extent of the authority of this Department n~he premises and ~s transferab e and assignable
on y w th the written consent of the Commissioner of Transportation.
c. Commissioner's Reservation
The Commissioner of Transportation reserves the right to mod fy fees and to revoke or annul the permit at any
time, at his d scret on w thout a hearing or the necessity of showing cause.

Work locations must be approved by the Department.
e. Maintenance
Property owners having access to a state highway sha be fully respons b e for the maintenance of their driveway
in accordance with POLICY AND STANDARDS FOR ENTRANCESTO STATE HIGHWAYS.
10. COMPLETION OF PROJECT
Upon completion of the work within the state highway right-of-way authorized by the work permit, the person and

WATER SUPPLY AGREEMENT
AGREEMENT made this /~-~day~ of ~ , by and
between the Village of Greenport, a municipal corporation in
Suffolk County having its office and principal place of business
at 236 Third Street, Greenport, New York, herein called the
and GOLF VIEW ASSOCIATES, with principal offices

WHEREAS, the OWNER is desirous of securing a supply of
water for the project to be developed at the property shown on a
map and preliminary site plan; and.
WHEREAS the OWNER is willing at its cost and expense to
lay and install or cause to be laid and installed'the water mains,
hydrants, fittings and valves described on the map and preliminary
plan and to transfer and convey same to the VILLAGE upon comple-
tion and, if necessary, to give and procure easements for the
maintenance of the mains and the hydrants; and
WHEREAS, the VILLAGE is willing to supply the OWNER with
its requested water allowances and the parties have agreed upon
the terms and conditions for the supply of water and other mat-
ters; and
WHEREAS the OWNER is the owner in fee of certain premises
which premises are shown generally on a map and preliminary plan
annexed hereto, made a part hereof and marked Exhibit "A", and
entitled "THE PROPOSED MINOR SUBDIVISION OF GOLF VIEW AT EAST
MARION" dated January 15, 1987; and
WHEREAS OWNER is about to commence a development known as
"GOLF VIEW" at East Marion New York and wishes to construct water
mains and install a hydrant on the certain rights of way on a cer-
tain map entitled "THE PROPOSED MINOR SUBDIVISION OF GOLF VIEW AT
EAST MARION" consisting of one drawing, which are attached hereto,
made a part hereof, and marked Exhibit "B", and to connect with
the Village Water System marked Exhibit "C" in conformity with the
hereinafter set forth specifications for furnishing and
installing water mains and appurtenances.
NOW, THEREFORE, in consideration of the premises and
covenants herein, it is mutually agreed as follows=
FIRST. OWNER will

SECOND. Locations of all mains, hydrants, and
appurtenances are shown on a copy of the map entitled "THE
PROPOSED MINOR SUBDIVISION OF GOLF VIEW AT EAST MARION, Town of
Southold, Suffolk County dated January 15, 1987.
THIRD. All necessary engineering work, trenching,
laying, joining, backfilling shall be done by OWNER and shall
sometimes hereinafter be called the "WORK".
FOURTH. The VILLAGE will supply the hydrants for
installation at the locations shown on said map. OWNER will reim~
burse the VILLAGE for the hydrant located within the subdivision.
FIFTH. Payment shall be made upon delivery for
hydrants and the costs of the delivery of the hydrants to the site
by the VILLAGE. The VILLAGE shall deliver the hydrant to the
site at a time appropriate to the expeditious completion of the
work provided the VILLAGE is given no less than 21 days notice,
and subject to the availability of the hydrant from the suppliers
to the VILLAGE.
SIXTH. Until such time as rental for such
hydrants is assured and paid for by the East Marion Fire
Protection District, OWNER will pay annually to the VILLAGE such
rental for such hydrant as is from time to time being paid by such
District to the VILLAGE for other hydrants in the District.
SEVENTH. The standards for the installation of the
piping and the hydrant shall be in accordance with the following.
specifications: (1) ten (10) inch polyvinyl chloride pipe (AWWA
'Spec. C-900) Class 150 or equal with push-on joints/Couplings and
underground main metallic warning tape or (2) cement-lined duc-
tile iron ~ipe (AWWA spec. C151-76) class 150, or equal. Any pipe
and all joints and parts of the system must be able to stand
pressure of not less than 150 pounds per square inch.
EIGHTH. The VILLAGE will supply without charge to
OWNER sufficient water to make essential tests and to leave the
system on final approval completely sanitary, said supply to be
not less than ~pounds per square inch.

in the trench has been approved and tested by the inspector.
TENTH. OWNER will, and by this agreement does,
upon approval of the completed work, which the VILLAGE will lndi
cate to the OWNER in writing, dedicate the mains to the VILLAGE,
and does hereby grant and convey to the VILLAGE an easement and
right of way for the purpose of laying, relaying, repairing,
operating and maintaining water mains, both supply and distribu-
tion, and appurtenances, including domestic services and fire
hydrants in the full length and width of the now or hereafter
existing public or private streets in the premises as shown on the
attached map. The rights of way and easements shall also exten4
five feet on either side of the mains to be laid pursuant to this
agreement, whether or not such distance shall be within the road-
way The mains and appurtenances, and the rights of way and ease-
ments shall be deeded to ,the VILLAGE its successors or assigns.
and shall forever remain the property of the VILLAGE, its suc-
cessors or assigns. The rights of way shall be over the lands
herein described and marked Exhibit "B".
ELEVENTH. The easements herein granted are not
exclusive, and other easements in said streets may be granted by
OWNER to other persons or corporations maintaining public services
throughout the development, provided that no other mains are set
'within two feet internally of the water main and no poles are set
into the ground within two feet either side of a li~e on the sur-
face directly above the mains. If a gas, sewer or other main or
service necessarily crosses the water mains, OWNER will advise the
VILLAGE in writing of the exact location of the intersection
forthwith upon installation and shall supply maps to the VILLAGE
showing the exact locations. Said intersections shall not be per-
mitted without prior written consent of the VILLAGE.
TWELFTH. If OWNER contracts with a third party for
the WORK, as the parties contemplate will be the case, the VILLAGE
will examine the proposed contract, plans, and specifications, and
promptly furnish OWNER and the third party contractor with a writ-
ten statement of what Dart, if any, of the WORK proposed in such
contract should be revised to insure approval by the VILLAGE. The
VILLAGE will not require any abnormal conditions, unless the
situation at the site shall require them.
THIRTEENTH. Upon comp~etion, inspection and approval
the VILLAGE will supply water to the development and the owners of''
the lands therein at the rates and pursuant to the rules and regu-
lations of the VILLAGE in force from time to time.
FOURTEENTH. The parties understand that final approval
of the subdivision map has not been given by all necessary public
authorities. The VILLAGE enters into this agreement to assist
OWNER in securing such approval, and by way of contractually
assuring to OWNER public water supply, if such subdivision appro-
val is secured.

SIXTEENTH. The VILLAGE requires a cash payment of two
thousand five hundred and seventy dollars ($2570.00) per dwelling
unit to be recorded as a consumer hook-up deposit and placed in a
key money reserve account to help gain new production supply, so'
as to assure OWNER of future adequate supply. It is contemplated
by this contract that the OWNER anticipates construction of four
dwelling units. Upon execution of this agreement, the OWNER shall
deposit with the VILLAGE the sum of twenty-five hundred dollars
seventy dollars ($2,570.00) times four dwelling units for the
total of ten thousand two hundred and eighty dollars ($10,280.00)
in bank or certified check. This per dwelling unit amount may be
amended from time to time, depending on findings by the VILLAGE'S
consulting engineers, Eolzmacher, McLendon and Murrell, P.C. or
their successors and upon approval by the Village Board of
Trustees. In the event that the per dwelling unit cost is
increased or decreased between the execution of this agreement and
the application for water, the OWNER shall pay the VILLAGE, upon
application for water, the difference between the'per dwelling
unit amount specified herein and the per dwelling unit amount
required by the VILLAGE at the time of the application of water
times the number of dwelling units covered by said application.
Said payment shall be in bank or certified check and shall be paid
upon execution of the contract to the VILLAGE prior to any hook-up
for water. In the event that the OWNER does not complete the pro-
ject as contemplated by this agreement or does not make applica-
tion for the full number of dwelling units allotted or specified
herein, the VILLAGE shall keep all funds so deposited by the
VILLAGE as the sole exclusive property of the VILLAGE and the
OWNERS shall have no claim thereon.
SEVENTEENTH. The WORK contemplated by this agreement
shall be completed within 24 months of final approval of plans by
the Town of Southold, or within additional periods of 24 months
each, however, it is hereby mutually agreed and understood that
all specifications in reference to materials used for the
construction of said system, the WORK to be completed, and/or
water to be supplied shall be changed to conform with the then
current standards as set by the .VILLAGE of Greenport Utility
Department, its successor, or its authorized agent at each such

interval.
EIGHTEENTH. The OWNER agrees that upon completion of
the work in accordance with any contract made pursuant hereto,
title to the mains, hydrants, valves, and fittings so installed
and laid shall be deemed dedicated to the VILLAGE, and the OWNER
shall in confirmation of such passage of title, execute an instru-
ment transferring and assigning to the VILLAGE the title, free and
clear of all encumbrances or liens to the mains, hydrants, valves
and fittings so laid and installed and if required by the VILLAGE
shall procure from all persons having an interest in the land in
which said mains lie a proper easement in favor of the VILLAGE for
the perpetual maintenance repair or replacement of said mains and
fittings including the right to extend the mains and to connect
them with other mains to be laid by or under the supervision of
the VILLAGE. The instruments so executed shall be in recordable
form.
NINETEENTH. The VILLAGE agrees that when the installa-'
tion, laying of the mains, valves, hydrants and fittings has been
completed, pursuant to the terms of this agreement, and proper
easements have been given, all as hereinbefore provided, the
VILLAGE will accept the assignment and conveyance of the mains,.
valves, hydrants and fittings and maintain them thereafter and.
supply water to consumers along the mains subject to conditions,
rules and regulations of the VILLAGE.
TWENTIETH. This agreement contains the complete
agreement between the parties for the acquisition by the VILLAGE
of the mains, valves, fittings, and hydrants hereinbefore
described and the OWNER agrees that it will not make any claims
against the VILLAGE on account of the installation of the mains,
valves, fittings or hydrants and acceptance of the terms of this
agreement, notwithstanding the provisions of any general or spe-
cial law to the contrary which may or may not be enacted.
TWENTY-FIRST. This agreement shall inure to the benefit
and shall bind the respective heirs, legal representatives, suc-
cessors or assigns of the parties hereto.
TWENTY-SECOND. This agreement shall not be assignable by
the OWNER without the consent in writing of the VILLAGE, which
consent shall not be unreasonably withheld.
IN WITNESS WHEREOF, the parties have executed this
agreement in four (4) counterparts, all of which shall constitute
originals, the day and year first above written.
