State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Sal & Benny Caiola Jr, is a two-lot
subdivision located at Greenport.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.
Because there has been no response in the allotted time
from the Suffolk County Department of Health Services
it is assumed that there is no objection nor comments
by that agency.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

Dear Mr. Kapell:
The following action was taken by the Southold Town Planning Board,
Monday, July 19, 1982:
RESOLVED that whereas, a formal application for the approval of a
subdivision plat entitled Sal & Benny Caiola, Jr., located at
Greenport was submitted to the Planning Board on April 14, 1982
and, an application fee of $50 was paid June 8, 1982, and
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, SouthOld, New York, on June 28, 1982 at
8 : 15 p . ill., and
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of Sal & Benny
Caiola, Jr., for approval of said subdivision plat prepared by
Roderick Van Tuyl, P.C. dated June 4, 1982 , be approved and the
chairman be authorized to endorse approval on said subdivision plat
subject to the following conditions. within six (6) months from date
of resolution:
1. Compliance with those conditions stated in the Suffolk
County Planning Department's resolution dated July 9,
1982.

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on July 7,
1982, reviewed the proposed subdivision plat entitled, "Minor Subdivision _
Sal & Benny Caiola, Jr.", referred to it pursuant to Section 1333 of the Suffolk
County Charter. After due study and deliberation it resolved to approve said
map subject to the fOllowing seven conditions deemed necessary to help preserve
the natural and aesthetic attributes of the shoreline of Long Island Sound:
1. Approval of this subdivision does not in any way signify approval
of the subdivision proposed for the remaining l8I acres owned by
the subdivider nor does it imply any acceptance of the proposed
layout for the l8I acre parcel.
2. No lot shall be subdivided or its lot lines changed in any manner
at any future date unless authorized by the Southold Town Planning
Board.
3. No sanitary disposal facility shall be installed or constructed
within 100 feet of the top of the bluff.
4. No stormwater runoff resulting from the development and improvement
of the subdivision or any of its lots shall be discharged down the
face of the bluff in any manner.
5. No grading shall be permitted within 50 feet of the top edge of the
bluff except that that may be necessary to control or remedy erosion
or to prevent stormwater from flowing over the edge of the bluff.

6. Access to the beach shall be by means of a suitable structure de-
signed and constructed in a manner that will result in the least
disturbance of the stability of the bluff and access to the beach
shall also be limited to a single structure to serve all residents
of the subdivision.
7. With the exception of Condition No. I the above conditions shall be
filed as covenants and restrictions in the office of the County
Clerk on or prior to the granting of approval to this subdivision.
The Commission also offers the following comment on the map for your use
and consideration:
It is suggested that approval of this subdivision be made subject to the
subdivision's meeting the requirements and standards of the Suffolk County
Department of Health Services.
