The Chairman advised Mr.- Aldin Young, professional Engineer, of the suggestion-of'Mr. Lawrence Tuthill, in regard to the drains. Mr. Young felt that this was a good idea and was willing to gm along with it. The Chairman advised that the installation of a trap. gate as proposed by Mr. Tuthill would involve some dealings with Mr. Melot, adjoining property owner. The subdivider would need a legal instrument toshowthat ,easement had been granted by Mr. Melmt for the installations of drains as discussed. A quite lenghty discussion was held on the proposals for the installationandtype of drains and their' benefit to the entire area and all concerned .with the drainage._ on motion by Mr. Grebe, seconded by Mr. Unkelbach, it was RESOLVED that John Wickham, Chairman, Southold Town Planning Board be authorizedto sign the final maps on Eastern Shores at Greenport, Section II. - It is' NMXIUPX pointed out that the Building Inspector can not issue anybuiHing permits on this lan& X= until such time as the subdivider has secured permission to make the road connecting to County Route 27A. Vote of the Board: Ayes-Mr.- Wickham, Mr.' Moisa, Mr. Grebe, and Mr. Unkelbach. M. S. Land & Development Corp. and H. J. S. Land & Development Corp. , domestic corporations having their principal place of business at Greenport, New York, herein collectively referred to as "Eastern"; WITNESSETH Eastern is about to open up Section Two of its development between the North Road and Long Island Sound at Greenport, New York, and wishes to con- struct water mains and install hydrants in the streets and rights of way as laid out on a certain map entitled,"Map of Section Two, Eastern Shores at Green- port", and connect with the village main on the North Road. The Village is wining to supply water to Eastern, and the parties have agreed upon the terms and conditions for the making of the connection and other matters. Now, Therefore, in consideration of the premises and the cornants herein, it is mutually agreed as follows: 1st: Eastern will install at its own cost and expense, a water main, for supply and distribution, throughout the roads as shown on a copy I aaiu inap attached hereto and made a part hereof. The necessary engineering work, trench- ing, laying. Joining, backfilling. ate. , in sometimes hereinafter referred to as the work". 2nd: The Village will supply the hydrants for installation at the loca- tions shown on said map. 3rd: Until such time as rental for such hydrants is assured and paid fodby the East-West Greenport Fire Protection District, Eastern will pay annually to the Village such rental for such hydrants an to from time to time being paid by such District to the Village for other hydrants in the District. The Village will deliver the hydrants to the site at a time appropriate to the expeditious completion of the work, if given ample notice by Eastern. 4th: Johns-bfansvilieTransite pipe, or equal, may be used for the mains. Any pipe and all Joints and parts of the system must be able to stand pressure of not lose than 150 pounds per square inch. 5th: The Village will supply without charge to Eastern sufficient water to make essential tests and to lease the system on final approval completely sanitary. 5th: The work is subject to Inspection by the Village which hereby delegates tie its Superintendent of Utilities full power of inspection hereunder. Eastern will grant complete freedom of access to all parts of the premises and the work for inspection. The Village will have an authorised inspector at the site at all proper times so as not to delay the work. No work not passed by the inspector will be accepted by the Village. No backfilling shall be donee until the pipe and work in the teash has been approved by the inspector. 7th: Eastern will, and by this agree .idoes, upon approval of the completed work, which the Village will indicate to Eastern in writing, dedicate the mains to the Village, and does hereby grant and convoy to the Village an easement and A&M of way for the purpose of laying, relaying, repairing, operat- e tag and maintaining water mains, both supply and distribution, and appurtenances, tueludi ft domestic services and fire hydrmts in the full length and width of the naw or hereafter existing public or private streets in the premises as shown on the attached map. It is reasonable for the Southold Planning Board to require that the 212 acres of the low area on the west side of the new road be some- what dredged and landscaped for park area under the Town' s park and playground provisions. This agreement is to be in satisfaction of the Board' s requirements as to the areas subdivided and known as "Eastern Shores at Greenport, Sec- tion I" and " Eastern Shores at Greenport, Sec- tion II" . b. That at some time in the near future, the Southold Town Planning Board and/or the Town will require access to the Long Island Sound upon the filing of some future section or subdivision, and that the requirements will probably be not less than 200 feet of access to salt water, which grant when made will be defined by the mutual agreement of the Board and the corporate owners. That only one single family dwelling house for residential purposes, and a private garage attached thereto for family use only, shall be built on these premises. No occupancy of any such dwelling house shall be permitted until the outside and the roof shall be fully and completely finished and painted. No trailer, tents or camping shall be permitted. 2. That no building, structure or structures shall be erected or main- tained at a height in excess of two stories, and that all roofs shall be of the hip, gable or pitch roof type construction. All buildings shall be erected on closed foundations of poured concrete or cement blocks, and no buildings on posts shall be permitted. No flat roofs or lean-to roofs shall be permitted. There shall be no outside storage of boats or commercial vehicles on any lot. 3. That no dwelling house, exclusive of garage, shall be erected on said premises which shall contain less than one thousand (1000) square feet of living area on the ground floor. All roofs shall be of asbestos, cedar or composition shingle and no roof shall be laid down with rolled roofing. All plans and speci- fications shall be subject to the approval of the party of the first part, and in writing. Such approval shall not be unreasonably withheld. 4. No trade, craft, business, manufacture, industry, commerce or profession (medical, dental and legal professions permitted) including hotels, boarding and rooming houses, shall be conducted on said premises. 5• No nuisances nor noises of any kind, unwholesome and offensive to the neighborhood, shall be permitted to exist on said premises, nor shall any accum- ulation of rubbish, garbage, junk or materials of any kind be permitted to remain on said premises. No advertising signs, billboards or other sign devices shall be permitted on any of said lots, excepting a developer's sign of reasonable dimensions, or a "for sale" or "for rent" sign not larger than 12" x 24". 6. No fowl, poultry, animals or livestock shall be kept on said premises except domestic household pets. Pets shall be limited in number to two except by special permission of the grantor herein. T. Exterior clothes lines shall be installed in a manner that will de- tract to a minimum from the appearance of the neighborhood and with due considerat- ion for the aesthetic value thereof. 8. There shall be no outside toilets or outhouses erected upon said premises. Adequate septic tanks or cesspools shall be erected and maintained on said premises for sewage disposal in conformity with the requirements of the Suffolk County Health Department. No fencing whatever shall be erected or grown in that area of the front yard of each plot which is forward of a line established by extending the front line of the house to each sideline of the plot. On corner properties this restriction shall apply to the yard area facing both streets. 12. No title in and to the bed of any private road on said tract of land bordering said premises is herein conveyed to the grantee. Southold, New York Rei Subdivision- Eastern Shores at Greenport, Section II Dear Mr. Edsone As a result of discussion in executive session the Planning Hoard on November 24, it was felt by the Hoard that it would be reasonable to require two and one-half (2�) acres of the low area on the west side of the new road to be somewhat dredged and land scaped for park area under our park and playground provisions. We feel that this would be an asset to the community and your development in particular. We feel that this would satisfy the requirements for the area which you have in Section I, and the requirements in Section II. The Planning Hoard feels, however, as we have made known to you, at some time in the near future we will require access to the sound upon filing of some future section of this subdivision, and that our requirements will probably be not less than 200 feet of access to salt water at some point. This will be mutually agreeable to you and us, which once again will be of value to your defelop- ment and to the Town of Southold.
