Dear Mr. Wickham:
Thank you for the copy of your letter to Frank Sturm
of February 8, 1972. Mr. Sturm called here to tell me he
had received it.
Mr. Sturm said that he fully realized that the present
condition of the roadway in Section Five is not good. The
present deep ruts were caused by a tremendous cement truck
which used the road in connection with present construction.
Mr. Sturm also states that as soon as the thaw is out
of the ground the roadway will be put in good order and
oiled.
When Charles W. Morgan returns from his trip I will ask
him to see you concerning the original approval. The con-
struction records of the corporation will indicate that the
roads were completed prior to the filing of the map in order
to avoid the expense of bonding and the mechanics in connection
therewith.

Dear Sir:
The Planning Board received a letter from your attorney
Lefferts P. Edson on date of January 24, 1972, in reference
to your subdivision "Eastern Shores, Sec. V" , at their meet-
ing held on February 7, 1972.
Please be advised that we have no records of these roads
ever being approved by any of the Town departments. It appears
that these roads are deteriorating and we feel that they can
not be considered as approved access for very much longer. It
is our opinion that these roads will be impassable by spring.
When this occurs, the Building Inspector will be instructed
not to issue any building permits in this subdivision.

Dear Mr. Wickham:
Frank Sturm has delivered your letter to him of
January 19, 1972 to me.
The roads shown on the map of Section V have not yet
been dedicated to the Town of Southold as public highways
because the present assessment values of construction thereon
do not qualify for the dedication.
The roads shown on the map of Section V were construc-
ted prior to the approval of the map by the Town Board and prior
to the signing of the map by the Planning Board. This was done
in order to avoid the necessity of again obtaining a bond for
the construction.
Frank Sturm tells me that prior to the approval of the
map by the Town Board and the signing of it by the Planning Board,
approval of the road construction was obtained after he initiated
the examination of the roads by talking to the Superintendent
of Highways.
Evidently a report was made either by the Superintendent
or by the Town Engineer approving the construction, otherwise, the
Town Board would not have been advised to approve.
There is, of course, nothing in my file concerning
these discussions, since the attorney does not get involved in
the actual road construction.

in obtaining the approval of the road, but he is not now avail-
able and won 't be for another two months, since he is on a
trip around the world.

HIGHWAY SPECIFICATIONS
i
TOWN OF SOUTHOLD
Any person or persons desirous of dedicating land for town
highway purposes shall be required to file three (3) prints of
the proposed layout of such highway with the Planning Board of
the Town of Southold. The Planning Board shall examine such
prints and prepare a written report thereon, containing its
recommendations concerning the proposed layout, and file the
same with the Southold Town Board together with one print of
the proposed layout. The Planning Board shall retain one print
for its files and shall return one print to the applicant.
Thereafter, the Town Board shall approve or disapprove such
layout and so advise the Planning Board and the applicant.
After such proposed layout has been approved by the
Southold Town Board, the following specifications shall be
complied witha-
l. Any person or persons desiring to dedicate real estate
to the Town of Southold for highway purposes must execute and
submit to the Town Board the following: -
a. A duly acknowledged dedication and release,
together with the required County Clerk's recording fees.
b. Proposed consent to the Town Board.
c. Proposed order of the Superintendent.
d. A survey map of the property.
e. An Attorney's certificate of title and an abstract
of title certified to the Town Board by an Attorney or a $2,000.
title policy issued in the name of the Town of Southold.
f. A bargain and sale deed with covenant against
grantor's acts in the proper form for recording in the County
Clerk's Office, together with the recording fees.
The foregoing six documents shall be fastened together in
one folder and the dedication and release shall include the
signatures of all fee owners, easement owners, mortgages and so
forth, and the Attorney's certificate shall certify to such.
2. All highways accepted by the Town as Town Highways
must be at least fifty (50) feet in width; such width shall
hereinafter be known as the bounds of the highway.
3. All proposed highways shall be properly surveyed,
monumented with concrete monuments on all points, curves and
intersections, with maps showing a profile at an appropriate
scale, cross-section of highway, name of highway, name of all

adjacent owners, if any, drainage rights of way or leaching areas,
width and length of highway, scale of map shall not be more than
1" to 2001 . An additional survey map of the property other than
the one in the folder shall also be submitted.
4. All highways terminating at tidewater shall have a wid
of not less than 100' back from the mean high water mark. All
highways on water front property must have the same access to the
water as above required.

5. All dead-end highways must have a width of not less tharil
100' for a distance of 100' back from the dead-end to provide for
a turnaround all of which must be free from trees, bushes and
stumps.
6. The name of such highways may be proposed by the owner
or owners of property dedicating such highways but the name of
such highways shall be subject to the approval of the Town Hoard
7. A width of thirty-four (34) feet shall be hereinafter
known as the highway area from which all trees, brush, rocks,
stumps and other obstructions shall be thoroughly cleared and
all such material shall be removed from bounds of the highway.
8. The portion known as the highway area shall be plowed,
disc-harrowed, rolled and graded to a uniform surface to the
longitudinal grade as shown on the final map.
SECTION 9, AMENDED FEBRUARY 24, 1966
9. Three (3) inches of loam, free of all vegetable matter,
mixed with three (3) inches of bank run shall be applied to a
depth of six (6) inches below the finished grade of the road
section.
10, where cuts and fills are necessary in order to bring
the highway to the proper grade and cross sections, the cut or
fill shall meet the abutting surface with a 1 on 2 slope. where
the slope or fill extends beyond the fifty fee, the necessary
releases, easements or deeds must be obtained from the property
owner or owners.
SECTION 11, AMENDED FEBRUARY 4, 1966
When deemed necessary by the Superintendent of Highways,
storm sewers, leaching basins, leaching areas, curbs and/or
gutters shall be installed in accordance with and under the super-
vision of the Superintendent of Highways. when leaching basins
and curbs and/or gutters are required the same shall be const-
ructed as follows: a. Leaching basins: Only inlet type basins
shall be used and shall have a concrete curbing extending six (6
feet from both sides of the inlet. All basins within fifty (50)
feet of each other shall be connected to each other with eighteen
(18) inch corrugated pipe. b. Concrete curbs and/or gutters:
Curbs and gutters shall be installed at the intersections of all'
streetsi Shall have a curve with a radius of not less than
twelve (12) feet and shall extend at least twenty (20) feet alon
each street from each end of the curve, The minumum distance
between curb faces on both sides of the highway shall be thirty-
seven (37) feet.

SECTION 12, AMENDED FEBRUARY 24, 1966
12. After the highway area has been Properly graded, rollel
and shaped to the approval of the Superintendent of Highways, the
twenty-four (24) foot section in the center of the highway area
(hereinafter referred to as the road section) shall be stablized
with an application of three (3) gallons of SC-1 (Bituminous Cut
Back) per square yard mixed to a depth of six (6) inches. Within
two (2) months, and not less than one (1) month after stabilizat .oi
the road section shall be rolled and properly prepared and an
application of one half (h) gallon of MC-2 (Bituminous Cut Back)
per square yard shall be applied with sufficient sand to absorb
the excess oil. In case of dry weather, the subgrade shall be
wet-down before application Of Oil. Before the highway in
accepted by the Town of Southold, the Superintendent of Highways
will examine the same and thereafter a final application of .3
gallons of RC-2 (Bituminous Cut Back) per square yard shall be
applied and shall be covered with three eights (3/8) inch blue
stone, which shall be rolled with a roller having a minimum weiglkt
Of five (5) tons. Where curbs are installed, the road section
shall be deemed to be the entire area within the curbs.
13. On both sides of the oiled surface or road section of
the highway area, there shall be a five foot shoulder which
shall be graded, shaped, rolled and free from all debris of all
kind.
14. Before any highway shall be accepted by the Town of
Southold as a town highway by dedication, the assessed value of
the buildings and structures on the land on both sides of such
highway (as shown on the current tax roll of the Town of Southolc )
shall have an assessed value of not less than forty thousand
(540, 000. 00) dollars permile or proportioned at that rate if
more or less than a mile.
SECTION 15, AMENDED FEBRUARY 24, 1966
15. Where it in necessary to have a drainage area located
beyond the fifty (50) foot bounds of the highway, fee title to
such area shall be conveyed to the Town of Southold together witt
the necessary land to connect such area to the bounds of the
highway, corrugated pipe having a minimum diameter of eighteen
(18) inches extending from the drainage area to the bounds of th
highway shall be installed with clean out boxes at one hundred
fifty (150) foot intervals.
16. Sidewalks shall be a standard four foot in width, four
inches thich except in driveways where they must be not less the
six inches thich. All cWbs and gutters to be built to standard
forms an may be directed by the Superintendent Of Highways. On
existing Town Highways the Town will furnish the necessary
engineering, grading, fill and labor; the property owner of
owners shall furnish the necessary ready mixed concrete and
shall deliver such concrete to the site an directed by the
Superintendent of Highways. The amount of sidewalk construction
throughout the Town shall be determined by the Town Board.

17. Whenever in the opinion of the Superintendent of
Highways he feels that for the beat interest of the Town,
alterations or modifications should be made to the above
specifications, rules, and regulations, such alterations or
modifications may be made on the recommendation of the Superin-
tendent of Highways to and with the approval of the Town Board.
These specifications shall be effective on and after the
24th day of February 1966.

9. Three (3) inches of loam, free of all vegetable matter,
mixed with three (3) inches of bank run shall be applied to a
depth of six (6) inches below the finished grade of the road
section.
10. Where cuts and fills are necessary in order to bring
the highway to the proper grade and cross sections, the cut or
fill shall meet the abutting surface with a 1 on 2 slope. Where
the slope or fill extends beyond the fifty fee, the necessary
releases, easements or deeds must be obtained from the property
owner or owners.
SECTION 11, AMENDED FEBRUARY 4, 1966
When deemed necessary by the Superintendent of Highways,
storm sewers, leaching basins, leaching areas, curbs and/or
gutters shall be installed in accordance with and under the supe -
vision of the Superintendent of Highways. When leaching basins
and curbs and/or gutters are required the same shall be const-
ructed as follows: a. Leaching basins: Only inlet type basins
shall be used and shall have a concrete curbing extending six (6
feet from both sides of the inlet. All basins within fifty (50)
feet of each other shall be connected to each other with eightee
(18) inch corrugated pipe. b. Concrete curbs and/or gutters:
Curbs and gutters shall bL installed at the intersections of all
streets; Shall have a curve with a radius of not less than
twelve (12) feet and shall extend at least twenty (20) feet alon
each street from each end of the curve, The minumum distance
between curb faces on both sides of the highway shall be thirty-
seven (37) feet.

SECTION 12, AMENDED FEBRUARY 24, 1966
12. After the highway area has been properly graded, rolle
and shaped to the approval of the Superintendent of Highways, the
twenty-four (24) foot section in the center of the highway area
(hereinafter referred to as the road section) shall be stablized
with an application of three (3) gallons of SC-1 (Bituminous Cut
Back) per square yard mixed to a depth of six (6) inches. Within
two (2) months, and not less than one (1) month after stabilizat o.
the road section shall be rolled and properly prepared and an
application of one half ('h) gallon of MC-2 (Bituminous Cut Back)
per square yard shall be applied with sufficient sand to absorb
the excess oil. In case of dry weather, the subgrade shall be
wet-down before application of oil. Before the highway is
accepted by the Town of Southold, the Superintendent of Highways
will examine the same and thereafter a final application of .3
gallons of RC-2 (Bituminous Cut Back) per square yard shall be
applied and shall be covered with three eights (3/8) inch blue
stone, which shall be rolled with a roller having a minimum weig t
of five (5) tons. Where curbs are installed, the road section
shall be deemed to be the entire area within the curbs.
13. On both sides of the oiled surface or road section of
the highway area, there shall be a five foot shoulder which
shall be graded, shaped, rolled and free from all debris of all
kind.
14. Before any highway shall be accepted by the Town of
Southold as a town highway by dedication, the assessed value of
the buildings and structures on the land�on both sides of such
highway (as shown on the current tax roll of the Town of Southol )
shall have an assessed value of not less than forty thousand
($40, 000. 00) dollars permile or proportioned at that rate if
more or less than a mile.
SECTION 15, AMENDED FEBRUARY 24, 1966
15. Where it is necessary to have a drainage area located
beyond the fifty (50) foot bounds of the highway, fee title to
such area shall be conveyed to the Town of Southold together wit
the necessary land to connect such area to the bounds of the
highway, corrugated pipe having a minimum diameter of eighteen
(18) inches extending from the drainage area to the bounds of th
highway shall be installed with clean out boxes at one hundred
fifty (150) foot intervals.
16. Sidewalks shall be a standard four foot in width, four
inches thich except in driveways where they must be not less tha
six inches thich. All cprbs and gutters to be built to standard
forms as may be directed by the Superintendent of Highways. On
existing Town Highways the Town will furnish the necessary
engineering, grading, fill and labor; the property owner of-
owners shall furnish the necessary ready mixed concrete and
shall deliver such concrete to the site as directed by the
Superintendent of Highways. The amount of sidewalk construction
throughout the Town shall be determined by the Town Board.

17. Whenever in the opinion of the Superintendent of
Highways he feels that for the best interest of the Town,
alterations or modifications should be made to the above
specifications, rules, and regulations, such alterations or
modifications may be made on the recommendation of the Superin-
tendent of Highways to and with the approval of the Town Board.
These specifications shall be effective on and after the
24th day of 8ebruary 1966

like to request that you make an inspection of Eastern Shores,
Section V.
At the last meeting of the Planning Board it was decided
that if the highways in Eastern Shores, Section V met the
Specifications in force at the time preliminary approval was
given we would accept them.
As I see it we are not so much concerned about the grade or
drainage as we are about the actual highway surface. I would
suggest that you -determine if this road surface is stabilised to
a depth of 6 'inches with SC-1 or the equivalent, and in addition,
if it has had a top coat of MC-2 as required.
My information is that this road only had a top oil. I do
not really know and would appreciate you making a determination.

Any person or persons desirous of dedicating land for town highway purposes
shall be required to file four (4) prints of the proposed llyottt of such highway
with the Planning Board of the Town of Southold. The Planning Board shall
examine such prints and prepare a written report: thereon, containing its re-
commendations concerning the proposed layout, and file the same with the Southold
Town Board and one copy to the Superintendent of Ilighways, together with one
print of the proposed layout. The Planning Board shall retain one print for
its files and shall return one print to the applicant. Thereafter, the Town
Board shall approve or disapprove such layout and so advise the Planning Board
and the applicant.
After such proposed layout has been approved by the Southold Town Board,
the following specifications shall be compiled with:-
] . Any person or persons desiring to dedicate real. estate to the Town of
Sonthold .for highway purposes must execute and submit to the Town Board the
following:
a. A duly ,atcknowledged dedication and release, together with the required
County Clerk's recording fees. .
b. Proposed consent to the Town Board.
c. Proposed orderfof the Superintendent
d. A survey map 9f the property which shall show the actual location of
the highway area with$n the highway right-of-way.

e. An Attorney'slcertificate of title and an abstract of title certified
to the Town Board by nn Attorney or a $2,000 title policy issued .in the name of
the Town of Southo]d.l
f. A bargain and sale deed with covenant against grantor's acts in the
proper .form for recording in the County Clerk's Office, together with the re-
cording fees.
The foregoing six documents shall he fastened together in one .folder and
5the dedication and release shall include the signatures of all fee ownersy
' easement owners, mortgagees and so forth, and the Attorney's certificate shall
certify to such.
2. All highways accepted by the Town as Town iiigliways must be at least
fifty (50) feet in width; such width shall hereinafter be known as the bounds
of the highway,
3. All proposed highways shall be properly surveyed, monumented with con-
crete monuments on all points, curves and intersections, with maps showing a
profile at an appropriate scale, cross-section of highway, name of highway,
name of all adjacent owners, if any, drainage .rights of waty or leaching arras,
width and length of highway, scale of map shall not be more than 1 " to 200'.
An additional survey map of the property, other than the one in the folder,
shall also be submitted.
4. All highways terminating at tidewater shall have a width of not less
than 100 feet back from the mean high water mark. All highways on water front
property must have the same access to the water as above required. Each dead
end shall. have a Stop Sign on a 10 foot steel U type sign ;lost.
5. All dead end highways must have a width of not less than 100 feel: for
a distance of 1.00 feet back from the dead end to provide for a turn-a-round,
all of which rmtst be free of trees, hushes and stumps,.- A ,guard .rail of 18',;
inches in width galvanized steel to be mounted on 4x0x6 inch frosts of which
30 inches must be dipped in creosote to be pnt in the ground to cover the dead-
end and a Stop Sign to be mounted on a 1.0 font steel U post sbrtl] be placed in
the middle of the dead-end.

6. The name Of such highways may be proposed by the owner or owners of
of property dedicating such highways but the name of such highways shall be
subject to the approval of the Town Board.
7. A width of 36 feet shall be hereinafter known as the highway area from
which all trees, brush, rocks, stumps and other obstructions shall be thoroughly
cleared and all such material shall be removed from the bounds of the highway,
the remaining distance from the curb line to the property line, shall be raked
and seeded.
S. The portion known as the highway area shall be plowed, disc-harrowed,
rolled and graded to a uniform surface to the longitudinal grade as shown on
the final map.
Q. Six inches of Bank Run Base Material with a gravel content of 20% or
more will be installed below the finished grade of the road section if the
existing material is not satisfactory, and shall he free of all vegetable matter

b. Concrete Curbs: Curbs shall be installed on all streets within
the sub-division or development. All intersections shall have a curve with a
radius of not less than twelve (12) feet. The distance between curb faces on
both sides of the highway shall be 36 feet. Curbs shall be 6 inches wide,
16 inches deep. 6 inches above road surface.

in the center of the highway area (Hereinafter referred to as the "road section")
shall be stabilized with an application of three (3) gallons of MC-250 (bitumin-
ous cut baCK) per square yard mixed to a depth of six (6) inches in two (2)
separate applications. Within two (2) months and not less than one (1) month
after stabilization, the road section shall be rolled and properly prepared and
an application of one-half O gallon of RC-250 (bituminous rut back) per square
yard shall be applied with sufficient sand to absorb the excess oil. In case of
dry weather, the sub-grade shall be wet-down before the application of oil. Be.for.

17. Whenever in the opinion of the Superintendent of Highways he feels that
for the best interest of the Town, alterations or modifications should be made
