As an alternative,possibly a new smaller bond could be posted for the above mentioned revomeendations, and the original bond could be released entirely. The Planning Board is satisfied with the work, but feels that two noted items should be covered by bond until such time as this work can be completed. Any pipe and all joints and parts of the system must be able to stand pressure of not less than 150 pounds per sgr;.ire inch. 5th; The Village will supply without charge to Eastern sufficient water to make essential tests and to leave the system on final approval completely sanitary. 6th: The work is subject to inspection by the Village which hereby delegates to its Superintendent of Utilities full power of inspection hereunder. $astern will grant complete freedom of access to all parts of the premises and the work for inspection. The Village will have an authorized inspector at the site at all proper times sous not to delay the work. No work not passed by the inspector will be accepted by the Village. No backfilling shall be done until the pipe and work in the trench has been approved by the inspector. 7th: Eastern will, and by this agreement does, upon approval of the completed work, which the Village will indicate to Eastern in writing, dedicate the mains to the Village, and does hereby grant and convey to the Village an easement and right of way for the purpose of laying, relaying, repairing, operating and maintaining water mains, both supply and distribution, and appurtenances, includ- ing dome stic services and fire hydrants in the full length and width of the now or hereafter existing public or private streets in the premises as shown on the at- tached map. The rights of way and easements shall also extend five feet on either side of the mains to be laid pursuant to this agreement, whether or not such distance shall be within the roadway. Individual lot grading shall be completed before occupancy. 11. No fence shall be erected or maintained on any lot over four feet in height. Fences shall be picket, ranch type, privit or evergreen only. No fencing whatever shall be erected or grown in that area of the front yard of each plot which is forward of a line established by extending the front line of the house to each sideline of the plot. On corner properties this restriction shall apply to the yard area facing both streets. 12. No title in and to the bed of any private road on said tract of land bordering said premises is herein conveyed to the grantee. The grantor retains the said title, and also the right to dedicate and convey the said title to the Town of Southold, or to the Village of Greenport, or in its sole discretion, to convey said title to an association of owners of lots of said tract. 13. The said covenants and restrictions are hereby declared to be covenants and restrictions attached to and running with the land, and shall expire on January 1, 1984, except that any or all of the above covenants and restrictions may be modified, altered or annulled as to the premises described herein or as to any other neighboring property now or formerly owned by the grantor at any time by written agreement by and between the grantor, its distributees or assigns, and the then owner for the time being of the premises upon which it is agreed to amend, alter or annul such covenants and restrictions and such agreement shall be effectual to modify, alter or annul such restrict- ions as to said premises without consent of the owner or owners of any adjacent premises or any other neighboring premises, now or formerly owned by the grantor, or of any other party or mortgagee holding any interest in the said premises.
