Kassner, Site Plan Reviewer Carol Kalin, Secretary Mr. Orlowski: Good evening. I'd like to call this meeting to order. The first order of business is for the Board to set Monday, July 31, 2000, at 5:30 p.m. at the Southold Town Hall, Main Road, Southold, as the time and place for the next regular Planning Board Meeting. Southold Town Planning Board Pa.qe Two July 10, 2000 PUBLIC HEARINGS: Site Plans: Mr. Orlowski: 5:30 p.m. - Buccaneer Books - This proposed site plan is for the construction of a 5,300 square foot storage building located on Depot Lane in Cutchogue. SCTM#1000-96-5-8. Are there any comments on this site plan? Hearing none, are there any questions from the Board? Mr. Orlowski: Mr. Latham? Mr. Latham: No. Mr. Orlowski: Mr. Cremers? Motion carries. (The hearing was closed at 5:31 p.m.) What is the pleasure of the Board? Mr. Cremers: Mr. Chairman, I'll offer the following resolution: WHEREAS, this proposed site plan, to be known as site plan for Buccaneer Books, is for a 5,300 square foot private warehouse; and WHEREAS, Walter P. Hennessey and Marianne Fontana are the owners of the property known and designated as Buccaneer Books, Depot Lane, Cutchogue, SCTM#1000-96-5-8; and WHEREAS, a formal application for the approval of this site plan was submitted on April 12, 2000; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on June 12, 2000; and WHEREAS, this site plan, last revised June 20, 2000, was certified by the Building Inspector on July 7, 2000; and WHEREAS, the Architectural Review Committee has approved the elevation drawings on May 25, 2000; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the final survey, dated June 20, 2000 and revision of November 23, 1999, with Suffolk County Department of Health Services approval stamp subject to a one year review from date of building permit. Hearings Held Over From Previous Meetings: Mr. Orlowski: Summit Estates, Section 4 - Section 4 of this major subdivision is for one 4.3739 acre lot (Lot #33). The property is located off Shipyard Lane in East Marion, SCTM#1000-38-7-p/o 10 (a.k.a. SCTM#1000-35-8-5,3). I'll make the following motion: BE IT RESOLVED that the Planning Board hold the final hearing for Summit Estates, Section 4, open until such time that Conditions Number 3, 4, and 5 of the approval in regard to the public hearing in accordance with Condition Number 11 of the Declaration of Covenants and Restrictions are fulfilled to the satisfaction of the Planning Board. MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES, SET OFF APPLICATIONS: Final Extensions: Mr. Orlowski: Wildberry Fields - This major subdivision is for 10 lots on 22.3886 acres, located on the south side of Sound View Avenue; 289 feet west of Clark Road and the north side of C.R. 48; 320 feet west of Clark Road in Southold. SCTM#1000-51-3-12.2 & 12.4. Southold Town Planning Board Pa.qe Five July 10, 2000 Mr. Latham: Mr. Chairman, ~'11 offer this: RESOLVED that the Southold Town Planning Board grant a ninety (90) day extension of conditional final approval. Conditional final approval was granted on December 13, 1999. The 90 day extension will expire on September 13, 2000 unless all conditions of approval have been fulfilled. Sketch Determinations: Mr. Orlowski: Ann Marie Goerler Revocable Livinq Trust - This proposal is for both a set-off and a lot line change. The proposed set-off is to set off a 80,000 square foot parcel from an approximately 38.7 acre parcel on which the development rights will be purchased by the Town of Southold on 36.39501 acres. The proposed lot line change is to subtract 21,597 square feet from the 38.7 acre parcel and to add it to an adjacent 1.641 acre parcel. The parcels are located on the west side of Cox's Lane in Cutchogue. SCTM#1000-96-3-3.1 & 4.1. Mr. Cremers: Mr. Chairman, I'll offer the following: WHEREAS, the proposal is to set off a 80,000 square foot parcel from an approximately 38.7 acre parcel; and WHEREAS, the proposed lot line change is to subtract 21,597 square feet from the 38.7 acre parcel and to add it to a 1.641 acre parcel (SCTM#1000-96-3-3.1); and WHEREAS, the development rights will be purchased by the Town of Southold on 36.39501 acres; and WHEREAS, there is an existing dwelling on the parcel to be set off; and Southold Town Planning Board Page Six July 10, 2000 WHEREAS, the development rights will be sold on the entire parcel with the exclusion of the parcel to be set off; and WHEREAS, due to the fact that there is an existing house on the parcel to be set off and the development rights will be sold on the remaining parcel, this proposal creates no new impacts; therefore, BE IT RESOLVED that the Southold Town Planning Board grant sketch approval to the set-off, map dated June 28, 2000. Mr. Cremers: In addition: BE IT FURTHER RESOLVED that the Southold Town Planning Board, acting under the State Environmental Quality Review Act, establishes itself as lead agency, and as lead agency, makes a determination of non-significance and grants a Negative Declaration on both the set-off and the lot line change. Southold Town Planning Board Page Seven Ju1¥10,2000 MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES, SET OFF APPLICATIONS - STATE ENVIRONMENTAL QUALITY REVIEW ACT: Determinations: Mr. Orlowski: Rushin/Motle¥: This proposed set off is for 2 lots on 3.4218 acres. The property contains 2 existing dwellings and is located within the R-80 Zoning District. Area variances with respect to lot lines, lot size and setbacks of existing buildings have been granted by the ZBA. The property is located on the south side of Indian Neck Lane in Peconic. SCTM#1000-86-7-5. Mr. Edwards: Mr. Chairman, I'll offer the following resolution: BE IT RESOLVED that the Southold Town Planning Board, acting under the State Environmental Quality Review Act, assumes lead agency, and as lead agency, makes a determination of non-significance and grants a Negative Declaration.
