The following action was taken by the Southold Town Planning
Board, Monday, February 23, 1987.
RESOLVED that whereas a formal

WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on January

WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision plat

NOW, therefore, be it RESOLVED that the application of Kenneth

Janury 12, 1987 be approved and the Chairman be authorized

Road, Orient, New York.
Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on February
4, 1987 reviewed the proposed subdivision plat, entitled, "Minor Subdivision -
Kenneth Strachan, Jr. & Margaret L. Strachan" referred to it pursuant to Section
1333 of the Suffolk County Charter. After due study and deliberation it
resolved to disapprove said map for the following reasons:
1. The proposed subdivision will result in the creation of two
landlocked parcels; that is, two parcels that do not have
frontage on an existing or proposed public road. The creation of
such lots is contrary to good subdivision layout principles and
creates problems as far as access by emergency and service
equipment is concerned. This lack of access could result in
health, safety and welfare problems for the future residents of
landlocked lots, not to mention potential disputes over the use
and maintenance of any right-of-way over an adjacent parcel that
may be created for the purpose of access.
2. Creation of landlocked lots also places the Zoning Board of
Appeals in the awkward position of having to grant a building
permit for lots under Section 280-a of the Town Law as the future
owners of landlocked lots cannot be held responsible for the
landlocked nature of their parcels.
The Commission also offers the following comment on the map for your
use and consideration:

It is suggested that any subdivision of this tract be made subject to
conditions that will afford protection to the shoreline. These
conditions should include:
a. No lot should be subdivided or its lot lines changed in any manner at
any future date unless authorized by the Southold Town Planning Board.
b. No new residential structure or sanitary disposal facility should
be constructed or otherwise located within 100 feet of the
upland edge of the tidal wetlands along the shoreline of Orient
Harbor.
c. No stormwater runoff resulting from the development and improvement of
the subdivision or any of its lots should be discharged into the
adjoining body of water and the tidal wetlands within the parcel.
d. Before approval is granted to this subdivision, the subdivider should
be required to submit this proposal to the Suffolk County Department
of Health Services for review to insure that the proposed subdivision
will meet the requirements and standards of that agency.
e. Any map for the minor subdivision should be filed in the office
of the County Clerk. This is to insure the validity of the
subdivision map and that the subdivision map will be available to
the general public in a central office of official records.

Law State Environmental Quality Review Act and 6NYCRR Part
617, Section 617.10 and Chapter 44 of the Code of the Town
of Southold, notice is hereby given that Southold Town Planning
Board as lead agency for the action described below has determined
that the project will not have a significant effect on the
environment.
DESCRIPTION OF ACTION
The minor subdivision of Kenneth Strachan Jr. and Margaret
Strachan is for 3 lots on 16.4 acres located at King Street,
Orient, tax map no. 1000-27-4-9.1 and 1000-32-1-1,14.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effects to the environment
were likely to occur should the project be implemented
as planned.
Because there has been no correspondence received in the
alotted time from the Suffolk County Department of Health
Services it is assumed that there are no comments or objections
from that agency.

for a set-off and lot line change.
This project is unlisted and an initial determination
of nonsignificance has been made. We wish to coordinate
this action to confirm our initial determination.
May we have your views on this matter. Written comments
on this project will be received at this office until October
23, 1986. We shall interpret lack of response to mean there
is no objection by your agency in regard to the State Environmental

Dear Mr. Orlowski:
On behalf of Margaret L. Strachan and myself, I would request
that the Southold Town Planning Board override the Suffolk County
Planning Commission's disapproval of said minor subdivision.
The reasoning behind this request is that the Planning Board
in August of 1979 approved the setting off of lot # 2 and the Board
of Appeals approved the 25 foot right of way. A public utility
easement was obtained as well. There are presently no health nor
safety problems in terms of access.
The Suffolk County Planning Commission's five suggested
conditions have been already met by lot # 2 and will be adhered
to by lots 1 and 3. In fact, the Suffolk County Department of
Health has given approval for this minor subdivision.
