(631)765-1809•Fax(631)765-9064 JUN 2 2 2000 ,, j FINDINGS, DELIBERATIONS AND DETERMINATION SO_ io d Town Cler MEETING OF MAY 25,2006 ZB File No.5881-JOHN and JACQUELINE BENDICK Property Location: 860 Carrington Road,Cutchogue CTM 111-6-11 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' property has 244.50 feet along the south side of Carrington Road and 90.36 feet along Haywaters Road, Cutchogue, and is shown as Lot 364 on the Map of Nassau Point club Properties Inc.,Section D,filed May 7,1926 in the Suffolk County Clerk's Office. The premises is improved with a single-story,one-family residence. BASIS OF APPLICATION: Zoning Code Sections 100-242A(Walz Interpretation No. 5039) and 100-244, based on the Building Inspector's March 3,2006 Notice of Disapproval, which determined that the proposed additions to the existing single-family dwelling will be an increase in the degree of the nonconformity when located less than less than 50 feet from the rear yard line, and that the existing conforming front yard will be reduced from the code required 40 feet from the front yard lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 27, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct additions to an existing single-family dwelling over the existing foundation, adding a covered porch which. The front covered porch will be 35.8 feet from the southerly lot line(or 33 feet from the new step area), and the new second-story addition and new side covered porch will be 28.4 feet from the rear lot line,at its closest point,as shown on the map revised 5-1-06 by Angelo F.Corva,Architect. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's property is a corner lot with frontage along two town streets and improved with a single-family dwelling, all shown on the November 19, 2005 survey prepared by AK Associates. The applicants propose a new second floor addition at 30 feet to the top of the ridge from natural grade, and over the existing first floor, which has existed in a nonconforming location since its construction in 1962 at 28.4 feet from the rear lot line. The new front yard setback would be a 1.7 ft. reduction to allow for a Page 2—May 25, 2006 ZB File No. 5881 —J. and J. BetiuiuK CTM No. 111-6-11 four-ft deep, one-story front porch facing Carrington Road. The front setback from Haywaters Road substantially exceeds the code's minimum requirement. 2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicants to pursue, other than an area variance. The existing nonconformity of the dwelling has been 28.4 feet from the rear lot line, when built in 1962. 3. The variance granted herein Is substantial. The rear yard reduction for the second-story addition and porch addition is 56%less than the code required 50 ft.minimum setback. 4. The difficulty has not been self-created because the nonconforming foundation with one-story construction will remain to support a new second-story,with the same angle to the property lines that has existed for many years. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of additions, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Weisman, and duly carried, to GRANT the variance as applied for, as shown on the site and floor map revised 5-1-06, and and elevation diagrams prepared 2-6-02, by Angelo F. Corva, Architect, subject to the CONDITION that an engineer report be obtained to confirm that the integrity of the existing structure is solid and sufficient to hold the new second floor addition. Any deviation from the variance given such as extensions,or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Vote of the Board: Ayes: Members Oliva (Chairwoman), Goehringer, Dinizio, Simon, and Weisman. This Resolution was duly adopted(5-0). (Th CLQ. dr- . Article XXIV Section 100- 242 Subsection_(nonconforming rear yard) Article III 100-244 (front yard) Type of Appeal. An Appeal is made for: 1 A Variance to the Zoning Code or Zoning Map. y A Variance due to lack of access required by New York Town Law-Section 280-A. y Interpretation of the Town code,Article Section y Reversal or Other A prior appeal y has(has not been with respect to this property UNDER Appeal No. Year REASONS FOR APPEAL (additional sheets may be used with applicant's signature): AREA VARIANCE REASONS: (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The existing house is situated on a corner lot and facing Carrington Road. The existing house is in need of renovations and the owner wishes to relocate the bedrooms to the second floor. The architectural design of the house proposes a covered porch with a stone facade which will encroach beyond the existing dwelling. The setbacks in Nassau Point vary depending on the topography of the parcel, some homes are 35 feet from the front yard while other homes are built on hilly lots away from the road. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The existing house has established setbacks which the owner will preserve, however, the architectural design of the house is softened by a covered porch. The existing front porch cuts into the living space and will be replaced by living area. (3) The amount of relief requested is not substantial because: The setbacks in existence when the property was developed required a 35 foot front yard. The proposed setback is 35.85 and in conformity to the character of the area. The existing house is retained therefore the architect has retained the existing footprint to the extent practical. • • (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The existing house will be updated and expanded with a second floor. The height of the second floor is 30 feet to the top of the ridge (less than the code allows). The house will be a beautiful improvement to the neighborhood, no adverse impacts on the environmental conditions of the neighborhood or district will result from this second floor addition. (5) Has the alleged difficulty been self-created? ( )Yes, or (X )No. The existing house predates the setbacks in the code. The front porch would enhance the design and removal of the porch would compromise the look of the building. This is the MINIMUM that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood and the health, safety, and welfare of the community.
