As you are the agent for the above application please be advised that a Local Law was adopted at
the regular meeting of the Southold Town Board on August 13, 2002 entitled "Local Law to a
Temporary Moratorium on Processing, Review of, and making decisions on applications for
Major Subdivisions, Minor Subdivisions and Special Use Permits containing Dwelling Units in
the Town of Southold". The Local Law Number 3. 2002 is attached.
The Local Law states that the Planning Board Office "shall not accept, review continue review,
hold hearing or make any decision upon any application for a subdivision, whether that
subdivision application was submitted prior to or after the effective date of this law" for a
duration of six months beginning August 13, 2002. The above application are covered by the

The Planning Board has reviewed the above file for completeness. In order to expedite
the application further, the following issues need to be addressed:
1. Lot 1
a. Two large structures exist on Lot 1. Please identify and clarify the
use of the structures.

b. Please show the driveway for Lot 1 on the map.
It is unclear what purpose the 25' right of way on the eastern
border of Lot 1 serves, Lot 2 also shows a 25' Right of Way on the
eastern border. Was this required by Suffolk County?
A section of the parcel xs labeled Developme Rights" please
provide the latest correspondence (if any) from Suffolk County
indicating the status of the transaction.
Lot 1 abuts the 12.125 acre "Development Rights" area. If the
Development Rights area is an individual lot, please label as such.
If lot 1 is inclusive of the "Development Rights" area, please revise
the northern boundary of lot 1 to a dashed line and label the lot as
"reserved open".
2. Lots 2 & 3
The Southold Town Planning Board is not in favor of triangular
shaped lots. Please adjust lots 2 and 3 to eliminate the triangular
shape of the lot.
Pursuant to Article xvm, Section 100-181 clustering is required
for any parcel over 10 acres in the R-40 zoning district. The
proposed lots are larger than permitted in the R-40 zoning district.
However, the Planning Board has reviewed the layout and the
pending development fights sale and has requested that the
building envelopes for the two lots meet R-40 zoning
requirements. Please show the proposed building envelopes for
the lots.
3. The deed does not accurately match the survey, please revise survey to
accurately reflect the deed.
Once we are in receipt of the requested information, the application will be scheduled for
an upcoming work session. In the interim, if you have any questions, please do not

Dear Mr. DiPietro:
Water supply and quality within the Town of Southold is a serious community issue. Public water supply,
although provided by thc Suffolk County Water Authority, is determined through the current and
projected usc of thc community. To date, thc supply docs not meet the demand, however, water use is
controlled by an individuals' actions and can often bc mitigated through numerous water conservation
measures implemented during the planning process.
Water quality is very difficult to control. Although point source pollution can usually be traced to its
origin, non-point source pollution is boundless and one of the largest threats to local environmental and
community health. Non-point source pollution has been identified as the primary cause of water quality
degradation in more than 90 percent of New York State's impaired water bodies. In the Town of
Southold, localized well and surface water contamination already exists.
Consequently, the Town of Southold Planning Board in cooperation with the Suffolk County Water
Authority now requires the completion and submittal of the attached Environmental Assessment Form,
Section D. Informational Details and Water Supply Narrative as part of the SEQR review process. Until a
completed Environmental Assessment Form, Section D. Informational Details and Water Supply
Narrative is submitted, applications will be considered incomplete and the SEQR review will not proceed.

c. The conservation of existing open space areas.
d. The implementation of "natural" stormwater management practices (grass swales, filter
strips, created wetlands, etc...).
