Present were Ray Jacobs, Superintendent of Highways, Ray Dean and C.S. Heffernan of this office. We find that all the work in this subdivision meets the specifi- cations and requirements of the Town of Southold. However, there are two items that must be addressed prior to our recommendation for acceptance. 1. Install Road Signs, as required. Ray Jacobs had, in previous inspections, found all the required signs in place. Since then a number of signs have been vandalized and are missing. Mr. Mandel has ordered these missing road signs from the Southold Highway Department and upon delivery, assures that these signs will be installed immediately. 2. The board discussed the shallow drainage area and noted the northwest corner has a section that will be conveyed out. The board also noted the western intersection is in excess of 1200 feet and would require a variance. Mr. Mandel informed the board that this proposal will be done in two sections; the southern portion will be the first. It was agreed that the small asphalt paver could be used on [he turnarounds. Areas paved as follows: May ]0, 1985 Turnaround on Rd."D" and part of typical road width r_ompleted today. Also, part of circular area at Rd. "F". May II, 1985 Turnaround at Rd. "F", circular area completed. Total tonnage for two days 214. The asphalt mix was satisfactory. The required co®pacted thickness, I~", was in most part acceptable. Due to irregularities in the binder course some depths of the top course on this project will be over and under 1~". Tne asphalt has to meet definite gut+er and center line grades making it necessary that the base be constx^~cted with as much accuracy as possible. mom checks, I found most of the gutter elevations within reason and in a few areas the centerline material was slightly lox. Discrepancies such as these can be corrected when the base is fine graded and compacted after pulvermixing. The material has a high gravel content, possibly 25~ and should provide a good base. HILLCREST ESTATES - Section 1 - Letter of credit - $400 000 - 1983 Work was resumed on this project about 3 weeks ago. Some clearing was done last year. Present work includes additional clearing, topsoil stripping and rough grading only. Avery small percentage of the total work has been done. - 1 - HONEYSWCKLE HILLS - Perf. Bond - $78,000 - 1981 Work is completed on this project except for the following work and necessary repairs. 1. Two large holes in pavement at entrance to be corrected. 2. The total acreage of Sections 1 and 2 (58 acres) is included as runoff areas. The capacity of the tw recharge basins ie sufficient fos the 6° rainfall runoff ae computed. A runoff :actor a little higher than 0.25 could have been used due to pavement areas and potential development. However, no perculation factors were used at the recharge basins. This latter statement is contrary to the spirit meaning and intent of Local Law 4111 because Section II was, in fact, filed as part of the initial filing on April 14, 1982 which was sub- sequently approved for mapping. The mere designation of a name for a section of property does not change its characteristics. Raynor, Jr., Chairman Southold Town Planning Board Main Road Southold, New York 11971 Re: Highpoint at East Marion Section 1 and 2 Dear Henry: By your letter dated September 21, 1983, you sent me copies of the relevant proceedings with respect to the above subdivision map and requested my opinion as to whether the developer may develop Section II as one acre lots. To begin with, under the provision of the Town Law and the Rules and Regulations of the subdivision of land (Chapter A-105 of the Town Code), the Planning Board is required to hold a hearing on an application for preliminary approval of a subdivision map within 45 days of its filing with the Planning Board, unless the applicant consents to an extension of time. This is so even though the lot sizes shown on the map do not conform with the Zoning Code requirements. The Planning Board, however, after holding a hearing thereon, may disapprove the same for the reason that the lots do not comply with the Zoning Code requirements. With respect to the question of whether Section II may be developed as one acre lots, it is my opinion that the zoning requirements in effect at the time that the Planning Board acts on an application shall control. Since the application for preliminary approval of Section II was not filed with the Planning Board until August 10, 1983, and Local Law No. 7 requiring 80,000 sq. ft. lots became effective on May 20, 1983, Section II must comply with the two acre lot requirement. If the applicant filed an application for sketch plan approval of Section II prior to January 1, 1983, he may seek relief pursuant to Local Law No. 11 adopted by the Town Board on October 4, 1983. RE: HIGHPOINT AT EAST MARION SECTION II Regarding your letter of October 14, 1983, paragraph three regarding classification A-80 and its application under local law #11. After exhaustive search through the file, it appears the applicants Section II falls under the catagory (2) major subdivision maps for which application for sketch plan approval was filed prior to January 1, 1983. The applicants initial submission for sketch (Emar Acres) was granted approval June 15, 1982. Application fee was filed with the Town Clerk in the amount of $345 encompassing entire tract. Subsequent to this, this subdivision was renamed "Highpoint at East Marion" and sectionalized. In order for the applicant to properly design Section I, certain engineer- ing factors had to be designed into Section II in order to comply with our subdivision regulations. The Suffolk County Planning Commission, Superintendent of Highways and our Town Engineer, in reviewing the preliminary .map, studied and commented on the entire tract encompassing Section I and Section II. It is the Planning Board's opinion that the applicant should proceed under Local Law #11, as in agreement, as you have stated in the last paragraph of your letter of October 14th. It is also the opinion of the Planning Board that the applicant has dealt in good faith throughout the procedure; he has complied with those items regufsted, and should have favorable consider- ation by this Board to the Town Board for releif in this action. ie; Section II should be favorably reviewed for a one acre sub- mission.
