RESOLVED that tha Southold Town Planning Board recommend to the Town Board that the change of zone request of Herbert R. Mandel from "A" to "M" located at Boisseau Avenue and Yennecott Drive, Southold be denied since this zone is not consistent with the Mas~e~;Plan Update proposaI; however, it was felt that the applicant should consider the use of the Affordable Housing District since this area meets the criteria for that zone and the Board would be supportive of the AHD zoning. After reviewing the application, conducting a field inspection and in light of the supplementary letter dated March 4 by William Moore which conditions the application and limits the effect of the change-of-zone to the sole permitted use of single family residences on one-acre lots, we believe a negative declaration, conditioned upon certain elements being approved by the Planning Board in the subdivision review process, as stated in Part III of the LEAF properly addresses SEQR.- Should any of the conditions stated in the application be changed, or any of the elements to be included in a subdivision application to the Planning Board be missing, the SEQR declaration herein proposed may be rescinded by the Town Board as lead agency. The change-of-~one would allow in effect a doubling of the permitted density on the site compared to existing ~oning~ as conditioned by petioner's letter of March 4. As such it would require Suffolk County Health Services approval for both water supply and sewage disposal. Should public water serve the proposed development, no significant impact on groundwater is anticipated. Approval by Suffolk County Department of Health Services and by the Village of Greenport of connection to the Greenport water system should precede full preliminary approval of the subdivision by the Southold Planning Board. Change-of-Zone attachment 6e Since a significant change in the runoff characteristics of the site is proposed, adverse off site drainage impacts are possible. These can be eliminated by .Planning Board approval of a drainage plan that recharges all drainage flow on site above that rate naturally flowing off site. 7e During construction, adverse air quality impacts are possible. The use of standard dust control and vehicular emissions control measures will ~eliminate air quality impacts. Dust control measures shall be approved by the Planning Board. 15. MANDEL For a Change of Zone Pursuant to the Southold Town Code section 100-150 MEMORANDUM IN SUPPORT OF PETITION FOR A CHANGE OF ZONE This memorandum is made in support of and is hereby incorporated by reference for the petition for a change of zone to amend the zoning maps on certain property located on Boisseau Avenue, $outhold from the present zoning designation of "A Agricultural - Residential" to "M Light Multiple Residence District." The property is more particularly described in Schedule A attached to the petition and is depicted on the survey made a part of this petition. M LIGHT RESIDENCE DESIGNATION IS APPROPRIATE FOR THIS PROPERTY Surrounding Properties are Small Lots The properties in the immediate vicinity of the subject property range in size from approximately 14,000 to 22,000 square feet (See Suffolk County tax map of subject parcel attached hereto and made a part hereof as Exhibit A.) The proposed zoning designation "M Light" requires a minimum lot size of 40,000 square feet. Development of this property as one-acre parcels would not adversely affect the existing properties which are smaller lots. The proposed Master Plan presently under consideration designates the surrounding properties along both Boisseau Avenue and Yennecott Drive as "R-40" requiring lots to be one acre (40,000 square feet). The purpose of the Low Density Residential R-40 District is to provide areas for residential development where existing neighborhood characteristics, water supply and environmental conditions permit the full development densities of approximately one dwelling per acre and where open space and agricultural preservation are not predominate objectives. Proposed Zonin~ Regulations of the Town of Southold Article III-A section 100-30A. This petition for an "M Light" zoning designation is in keeping with the proposed uses and requirements for the surrounding property. The property is served by the Greenport Water District thereby making the increased density feasible. Additionally, a more than adequate supply of water is available on the property itself. The subject property is appropriate for one-acre density in view of the surrounding land uses, the property's proximity to the hamlet of Southold and the availability of water. Property is Within the Hamlet of Southold An "M Light" designation is appropriate for this property because the property is located within one-half (1/2) mile of the Southold hamlet. The proposed Master Plan includes a "Hamlet Density Residential (HD) District, the purpose of which is to permit a mix of housing types and level of residential density appropriate to the areas in and around the major hamlet centers and to promote the provision of lower cost housing in these hamlet and village areas, where provision of utilities exists or may be possible and desirable and where public facilities and commercial activities are available. While the proposed HD district does not exist, the existing M Light densities and uses are similar and seek the same objectives as the HD district. In fact the proposed zoning ordinance states the HD district is comparable to the existing M District. The property's proximity to the Southold hamlet make the M Light designation appropriate. Properties in the Area Have Been Similarly Developed Properties near the hamlet areas have been developed with similar increased density. In the immediate vicinity of the subject property both Colonial Village and Founder's Village have been developed successfully with increased density. Such property uses are in accordance with the proposition that increased densities are appropriate for the hamlet areas thereby leaving other, more appropriate, areas free from development. MAR ,5 1,.987 Feb. 28, 1987 Dear Town Board members, We were notified on February 10, 1987 that Herbert Mandel has submitted a request to downzone approximately 38 acres in the area of Yennecott ?ark and Boisseau Avenue. He proposes to ch@nge the area form an agricultural-residential district to an M-light multiple dwelling district. This property is sur- rounded on three ~ides by single family dwellings. The access to this property would be from Tuthill Rd. and Boisseau A~e. We are opposed to the construction of any multiple family units in this area. Many years of prudent planning went in to Yennecott Park including covenants intended to strictly maintain the area.~s rural residential design. We chose this area for just that reason. We have resided in Yennecott Park for ten years and have watched Southold grow. The proposed Southold Town Master Plan shows this area to be scheduled as two-acre zoning. We believe that downzoning our town's residential'areas will do nothing to create TRU~ affordable housing, but will serve to increase the possibility of turning Southold into a carbon copy of many Western L.I. towns. Unless property taxes, utility rates, land values and the general local economy sharply decreases, afford- able housing will NOT be within reach of our young people. In- creasing the density of any given area will create more problems than it solves. Many people have left the crowded western towns in exchange for the benefits of living in a rural community such as Southold. The time has come for us to put concern in the town's future ahead of the private gains of any individuals. Let's keep Southold the great town it is!
