BOX 38 • MAIN ROAD - MATTITUCK, LONG ISLAND, NEW YORK 11952 • PHONE 516 298-4844 March 19, 1974 Re: Minor Subdivision Orient, New York File # 1174 Gentlemen: Please be advised that on February 25, 1974, I discussed the above captioned matter with Robert Tasker, Town Attorney, I indicated to him that my client would be willing to execute and record a document in the Suffolk County Clerk's Office restricting the first floor elevations to a minimum of 7 feet above ground water and providing some fill to raise the grade where the leaching pools will be installed, so that any prospective purchaser will be on notice that the said fill will be required before a Certificate of Occupancy can be issued. Mr. Tasker indicated that he does not see any reason why this approach should not meet with approval from all concerned. He has also stated that the Board does not have the right to impose upon the subdivider a requirement that he improve or raise elevations of the existing town roads. I hereby request that the Board send me a letter approving the revised minor subdivision submitted by me to the Board at its March 14 meeting, conditioned of course, upon the subdivider filing the above restrictive covenant. Prior to the covenant being recorded I would submit same to Mr. Tasker for his approval and comments. I would also be willing, if it would help to resolve the stalemate at which we presently find ourselves, to meet with the members of the Planning Boarcl.and Mr. Tasker to discuss this file. On March 4 and %th measurements were taken from the test will near the north property line and about 2001 west of Orchard Street. The grourri water level was 30" below the surface. This dif8brs substantially from the 5' recorded by Mr. Casela on his test well report. 2. The present elevations of the land is below that which is flooded during abnormal storm tides. 3. This area is protected from these floods by dikes south of King street on private property. 4. Mr. Bern has shown a plan of proposed layout of wells and sanitary system, but failed to show elevations of structures. The land in the area of the sanitary structures will have to be raised in some places 61 in order to meet the requirements of the Health Department. With gentle slopes graded from these areas, the land will not be left in its natural state as intended by Mr. Born. // 5. Because of the high level of the water able, foundation construction must be given considerable study. 6. The town roads in this area adjacent to the subdivision are below the safe grade for use in abnormal tides. Mr. Casola has referred this to me since the property was purchased by him as my recomendation and since I had also recommended he divide it into four lots inste% of eight or nine as he originally wanted. 1 looked through my dictionary to get the definition of "an environmental impact study" but found nothing so would you be kind enough to define this request and give some specifics that 1 could analize and act accordingly. As you know, this matter has been months and months since the application was filed and quite a bit of money has been spent on surveys, topographical test well maps and interest on mort- gage and legal expenses] He has not requested 40,000 square feet lots but lots ranging from 90,000 feet to 120,000 square feet, well beyond the average size lots in town where soma are as small as 10,000 square feet. He can easily build a 30 x 50 house in the middle of these lots and give 150 feet distance between well and cesspools. He has proven there is good water at the site and sufficient for any one family homes. He has dug a test hole and seen that good sand and gravel are below the surface and that drainage would be no problem. With a single family house on 2+ acres, the cesspool usage would be minimal and certaiily no where near the problem that mibht be created if there were lots 100• X 100' as in many places presently in the Orient Village and closer to the water by far. The cons- truction of four homes on ten acres would certainly have no effect on air polrution. They would not put any undue strain on any of the roads or highways nor contribute any noise po- Iution or unnecesary vibration. The fact that people will be on these premises will help to prevent any noxious conditions, especially in view of the fact they must comply with a code by town and by counter. The fact that some would have a natural pkce of land with its variety in land level and plantlife and wildlife affected by filling all of the property to a six or eight feet level is a mockery to the existing beauty and in my opinion ugly, senseless and un- reasonable. My client wants to preserve the natural beauty and will covenant that this is protected, but why not let four families enjoy the "good life" that this ten acres can offer. I am enclosing a sketch of how a home, well, and cesspool may be located on each lot and where each could be. Your concern might also be cellars, but there is no necessity to have a cellar on these homes as there are many fine quality homes without cellars but with separate utility rooms at ;rade level . Mr. Casola has people who presently want these lots and are happy to have the privacy of two acres homesite where they can put up a summsoome and enjoy the relaxing surroundings at Orient. He would appreciate a definite action on his application soon as he feels he has been more than patient. You can be assured of our cooperation to resolve this reasonably.
