Construction requirements . (a) No dwelling shall be erected for less than 1800 square feet of interior living area. (b) No above-ground swimming pools shall be erected or maintained on any of said lots . (c) No part of any building and/or structure shall be located upon any lot within seventy-five (75) feet of the front street line of the lot nor within thirty ( 30) feet of any side line of the lot, nor within forty (40) feet of the rear line of the lot. (d) The foundation of any dwelling and/or structure shall be no more than 8" above ground level after final grade. (e) All plans for the construction of any building and/or structure and siding and facing upon the lot must be presented to and approved in writing by Peter Blank, Jr, and/or Mary Louise Blank, their successors or assigns, prior to the start of any construction. Such approval, which shall not be unreasonably withheld, shall be based on the judgment of Peter Blank, Jr. and/ or Mary Louise Blank as to whether the proposed structure will be consistent with, and will not distract from the aesthetic character of the Bayview Farm community. All exterior construction, painting and grading shall be completed within one year after commencement of construction. II. No lot shall be divided and conveyed as two or more separate parcels, nor shall more than one dwelling house be located on any dwelling lot. III . No lot shall be used except for residental purposes . IV. No sign of any kind shall be displayed to the public view on any lot except one professional sign of not more than one square foot, without a written consent of Peter Blank, Jr. , and/or Mary Louise Blank, their successors or assigns. V. No more than one pet dog and one pet cat shall be maintained on the premises by any lot owner. No animals, livestock or poultry of any kind shall be raised, bred or kept on any lot except as herein provided. VI . No trailer, except a boat trailer as hereinafter provided, or tent, shall be located, erected, or used permanently on any lot. No trailer, except the boat trailer as hereinafter provided, or tent, shall be located, erected or used on any lot for a continuous period exceeding five (5) days and shall be subject to any state or local law, rule and regulation thereof. No boat or boat trailer shall be placed on any lot so as to be visible when the lot is viewed from the front boundary of such lot. No boat or boat trailer in excess of 25 feet overall length shall be placed on any lot unless in a garage or authorized existing building. VII . No boundary fences other than two-rail post fences not exceeding four (4) feet in height, shall be placed on any lot. No fences , whether fabricated or growing, shall be placed on the front boundary of any lot. VIII . No noxious or offensive activity shall be carried on on any lot, nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood. IX. No accumulation of rubbish, garbage, junk or materials o£ any kind shall be permitted to remain on any lot. X. Clotheslines and laundry poles must be located in the rear yard and so placed and so screened so as not to be visible from the street upon which the premises front or from other adjoining property. XI . Road and Park Facilities (a) Construction of Road. Peter Blank, Jr. and Mary Louise Blank, hereinafter referred to as the subdivider, shall install road improvements pursuant to specifications approved by the Town of Southold. No title to land in any such road opened or laid out by the subdivider is intended to be conveyed to purchasers of any lots, and the subdivider reserves to himself a fee over all land lying in the path of any and all such roads . (b) Subdivider has set aside, as indicated on the subdivision map, a park area for the use of the owners of lots and their guests and invitees . (c) All owners of lots, their guests and invitees , are hereby granted an easement for the purpose of ingress and egress in common with others , at their own request, over the roads of Bayview Farm, shown on said map. All owners of lots are hereby granted the right to use (pursuant to reasonable regulations from time to time promulgated by the subdivider or by an association of property owners succeeding to the rights of subdivider) in common with others at their own rise, the park area. XI . (Continued) (d) After installations provided for in (a) , each lot owner whose lot abuts Old Farm Road, shall be responsible for one-twelfth (1/12th) of the real estate taxes attributable to the road. All decisions as to snow plowing, upkeep and maintenance of the road, including decisions as to the extent and cost of any repairs thereof, shall be in the exclusive discretion of subdivider or his successor in interest, an association of property owners as hereinafter provided. (e) After the installations provided for in (b) above, each lot owner shall be responsible for one-sixteenth (1/16th) of the real estate taxes attributable to the park area. All decisions as to the upkeep and maintenance of the park area, including decisions as to the extent and cost of any repairs thereof, shall be at the exclusive direction of the subdivider or his successors in interest, an association of property owners as hereafter provided. (f) The subdivider has constructed or intends to construct a road in the subdivision in such a manner that the area of each lot abutting the road to a depth of five (5) feet therefrom has been or will be so constructed, sloped, paved, graded and seeded as to provide a surface water recharge system for the purpose of drainage of surface water within such subdivision. In order to insure that such drainage system shall function properly, the following covenants and restrictions are hereby imposed upon the area of each lot abutting the lot within the subdivision to a distance of five (5) feet therefrom (herein referred to as the drainage area) . (1) The owner of each lot shall maintain drainage area thereon free from leaves , debris and other matter which may impede the flow and/or percolation of surface water over or into such drainage area. (2) No trees , shrubs , planting or other vegetation except grass , shall be planted or maintained in the drainage area without the written consent of the subdivider or his successors or assigns and the Planning Board of the Town of Southold. (3) No sand, gravel, loam or other material shall be deposited in the drainage area, nor shall any material be removed therefrom without the written consent of the subdivider, or his successors or assigns and the Planning Board of the Town of Southold. (4) No fences or other structures shall be placed or maintained in the drainage area. (5) The subdividers or his successors and assigns shall have the right to enter upon the drainage area and to construct, repair and remove such drainage pipes, culverts, catch basins, sumps, and other facilities and to perform such excavation, filling, grading and seeding operations as may be deemed necessary for surface water drainage purposes. (6) In the event that the roads in the subdivision shall hereafter be dedicated to the Town of Southold, then and in that event, the Town of Southold shall have all the rights set forth in the preceding paragraph with respect to the drainage area. (g) While a subdivider holds title to the road and park area, he will pay the taxes and expenses mentioned in Paragraphs (d) and (e) above, and will submit bills to the individual lot owners for their respective contributions . Such bills will be paid in full to the subdivider by the then present lot owner within thirty (30) days after said bills have been mailed. (h) In no event, while the subdivider holds title to the lot and park area, shall any lot owner be required to pay a sum in excess of One Hundred Fifty ( $150 . 00) per annum toward real estate taxes for the road and park area for snow plowing, upkeep, repair, and maintenance of said facilities . (1) If at any time after one-third of the lots have been conveyed to the subdivider, the subdivider may decide to transfer title to the road and park area to the property owners association, and if two-thirds (2/3) of the then lot owners (exclusive of the lot owned by the subdivider) vote to take title to said facilities , the conveyances shall be made. However, the subdivider may withdraw its offer to convey the facilities at any time prior to receipt of written notice of the offer 's acceptance. (2) If a conveyance is made to a property owners association pursuant to (1) , then: (A) All costs and expenses associated with the road and park area shall thereafter be borne entirely by the property owners association. (B) The owners of all lots purchased from the subdivider shall be members of the property owners association. (C) Each member of the property owners association shall be liable, on a per lot basis , for a share of the costs and expenses of the property owners association; however, in no event shall the owners of Lots Nos . 1, 2 , 3 and 4 be liable for any contribution attributable to the real estate taxes upon Old Farm Road or for any charges for the maintenance, repair or snow plowing of Old Farm Road. (D) Each member agrees to comply with the regulations for the use of the park and road facilities enacted by the property owners association. A two-thirds (2/3) vote shall be required for the enactment of each such regulation. (E) Upon a two-thirds (2/3) vote by the members of the property owners association, title to the road and park area shall be dedicated to the Town of Southold. (3) For the purposes of (1) , (2) (D) and (2) (E) , each lot owner shall have one (1) vote for each lot owned, whether improved or unimproved. (i) Conveyance or dedication of road. (1) The subdivider presently intends to convey title to the road and park area to a property owners association consisting of the lot owners . However, when and if such conveyance shall be made, it shall pass in the sole discretion of the subdivider. (2) In lieu of conveying the road to a property owners association, the subdivider reserves a right, in its sole discretion, to dedicate the lot to the Town of Southold without the consent of the owner of any lot or of the holder of any lien thereon or any interest therein. (3) If the subdivider or the property owners association decides to dedicate the lot and the Town of Southold requires any instruments to be signed by any of the persons referred to in (2) above, such person or persons shall execute such instruments upon written request. If such executed instruments are not received within ten (10) days after the written request was made, a lot owner, lien holder or person with any other interest therein, hereby authorizes the subdivider or the property owners association to execute the required instruments as its special agent. Therefore, there would be no enforcement from the Town. If the Covenants and Restrictions were filed with the County Clerk, then they are permanent, unless changed through the filing of new covenants (the method for allowing this would have to be specified in the original covenants). The official survey of the property says Deed. L N/A Question: In such a case, generally speaking, are the Covenants still valid, and is she required by the Planning Department to comply? SUBDIVISION COMMENTS : I was advised by the Planning Board on December 2nd that work was completed on the above subdivision. Alao, was shown the Superintendent of Highway's copy of letter received by the Planning Board in reference to the same matter. I made an inspection of the subdivision on December 3rd as follows: The last report (No. 254 dated Oct. 212 1982) indicated three items of work to be done. they were grading the swales, correcting the elevation of a L.B. and seeding the swale areas. The swales, with exception of a very small area at the Orchard Street, entrance, have been graded. This grading has been disturbed and rutted by persons unknown (probably teenagers) by driving cars and motorcycles in the swales. I would not require any re— grading by the owner. If done, the same kind of vandalism would no doubt be repeated. Mr. Blank assured me that he would take care of the minor grading operation at the Orchard Street entrance. 'he high L.B. casting, Rt. side at King Street has boon lowered. It has been agreed to delete the seeding in the swale areas. This item was 1.28% of the bond estimate. Theproposedsubdivision was approved by the Southold Town Planning Board some time ago. The proposed subdivision is .locaed at Orient. The approval granted by the Planning Board was subject to approval by the Suffolk County Department of Health. : , DThe Proposed subdivision has not yet been approved by the Suffolk County Health Department because of variations in the nitrate level above the required 10 parts per million standard. In January of 1980 I appeared before the Appeals Board of the Health Department and proposed approval with the condition that no building permit be issued without the demon- stration of a potable source of water. At that time the local representative of Culligan Water and one of Culligan's en- gineers testified to the effect that filtration systems could be installed, with effective monitoring devices, which would remove sufficient quantities of nitrates so as to pass the Suffolk County standards. Since the time of the appeal, we have received no decision. This has occurred even though I have called Mr. Robert Villa and Mr. Herb Davids of the Depart- ment of Health as well as then County Attornev Stan Corwin on numerous occasions. Since Mr. Corwin's retirement from the County Attorney's office, the Department of Health has decided that they once again must go to the Administration of the County Attorney' s office to present the entire proposal. It is my opinion that this matter will again take an undue amount of time before resolved by the Department of Health. Rdbert W. Tasker, Esq. -2- September 29, 1980 While I am aware that an Article 78 proceeding could be commenced to force a decision from the Board of Health, my client would like to explore the possibilities of applying for a minor subdivision while waiting for the Department of Health's decision. On September 22, 1980 I discussed the possibility of applying for a minor subdivision with the Planning Board. Mr. Raynor informed me that the Board could not entertain such an application without the previous application for a major subdivision being withdrawn. Mr. Raynor also pointed out that even if such an application could be entertained, if approved, the four lots would be subject to the covenant against further division. The subject parcel consists of 27.163 acres which if divided into four lots, would result in lots each of 6.79 acres. The Board has authorized me to request from you an opinion concerning the prohibition against a proposed minor subdivision for the same parcel of property which is subject to an approved major subdivision which has not yet been filed with the County Clerk's office. They have also authorized me to request an opinion concerning the absolute prohibition against further subdivision in the event that a minor sub- division with this size lots is approved. The chief engineer of the bureau of environmental health is gathering background data to support a proposed amendment to the county sani- tary code which would modify the application of the federal standards as to private systems and permit the department of health services to approve subdivisions without public water supplies where the con- centration is less than 20 ppm. Additionally, an opinion has been given to the bureau that it is possible for the variance board to find circumstances that would permit it to is- sue orders granting conditional approval where the concentration is greater than 10 ppm through map endorsement requirements along with deed restriction provisions. Such are the circumstances that an applicant would be well justified in asking the town board having jurisdiction to grant extensions of time to obtain county approval. We realize that there have already been granted two extentions to secure health department approval. However, under the cir- cumstances, we believe that an additional extention or a renewed preliminary site plan approval would be warrented. The sole problem which we have encountered with the Suffolk County Department of Health concerns the level of nitrates which have been found in the sample wells. We have fully cooperated with Mr. Villa from the Health Department and have tested the wells at numerous levels and have drilled addional wells, at Health Department's request, on two occasions. I have personally met on several occasions with representatives of Culligan Water to ascertain whether a filtration system would be a viable alternative. We arrived at two possible solutions, a reverse osmossis system or a deionization system, which would remove nitrates without using chemical additives . Both alternatives were rejected by the Health Department because they would require monitoring by each individual homeowner, if the home- owner wanted to protect himself. These systems would have had to been installed in each home if the water on the particular homesite did not meet the nitrate standards. The Health Department has suggested the possibility of establishing a private water company to service the subdivision. At the moment, our clients feel the cost of such a project to be excessive. We hope that in time we shall be able to arrive at a solution to this problem through cooperative efforts with the Health Department and with additional negotiations. Section A 106-23 (E (4) requires that the owner submit the plat in final form within six months of the preliminary approval. At this time, my clients, Peter Blank Jr. and Mary Louise Blank are unable to submit for approval a final plat. The reason for the delay is that we have been unable to obtain approval from the Suffolk County Department of Health of the water found on the premises. I am sure that you are aware that Suffolk County requires the nitrate level of the water to be less than 10 parts per million before they will grant approval of a proposed subdivision. One of the three test wells located within the proposed subdivision has not yielded water acceptable to the Suffolk County Department of Health standards. The latest test at that well yielded a sample having 10.3 parts nitrate per million. Because of the above stated difficulty in obtaining approval by the Suffolk County Department of Health of the water at the site of the proposed subdivision, I respectfully request an extension of the time limit during which the final plat must be submitted. I further respectfully request that your extension be for a period of three months from the time that the water situa- tion is finally resolved. Last August, when I originally reviewed this proposal, I indicated that the swale concept was feasible. The reservations I had at that time have remained unchanged. The depth of the topsoil is the major constraint. We expect Haven soils to have up to four feet of silt loam topsoil over coarse textured sand and gravel subsoils. My soil boring in lot No. 5 last August verified this; I found four feet of a medium textured silty topsoil. This could vary, especially since it was once agricultural land. Erosion would have transported the silty topsoil from the higher areas and slopes to the lower lying area. This results in a silty topsoil with a thickness ranging from three to seven feet. Depending on location of the swales, extensive excavation may be required to provide an adequate outlet for storm water. The town also had some questions regarding continued operation of the swale after silting, and if any alternative existed which could provide additional storage. Yes, cesspool rings can be used as leaching catch basins if desired. Generally, a swale will be designed with the driveways acting as dams to pond and recharge water uphill.. If cesspool rings were desired, the ideal location would be uphill from the driveways. I do not feel, however, that this additional precaution is necessary. A design based on an accurate delineation of the contributing watersheds with calculation of runoff based on a ten year 24 hour (five inches) storm event will provide an adequate design. By calculating the recharge capa- city of the swale using a 0.5 gallon per minute per square foot surface area, an additional safety factor is built-in since we have found clean sand subsoils and have a recharge rate of twice that. I must stress, at this point, that a basic need on recharge swales or re- charge of any kind is maintenance. Just as the swales silt up so do the leaching catch basins. The plan indicates 16 lots located on a 27.2 acre parcel located between Orchard and King Streets in Orient, New York. The Town of Southold has requested information regarding the feasibility of drainage recharge swales in the subdivision. My comments are: - 1. Soil in this area are mapped as gently sloping (0-3 percent slope) Haven Loams. A test boring 50 yards from Orchard Street in the vicinity of the proposed road confirmed the map. The boring showed 4 feet of medium textured silty material lying over coarse textured sand and gravel. No evidence of a high water table was found. 2. The use of recharge swales in the subdivision appears feasible. Several factors should be considered before a final determination is made, including: a. Haven coarse textured subsoils have adequate percolation for recharge swales. They are however, 4 to 5 feet deep throughout this area, requiring extensive excavation to provide an adequate inlet. b. Recharge swale design should be based on a infiltration rate of 0.5 to 0.75 gallons per minute per one square foot of swale surface area. C. A detailed contour map, with 1 foot contours, of the Blank and adjacent properties will be necessary to estimate storm water runoff quantities. Runoff rates should be calculated for a 10 year storm (5 inches in 24 hours). d. Some provision should be made to handle runoff water along Orchard Street, more is indicated on the map.
