Dear Mr. Orlowski:
A further extension of six months to the time limit for the
submission of the final map for this project is requested.
Sketch plan approval was granted on April 3, 1989, with a time
limit for submission of the final map of October 3, 1989. An
extension to April 3, 1990 was granted by the Board on October
16, 1989. A further extension to October 3, 1990, was granted
by the Board on April 9, 1990. It was stated that this was the
last extension that the Planning Board would grant.
The question of a satisfactory water supply has not yet been
resolved with the Suffolk County Department of Health
Services. Initial test results were outside specifications for
nitrates and several organics. Several adjustments (both
deeper and shallower), with resamples, were made in the depth
of the well, but there was little improvement in the overall
test results. The Health Department has now requested that
covenants and restrictions be included in the deed to the set-
off lot.
Additional time will be required to prepare the C&R's, obtain
appropriate approvals, record them, and obtain approval of the
proposed set-off from the Health Department. It should be
noted that the project has been diligently pursued from the

outset, and all delays were unavoidable. Further, conditions
at the site are identical to those which existed at the time
of the original sketch plan approval. In view of these

A further extension of ninety days to the time limit for the
submission of the final map for this project is requested.
Sketch plan approval was granted on April 3, 1989, with a time
limit for submission of the final map of October 3, 1989. An
extension to April 3, 1990 was granted by the Board on October
16, 1989. We now ask that this limit be further extended to at
least July 3, 1990.
The test well has been installed and the water sampled by the
Suffolk County Department of Health Services, but the testing
is not yet complete. Test results are expected before the end
of next week, and then the Health Department review will con-
tinue.
The delay in the test well installation resulted from problems
in obtaining competitive quotes from contractors, weather
problems, and travel by the owner.

In response to your letter of October 6, 1988, we have ob-
tained an Declaration of Easement from Mary Louise Blank and
Peter Blank in favor of Robert Van Nostrand, binding upon the
heirs, successors and assigns of the parties, providing access
to the proposed set off. A copy of the Declaration of Ease-
ment, dated December 30, !988, is attached.
With regard to the discrepancy between the property descrip-
tion in the Van Nostrand deed and the map submitted, it is
accounted for by the sale of a parcel (SCTM# 1000-25-4-11.5)
to Donald Boerum on May 4, 1978. A Copy of the deed to that
parcel is attached. A new deed for ~he remaining Van Nostrand
property, reflecting the sale, has not been prepared, but this
can be done if it is necessary in omder to secure approval of
the currently proposed set off.

between MARY LOUISE BLANK and PETER BLANK, JR., residing at
Peter's Neck Road, Orient, New York (hereinafter referred to as
"BLANK") and ROBERT VanNOSTRAND, residing at 1410 Village Lane,
Orient, New York (hereinafter referred to as "VanNOSTRAND").
WHEREAS, Blank is the owner of a certain plot, piece or
parcel of land situate, lying and being at Orient, Town of
Southold, Suffolk County, New York, known as a portion of Old Farm
Road on a subdivision map of Bayview Farm at Orient, Town of
Southold, Suffolk County, New York, more particularly bonded and
described on Schedule A annexed hereto and made a part hereof,
hereinafter referred to as the "SERVIENT TENEMENT", and
WHEREAS, VanNostrand is the owner of certain property situate
at Orient, Town of Southold, Suffolk County, New York, contiguous
to the West to the Servient Tenement, herein referred to as the
"DOMINENT TENEMENT", and more particularly bounded and described
on Schedule B annexed hereto and made a part hereof, and
WHEREAS, VanNostrand desires to acquire certaiu rights in the
Servient Tenement.
THE PARTIES AGREE AS FOLLOWS:
1. GRANT OF EASEMENT: In consideration of the payment of
Ten Dollars and 00/100 ($10.00) and other good and valuable
consideration from VanNostrand, receipt of which is hereby
acknowledged, Blank here~y grants to VanNostrand an easement as
hereinafter described.
2. CHARACTER OF EASEMENT: The easement granted in this
instrument is appertenant to the Dominent Tenement.
3. DESCRIPTION OF EASEMENT: Blank grants to VanNostrand an
easement for vehicular and pedestrian purposes over and across the
Servient Tenement from King Street to the Dominent Tenement.
4. TERMINATION: The easement, rights and privileges granted
under this instrument shall cease and terminate upon the
dedication of the Servient Tenement known as a portion of Old Farm
Road by Blank to any municipality.
5. BINDING EFFECTS: This agreement shall bind and inure to
the benefit of the respective heirs, personal representatives,
successors and assigns of the parties.
6. ENTIRE AGREEMENT: This agreement contains the entire
understanding between the parties relating to the rights granted
and the obligations assumed pursuant to this instrument. Any oral
representations or modifications concerning this instrument shall
be of no force and effect, excepting a subsequent modification
reduced to writing, signed by the party to be charged therewith.

The parcel to be set off is located on Old Farm Road which is a
private road. Proof of access over this private road must be provided
before the Planning Board can proceed. If proof of access cannot be
shown, the Planning Board recommends that the layout of the parcel to be
set off be changed, as shown on the enclosed map, to provide access off
King Street.
Please note also that there is a discrepancy between the property
description for the large parcel and what is shown on the map. Please
see enclosed copy of the property description which indicates where this
discrepancy is.
