In the PD (Park District) no building or grounds shall be used,

January 30, 1992
A subsequent site inspection by representatives of the Trustee
office this date revealed the presence of at least two wetland
indicator species and standing water in the disturbed area of
the property corresponding to the northerly most 6 proposed
parking slips on the Richard Saetta plan previously reviewed
on December 18, 1991.
The Trustees would likely entertain a wetland waiver for this
project if the 6 parking slips could be moved out of the
questionable area, the junk and debris in the area cleared by
hand and the Board shown a NYSDEC permit or letter of
non-jurisdiction for potential freshwater wetlands with in the
150 feet of the site.
I have placed a call to Mr. Saetta's office. As soon as he
returns my call, I will let you know he has been informed of the
above information.

The Planning Board has reviewed the requirements for the
front yard setback for the new building addition.
A variance will not be required. Town Code 100-230 A.,
permits the front yard setback to be the average of the front
yard setbacks of all buildings within three hundred (300) feet
to the west and east of Billys Bistro. Our calculations show
an average setback of approximately twenty seven (27) feet. Your
proposed setback of forty two (42) feet is within this average.
We regret any confusion our letter of December 3,1991 may have
caused.

The Planning Board has received your letter of November 13,
1991.
The following changes must be made before the Board can
proceed with their review:
A variance must be obtained from the Zoning Board of
Appeals for the forty two (42) foot front yard set
back.
Move three parking spaces from the east parking lot
and incorporate with the new parking expansion on the
west side of the building. Retain the two handicapped
spaces in the east parking lot and align them parallel
to Route 25.
3. Dumpster location must be shown.
4. Parking lot lighting must be shown.
Town Code 100-212 B. requires a five (5) foot
landscaped area abutting the front of the new
addition.
6. Landscaping, and percent landscaped area must be
shown.
A public entrance to the restaurant should be
considered from the west parking lot.
The Board recommends that the new addition be moved eight
(8) feet to the north, if possible, to avoid the need for a
front yard set back variance. A copy of the marked up site plan
is included for your use.
The Board will coordinate with the State Department of
Transportation for their requirements. Health Department
approval or exception will be required before the final review.
