At the Board's reauest for revisions and additional informa three sets of revised plans were sub mined, the last bei;g on Oc:ober 27, 1987, Tne following October 28, the Board initiated the process of re'new mandated by the State E:Jvironmemal Ql Review Act (SEQR.A.) by forwarding a copy of the application co other age:Jcies, including the Su County Depe Of Health Services (DHS), for their comme:Jts. " The response from the DHS, =eived by the Planning Board on November 17, 1987, indicates tll,lt it did not have sufficie:u information about the projec: to do a "complere te<:hnica! review" and that it Ilad "no =ord of an application to this Department." On De<:ember 14, 1987, the Board sent a cOPy or the DHS letter to John Be.--:ani, a builder who, in conjunction with the architect, was acting on pl;lintiff's behaif, and requested "that an application be made to the health department for approval of till: proposal by that agency prior to fun:her review by the Planning Board." Plaintiff submitted an application to DHS on June 13, 1988. By December 5 of that year, when pl.untifr~s attorney appe:lI'ed at a medng of the P!anning Board to ask that the site plan be approved, t/l': DHS application was still being "processed." During the meeting a Board member, Ricl1ard Ward, sl;lted that the Board's "preference for this site is :esidential" in keeping with the "comprehensive plan ul'dare" and that there were "serious reservations about this site for commercial" use. Ward then moved tli:lt a positive declaration be made under SEQRA be--..:mse of the proje<:t's inconsiste:1cy ...ith the master plan and "the traffic situation." A formal positive declaration was issued on December 16, 1988; it idC::1tifies "tr-..ffic impac~" and "adverse effec:s ... to the groundwater resource" as the e:1vironmenra! cllllseque:1ces of most immediate concer:!. Additional evide:1ce. in the form of decosition testimony and affidavits, demonsU<.tes that in loJ85 the Planning Board had :eccmmended thai ;:b.e Town Board 'adopt an updated mas,e:- pian and new zuning map. On December 1, 1988, the Town Board held a public hearing on the new plan and zoning cude; subsequemly they were adopted by the e:1aC:lnent of a local law on January la, 1989. As of the crfe<:::ive date of the amended zoning code, February 1, 1989, re:ail stores were no longe:- pe:mitted on plaintiff s prope~ and the Planning Board took no furJ1e:- action on his application. Plaintiff comme:1ced, then withdrew, an Article i8 proceeding; the instant declaratory judgment at:tion was subseque:1dy comme:1ced. The issues raised on the summary judgme:1t motion are two: (1) whether the Planning Board complied with the procedures, in particular, the time constraints, set forth ill the SEQR regulations (6 NYCRR Pan: 617), and (2) whether plaintiff is entitled to the "special facts" c:~ception to the general rule that a coun: must apply the law as it exists at the time of its decision. An action is subject to review under SEQRA if any state or local agency has the authority to illsue a discretionarf pe:mit, license or other type of approval over that action. The review process bcgins with the age:1cy that first =eives an application. Where other agencies are involved and a coordinated review is undertake:1, the re<:eiving' age:1cy must, as soon as possible, mail a copy of the application to all involved agencies, notifying them that a lead agency must be agreed upon within 30 c;ue:1dar days of the mailing (g 617.6[c][1]). Once the lead agency is established, it must "determine tJle:: significance of the action within 20 calendar days of its establishment..." or within 20 days of its rcceipt of "all information [t may rensonabiy need to make the determination of significance..." (~ 6 17.6[c] [2]). Here, as no other involved agency objected, the Planning Board's starns as lead agency became final on November 27, 1987. Tnis question is complicated by the fact that the SEQR process is, according to the Board's Senior Planner Valerie Scopaz, "integrated with" the procedures for site plan review set forth in the Town Code. The Code requires ce..'"tain elements to be included in a site development plan (9100-134), including, under sub-section C(3) "loc:uions...of e.'cisting sewers, culverts and waterlines...within and adjace..'1t to the property,' and under sub-section D(7) 'location of all proposed waterlines, valves and hydrants and of all sewer lines or alte.""llate means of water supply and se'Nage disposal and treatment." As these aspeas of a development are within the exclusive jurisdiction of the Health Department, the Planning Board has a 'policy' of not approving a site plan 'until and unless all requisite Health Deparone.'1C approvals" have been obtained, thereby ensuring that the proposed development will comply with the Suffolk County Sanitary Code with resp= to water supply and sewage disposal. , Correspondence be!Ween plaintiffs attorney and the Planning Board during October and November of 1987 reve:lls that in attempting to C"JII'j out an 'integrated" review, the Board equated the "comments' solicited from DES for the purpose of making a determination of significance with the information the DES "technical review" would Yield to enable further action on the site olan aoolication As lead agency the Board was obliged to ma.1(e 'a determination of significance within a prescribed tim~ period (there is no provision in the regulations for an 'initial" or preliminary determination of "nonsignificance'), based upon information already had and input from other involved agencies. The regulations do not limit the pe..-iod of time for responding to a lead agency's request for" comments"; however, there is a gene:-..! rule that all agencies "shall" act with 'minimum procedural and administrative delay" and 'shall e.-cpedite all SEQR procAAdings in the interest of prompt review" (9617.3(11). Hence a lead agency may not wait indefinitely for "comments" from other involved agencies before making a dete..'1TIination of significance. Although the Planning Board could have issued the SEQR determination as early as December' of 1987, the end result would probably not have been any different. That is, because of its policy, site plan approval would have been withheld until the necessary approvals were obtained from the D t;;:S. This brings the discussion to the issue of whether' special facts" are present to demonstrate that the town authorities acted in bad faith and unduly delayed acting upon plaintifr"s application while they amended the zoning ordinance. In this conne..."ti.on it is noteworthy that even in the absence of bad faith, negligent or willful administrative procrastination of sufficient ma"anitude affords a basis for applying the pre-existing regulation to the application (Amsterdam-Manhattan Associates v Joy, 42 NY2d 941, 397 NYS2d 1000, 1001 [1977]). A municipality may be estopped from claiming the benefits of its own inaction, whether intentional or merely negligent (Faymor Development Co., Inc. v Board of Standards and Appeals of cuy of New York, 45 NY2d 560, 410 NYS2d 798, 801 [19781). However, the coun finds that the "special facts" exception does not apply in this case. Assuming, arguendo, that the site plan in its final revision conformed to the then-existing zoning regulations, and, so as to cast the most favorable light possible upon the plaintifI"s case, assuming further that the Planning Board were persuaded to abandon its policy in order to approve the site plan, plaintiff still would have had to apply for a building permit. No building permit would have been issued without prior 'approval of water supply and sewage disposal systems by the DES. An additional factor to be considered in this regard is that plaintiff was aware from the Outset that his property was slated for rezoning to reside:ltial use. As early as April of 1987, during informal discussions with members of the Planning Board, plaintiff's represe."1tatives had been advised that the proposed retail. development was counter to the new master plan. Plaintiff's builder even c:une forward with a rough sketch for a reside."1tial development, and the Board was willing to approve a higher density than the new zoning map would pe:mit. The plaintiff chose to pursue the retail development rather than residential. Th~,.,~tiff ~q~ ..\<Wm. tl\<l~ he was misled ~g lJip.c;ie.,"lXl by Bo'lrd membifS (see, Marter of Alaimo v Town of Greece, 68 AD2d 743, 418 NYs21! 492, 494 [4th Dept 1979]) or that the delay was due to the Board's arbitrary actions in processing the application (Marter of Hu1ltin.gton Ready-Mi:: COllcrete, Inc. v TowlZ of Southampton, 112 AD2d 161,491 NYS2d 383 [2d Dept 1985j). Moreover, "persons who own prope.."'ty in a particular zone or use dismct enjoy no eternally vested tight to that classmcation" (McGowan v Cohalan, 41 NY2d 434, 393 NYS2d 376, 379 [1977]); and, llI1less in reliance upon the zoning ordinance substantial work has been commenced prior to its ame."1dmenr, an owner cannot claim a vested right in the original ordinance (Alaimo v TowlZ of Greece, supra, 418 NYS2d at 494). Accordingly, the COUrt grants summary judgmenr :0 the derendants and dedares that 1) the Planning Board did not purposefuily or maliciously delay approval of plaintiff s site plan application for the subject property; 2) the Town of Southold's Local Law No. 1 of 1989 is valid; 3) the plaintiff does not have a vested right to use his property for retail stores in accordance with his sire plan application of March, 1987. In view of the above declarations, the further relief demanded is denied. Dowd, being duly sworn, deposes and says: 1. I am an attorney at law and represent the defendants, members of the Southold Town Planning Board, in the above-captioned action and make this Affidavit in opposition to the relief requested by Plaintiff in the Order to Show Cause dated April 21, 1995 along with the Support Affirmation of William Esseks dated April 20, 1995. 2. The Order to Show Cause requests relief to reargue under CPLR 2221. 3. In an Order of the above-titled case dated March 20, 1995, the Court granted summary judgment, concluding that: 1) the Planning Board did not purposefully or maliciously delay approval of plaintiff's site plan application for the subject property; 2) the Town of Southold's Local Law NO.1 of 1989 is valid; 3) the plaintiff does not have a vested right to use his property for retail stores in accordance with his site plan application of March, 1987. 4. Pursuant to CPLR 3212, summary judgment can be granted where there are no questions of fact. Logically, there is no need for a trial to hear q of fact illrm @JE D W ~@! 1 :Lh'. APR 28 i995 .. ." where the facts are agreed. This case does not involve a dispute of facts, but a dispute of how the law applies to established facts. This issue may properly be resolved in a summary judgment. 1 5. Plaintiff calls for this rehearing on the grounds that there are significant ques- tions of fact in this case that the Court has misunderstood. This motion is opposed on the ground that the "questions of fact" which Plaintiff tries to raise are immaterial to the disposition of this case. They are not material factual questions because, even if they were resolved in a way entirely favorable to Plaintiff, they would not support Plaintiffs claims under the law.2 The logic of the Court's decision stands firm, even with Plaintiffs interpretation of the facts. The decision specifically gives the facts the con- struction sought by Plaintiff, and decides against him. 6. Plaintiff claims there is a question of fact as to whether the Planning Board had a "policy" of seeking Health Department comments prior to issuing an environmen- tal determination. In its decision the Court clearly states that it did not use the conclu- sion as to "policy" to decide the special facts question. The ruling states that: The Court finds that the 'special facts' exception does not apply in this case. Assuming, arguendo, that the site plan it its final revision conformed to the then- existing zoning regulations, and so as to case the most favorable light possible upon the plaintiffs case, assuming further that the Planning Board were persuaded to abandon its policy in order to approve the site plan, plaintiff still would have had to apply for a building permit. No building permit would have been issued without prior approval of water supply and sewage disposal systems by the DHS. All the evidence indicates that the delay in this matter was due to 1 Carden Hall. Inc. v. Abidor (1959) 18 Misc2d 584; Marinas of the Future. Inc. v. City of New York (1982) 87 AD2d 270, 278 2 Nidds v. Procidano (1983) 95 AD2d 912 states "only the existence ofa bona fide issue raised by evidentiary facts and not one based on conclusory or irrelevant allegations will suffice to defeat a motion for summary judgment." 2 . .. plaintiffs initial procrastination in submitting an application to DHS and subsequently in its processing. 7. Plaintiff also tries to create a factual dispute about whether the project could have obtained Health Department approval by claiming that the project "could" meet Health Department criteria. In fact, the project did not obtain Health Department appro- val. Speculation as to whether the project "could" obtain Health Department approval is fruitless and irrelevant to the disposition of the case. 8. Plaintiff was precluded by Town code from obtaining a building permit until County Health Department approval was obtained. Plaintiff does not dispute the fact that he did not have Health Department approval. The absence of Health Department approval is an independent cause for Plaintiffs failure to vest prior to a change in the ordinance. Thus, Plaintiffs failure to obtain Health Department approval an indepen- dent reason for his failure to vest his project, and absence of site plan approval is not a basis for claiming relief under the special facts exception. 9. The decision of the Court is correct inasmuch as, even if Plaintiffs position is accorded full belief, Plaintiff fails to establish that he could or did obtain a vested right to proceed with the project after the zone was changed. The special facts exception lies to grant relief when an applicant is precluded from vesting by inappropriate town con- duct. There is no material factual dispute as to Town conduct. Town conduct did not preclude Plaintiff from obtaining a building permit and vesting before the change in the Town's Master Plan. The Court correctly points out that Plaintiff knew of the proposed 3 e e. Master Plan changes during the entire application period and that Plaintiff chose to pro- crastinate in pursuing development 10. There is no substantive or procedural reason to modify the Order of this Court dated March 20, 1995. Mr. Angel: Besides myself(Steven Angel), this is Robert Lawless, he is the Architect for the site plan. Mr. Orlowski: Do you have some questions? Mr. Angel: Not really. I think our position is outlined in our letters, sent back and forth to the Board. I can summarize them for you. Mr. Orlowski: Would you do that? Mr. Angel: What we have here, is an application that was started with a site plan. I guess he submitted an application about twenty months ago. There were, I believe two sets of revisions and two different revised plans were submitted. There was some correspondence. I wrote the Board on October 19th in accordance with your regulations and summarized briefly what had transpired in this application as far as I could tell from looking at your file and speaking to Mr. Lawless. Then requested approval in accordance with the previsions, I guess in Section 100-133 of your code. Which starts the time running for you on site plan applications similar to the time frames on subdivision. I got back a letter from the Chairman dated October 27th, which I believe it says there has been no SEQRA review on the application. Even though it has been pending for nineteen months and refers to the necessity of a Health Department application to complete SEQRA review. I commented on that on November 7th. I took the position in that I did not understand why you needed detailed application to the Health Department to make an initial SEQRA determination. Than I appeared here on November 14th in conformance to my original self invitation. And then on the 14th you suggested that we come back on the 5th of December. And we are back here, to deal with any questions you might have with the site plan. I asked Mr. Lawless to come out from Yonkers so that he can discuss any particular details. I have reviewed the application and it seems to be conforming under the provisions of the B-light Business District. It has been kicking around for . . quite some time. It has, apparently, been a low priority item. Our client, however, does not consider it a low priority item and would like it to be expedited, so that he can proceed. Mr. Ward: We basically have had a problem in reviewing this because our preference for this site, I realize the current zone is Commercial, our preference for this site is Residential. Our comprehensive plan update is to identify with zones to residential. I would recommend tonight, if you want to peruse this, is to positive dec. it for traffic and other reasons. And put it into that remedial. We have serious reservations about this site for commercial. I just want to say where we are coming from. I realize you have a right. It is a property ownership, but in terms of the overall Town there is a sore point to it, that it is commercial. Mr. Angel: But, with all do respect, we have had a conforming application before you for nineteen months, to make a initial determination, well twenty months, of a positive declaration under SEQRA when it conforms to all the requirements of legislative zoning. The Board can't do that. It has been like that for some time. I think it would be an arbitrary act. It would just unnecessarily delay our client. It is ascentially a simple application. It may be that you do not agree with the zoning. You are sort of stuck with it, currently. Mr. Ward: I think we have to address the impact statement as to what is happening. Mr. Angel: My position is pretty well taken. I don't want to band any threats back and forth, but you understand my position. Mr. Ward: Yes, I do. Mr. Angel: A positive declaration, a situation where you have public water. The Health Department says it meets all their requirements and it conforms to everything in your zoning ordinance. As I read your letter, you take the following positions: 1) that the Planning Board has not made an initial SEQRA determination; 2) that the Department of Health Services ("Health Department") has not received an application from our client; 3) that you are awaiting Health Department comments before issuing your determination; and 4) that the Health Department somehow needs our application before it can issue such comments. With all due respect, I do not understand your letter. Our review of the file shows that at the time the application was submitted in March of 1987, a short environmental assessment form was filed on behalf of the applicant by Robert E. Lawless, his architect. On October 28, 1987, you stated, in a letter to the DEC, that "an initial determination of nonsignificance has been made" in connection with this matter. A copy of your letter to the DEC was sent to the Health Department and other agencies. The Health Department replied on November 16, 1987. Its reply ~ . . ~ Bennett Orlowski, Jr., Chairman November 7, 1988 Page Two simply acknowledged that it had not received an application from our client and that .complete technical review. of the project would have to await the application. This same reply stated, moreover, that the project could be served by sub-surface sewage disposal systems. Thus, as early as November 1987, you were aware that the project met Health Department standards. I must assume by your letter that you are either 1) misin- terpreting the State Environmental Quality Review Act (SEQRA _ Article 8 of the Environmental Conservation Law) or 2) attempt- ing to delay this application. I have never been faced with a request that an applicant make a detailed application to the Health Department prior to initial SEQRA review by a Planning Board. SEQRA review has to be started at the inception of the project. Moreover, the file maintained by your Board indicates that you reviewed this site plan application, that Health Department standards were met, that you made suggestions to the applicant and his architect, and that the site plan was amended to reflect your suggestions. Certainly, this, coupled with your statement that an initial determination of nonsignificance has been made, would indicate that, as far as you were concerned, SEQRA compliance had been completed. To argue otherwise would require you to take an arbitrary position which would damage my client. More than 19 months have passed since this application was submitted. It is fully conforming. It has been reviewed. There is no reason, other than delay, to contend that an initial SEQRA determination has yet to await further review by the Health Department. For your information, however, the Health Department application was, in fact, filed for this project on or about June 13, 1988 (Application No. CIO-88-007). As I am sure you are aware, it would be illegal for the Town to have such a policy. They were submitted to the Planning Board on August 3, 1987. 6) Apparently, additional comments were generated by the Planning Board or the Planning Board staff and, on October 22, 1987, Antonucci and Lawless prepared a further revised site plan. This was also submitted to your Board. 7) By letter dated December 14, 1987, your Board requested that an application be made to the Suffolk County Department of Health Services prior to further review. This application is being processed, but Mr. xikis' consultant for this matter, Roy Haje of En-Consultants, Inc., has been advised by the Department of Health Services that its review will have to await a determination on the site plan by your Board. 8) I understand that numerous attempts have been made to process this application for site plan approval by Robert Lawless of Antonucci and Lawless and his employees. These attempts have, apparently, been unsuccessful. I have reviewed the plans submitted by Mr. Lawless' firm and the requirements of your code. It appears to me that the site plan application is fully conforming and worthy of prompt approval.
