It is again noted that the public comment period cannot even begin, in our opinion, until this data has been submitted and accepted to complete the DEIS. Schpltze, SAI DATE: July 21, 1988 RE: Cedarfields/Moeresland Meeting Notes of July 13, 1988 David Emilita and Diane Schultze from SAI met with Valerie Scopaz, Town Planner and Merlon E. Wiggin, consultant for the applicant, John Costello, to discuss the affordable housing/town house proposal located at Greenport. Councilwoman Jean Cochran was also in attendance. Mr. Costello arrived late since the meeting began earlier than scheduled. This proposal was -previously reviewed and denied approval from the Village of Greenport to hook up into the sewer system. However, the Village of Greenport has reactivated the proposal and the project is continuing. Mr . Wiggin questioned the procedure from this juncture in order to reactivate the file with the Town. It was noted that a Draft Environmental Impact Statement and 2 supplements had been prepared by the applicant. The latest supplement was submitted in June of 1987. When negotiations with the Village ended there was no further review of the supplements submitted since the project could not proceed without Village approval for sewer hookups . Mr . Emilita pointed out that technically the supplement has not been accepted as complete for review. The main concern with regard to the proposal was the well site situated in the middle of the high density development . The future of the well had to be considered. In review of the information submitted, Mr . Emilita found that the calculations were not sufficient to determine that the well would be acceptable and there was no engineers stamp on the work . It was also felt that if approval from the Village for the sewer was not obtained the well could not work with individual septic systems. N Mr . Emilita requested a larger zone map for the zone of concentration. He also pointed out that there was a contradiction in the report between the zone and the area recharged. Recharge calculations need to be based on `furtheT �{L,.�f. land use within the zone of concentration. Locations of all nearby public wells also need to be shown. Mr. Costello stated that in recent talks with the Village, they may accept up-front money rather than a well within the proposal. It was felt that if water hookup can be obtained with out"�'an on-site well then the project would be acceptable. The traffic report in the recent supplement was acceptable. - - - - Mr. -Emilita -stated thatthedrainage calculations had not been checked to date, however, they would be reviewed. There was also discussion with regard to the sidewalks as requested by the Planning Board and whether the project could accommodate them wi=th the swale drainage system proposed. It was felt that if the width could be reduced, they could be constructed on one side of the road within the right-of-way. In an attempt to bring the SEQRA Process for this project to a logical conclusion , especially as it represents an Affordable Housing Project , enclosed is a list of chronological events , actions taken , and the resultant responses which hopefully will result in the conclusions of the required actions . 1 . April 24 , 1987 - D. E. I . S. Submitted . 2 . June 25 , 1987 - At the request of the Planning and David Emilita , a Supplement to the D. E. I . S. containing groundwater impact ( Nitrates ) , drainage calculations , and peak hour traffic study . 3 . July 16 , 1987 - Resolution by the Southold Town Planning Board accepting both the D. E. I . S. and the Supplement as complete and accurate for review (copy attached ) . 4 . July 29 , 1987 - Submittal of planning consultants review of July 8 , 1987 . 5 . August 7 , 1987 - Response to planning consultants review comments . No record of acceptance of same . 6 . August 10 , 1987 - Public hearing on the D. E. I . S. The Planning Board minutes of this date reflect that there were no written comments received on the D. E. I . S. , and the only comment requiring action is from Dave Emilita , which is "There is still no calculated evidence that the well will work , and I would like the Southold Town Planning Board October 14 , 1988 Page 2 record to so state that the subject is still not sufficiently treated for the purpose of SEQRA. We have not taken a hard look as to why this well will work . " 7 . August 21 , 1987 - Record of meeting with Sidney Bowne on August 19th in regard to the methodology and calculation of drainage requirements for the project (copy attached ) . Verbal approval was given by Sidney Bowne that this was a very acceptable method of determining drainage requirements , with the possible question as to the need to perform on-site soils tests to determin the permeability coefficient . 8 . August 25 , 1987 - Action by Southold Town Planning Board approving the Preliminary Map for the sub-division subject to : 1 ) adequate response to the Draft Environmental Impact Statement ( D. E. I . S. ) in regard to potable water ; 2 ) provision of adequate storm drainage and roadway in accordance with the Town of Southold Highway Standards ; 3 ) provision for sidewalks ; 4 ) approval from the Town ' s Consulting Engineer ( copy attached ) . 9 . August 31 , 1987 - Letter to the Planning Board from Peconic Associates requesting clarification and assistance as to what was required in regard to potable water , and request for clarification on the use of drainage swales versus curbs and leaching basins and acceptance of drainage calculation methodology . No record of a response (copy attached ) . 10. October 8, 1987 - Request from the Planning Board to Donald Bracken to request a sixty ( 60 ) day extension for the Planning Board to prepare a Final Environmental Impact Statement (copy ' r i Southold Town Planning Board October 14 , 1988 Page 3 attached ) . Have no record that this request was ever received . It was also about this time that the developer requested a delay in doing the perculation tests , primarily , I understand , because of the uncertainty of having both water and sewer available from the Village of Greenport . 11 . Between the above and the following , the major acitivity of concern was trying to get a resolvement and a committment as to the availability of water and sewer for subject project . 12. May 17 , 1988 - Request to the Planning Board for verification that the SEQRA Process was complete based on previous responses (copy attached ) . No record of a reply . 13. July 13 , 1988 - Action by the Southold Town Planning Board to have Dave Emilita review the Supplement to the D. E . I . S. dated June 25 , 1988. This is a typo , as the Supplement was dated June 25 , 1987 and previously , by a resolution by the Board on July 16 , 1987 , resolved that Dave Emilita to determine that both the D . E. I . S. and the Supplement were complete . 14. July 13 , 1988 - In anticipation of the above , met with representatives of the Planning Board to review items necessary to complete the D. E. I . S. Items discussed include the following : a . Zone of influence for the proposed well . It was indicated that this was not complete as it did not cover all of the areas within the zone . The zone of influence calculations have been revised and a copy enclosed as an attachment . t Southold Town Planning Board October 14 , 1988 Page 4 b . Question about the acceptance of the on-site well . Reported to the Planning Board the H2M engineering report on the proposed well number 10 (well on the Costello property ) dated June 1987 , which concluded that the test results indicated that the well had a capacity of 250 G. P. M. , and recommended its acceptance by the Village of Greenport for additional potable water supply . As and added note , application for the well has been made to D. E. C . . Also , this project is within the Village of Greenport ' s water franchise area . c . There was a considerable amount of discussion in regard to the pavement widths and the requirements for sidewalks . John Costello was requested to provide some supportive type data on what other affordable housing projects did for road widths and sidewalks . The same was submitted on September 1 , 1988. Copy of the transmittal letter is attached . No record of a response . 15 . August 1988 - The decision was made by John Costello to go ahead and have the soil permeability tests done . These were completed and the results were received on September 7 , 1988 , a copy of which is enclosed . The borings were taken in six ( 6 ) locations which represent the location of the inground drainage leaching systems . All sites , except two ( 2 ) indicated that the permeability rate was in excess of that used in the draft calculation of August 21 , 1987 . Permeability at the B- 1 and B-2 sites Southold Town Planning Board October 14 , 1988 Page 5 was 2 X 10-3 centimetels per second , instead of the 1 X 10 used in the calculations . Based on the above the leaching pools at these two (2 ) sites are being changed from four (4 ) feet deep to eight (8) feet deep and being surrounded by a backfill of graded stone . The above modifications at these two (2 ) locations will result in added adequate drainage capability with a safety factor in excess of 1 .4. 16 . October 1988 - As a response had not been received on pavement widths and sidewalks . John Costello went ahead and suggested a revision to the Site Plan showing sidewalks on one ( 1 ) side and on certain roads in the Cedarfields area . These sidewalks will be three ( 3 ) feet wide and located adjacent to the pavement between the pavement header curb and the swail . Plan views and typical sections are enclosed . Hopefully , the above recapulation and the enclosed documents will complete the SEQRA process on this urgently needed affordable housing project . The Planning Board wishes to provide a safe off-the-road walkway (sidewalks) for children along one side of the streets in the Affordable Housing District. However, the design specifications for drainage on the site call for swaled roads to be built. While the construction of curbed roads would make it easier to provide sidewalks, they also would require the relocation of Greenport Village' s pump station, an expense and aggravation the Planning Board and the applicant wish to avoid. Therefore, the swaled road must be used to provide drainage. But, there is no provision in the Highway Specifications Code for the placement of a 3 ' or 4 ' sidewalk within one side of the drainage swale. In my conversation with Merle Wiggin, the engineer for the applicant, he expressed a willingness to redesign the drainage swale on one side of the road so as to allow for the inclusion of a 4 ' sidewalk within the Town right-of-way without compromising the integrity of the drainage swale itself. Any such change in the design specifications would require your approval. ENVIRONMENTAL CONSULTANTS July 8, 1987 Mr. Bennett Orlowski Chairman Southold Planning Board Town Hall Main Road Southold, NY 11971 Re: Cedarfields-Moorelands DEIS Dear Bennett, We have reviewed the Supplement to the DEIS dated June 25, 1987 and find that together with the DEIS itself, the DEIS plus supplement are complete and adequate for review and public comment. We continue to have reservations about the sufficiency of analysis with regard to the long term viability of the proposed well. Specifically, it is implied that only' the proposed project will have any recharge impact within the zone of influence of the proposed well. This project does not exist in isolation within the zone of influence. There are (presumebly) other existing land uses and surely additional development will take place within the well' s radius. The DEIS does not address these uses. The well will also need DEC approval as well as SCDHS approval. We call this to your attention as a coordinated review with these two agencies will be extremely important on this issue. The assessment of traffic and drainage impacts will be addressed during the comment period. We are available for consultation on the above points. Orlowski : During a meeting several weeks ago on affordable housing , Valarie asked John Costello and myself if we could develop some information on other affordable housing projects in regard to sidewalks , street width , and so forth . Enclosed are highlighted pages from various affordable housing projects that deal directly with the above items . You will note that the most savings have come from reducing the street width , the elimination of sidewalks or including them as part of the road shoulder , and the use of swales for drainage . It has been attempted to incorporate all of the above in recent affordable housing layouts . It is our opinion that consideration of some of these options would not only insure that affordable housing can be built and kept affordable , but also will make it more possible to have such things as basements and garages , which in my opinion is much more important , not only for the prospective occupant , but also for the maintenance and appearance of the affordable housing community . Orlowski : It is our understanding that you will be conducting a work session on subject project this afternoon , which may include the subject of sidewalks . Reference is made to the attached letter of August 21 , 1987 . The present site plan was developed by the use of drainage swales and leaching basins . If the decision was made to change to sidewalks , which are not compatible with the drainage swales , then it would be necessary to redesign the project to a piped drainage system. This was considered early on in the project , but was determined unfeasible because of the interference with the inverts of storm drains with that of the sewer lines . The location of the sewer lines are severely restrictive because of the available invert at the Village of Greenport ' s existing lift station . Placing the storm drains lines beneath the sewer lines would result in a portion of the storm drain lines being below groundwater level , causing flow to be restricted . It was therefore determined that it would be a physical impossibility to install the piped storm drain system and the sewer lines without replacement of the Village ' s lift station . Being an affordable housing project , cost was also a consideration , and the replacement of the lift station and the installation of a pipe drainage system is estimated to increase the project cost from approximately Three Hundred Fifty to Five Hundred Thousand Dollars , as well cause a significant delay in the design and added expense for same. Dear Mr. Orlowski : On August 19th , 1987 , Nancy Harrington and the writer met with Bob Brown and John Cahn of Sidney Bowne in Smithtown , to discuss a different site drainage system for Cedarfields/Mooresland. We were advised that despite the previous understanding of using swales that a member of the Planning Board had recommended that they be eliminated and go to a more conventional drainage system, namely , storm drains and drainage system to convey storm water off the site. Consequently , the swales are to be removed and curbs installed . The initial proposal was to pipe the storm water from Cedarfields to Moores Drain (outlet of Silver Lake ) or out to Moores Lane and South on Moores Lane to the point that the Moores Drain crosses Moores Lane. Discussion on this method of site drainage included the physical impossibility to place the cross street drains above the sanitary lines because of the minimum slope and invert elevations necessary to gain entry into the Village of Greenport ' s pumping station , and , if the drain was placed beneath the sanitary line , it would be very difficult to get a clear outflow without being in ground water. Mr . Bennett Orlowski , Jr. August 21 , 1987 Page 2 Added to this was the expressed concerns about getting Village of Greenport easement approval and D. E.C. wetlands approval prior to early next year. As an alternative , we suggested the New York State D.O.T. design formulas for leaching basins be used as follows : with Kt the transmission zone hydraulic conductivity and Qt providing the cumulative flow out of the leaching basin at any time. In these formulas , the Ks ( Saturated Soil Permeability ) is the most important factor to be determined based on permeability coefficient ranges . From soils data from Riverhead Sub-Strata this is expected to range from 10•' to 10-' , with an average of 10•' . Because of the concern in regard to the actual capability of the basins , it was recommended that the soils be actually tested to determine its permeability coefficient. Eighteen ( 18) tests are planned and it should take approximately two ( 2 ) to three ( 3 ) weeks to get the test results , after which the calculations can be completed and the exact number of leaching basins can be determined. The previously submitted drainage calculations are to be voided and new ones based on the above to be provided in approximately four (4) to five ( 5 ) weeks . An example of determining leaching and storage capability as used in the above method is attached. You will note that there is a safety factor of 1 .4 and in addition we only propose to use a four (4 ) foot head , which is half of the depth of the proposed leaching basin. Mr. Bennett Orlowski , Jr. August 21 , 1987 Page 3 The proposed run-off calculation is based on 2.5 inches per hour , or a twenty-five (25) year storm. It was suggested , that if possible , that we should increase the drainage system capability to handle 3 1 /2 inches in one ( 1 ) hour to provide some additional safety factors , which would approximate to a one hundred ( 100) year storm. There are no agreements or permits or anything in effect that would construe that this would be a conflict and that I would gain any advantage to this zone change. Thank you. COUNCILMAN STOUTENBURGH: I'd like to make a statement here. First again, with your indulgence, let me again reassure you my strong support for affordable housing. Few people could be against that concept. On the other hand, this support comes with certain restrictions attached to it: One would be not to overburden Greenport water supply, that is already pushed to its limits by new development. Also, creating additional salt water intrusion by this use of water into an already sensitive and limited Greenport water area. It has been reported that the new well at Brecknock Hall has been found to have salt in' it 'and this well, like the proposed Costello well, was to booster the Gre_enport's limited supply of water. And three, that Costello will be ' sewered, which means all that sewer water will be pumped into Long Island Sound, as all sewer water is; and not go back into the ground through cesspools, if the density were one acre or more, therefore building up the water supply below us, and we all do this in our own homes, most of us anyway. Affordable housing should not put additional burdens on any Village resident. Examples could be where Green- port's allocated electricity is bought at a certain rate, and should they have to now, with this extra amount of people, pay more, that means the people in Greenport Village would be paying the extra burden. And lastly, we have two acre zoning proclaimed throughout this Town of ours and should this proposed project go through, it should not go through unless all the above problems that I've mentioned have been mitigated. Now, some people might thing they have. I do not think they have. I will not vote against this, but I will not support it. I will abstain. I just want it on the record that I think people should be looking into the environmental problems that we're creating for our future residents in this Town, and I realize the importance of this so-called project with the need for housing in' this 'Town, but I do think it should have been in a better location where there was a much better supply of water. Orlowski : The Suffolk County Department of Health Services ( SCDHS ) has reviewed the above-referenced Draft Environmental Impact Statement ( DEIS ) and submits the following comments regarding sanitary code compliance and natural resources concerns . I . Sanitary Code The SCDHS has received an application for realty subdivision for this project and is awaiting further information from the applicant . This project will meet density requirements for Article VI of the Suffolk County Sanitary Code if municipal water and sewer services are provided , as is proposed in the DEIS . The SCDHS maintains jurisdiction over the approval of plans for public water and public sewer installation . Therefore , the applicant should not undertake the installation of any such systems without Health Department approval . An application for water supply distribution system approval was submitted to the Bureau of Drinking Water and has been reviewed . The Bureau subsequently notified the applicant of its concerns by letter dated August 5 , 1987 . A copy of this letter is attached for the Town ' s information . II . Natural Resources A . Our staff conducted a field inspection of the project site on August 22 , 1987 and found the area to contain important old field and pioneer forest habitat for wildlife . The patchiness COUNTY CENTER RIVERHEAD.N.Y. 11901 Letter to Bennett Orlowski August 24 , 1987 Page 2 ( dispersion and juxtaposition of herbaceous shrub and tree growth ) of the habitat on the site results in the provision of significant edge situations capable of supporting a high diversity of wildlife species . The Terrestrial Ecology section of the DEIS is deficient in its coverage of the flora and fauna that occur on the site . Further- more , there is no mention of the loss of valuable wildlife habitat under Section V - Significant Environmental Impacts . We believe that the project , as planned , will result in the permanent displacement of certain typical old field and pioneer forest wildlife species from the site . A thorough evaluation of the wildlife resource on the site must be completed . The potential negative effects of the project on that resource and appropriate mitigation measures should be discussed before further action is taken . The cumulative impacts on wildlife as a result of this project should be clearly outlined in this discussion . B . Although the planned buffer zones will be capable of supporting typical suburban wildlife species , these areas will be incapable of maintaining many of the old field species which now inhabit the site . A revised site plan that displays an increase in the number and width of buffer zones may aid in the partial mitiga- tion of this negative environmental impact . We recommend a minimum 75-foot width for planned buffer zones along North Road , Moores Lane , and between the townhouse and affordable housing sections . In addition , we recommend the preservation of 25-foot natural buffer zones between the affordable housing units , and adjacent Village of Greenport Trailer Park and private homes along Middletown Road . The buffer zones should be planned in contiguous tracts , oaiierever possible , to preserve wildlife travel corrid--rs arc, ndbitat quality in general . The existing vegetation should be preserved to the greatest extent practicable . Wherever additional plantings are needed , native species should be utilized . C . The nature of the water-saving devices planned for the residen- tial units should be described in better detail . III . Alternatives We find that the presentation of alternative actions is not sufficient for comparative assessment . The DEIS , therefore , is incomplete with respect to its content . The DEIS offers no alternative site plans or subdivision designs . Alternatives should be presented objectively and in detail sufficient for determining the most environmentally sensitive plan for the subject proposal . Alternatives that achieve the goals of the applicant and provide for greater environmental protection than the present plan should be prepared and be suitable for objective comparative assessment . If it is the intent to use this parcel for a water supply well , clarification should be provided to our office along with a copy of a contractual agreement made with the Village. A New York State Department of Environmental 4 Conservation Water Supply Applicatian and detailed site plans must be submitted and approved for the wellfield. A copy of the contractual agreements with the Greenport o Water Supply regarding ownership of the water mains should also be provided our office. Dear Mr. Orlowski : On August 19th , 1987 , Nancy Harrington and the writer met with Bob Brown and John Cahn of Sidney Bowne in Smithtown , to discuss a different site drainage system for Cedarfields/Mooresland . We were advised that despite the previous understandingof in swal using es that a member of the Planning Board had recommended that they be eliminated and go to a more conventional drainage system , namely , storm drains and drainage system to convey storm water off the site . Consequently , the swales are to be removed and curbs installed . The initial proposal was to pipe the storm water from Cedarfields to Moores Drain (outlet of Silver Lake ) or out to Moores Lane and South on Moores Lane to the point that the Moores Drain crosses Moores Lane . Discussion on this method of site drainage included the physical impossibility to place the cross street drains above the sanitary lines becausef o the minimum slope and invert elevations necessary to gain entry into the Village of Greenport ' s pumping station , and , if the drain was placed beneath the sanitary line , it would be very difficult to get a clear outflow without being in ground water . Mr. Bennett Orlowski , Jr. August 21 , 1987 Page 2 Added to this was the expressed concerns about getting Village of Greenport easement approval and D. E. C . wetlands approval prior to early next year. As an alternative , we suggested the New York State D. O. T. design formulas for leaching basins be used as follows : k XS( 'n/ _ Mkt Alyt �„ ✓� with Kt the transmission zone hydraulic conductivity and Qt providing the cumulative flow out of the leaching basin at any time . In these formulas , the Ks ( Saturated Soil Permeability ) is the most important factor to be determined based on permeability coefficient ranges . From soils data from Riverhead Sub-Strata this is expected to range from 10-' to 10'' , with an average of 10-2 . Because of the concern in regard to the actual capability of the basins , it was recommended that the soils be actually tested to determine its permeability coefficient . Eighteen ( 18) tests are planned and it should take approximately two ( 2 ) to three ( 3 ) weeks to get the test results , after which the calculations can be completed and the exact number of leaching basins can be determined . The previously submitted drainage calculations are to be voided and new ones based on the above to be provided in approximately four (4 ) to five ( 5 ) weeks . An example of determining leaching and storage capability as used in the above method is attached . You will note that there is a safety factor of 1 .4 and in addition we only propose to use a four (4 ) foot head , which is half of the depth of the proposed leaching basin . Mr. Bennett Orlowski , Jr. August 21 , 1987 Page 3 The proposed run-off calculation is based on 2 . 5 inches per hour , or a twenty-five (25 ) year storm. It was suggested , that if possible , that we should increase the drainage system capability to handle 3 1 /2 inches in one ( 1 ) hour to provide some additional safety factors , which would approximate to a one hundred ( 100 ) year storm. (SBB NO. 87148) Dear Sir: We have begun our review of the above referenced projects. A summary of our comments and recommendations is as follows: 1. Mr R. G. Ward of the Town's Planning Board had commented that the sketch plan approval was subject to a 100 ft. buffer on Moores Lane. It should be noted that by increasing the buffer from 50 feet to 100 feet will probably necessitate the relocation of several buildings in order to maintain the minimum separation between them, or possibly a reduction in the number of units. 2. The 18 feet pavement width for the Mooresland Townhouses is too narrow and should be increased to 24 feet, thus providing greater separation between vehicles passing in opposite directions. It will also provide a wider area for maintenance and emergency vehicles. 3. A positive drainage system with a recharge basin in lieu of leach- ing pools should be provided. Refer to Section 108-26 of the Town Code. 4. The overall road layout and grading plan in general is acceptable. However, we are concerned as to the tight turning radius of the bends (75 feet centerline) in the roads, at places other than intersections. For those not familiar with the site , attached MCII is a copied portion of the County Topographic _ I n Map show the area of influence of the proposed well . You will note that to the East is Fleetfield , which is already developed ; to the Southeast is Silver Lake and wetlands area which is not subject to development ; to the South is additional wetlands , trailer court , and Greenport School athletic area , which is not scheduled for development ; to the West is almost exclusively Village of Greenport designated recharge and Natural Area , which has already been designated to be preserved ; to the North is the majority of the proposed development plus the Southern portion of the McCann Estate which has already been developed . 40 Mr. Bennett Orlowski , Jr. August 7 , 1987 Page 2 2 . Buffer Area Between Moores Lane and Proposed Development . The Planning Board approved sketch plan submittal for the buffer area was fifty (50 ) feet , not one hundred ( 100 ) feet . 3 . Drainage Swales . Drainage swales were selected for this project in lieu of curbs and a collection type storm drainage system as being a better environmental approach because of the well drained soils in this particular area . As this is an Affordable Housing Project it was also an economic consideration . The plan to use drainage swales was made known in a letter to the Planning Board on March 26 , 1987 and subsequent discussion has been , I understand , that the Town would prefer drainage swales . The drainage system , therefore , was designed accordingly . ( See attached Preliminary Plan dated 4/23/87. ) Drainage Swale calculations were also accepted in the Draft Environmental Impact Statement and its Supplement . 4 . Sidewalks . The requirement for sidewalks has never been made during any of the discussions and planning reviews . It is our understanding that the Town Highway Department prefer not to install sidewalks . We continue to have reservations about the sufficiency of analysis with regard to the long term viability of the proposed well. Specifically, it is implied that only. the proposed project will have any recharge impact within the zone of influence of the proposed well. This project does not exist in isolation within the zone of influence. There are (presumebly) other existing land uses and surely additional development will take place within the well' s radius. The DEIS does not address these uses. The well will also need DEC approval as well as SCDHS approval. We call this to your attention as a coordinated review with these two agencies will be extremely important on this issue. The DEIS is basically very similar to the one prepared for the former annexation effort and so much of its content has been reviewed and commented on previously. This project, however, has potentially significant nt and different impacts from the annexation and these need to be addressed. These are as follows: 1) "M" Zone vs "HD" District The "M" Zone will not entirely accomplish the applicants stated r. desire, that is to produce affordable single family lots. Nor will it in itself accomplish affordable housing of any kind. It d is thus recommended that the "HD" District be applied to this site as soon as feasible. In the interim, covenants and restrictions should be utilized or a rezoning conditioned on the provision of affordable housing as defined by the Town. 2) Impact on on-site-well It has not been clearly demonstrated what effect that 180 dwellings on 48 acres will have on an on-site well in terms of recharge quality. Input from the Village water system and the r County Health Department would seem necessary in this regard. i II Existing water quality in the test well is acceptable, but there will be a loss of recharge due to consumptive use and wastewater collection, and there will be an introduction of lawn fertilizers I and other household contaminants into the recharged groundwater. The impact on groundwater, (and the on-site well) has not been stated. �I Input from the Village of Greenport's water system and from the Suffolk County Department of Health would also seem necessary in the event that one or both public utilities would prove to be unavailable. ( A letter from the Health Department on the annexation alternative is included in this DEIS. Set-off 1/2 of the property and do 1008 Affordable Housing o this 1/2. The affordable housing must be 50% of th otal acreage prior to the set off. 2. The affordable housing must be plotted on 10 , 000-46 2 /afJ square foot lots. Covenants and restrictions that for each unit constructed on the M-zoned area, a unit will be constructed on the affordable housing side. Mullen, Jr. Member DATE: May 28, 1987 RE: Costello housing project This is to advise you with regard to the status of the above mentioned affordable housing project located at Greenport. The Planning Board is making their review under the State Environmental Quality Review Act (SEQRA) . The Draft Environmental Impact Statement has been reviewed by the Planning Consultant, David Emilita; and, his comments on the completeness of the DEIS are expected by the end of this week. Upon receipt of same, the Board will continue with the SEQRA process. The Board is in favor of the layout and will be proceeding with the site plan and subdivision applications upon completion of the SEQRA process. 1 Planning Board Page 6 9/15/86 Breakers at Lands End Mr.Hyman stated that this would be detailed on the final water and sewer plans to the Village. Mr. Orlowski stated that the drainage problem can be worked out. On a motion made by Mr. Latham, seconded by Mr. Edwards , it was RESOLVED that the Southold Town Planning Board approve the site plan for "The Breakers at Lands End" located at NYS Route 25, Greenport for construction of 350 condominium units and amenities as indicated on the site plan dated December 2 , 1985 (sheets 1-25) by Steve Hyman, subject to: 1. Covenants and restrictions filed with the office of the County Clerk that the roads within this development will remain private and will not be offered for dedication and will not be under the jurisdiction of the Southold Town Highway Department. 2. Posting and acceptance by the Town Board of a performance bond in the approved amount of $100, 000 for bluff plantings for the Long Island Sound bluff stabilization and erosion control on the site. 3. Receipt of an insurance policy naming the Town as an additional insured with rgard to the unfenced ponds. 4. A one-year review by the Planning Board and inspection prior to the issuance of a certificate of occupancy. It was noted that this project has been certified by the Building Department, and has a signed contract with the Village of Greenport forwater and sanitary sewer facilities. There. was also concern among the Board with regard to the use of ground water for the make-up water for the ponds proposed on the site. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Wards Mr. John Costello, Mr. Donald Bracken Mrs. Diane Carroll and Mr. Charles Egosi were present to discuss the affordable houseing project at Moore ' s Lane and County Route 48, Greenport. Mr. Egosi, the architect explained the proposal to the Board. Mr. Egosi stated that 50% of the property would be used for affordable housing and the remaining 50% would be used for townhouses. Mr. Egosi had a rendering of the proposal for the Board' s review. The affordable side of the project would be two-family or semi-attached homes and the other half would have a cluster of four townhouses. Mr. Egosi stated that he had proposed a two-family dwelling to reduce the amount of roads. Mr. Egosi stated that with the lot coverage, 81% of the land would be left without construction, existing vegation of replaced vegatation. There will be 42 lots, with two units on each for the affordable houses which willl be 84 individual homes and onthe townhouses, twenty four clusters inclusters of 4. Mr. Mullen questioned if the project would be in two sections, with no ingress or egress from either one. Mr. Egosi staed that this was the way it was proposed. The townhouse side will have one driveway which will create a loop. Mr. Egosi stated that he did not proposed through traffic since he had experience in the past with this and he felt that through traffic would reduce the privacy of the community. Mr. Mullen questioned if there would be any vegetation between the two sections? Mr. Egosi stated that there would be a buffer of 80 ' between the two sections. Mr. Mullen asked if a condominium association would be used on both sections for maintenance of the open space. Mr. Egosi stated that the single family would be sold as individual residences with approximately 8500 '`- squre feet of land. Mr. Egosi stated that the homeowners association will be in charge of the entire open space area. Mr. Mullen questioned the projected cost for the units. Mrs. Carrol stated that she had previously stated that they would be selling in the $75, 000 area to try to bring it in at that price. Mrs. Carroll clarified and stated that the price would be mid $70 , 000 price range. Mr. Mullen questioned the design of the homes. Mr. Egosi stated that they would be cape design with a possible extension on the second floor and the approximate upstairs area would be another 400-450 square feet. Mr. Egosi stated that there would be no service on the second floor to try to cut down on the building costs. Mrs.Carroll stated that they had not contemplated the cost of the homeowners association for each member, however, on a project which they completed in Port Jefferson it came to about $80 per home. Mr. Bracken stated that to avoid confusion, he wanted to clarify that the homeowners association would be on the Townhouse side of the project only. This association would maintainall the open space. The houses of the affordable housing side were to be sold all single and separate. Mr. Mullen asked if they could give any consideration to reducing the projected price because every little reduction helped the homeowner; Mr. Mullen stated that for $75 , 000 per house the occupants would have to earn $25 , 000 and in a study which Mr. Mullen conducted, people in the Town do not make that much. Mrs. Carrol stated that most people take 30 year mortgages and that difference in the 30 year mortgage helps out.Mr. Mullen asked if they would consider getting a construction loan. Mrs. Carrol stated that she has had experience with the banks out' here that they offer morgages based on the land and construction loan commitment. Mrs. Carroll stated that there would be closing costs savings to the person who used the bank. Mr. Mullen stated that this was a very good idea. Mr. Mullen stated an example with the Town of Brookhaven who had an affordable housing program and asked for $3, 000 to $4, 500 in cash at the closing. He stated that he was simply trying to save the homeowners money. Mr.Mullen stated that he would be happy if something could be looked into with regard to the mortgages with the banks. Mrs. Carroll stated that she would look into this with the local banks and was pretty sure that they would cooperate since they wanted affordable housing too. Mr. Mullen asked if Mrs. Carroll and Mr. Bracken had put up any affordable housing anywhere else. Mrs. Carroll stated that they have not put up housing in this price range before. Mr. Bracken stated that he is a contractor who has been inthe business 37 years and he has five sons who work with him in the businss. Mr. Latham asked why there was no through road. Mr. Egosi stated that in the Village of East Hampton he had designed a subdivision and everybody used the through road as a short cut making a lot of traffic on it. Mr. Latham asked for a ball park price for the townhouses. Mr. Egosi stated that they would be $130, 000 to $140, 000: Mr. Ward questioned why the layout was proposed as such when variances would be required, thus adding anouther level of approvals to obtain. Mr. Egosi stated that because the affordable housing zone had not been granted he had to do what conformed with the M zone. Mr. Ward stated that the proposal did not conform to the M zone either. Mr. Egosi stated that they could not accomplish their objectives on the property as it was currently proposed and they would have to et variances to accomplishe their objectives. Mr. Ward also questioned the second access road and why it was not provided in the plan. MR. Ward also asked if they were still considering water and sewer fromthe Village. Mr. Costello stated that presently they are negotiating withthe Village. He presented copies of the minutes from the Village Board meeting. Mr. Costello stated that Jim Monsell was to submit a letter today stating that the attorneys have to come up with a description of the roads where the utilities will be located. They will supply them with a survey for well locations . They are trying to locate the well in the buffer area so Greenport can have the well area. Mr. Costello stated that he is inthe process of obtining everything that has to be submitted to the Village, to get the contract underway. Mr. Edwards questioned if the homes would be on-site construction or manufactured homes. Mr. Bracken stated that they would be on-site construction. Mr. Orlowski asked why the affordable houses are attached. Mr. Egosi stated that this was to make better use of the land and to reduce the cost of the development. Everything will be sepearate except the connection to the sewer on the attached houses. There is 32 ' of road frontage for every unit and this is a savings versus normal residential construction. Mr. Orlowski questioned if they would be submitting a written guarantee that the units will be affordable. Mrs. Carroll stated that they would submit that, and for that size house it would be Planning Board Page 9 9/15/86 $75, 000 to $79, 000. Mrs. Carroll stated that they would submit this whenever it was asked for. Mr. Orlowski stated that they hve been over this proposal with Mr. Costello many times and everything was contingent on the providing of affordable houses. Mr. Orlowski questioned John Costello if he was still involved in the project. Mr. Costello stated that he was involved as long as it was to provide affordable housing. Mr. Costello stated that he could guarantee a price if the Board could guarantee a completion date to him. Mr. Mullen questioned if Mr. Bracken would give consideration to providing the spread sheets for the project. Mr. Bracken stated that he would not want to do this. Mr. Orlowski questioned if they would guarantee prices under $75, 000 on the affordable housing side. Mr. Bracken stated that he could not guarantee that unless he got a commitment from the Board on the plan. Mr. Egosi stated that the only way the site would bear the affordable houses would be if they had the luxury condominiums to bear some of the costs. Mr. Bracken staed that he was proposing town houses not condominiums. They would be individual homes with there own separate parcel of land. Mr. Ward stated that he would like to see an outline of how the applicants were proposing to proceed since they know what variances they will require. Mr. Ward stated that it would be very helpful if the applicants submitted an out line of what direction they were heading in since they needed other various approvals, for instance the Board of Appeals. Mr. Egosi stated that it was just a matter of interpretation and perhaps variances were not needed. Mr. Egosi requested the Board' s approval of the preliminary layout so that he could prepare the final maps and get whatever variances were required. The Board will make a field inspection prior to any further recommendations or comments. 8: 35 p.m. Planning Board Member William F. Mullen, Jr. , left the meeting at this time. Mr. Daniel Natchez was present for a presubmission conference to discuss the site plan for Brewer Yacht Yard located at Greenport. This site plan is for re-design of an existing marina. Mr. Natchez is the president of Daniel S. Natchez and Associates a water front development environmental planning company and with him was Michael Abo the general manager of Brewers yacht Yard. Mr. Natchez stated that they had proposed an amended site plan from the one which was previously approved and they were redesigning the basin. The first approval took two years to obtain with all of the agencies and therefore, the price of the first plan was now too costly to do, which is why they are proposing the change. They had alsoproposed to re-design the travel lift so that you have two lifts as opposed to one. There is also a proposed swimming pool, on of the existing buildings would be extended 50 ' x 40 ' and a new building for the transformer has been already approved.
