The following resolution was adopted by the Southold Town Planning Board
at a meeting held on Monday, August 7,1995:
BE IT RESOLVED that the Southold Town Planning Board authorize the
Chairman to endorse the final surveys dated October 22, 1994. Conditional
final approval was granted on April 10, 1995. All conditions have been
fulfilled.
Enclosed please find a copy of the survey which was endorsed by the
Chairman.

Dear Ms. Moore:
The following took place at the April 10, 1995 Planning Board public meeting:
The final public hearing for the lot line change for Edward and Virginia Thorp
was closed.
WHEREAS, Edward and Virginia Thorp are the owners of the property known
and designated as SCTM# 1000-37-6-2.1 & 3.1 located on Oak Court in East
Marion; and
WHEREAS, this lot line change, to be known as lot line change for Edward and
Virginia Thorp is for a lot line change to subtract 2,625 square feet from a
16,920 square foot parcel and add it to a 9,380 square foot acre parcel; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on December 12, 1994; and
WHEREAS, a variance was granted by the Zoning Board of Appeals on March
1, 1995;and

WHEREAS, a final public hearing was closed on said lot line change application
at Town Hall, Southold, New York, on April 10, 1995; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
South old have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the surveys dated October 22, 1994 and authorize the Chairman to
endorse the final surveys subject to fulfillment of the following condition. This
condition must be met within six (6) months of the date of this resolution:
1. The filing of new deeds pertaining to the merger of the 2,625 square feet
from the 16,920 square foot acre parcel SCTM# 1000-37-6-3.1 with the
9,380 square foot parcel SCTM# 1000-37-6-2.1.
A copy of the recorded deed must be presented to the Planning Board prior to
endorsement of the final survey.

State Environmental auallty Review
FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically e.xpert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3:
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced. .
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

square feet from a 0.351 acre parcel and add it to a 0.196

here or the agent for the applicant?
Mr. Moore: The Zoning Board has granted a variance which
was a condition we had to satisfy before completing the lot
line change. They adopted a recommendation you folks have,
which was to jog the line a little bit to provide access to
the rear of the house and then impose a condition on that
saying that we could not put an addition to this house until
we nullify the reason we are getting back was rather
reasonable and the applicant agreed to that at that hearing.
If you have' any questions, I will be glad to answer them but
I think it is pretty straight forward.

Mr. Edwards: Mr. Chairman, I would like to make the
following motion.
WHEREAS, Edward and Virginia Thorp are the owners of
the property known and designated as SCTM #1000-37-6-2.1 &
3.2 located on Oak Court in. East Marion; and
WHEREAS, this lot line change, to be known as lot line
change for Edward and Virginia Thorp is for a lot line
change to subtract 2,625 square feet from a 16,920 square
foot parcel and add it to a 9,380 square foot acre parcel;
and
WHEREAS, the Southold Town Planning Board pursuant to
the State Environmental Quality Review Act, (Article 8),
Part 617, declared itself lead agency and issued a Negative
Declaration on December 12, 1994; and
WHEREAS, a variance was granted by the Zoning Board of
Appeals on March 1, 1995 and;
WHEREAS, a final public hearing was closed on said lot
line change application at Town Hall, Southold, New York, on
April 10, 1995; and
WHEREAS, all the requirements of the Subdivision
Regulations of the Town of Southold have been met; be it
therefore
RESOLVED, that the Southold Town Planning Board grant
conditional final approval on the surveys dated October 22,
1994 and authorize the Chairman to endorse the final surveys
subject to fulfillment of the following condition. This
condition must be met within six (6) months of the date of
this resolution:
1. The fil'ing of new deeds pertaining to the merger of the

total reduction is from approximately 16,650 sq. ft. to 14,025 sq. ft. of lot 3.1
(westerly parcel-also referred to as Lot 4 on the Map of Gardiners Bay Estates).

lot width of easterly parcel, now 2.1, from 28.46 to 58+- feet; and 2. Lot
area-size reduction of not more than 2625 sq. ft. from the westerly lot 3.1, to
increase the lot area-size of the easterly lot, 2.1, with the following
CONDITION: There be no reduetion of building setback or future additions on
the easterly lot B, now 2.1, that would restrict access to the back yard, and
maintaining sufficient 10 ft. wide opening in yard area at the southwest corner
of the house to the closest property Hne for access by emergency-fire trucks.
REASONS/FINDINGS: Smaller lot to the east (2.1 or "B") will be increased in
size which lessens the nonconforming lot area. Substantially increases westerly
side yard of existing house on Lot B, (also referred to as Lot 3 on the Map of
Gardiners Bay Estates.) Owner has confirmed there will not be a relocation of
the house on Lot B near the top of bank at Gardiners Bay. No adverse affect
will be created on the westerly lot and r'emaining yar'd ar'eas arc sufficient to

Reasons Supporting This Detennination:
This project involves a lot line change that will result in a non-conforming
lot becoming larger; thus the change will not be a more intensive use of the
land.
The applicant will have to comply with the requirements of the Suffolk
County Sanitary Code (SCSC) and all relevant standards of water supply
and sewage disposal systems. Design and flow specification, subsurface
soil conditions and site plan details will have to be approved by the Suffolk
County Department of Health Services (SCDHS). This impact is not
considered significant due to the anticipated project compliance with
established requirements of the SCSC and the SCDHS and the required
relevant permits.
An Environmental Assessment Form has been submitted and reviewed,
and it was determined that no significant adverse effects to the
environment were likely to occur should the project be implemented
as planned.

State Environmental Quality Review
FUll ENVIRONMENTAL ASSESSMENT FORM
j} Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
I.: or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically e.xpert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3",
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced. "
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate ......ther or not the
impact is actually important.
