this Affidavit in connection with
his pending proposal before the Southold Town Planning Board
for permission to subdivide the herein above-mentioned
property.
In connection thereto Deponent states:
1. That no lot or portion thereof will be
further subdivided or otherwise split,
2. That only one private dwelling shall be
constructed on each lot,
3. That the minimum size of the lilTing area
on tne ground floor of said private dwelling
shall be 1200 square feet,
4. That plans and specifications must be sub-
mitted to the developer for approval, and such
approval shall not be unreasonably withheld,
5. That all owners of the several lots or plots
shall each share in the general expenses for
maintaining the thirty-foot right-of-way in X
mills per thousand of the assessed valuation.
Further, the said sum shall not exceed $50.00
per year in addition to the payment of the
taxes thereon.

COMMENTS I
The original surface of the four lots slopes in part from North
to South as noted by the few contours shown.
Some of the area has wooded sections.
A test hole in the R.O.W. where it meets the North Road showed 12"
of sandy loam with a small amount of gravel. Another test hole
had 16" of the same material. A small sand pit across the
North Road and opposite to part of the subdivision has about the
same surface material as found in the test holes.
Recommendations I
1. The owner to submit a road profile in the R.O.W. for at
least 350 L.F. in length from the North Road. The 30 ft.
R.O.W. is 2.5 ft. above the North Road at their intersection.
2. Road width to be 16 ft. in width in the 30 ft. R.O.W.
3. Clear the R.O.W. of all trees, brush or other obstructions
for the road length.
4. Remove topsoil, loam or other objectionable material for a
depth of 12" (road length 350 ft.). Replace with 12" of a
good grade of clean fill.
5. Place a compacted 6" course of bankrun containing 30% or more of
gravel and 10% of loam on the replaced material.
6. Place a compacted 3" crowned top course of 3/4" stone blend
on the bank run.

The Planning Board reviewed your letter of May 30, 1980
in regard to the minor subdivision of Armaroy Acres at a
regular meeting held June 16. The following is from the
minutes of the meeting.
"Covenants and restrictions were filed in the Suffolk
County Clerk's Office stating amongst other things that (2)
That only one private dwelling shall be constructed on each
lot and (3) that the minimum size of the living area on the
ground floor of said private dwelling shall be 1200 square
feet. The applicant's attorney, Abigail Wickham, has requested
a letter from the Planning Board indicating that the two above
statements were not required by the Planning Board as a
condition to their approval of the subdivision and that the
Planning Board has no interest in enforcement of those state-
ments, provided that any use of the property does not violate
the zoning ordinance of the Town of Southold. The Planning
Board sees no objection to the intent of the change and would
like a revised list of the covenants and restrictions to fit
the needs of the particular lot intended to be purchased by
the Fanny Behlen Community Health Center."

City, County and State of New York.
Deponent makes this Affidavit in connection with
his pending proposal before the Southold Town Planning Board
for permission to subdivide the herein above-mentioned
property.
In connection thereto Deponent states:
1. That no lot or portion thereof will be
further subdivided or otherwise split,
2. That only one private dwelling shall be
constructed on each lot,
3. That the minimum size of the living area
on the ground floor of said private dwelling
shall be 1200 square feet,
4. That plans and specifications must be sub-
mitted to the developer for approval, and such
approval shall not be unreasonably withheld,
5. That all owners of the several lots or plots
shall each share in the general expenses for
maintaining the thirty-foot right-of-way in X
mills per thousand of the assessed valuation.
Further, the said sum shall not exceed $50.00
per year in addition to the payment of the
taxes thereon.

be subject to the following covenant and restriction which
shall run with the land:
