Patchogue , New York 11772, hereinafter referred to as "Declarants" .
W I T N E S S E T H :
WHEREAS, Declarants are the owners in fee simple of a certain
parcel of land situate at Greenport, Town of Southold, County of
Suffolk and State of New York , containing 5 . 208 acres, and designated
Iwo on the Suffolk County Tax Map as District 1000 , Section 040 , Block 01 ,
and Lot 020 . 000; being the same premises conveyed to Declarants by
deed dated October 3, 1986, recorded in the Suffolk County Clerk 's
Office on December 16, 1986, in Liber 10193, at page 534 , and referred
to herein as the "premises" .

NOW THEREFORE, the Declarants do hereby declare that the aforesaid
premises and every portion thereof is hereby held and shall be
conveyed subject to the conditions , covenants and restrictions
hereinafter set forth, and that every purchaser of said premises so
purchased shall be held subject to the covenants, conditions , and
restrictions hereinafter set forth .
1 . No lot shall be subdivided or its lot lines changed in any manner
at any future date unless authorized by the Town of Southold
\ Planning Board .
2 . No new residential structure or sanitary disposal facility shall be

constructed or otherwise located within 100 feet of the top of the

bluff.

3 . Clearing and grading within each lot shall be limited to that
necessary for siting and constructing a house with the intent of
preserving as much of the natural vegetation on the site as
possible.
4 . Access to Lots 1 and 2 shall be by common driveway on Middle Road
(C.R. 48 ) ; said driveway to be constructed at an angle of at least
700 with Middle Road (C.R. 48 ) .
5. Each lot having frontage on Middle Road (C.R. 48 ) shall have a
turnaround provision, such as a T-shaped shunt, so that a vehicle
leaving a lot will not have to back into the traffic stream on the
road.
6. All stormwater runoff resulting from the development and
improvement of this subdivision or any of its lots shall be
retained on the site by adequate drainage structures so that it
will not flow out onto the right-of-way of Middle Road (C.R. 48 ) .
7 . No stormwater runoff resulting from the development and improvement
of this subdivision or any of its lots shall , be discharged down the
face of the bluff .
8. These covenants will be effective only at such time as the Southold
Town Planning Board endorses the subdivision map.
9 . That all of the covenants , conditions and restrictions contained
herein shall be construed as real covenants running with the land
and shall continue and remain in full force and effect at all times
as against the owner of the premises or any portion thereof , except
with the permission of the Southold Town Planning Board, or its
then equivalent successor. Said covenants, conditions and
restrictions shall be binding upon, inure to the benefit of and be
enforceable by the Declarant, his heirs, successors and assigns ,
any owner of any portion of the aforesaid premises, their heirs,
successors and assigns, and the Town of Southold, and its
successors and assigns, and the failure of any of the foregoing to
enforce any of such covenants , conditions and restrictions shall in
no event be deemed a waiver of the right to do so thereafter .

Dear Sirs :
The above-referenced subdivision map received final approval from the
Planning Board on March 13, 1989 . Pursuant to the Southold Town Code,
Article II , Section A106-26 (A) , this map must be filed with the
Suffolk County Clerk within thirty ( 30 ) days of approval .
This subdivision map was forwarded for filing on March 15 , 1989 . On
April 7 , 1989 , we were advised that the Suffolk County Clerk will not
accept this map because of certain County requirements omitted by the
surveyor . This situation is now being rectified and we may have the
amended maps in hand before the end of this week . However , the
amended maps must be submitted to and re-signed by both the Planning
Board and the Suffolk County Health Department before they can again
be presented to the County Clerk . Insufficient time remains to have
the map filed before April 13th .
We respectfully request that the Planning Board grant us an additional
thirty ( 30 ) days to accomplish this map filing.

determination as to whether you would donate Park and Playground
land or money in-lieu-of?

Ms. Scopaz: We will discuss it.
Mr. Saland: If the Board has a strong feeling one way or the
other, we are more then willing to cooperate.

Mr. Ward: Just one. One we may consider and maybe talk about in
' terms of property would be the natural slope between the park
; district property and the lots 10 and,ll. There may be some
consideration there that might be put into cash, lets talk about
that. I don't know if that will foul up your lot in terms of
acreage. The strip between Wolf Pit lake and lots 10 and 11 its
actual shown as a. . .
Mr. Saland: What where you saying?
Mr. Ward: Well what I was saying was the possibility of just
enlarging the park district property to accommodate the slope
that's in there so they have control. That's the only thing I
can say is that's the only possibility.
Mr. Saland: The problem I have with that is that will lower my,I
just made it under 13x5 . . .
Mr. Orlowski: Being no further comments I will declare this
hearing closed and thank you for coming.

minor subdivision of Anthony and Sally Pirrera, survey dated
September 17, 1987. Board to take action on the sketch plan for
this subdivision. Board to declare themselves Lead Agent under

the State Environmental Quality Review Act. This proposal is for
2 lots on 5.208 acres off CR 48, Greenport.SCTM# 1000-40-1-20.
Mr. Orlowski: This was scheduled ahead of time. I will open the
hearing and ask for a comment and close this hearing because we
have not granted sketch. I would like to proceed with sketch and
also Lead Agency so then we can set this up within the next
month for a hearing and do it proper way. Since we have
scheduled a hearing I will ask if there is any comments.
Mr. Bruer: Mr. Chairman members of the Board, Rudolph Bruer I'm
here for the applicant. This has been on for a while. I grant
you sketch plan has not been granted but I don't think the Board
is required to do sketch plan if they don't want to. If you look
at your general schedule of events over the past year you would
find have this thing snuck on maybe a month or so earlier this
would have been a set-off rather then a minor subdivision. It's
basically a division of a lot and a half. We have the ZBA. The
only thing that is not before the Board is the official comments
from the Health Department because they want comments from the
Greenport Water Authority which is not very easy to get. Matter
of fact, I was up there at their meeting on Friday. I prepared a
document for the Superintendent to say he will or will not, all
that he had to do is cross out will or will not. I gave him an
envelope and I still don't have it. I think the Board could
please consider this. I think everything is in order and what
Cever you could do to expedite it we would appreciate it. Again I
know you really don't have to go to sketch.
Mr. Orlowski: Well, it's our policy and we still have to do
SEQRA. In this case the Board has decided to proceed with sketch
and as diligently as possible to set for the hearing.
Bruer: I understand the Board is g

do and we would appreciate what ever you could do to speed it

Ms. Scopaz: Mr. Chairman I would like to make one point of
reference. Because of the way the SEQRA law is set up, old
set-off's have to go through the SEQRA process just as site
plans and any other subdivision. It is a nuisance, granted. I
don't have to tell you what the paper work involves in our side
of it. The law requires it. What we are working on is setting up
a system to automatically get the SEQRA process moving as a
matter of course. . . . I think in the future when the application
comes in we should automatically start the SEQRA process to
avoid this lapse in time.

This was denied by the ZBA. This leaves us no choice but to deny

retained on the site by adequate drainage structures so that it
will not flow out onto the right-of-way of Middle Road (C.R. 48 ) .
7 . No stormwater runoff resulting from the development and improvement
of this subdivision or any of its lots shall be discharged down the
face of the bluff .
8. These covenants will be effective only at such time as the Southold
Town Planning Board endorses the subdivision map and said map is
accepted by and filed with the Suffolk County Clerk .

herein shall be construed as real covenants running with the land
and shall continue and remain in full force and effect at all times

Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on July 6,
1988 reviewed the proposed subdivision plat, entitled, "Minor Subdivision -
Anthony & Sally Pirrera" referred to it pursuant to Section A14-24, Article XIV
of the Suffolk County Administrative Code. After due study and deliberation it
resolved to approve said map subject to the following twelve conditions that are
deemed necessary to help preserve the traffic safety and carrying capacity of
Middle Road (North Road), a county road, and to help preserve the natural and
aesthetic attributes of the shoreline of Long Island Sound.
tv/ 1. No lot line shall be changed in any manner at any future date unless
authorized by the Town of Southold Planning Board.
2. Clearing and grading within each lot shall be limited to that necessary
for siting and constructing a house with the intent of preserving as
much of the natural vegetation on the site as possible. Limiting
clearing and grading will minimize stormwater runoff and erosion.
3. Due to the minimum lot area requirement of the zoning classification of
this property being considerably less than the area of Lots 1 and 2,
each lot shall be made subject to a covenant that will prohibit future
subdivision.
4. An easement shall be created to provide for a common driveway to serve
as access on Middle Road for Lots 1 and 2 to minimize the number of
points of ingress and egress along the road.

5. The driveway on Middle Road shall make an angle of at least 70° and
preferably 90° with the county road.
6. Each lot having frontage on Middle Road shall have a turnaround
provision, such as a T-shaped shunt, so that a vehicle leaving a lot
will not have to back out into the traffic stream on the road.
7. All stormwater runoff resulting from the development and improvement of
this subdivision or any of its lots shall be retained on the site by
adequate drainage structures so that it will not flow out onto the
right-of-way of Middle Road.

Southold Planning Board that the creation of this subdivision in no way
commits either the Town or the County of Suffolk to any program to
protect this property from shoreline erosion through the construction
of engineering or other works.
11. Conditions 1-9, inclusive, shall be filed as covenants and restrictions
in the office of the County Clerk on or prior to the granting of
approval to this subdivision.
These covenants and restrictions can be modified only at the request of
the then owner of the premises with the approval of a majority plus one
of the Town Board or Planning Board of the Town of Southold after a
public hearing. Adjoining property owners shall be entitled to notice
of such public hearing but their consent to such modification shall not
be required.
12. The final map shall bear the following note: A Declaration of
Covenants and Restrictions has been filed in the Suffolk County Clerk's
office which affects lots in this subdivision.
The Commission also offers the following comments on the map for your use
and consideration:
1. It is suggested that before approval is granted to this subdivision
that the subdivider be required to submit this proposal to the Suffolk
County Department of Health Services for review to insure that the
proposed subdivision will meet the requirements and standards of that
agency.

WHEREAS , a public hearing was held and concluded on January 14 ,
1988 in the Matter of the Application of ANTHONY AND SALLY PIRRERA
under Appl . No . 3688; and
WHEREAS , at said hearing all those who desired to be heard
were heard and their testimony recorded ; and
WHEREAS , the Board has carefully considered all testimony
and documentation submitted concerning this application ; and
WHEREAS , the Board Members have personally viewed and are
familiar with the premises in question , its present zoning , and
the surrounding areas ; and
WHEREAS , the Board made the following findings of fact :
1 . The premises in Question is situated along the north
side of the North Road (a/k/a County Road 48 ) , Greenport , Town
of Southold , having a total acreage of 5 . 2 acres and lot width
of 255 . 26 feet , and is located in the "A-80" Residential and
Agricultural Zoning District .
2 . By this application , appellant requests approval of
the lot width (frontage ) of 127 . 63 feet of proposed Parcels
#1 and #2 in this pending two-lot division of land , as more
particularly shown on map prepared by Roderick VanTuyl , P . C.
dated September 17 , 1987 , amended December 11 , 1987 .
3. Article III , Section 100-31 , Bulk Schedule , of the Zoning
Code requires a minimum lot width of 175 feet .
4 . The premises is shown to be vacant and is believed to

be accessible to a 12 " water main from the Village of Greenport
Water Company .
5. For the record it is noted that by prior action taken
by this Board under Appl . No . 3354 , area and width variances
were denied for the reasons noted therein on January 21 , 1986 ;
and that an opinion was obtained from the Suffolk County Soil
and Water Conservation District dated November 29 , 1985 which
recommended a change in the location of the then-proposed
right-of-way outside of the natural drainageway areas .
6 . It is the position of the Board that the layout of
the perimeter of this 5 . 208-acre parcel as presently exists
with a total lot width of 255 . 26 feet is unique and there is
no other method feasible for appellant to pursue other than
a variance .
7 . In considering this application , the Board also finds
and determines : (a ) the relief requested is not substantial
in relation to the requirements of zoning and in relation to
those lots generally existing in the area ; ( b ) a substantial
change will not be produced in the character of the neighbor-
hood ; (c ) a detriment would not be created to adjoining
properties since the lot will in all other respects comply
with the requirements of zoning ; (d ) the practical diffi -
culties are not self-created and are sufficient to warrant
the grant of this variance ; (e ) in view of the manner in
which the difficulties arose and in considering all the above
factors , the interests of justice will be served by granting
the variance , as noted below.
Accordingly , on motion by Mr . Sawicki , seconded by Mr .
Douglass , it was
RESOLVED , to GRANT a Variance from the Provisions of
Article III , Section 100-31 ( Bulk Schedule ) of the Zoning
Code for the insufficient lot width [or frontage] of proposed
Parcels #1 and #2 of 127 . 63 feet , as applied in the Matter of
the Application of ANTHONY AND SALLY PIRRERA under Appl . No.
3688 , PROVIDED :
1 . That lot area for each parcel will not be less than
the current code requirement of 80 ,000 sq . ft . ;
2 . That any and all setbacks and other zoning requirements
will be complied with (without reductions at any time ) .

/ North of existing house (which is South end of envelope) be filled in or altered.

DORMAN, TOWNSEND, MACKAY AND MILLIS - beyond jurisdiction. The kettle holes
on site are not Wetlands. Nevertheless, every effort should be made to save them
as contiguous open space for the following reasons: 1. Site is a Significant Wintering
area for.White Tailed Deer which migrate to the North side of Orient when food and
cover in the lower areas deteriorates. 2. The Cedars on the site near the kettle
holes are important cover for Song Birds as well as the deer. 3. Woods on this
,parcel are very typically occupied by Red Fox and the larger owls (Great Horned, etc
because of the diversity and high quality of cover and food available.
The more restrictive the applicants can envision the building envelopes, the more
likely they or future owners will be treated to some very remarkable bird .and animal
watching from their houses.
