Dear Mr. Kaplan:
The following action was taken by the Southold Town Planning
Board at a regular meeting held December 3, 1979.
WHEREAS, a formal application for the approval of a s~bdivision
plat, entitled Minor Subdivision of Zena and Rhoda Kaplan, was
submitted to the Planning Board on August 3, 1979, and an application
fee of $30 was paid on November 27, 1979, and
WHEREAS, a public hearing was held on the said subdivision
application and Plat at the Town Hall, Southold, New York, on
November 14, 1979 at 7:30 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said Subdivision Plat and
application,
Now, therefore, be it RESOLVED, that the application of Zena
amd Rhoda Kaplan for approval of said subdivision plat prepared by
Roderick Van Tuyl, P.C. and dated September 10, 1979 be approved
subject to the following modifications, and that the Chairman of
the Planning Board be authorized to endorse approval on said
subdivision Plat upon compliance by the applicant with such
modifications as noted below.

1. All stormwater runoff resulting from the development and
improvement of this subdivision shall be retained on site
by adequate drainages and shall not be allowed to flow out
into Main Road or into the State recharge basin.
2. No driveway shall be located within 50 feet of the south-
west corner of the intersection of Main Road and Shipyard
Lane.
3. Where possible vehicular access to Lot 1 shall be restricted
to Shipyard Lane.
4. No residential structure or other major structure shall be
located within 100 feet of the mean high water line on
Gardiner's Bay.
5. No sanitary disposal facility shall be constructed or
installed within 100 feet of the mean high water line on
Gardiner's Bay.
6. No stormwater runoff shall be discharged directly into
Gardiner's Bay in any manner.

DECLARATION, made this 6iLday of November, 1979, by ZENA KAPLAN,
residing at 26 Dawn Drive, Smithtown, New York, and RHODA KAPLAN, residing at
220 Edgewood Avenue, Smithtown, New York, hereinafter collectively referred to as
"Declarant".
WITNESSETH
WHEREAS, the Declarant is the owner in fee of a certain parcel of land, situate,
lying and being at East Marion in the Town of Southold, County of Suffolk, and State of
New York, more particularly described in the attached schedule marked "Schedule A",
and
WHEREAS, the Planning Board of the Town of Southold, Suffolk County, New York,
(the "Planning Board"), on the 18th day of October, 1979, did approve a sketch plan (dated
July 26, 1979, and amended September 10, 1979) for a "Minor Subdivision", as the same
is defined in ~A 106-13 of the Code of the Town of Southold, including the parcel described
in Schedule A and other lands, and
WHEREAS, the Planning Board has called for a public hearing thereon, to be held
on the 14th day of November, 1979, and
WHEREAS, it is the intent and purpose of the Planning Board that, in the event the
aforedescribed "Minor Subdivision" receives final approval, any subdivision hereafter
of the parcel described in Schedule A shall be, or be deemed to be, a "Major Subdivision"
as the same is defined in the said Section of the Code of the Town of Southold, and not a
"Minor Subdivision",
NOW, THEREFORE, in order that said intent and purpose may be carried out, the
Declarant, in consideration of the premises, and other good and valuable consideration,
sets forth the following:
FIRST: The premises set forth in Schedule A, hereto attached, are
owned in fee by Declarant.
SECOND: Declarant covenants that, upon final approval of the pending
application for a "Minor Subdivision", Declarant will not hereafter make appli-
cation to the Planning Board of the Town of Southold for a "Minor Subdivision"
of the premises described in Schedule A, but will make only such subdivision as
would be a "Major Subdivision", or be deemed to be a "Major Subdivision".
THIRD: The aforesaid covenant shall enure to the benefit of the Town of
Southold.
FOURTH: This instrument may be recorded by the Town of Southold
upon final approval of the "Minor Subdivision" referred to in the preambles hereof.

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on November 14,
1979, reviewed the proposed subdivision plat entitled, "Minor Subdivision - Zena &
Rhoda Kaplan", referred to it pursuant to Section 1333 of the Suffolk County Charter.
After due study and deliberation it resolved to approve said map subject to the
fOllowing conditions deemed necessary to help preserve the traffic safety and
carrying capacity of Main Road and the natural and aesthetic attributes of Gardiner's
Bay:
1. All stormwater runoff resulting from the development and improvement of this
subdivision shall be retained on site by adequate drainages and shall not be

The Commission also offers the following comment on the map for your use
and consideration:
Provision should be made either at this time or when Lot 1 is subdivided for
the obtaining of a dedication of land for highway purposes at the southwest corner
of Main Road and Shipyard Lane so that a short radius curve can be provided at
that location. Such a curve will facilitate turning movements and help to insure
that sight distance will not become obstructed.

NEGATIVE DECLARATION
November 14, 1979
Pursuant to Article 8 of the Environmental Conservation Law
state Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that Southold Town Planning Board as lead agency
for the action described below has determined that the project
will not have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Zena and Rhoda Kaplan is a three-lot
subdivision of 46.465 acres located at East Marion.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted Which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
The New York State Dept. of Environmental Conservation
states that it has no objection but if any development
on the access parcel to Gardiner's Bay is proposed at
some future date application must be made to the NYS
DEC.
The Suffolk County Department of Health Services has
indicated that a precursory review of the above referenced
project indicates conditions are suitable for individual
sewage disposal systems and water supply, provided public
water is available.
The project will meet all requirements of the Code of
the Town of Southold Subdivision of Land regulations.

Dear Mr. Kaplan:
The following actions were taken by the Southold Town Planning
Board at a regular meeting held October 18, 1979.
RESOLVED to grant approval to the sketch map of Zena and Rhoda
Kaplan, said map dated July 26, 1969 and amended September 10, 1979.
RESOLVED that the Southold Town Planning Board declare itself
lead agency in regard to the State Environmental Quality Review Act
in the matter of the minor subdivision of property of Zena and Rhoda
Kaplan.
RESOLVED to set 7:30 p.m., Wednesday, November 14, 1979, at the
Town Hall, Main Road, Southold, New York, as the time and place for
a public hearing on the question of the approval of the minor
subdivision of Zena and Rhoda Kaplan located at East Marion.
The Board was unanimous in its request for a covenant on the
undeveloped portion of the property, said covenant to state that the
developers will not make application to the Board for another minor
subdivision on this particular piece of property.
