Since the Zoning Board placed the condition at issue on the variance that it granted, your client must apply to that Board for relief. It appears the ZBA placed a condition on lot #4 when it granted approval of the subdivision with insufficient area and width of parcels. That condition was that lot #4 never be used as living quarters or for residences. That condition was adopted by the Planning Board in approving the subdivision.
