STATEMENT OF INTENT AND SPECIFICATIONS CHEMICAL WASTE HAULER FOR TOWN OF SOUTHOLD PERMANENT HOUSEHOLD HAZARDOUS WASTE STORAGE FACILITY I. INTENT The intent of this bid proposal is to secure one (1) chemical waste hauler contractor to provide services in conjunction with the Permanent Household Hazardous Waste Storage Facility and the corresponding program for the' Town of Southold. II. DEFINITIONS A. Contractor - The chemical waste hauler who is providing the services for the Permanent Household Hazardous Waste Storage Facility (PHHWSF) . B. HHW - The acronym for Household Hazardous Waste and is the term which shall include all pesticides and other chemicals or otherwiSe harmful or potentially harmful wastes originating only from residential homes as defined in 6 NYCRR Part 366. Such HHW items shall only be accepted from the residents, not from commercial est,!blishments. C. PHHWSF - The acronym for Permanent Household Hazardous Waste Storage Facility, which is where the HHW will be stored, is located at the Landfill Site, CR 48, Cutchogue, New York. D. RCRA - The acronym for the Resource Conservation and Recovery Act of 1976 and subsequent amendments and re-authorizations. III. SCOPE A. HANDLING PROCEDURES AND ASSURANCES. The Contractor shall guarantee to provide all the professional services, including, but not limited to, supervision, labor, equipment and materials necessary to: 1. Revise the existing manual of "Standard which will include emergency procedures problem regarding a chemical hazard efficiently taken care of. Provide on or before two (2) weeks prior to the execution of contract, proof of all necessary local, state and federal permits and identification numbers pursuant to the handling, transportation, disposal 'of HHW. The Contractor shall: a) Indemnify, save and hold harmless the Town of Southold and any and all individuals present at the PHHWSF from any and all liability for bodily injury, property damage, and pollution contamination arising directly from the Contractor's activities. b) Provide the Town of Southold with a Certificate of Insurance on .or before two (2) weeks prior to execution of contract, which indicates C;ontractor's insurance coverage for its . employees, . equipment and all incidents r-elated to handling, transport and disposal of household hazardous wastes in an amount satisfactory to the Town of Southold. c) Be in compliance with the insurance requirements of the Motor Carrier Act of 1980 for the transportation of hazardous wastes (if applicable) and provide the Town with a Certificate of .Insurance naming the Town as an additionar insured on any. policy required by the Act. B. TRAINING Provide eight (8) hour operators of the facility, operators designated by .proper procedures for: update training for the Town's existing and forty (110) hour training for any new the Town. All training will include the. a) identifying and. segregating the in-coming HHW; b) labeling and preparing the drums of HHW for inspection by chemical waste hauler prior to shipment; and . c) completing the forms for the corresponding. waste collected within the fifty-five gallon storage drums. Training for the Town's personnel shall be provided pursuant to State Department of Labor and Federal OSHA re,gulations. It shall include the technical procedures for handling all waste that is accepted as well as the proper use of the safety equipment in a manner that is protective of the public health and welfare and the environment. C. EQUIPMENT INVENTORY The Contractor shall take an inventory of all items and equipment associated with the Town's existing household hazardous waste (S.T.O.P.) program and shall determine if such equipment is adequate to meet current applicable permit and regulatory requirements. Inventory shall be taken of items including, but not limited to, all safety and protective equipment, spill control material, necessary signs and notices, hazardous substance lists, and record-keeping forms. The Contractor shall provide additional inventory as needed and requested to meet applicable requirements. U. ADDITIONAL SPECIFICATIONS The Cuntractor shall review all operating plans and procedures associated with the Town's existing S. T .O.P. program for compliance with all applicable permit and regulatory requirements, including those requirements that may have been enacted since the Town received its current S.T.O.P. operating permit in June of 1991. The Contractor will inform the Town of any and all reVISIOns to current operating procedures that may be necessary and. meet revised permit requirements enacted since the Town received its current S.T .O.P. operating permit. E. While the Contractor and the Town agree that the Federal Resource Conservation and Recovery Act (RCRA) specifically exempts household waste from classification as a hazardous waste, both parties agree that all HHW accepted by the Contractor pursuant to this program will be handled, transported and disposed of to the extend required of contractors handling HHW from under NYS-DEC as if such waste was classified as hazardous or acutely hazardous waste. Page' :3 - Intent. Specifications . Since the PHHWSF is only for collection of household hazardous' waste received from the residents of the Town of Southold and will not be the recipient of any commercial wastes, the facility is exempt from the requirements of the NYS Solid and Hazardous Waste 'Facility permits pursuant to 6 NYCRR 373-1.1 (d) (1) (xvii). All HHW collected shall be manifested as "exempt" wastes on Hazardous Materials Shipping Order Form j/8-BLS-C4 ("red manifests") pursuant to Title 40 CFR Section 261.5. The Contractor shall enter the words "Exempt per 40 CFR 261.5" in the space for "shipper's no.". Duties include the following: 1. Initial preparation of the facility includes supplying: a. twenty empty fifty-five gallon drums; b. "Standard Operating Procedures" Manual that will give details regarding the proper procedures the operators shall follow in handling all acceptable material; and c. proper forms for compliance with State and Federal regula-' tions. 2. RCRA Duties: a. to complete necessary RCRA paperwork for the disposal of the Q rums. 3. A copy of this permit must accompany each vehicle identified in this permit whenever it is being used to transport waste. 2. The transporter permit number must be displayed on the' sides and rellr of each vehicle identified in this permit in letters and numbers of contrasting color and at least four inches (4") high. 3. Monthly Report Forms for each calendar month of the permit period must be filed with the Director of the Waste Management Bureau/waste Engineering and Enforcement Division on or before the lOth day of tne following month. Monthly Reports must specify: a. all Connecticut Regulated Waste and/or unmanifested Hazardous Waste transported; or b. that all Hazardous Waste transported was manifested; or c. that no waste was transported. (NOTE, Transporters not subject to the provlslons of Section 22a-454 of the Connecticut General Statutes are not required to report on Connecticut Regulated Waste they transport.) 4. Periodic inspections will be conducted to ensure permit compliance and may include but not be limited to investigation of records, photographs (inclllding aerial), or other means deemed necessary for documentation. The Permittee shall comply with all instructions issued by the Commissioner of Environmental Protection or his des'ignated agents when deemed necessary to protect the water. land and/or air of the State from pollution. 6. In the event of spillage or uncontrolled discharge while cOllecting. transferring and/or transporting any waste in or through the State of Connecticut, the Department of Environmental Protection, Oil and Chemical Spills Section must be notified immediately by telephoning 566-3338 or 566-4240. 7. All wastes transported of the Code authorized to be transported by this permit must be in compliance with all applicable provisions of Title 49 of Federal Regulations. 8. Permittees who act as brokers and include independent owner/operators on their permit are responsible for ensuring: a. that these owner/operators are in compliance with permit conditions. b. that all vehicles are in compliance with all state and federal regulations. c. that all drivers have the proper emergency response training. d. that all drivers engaged in the transportation of wastes which are hazardous materials are in compliance with and famili4r with all applicable requirements of Title 49 of the Code of Federal Regulations and, e. that these owner/operators have the required minimum levels of liability insurance. 9. By March J of each year an original certificate of insurance showing policy renewal must be submitted to the Department. 10. By March 1 of each year for transoorters located in Connecticut. Department of Motor Vehicles Safety Inspection Reports for All vehicles and local fire marshal certification forms for all tank vehicles must be submitted to the Department. 11. This permit will automatically be modified to include additional vehicles upon receipt of a properly completed Application for Vehicle Modification to a Transporter Permit and the required fee. The effective date for the modification will be noted by DEP on the application form. A copy of the application with the effective date must be carried on all vehicles affected by the modification. This permit will automatically be modified to include additional waste types upon receipt of a properly completed Application for a lIaste Type Modification to a Transporter Permit and the required fee. The violation of any provisions of this permit is subject to civil and/or criminal penalties as provided by Section 22a-6(b), 22a-131, 22a-131a and 22a-438 of the Connecticut General Statutes. A copy of this permit must be carried in each transport vehicle and presented upon request to any law enforcement officer or representative of the Delaware Department of Natural Resources and Environmental Control (DNREC). It shall be the responsibility of the permittee to be familiar with all the following conditions: 1 ^, specified in the application for this permit, the following wastes may be transported by the permittee: Hazardous waste as defined by the Delaware Regulations Governin~ Hazardous Waste, used or waste oils, waste antifreeze, PCB-contaminated waste, and hazardous waste contaminated soils. 2 Only those vehicles identified in the application for this permit may be used to transport the wastes identified in Condition 1, AIi vehicles shall be operated in accordance with Delaware Regulations Governing Hazardous Waste. Part 263, Section 263.105, Permittee shall also be responsible for leased vehicles and contractors operating under this permit. 3. Permittee may transport wastes only to those treatment, storage, disposal, or recovery facilities designated in the application for this permit. 4, Each vehicle must display the company name in 3-inch letters on both sides of the motorized unit (tractor). The permit number must be displayed in 3-inch letters on both sides and rear of the containerized unit (trailer), 5, All vehicles shall carry the safety and emergency equipment contained in the application for this permit in addition to any eqllipment required by Federal DOT 49 CFR Motor Carrier Safety Regulations. 6. All vehicles shall carry spill containment equipment appropriate for the type of waste being transported. All vehicles shall carry a copy of the Spill Control Plan. All vehicles shall be equipped and operated so as to prevent any release of waste material to the environment. 8. All personnel shall be properly trained pl'lor to handling or transporting wastes for which this permit is being issued. 9. Permittee shall at all times be in compliance with appiicable insurance requirements for motor carriers as prescribed by Federal DOT 49 CFR Part 387. 10. Permittee must notify the Hazardous Waste Management Branch in writing of W additions or changes in waste types to be transported, ownership information, TSD facilities, and/or changes in operations, procedures or equipment within ten (10) working days after putting those changes into effect. 11. This permit does not relieve the permittee of complying with any other applicable Federal, State or local regulations or ordinances. 12. In the event that regulations governing the activity authorized herein are revised, this permit may be reopened and modified after notice and opportunity for a public hearing. At that time, additional limitations, requirements, and/or special conditions may be included In the permit. 13. The provisions of this permit are severable, and if any provision of this permit, or the application of any provision of this permit to any circumstance is held invalid, the application of such provision to other circumstances and the remainder of this permit shall not be affected thereby. 14. Permittee shall immediately contact the Department in. the event of a release of any waste material while in transport in or through Delaware. Special conditions: Permittee shall. llpon obtaining and servicing customers in the State of Delaware, obtain a Delaware Business License from the State Division of Revenue as required by 30 Delaware Code, Chapter 21. As a condition for certification, the following items must be maintained: 1. A current notification of hazardous waste activity. 2. A valid EPA identification number. 3. A valid license to transport hazardous waste from the Vermont Agency of Transportation, Department of Motor Vehicles. 4. Motor carrier insurance as required under US DOT regulations that shall carry an approved DOT endorsement (Form MCS 90) covering liability for accidents, including environmental restoration, bodily injury and property damage and a provision that the insurer notify the Agency within thirty (30) days of cancellation or reduction of insurance below the minimum requirements. All vehicle drivers and employees who may handle haz:>rdous waste or accompany vehicle drivers duri.ng handling must be tra hied. Such training, at a minimum, shall include: a. Basic knowledge of the Vermont Hazardous Waste Management Regulations and DOT's labeling, packing, placarding and shipping requirements as set forth in 49 CFR parts 171 through 179 and all other applicable DOT regulations; b. Safe vehicle operations to avoid creating hazards to public health, safety, or welfare or the environment; c. Handling of hazardous wastes in a safe manner; d. Emergency handling procedures in the event of a discharge of hazardous waste during transportation, including containment of hazardous waste to minimize harm to public health, safety, or welfare or the environment in compliance with 49 CFR sections 177.853 and 174.14, and section 7-105 of the Vermont Hazardous Waste Management Regulations; e. Familiarity with and use of the most recent edition of the Emergency Response Guidebook for Hazardous Materials published by DOT; f. A method to assure that the instruction program has been successfully completed (e.g. written or oral testing); g. Means and methods to effectively communicate with generators, facilities, other transporters, law enforcement and emergency personnel as required. 6. No hazardous waste shall be transported in Vermont without vehicles being in possession of the following items: ,,'j,- a. Telephone numbers of: 1. The generator of the waste being transported; 2. The Vermont Agenc~ of Natural Resources (802/ 244-8702) / Vermont tmergency Management (24 hrs - 1-800-641-5005) and the National Response Center (1-800-424-8802). 3. The Chemical Transporation Emergency Center (1-800-CHEMTREC) . , . . . b. A copy of the most recent edition of the Emergency Response Guidebook for Hazardous Materials published by DOT,'" c. A fire extinguisher of appropriate size and type for the vehicle and wastes carried; and d. Personnel protective equipment appropriate for the types of material being transported (e.g. respirator, gloves, protective suit, boots ). 7. A report must be submitted annually detailing hazardous waste activities for the calendar year in the state of Vermont on the Annual Report Form provided. ANNUAL REPORTS ARE DUE ON OR BEFORE MARCH 31 OF EACH YEAR. PROHIBITIONS 8. The applicant shall not remove waste from the container in which it has been placed once it has been manifested and moved from the site of generation until it is accepted at the destination facility except for emergency provisions of Section 7-105 or at a designated facility or transfer station with the written consent of the generator. 9. The applicant shall not transport or accept for transport hazardous wastes which are unlabeled or which are in damaged, bulging, leaking, unsuitable or otherwise unsafe containers. 10. The applicant shall not transport or accept for transport hazardous wastes which are incompatible with each other such that a danger to public health or safety or the environment could result from their being transported together. 11. The applicant shall not accept hazardous waste from a. generator unless it is accompanied by a manifest signed in accordance with the provisions of RegUlation Section 7-702. 12. The applicant shall not accept such waste from a primary exporter or other person if the applicant has knowledge that the shipment does not conform to the EPA Acknowledgement of Consent. . The Acknowledgement of Consent must also accompany'~he manifested shipment. MODIFICATION, SUSPENSION, REVOCATION OR DENIAL OF CERTIFICATION 13. The Secretary may modify the transporter certification upon his or her own motion or upon the receipt of a written request for modification which contains facts and reasons supporting the request. If the Secretary , . . . determines that modification is appropriate, only the . conditions subject to modification are reopened. Cause for modification of a '~ransporter's certification is: a. Material alterations to the applicant's activities which occurred after certification of the applicant which justify the application of certification conditions that are different or absent from the existing certification; b. The receipt of information concerning the applicant which was not available when the certification was issued; or c. The standards or regulations on which the certification was based have been changed by promulgation of amended standards or by judicial decision after certification was issued. 14. The Secretary may suspend or revoke the transporter certification or deny any application for the applica~t certification upon his or her own motion or upon receipt of a written request for suspension, revocation or denial which contains facts and reasons supporting the request. Cause for the suspension, revocation or denial is: a. Non-compliance by the transporter with the requirements of 10 V.S.A., Chapter 159, Vermont Hazardous Waste Management Regulations, the regulations promulgated by the Vermont Agency of Transportation for the transportation of hazardous wastes, or any term or condition of certificatio~ order or assurance; b. Failure by the applicant to disclose all relevant facts during the certification process which wera known at that time; c. Misrepresentation of any relevant fact at any time; ~'p d. A felony conviction of the applicant in any juristiction when the conviction concerns violations of hazardous waste statutes or regulations; or '. e. A determination by the Secretary that the applicant's activities constitute a serious threat to human health or the environment and that such a threat can only be regulated to acceptable levels by suspension, revocation or denial of certification. , \ . . 15. The Seoretary shall provide written notioe of modifioation, suspension, revooation, or denial, inoluding the reasons 't:or such aotions, to the applioant involved. Any applioant who reoeives suoh notifioation shall have thirty days from the reoeipt of the notioe to submit a written request for a hearing to the Seoretary. The Seoretary shall then provide a hearing within thirty days of reoeipt of the request. The submission of a request for a hearing does not stay the effeotive date of the Seoretary's deoision. . STATEMENT OF INTENT AND SPECIFICATIONS CHEMICAL WASTE HAULER FOR TOWN OF SOUTHOLD PERMANENT HOUSEHOLD HAZARDOUS WASTE STORAGE FACILITY I. INTENT The intent of this bid proposal is to secure one (1) chemical waste hauler contractor to provide services in conjunction with the Permanent Household Hazardous Waste Storage Facility and the corresponding program for the Town of Southold. II. DEFINITIONS A. Contractor - The chemical waste hauler who is providing the services for" the Permanent Household Hazardous Waste Storage Facility (PHHWSF) . B. HHW - The acronym for Household Hazardous Waste and is the term which shall include all pesticides and other chemicals or otherwise harmful or potentially harmful wastes originating only from residential homes as defined in 6 NYCRR Part 366. Such HHW items shall only be accepted from the residents, not from commercial establishments. C. PHHWSF - The acronym for Permanent Household Hazardous Waste Storage Facility, which is where the HHW will be stored, is located at the Landfill Site, CR 48, Cutchogue, New York. D. RCRA - The acronym for the Resource Conservation and Recovery Act of 1976 and subsequent amendments and re-authorizations. III. SCOPE A. HANDLING PROCEDURES AND ASSURANCES. The Contractor shall guarantee to provide all the professional services, including, but not limited to, supervision, labor, equipment and materials necessary to: 1. Revise the existing manual of "Standard which will include emergency procedures problem regarding a chemical hazard efficiently taken care of. Operating Procedures" so that any potential can be quickly and 2. Inspect and remove the drums of HHW at intervals dependent on the rate of collection. 3. Transport and dispose of said drums of HHW to the appropriate hazardous waste treatment, storage, or disposal facility (TSDF) in accordance with all Town, County, NYS-DEC, US Department of Transportation, and US Environmental Protection Agency standards, rules and regulations. 4. Insurance naming the Town as an additional" insured on any policy required by the Act. B. TRAINING Provide eight (8) hour operators of the facility, operators designated by .proper procedures for: update training for the Town's existing and forty (40) hour training for any new the Town. All training will include the a) identifying and segregating the in-coming HHW; b) labeling and preparing the drums of HHW for inspection by chemical waste hauler prior to shipment; and c) completing the forms for the corresponding. waste collected within the fifty-five gallon storage drums. Training for the Town's personnel shall be provided pursuant to State Department of Labor and Federal aSHA regulations. It shall include the technical procedures for handling all waste that is accepted as well as the proper use of the safety equipment in a manner that is protective of the public health and welfare and the environment. C. EQUIPMENT INVENTORY The Contractor shall take an inventory of all items and equipment associated with the Town's existing household hazardous waste (S. T.a. P.) program and shall determine if such equipment is adequate to meet current applicable permit and regulatory requirements. Inventory shall be taken of items including, but not limited to, all safety and protective equipment, spill control material, necessary signs and notices, hazardous substance lists, and record-keeping forms. The Contractor shall provide additional inventory as needed and requested to meet applicable requirements. D. ADDITIONAL SPECIFICATIONS The Contractor shall review all operating plans and procedures associated with the Town's existing S. T.a. P. program for compliance with all applicable permit and regulatory requirements, including those r",quirements that may have been enacted since the Town received its current S.T.D.P. operating permit in June of 1991.
