Mr. Bruer said the Board of Appeals has approved
subject to conditions and suggested that the Planning
Board might want to confer with them. Mr~ Wickham
said that the Board would want some sort o:f reasonably
scaled map showing the road. Mr. Bruer said that with
the length of time this is going to take, I think if we
could get some sort of preliminary approval, it might aid
us as far as expenses are concerned. Mr. Wickham said that
the Board normally has much more complete maps. This is
a rough sketch. ~The location of the buildings is sketched
in. My point is that I would guess that the Planning Board
would say "Yes". This looks like a good idea but we want
to know how far above sea level it is, what type of roads,
what type of parking you are prepared to provide, how
far from side yard boundaries, how far each unit is away
from each other. Mr. Kavanagh said that he wanted to
change the road to give himself some privacy, and there
is a road in front that I would eliminate. Mr. Bruer said
that he thought a physical examination by the Board might
set their minds at rest. Mr. Raynor said that a member
or members of the Board would go to see it.
Rduolph Bruer, Esq. appeared before the Board with
regard to Clement W. Booth minor subdivision. M~r.
Wickham said that the sketch plan was approved July 16, 1973
when we made recommendations.
On motion by Mr. Raynor, seconded by Mr. Coyle, it was
RESOLVED that Minor Subdivision of Clement W. Booth,
Southold, New York, be approved.
Vote of the Board: Ayes:- Messrs: Moisa, Raynor,
Coyle, Wickham.
Mr. Bruer discussed with the Board the Pontino Sub-
division map. Mr. Bruer said that the water tes~ showed
up at 11; we also had a good one, 6.8. Mrs. Pontino has a
receipt on it. What we would like to do is to prepare a
map showing the road, moving everything down, and holding
this until such time as it clears up, and get approval of
Section I. Mr. Raynor said that he would make the stipu-
lation that Section II does not get refiled. Mr. ~ontino
said that it has gone down 2 points. Mr. Wickham said that
perhaps before the final hearing you will have it, if the
water is tested again. You might want to have a hearing on
Section I and Section II if the water clears up. Mr.
Raynor said that the only access to the west of this

In July 2001 I purchased an acre ofland with an
understanding that it was environmentally sensitive and
under the protection of the Trustees as well as the DEC. I
have done my part and complied with the many restrictions
that came with the land and have built a home that fits into
the building envelope without the need for variances.
I know that in recent months town officials have been
hard at work at creating a policy on the government of
wetlands in Southold Town and therefore must be educated
with regard to how wetlands are formed and how they
function within ecosystems and how they relate to storm
waters.

The highway department dug a trench on my property to
drain the storm runoff from the surrounding area into my
property .
Horton's Lane and Soundview Avenue have been graded to
enhance the flow of storm water into my property.
Storm rains enter my property from Horton's Lane and
Soundview Avenue.
There is an extensive storm drain system across the street
from my house on Horton's Lane that is under utilized do
to the poor grading. Most of the storm water bypasses the
drain and enters my property on Horton's Lane.
During heavy downpours more than three-quarters of my
land is inundated with water.
There are many large trees heaving out of the ground or
have already fallen and the carcasses that remain point to
the fact that this is a newer hazardous situation for them.
One 60'tree is precariously hanging on two smaller trees
creating a potential hazard for humans.
I spoke with Ron Herman at the DEC. He said that he has
heard this scenario over and over (that highway
departments create wetlands because they are just running
out of space for storm runoff).
StormlRoad runoff contains pesticides, fertilizers etc.-you
don't need to be an environmental scientist to realize this!
In my research on wetlands that includes pamphlets from
the NYS DEC, I have come to understand that my property
is a wetland in that it should serve as a buffer for Lily pond
across the street. While my property becomes inundated
with water during storms, the water drains extremely
rapidly. It works very well for the Highway Department. It
seems that this area has been "preserved" by the Trustees
for the exclusive use of the Highway Department and not
because it is environmentally sensitive.
Storm water drainage needs to be addressed in this area. In
the last three years many new homes have been build up-
land from my property with no thought to storm drainage.
It is not the responsibility of a private property owner to
bare the burden of storm runoff for the rest of the area
residents.
I live in constant fear that my foundation my home will be
undermined by a rising water table. I live with the
frustration that most of my land has become unsafe for
plants, animals and humans.
Will you please help me. I am weary from writing letters,
telephoning and e-mailing. I have spoken to Mr. Harris at
great length, as well as Mr. McMahon and Mr. Horton. It
seems that all are sympathetic to my situation but to date I
have no assurance that anything will be done to remedy this
situation.
I suggest a meeting of Planning Board Members, Mr.
Harris, Mr. McMahon and myself in an effort to discuss
possible solutions to this matter. Thank you in advance for

Dear Mr. Horton:
I purchased a piece of property that I was led to believe, due to the
fact that the former owner had to acquire a "wetlands" permit from the Town
Board of Trustees, was under the jurisdiction and "protection" ofthe Board
of Trustees. I also have a survey that came with the land that shows an area
that was flagged by the DEe in 1997 as having certain species of plants
apparently in need of "protection".
At that time; I had absolutely no idea that the land I purchased was in
actuality a drainage ditch- whereby the Town Highway Department digs
trenches when it feels necessary, grades Horton Lane and Soundview Ave.
to make even better use of the property for drainage
I have been in contact frequently since purchasing this property with
Mr. Harris ofthe Highway Dept. He seems to be the only one in the Town
government who understands that this situation is not right or fair.
On April 14, 2004 I spoke with Mrs. Finnigan the Town Attorney and
offered the town the opportunity to purchase a portion of the land to make
better use of it. It was my hope that a drainage/filtering system could be
installed and plants replaced that would be beneficial to the health of the
creek across the street. At present over % of my land is a filthy stinking mess
of rotting carcasses of trees that have been standing for 30 or 40 or 50 years
-poisoned or undermined by road and stormwater runoff. Many more are on
their way with roots heaving out of the ground -trunks leaning precariously.
It is dangerous in many other respects as well. A tremendous tree
that came down this past December is leaning on two smaller trees that are
ready to give way at any moment, I have been told by the Trustees not to
touch this tree. Several of my neighbors and I are concerned that children
playing in the woods may get killed when the tree does go all the way down.
The trench that the Highway Department has dug on Soundview
Avenue into my land is haphazard with large chunks of asphalt continually
breaking off. It is unsafe fur walkers, joggers and bikers. The constant
buildup of sand and debris is also a continual slippery danger to all.
The situation on Horton's Lane is of grievous concern as well. While
there is an extensive storm drain with many holding tanks, as I am told by
one of the highway men who worked to install it, located across the street
from my home; the storm water passes by it and drains into my property
only 20 feet from my foundation. This water sits for many many days after
rainstorms and I reasonable believe the water table is rising rapidly. Every
time it rains I worry that my foundation, my home, is in jeopardy.
I know the top priority of the Highway Department is to keep the
roads safe for its citizens. As an individual property owner I am not willing
to accept the burden that has been placed on my land to benefit the public at
large. The Highway Department is going to have to find somewhere else to
direct the water.
In conclusion, the storm water runoff will only continue to worsen as
the few vacant lots in the area are developed. In the three years since I
purchased my lot, many homes have been built up hill from me on
Soundview Ave. There are no storm drains on Soundview Ave. from
Lighthouse Rd. to Kenny's Rd. and I believe this is neglect on the part of our
Town Government.

Dear Mr. Harris:
I am writing with regard to a number of issues regarding the above property.
I spoke to you briefly shortly after you took your position as superintendent
and you assured me you would look into solving some ofthese issues. I
have telephoned your office on a number of occasions since and left
messages and never received a return call. I have also stopped in to your
office on a number of occasions and spoke to your secretary regarding these
issues and never received any response. Perhaps this letter will receive a few
moments of your attention
As you mayor may not know this property has had a problematic history
with your department beginning with the former owner Mr. Norman
Wamback. It seems your department installed a drainage pipe on the
property without permission from Mr. Wamback. Mr. Wamback had to hire
an attorney to get the pipe removed. The pipe was removed before I took
possession of the property.
As you mayor may not know this property is under the protection and
jurisdiction of the Town Trustees. I believe that your department has been
and continues to violate this Protection while I have done everything in my
power to hold to the restrictions set forth by the Trustees in an effort to
lessen the impact on the land during my building project.
When I first telephoned your office I was calling your attention to the rain
water runoff from Soundview Ave.; a situation that at the time I thought was
caused by the Suffolk County Water Authority company when they installed
water main pipelines (they removed the fill and topsoil and replaced it with
mostly sand in their installation process which 1 understand is quite
common). Just after the pipeline installation 1 noticed a deep (and dangerous
for walkers or joggers) gouge on Soundview Ave. 1 called sew A and they
said they would send out a crew to beef up the area they had disturbed. 1
received a call back from sew A the next day-they stated that the Southold
Highway Dept. dug the gouge and were told by Southold Highway Dept. to
leave it alone.
The gouge has gotten quite large. The road runoff accumulation is out of
control. It is killing all of the flora and fauna that the Trustees and myself are
trying to protect. A short time ago this land was heavily wooded -- now it is
mostly dead-a swirl of the rotting carcasses of many many tremendous
trees --and many more trees are leaning with roots heaving out of the ground
soon to go to their deaths.
There is another issue which has only recently come to my attention. A
neighbor who lives on Hortons Lane mentioned it a year and a half ago to
me but 1 thought he was talking about the situation on Soundview.
Apparently when sew A put in the water mains on Hortons Lane, Hortons
was then regraded. It was regraded so that the road runoff from Hortons
Lane makes a perfect left hand turn into my property (I have observed this
during heavy downpours and so have many of my neighbors on Hortons
Lane) bypassing entirely the only storm drain in the immediate area.
The road runoff coming down Hortons Lane is now of greater concern to me
than the runoff from Soundview. The area immediately affected by the
runoff is dangerously close to my new home. Thanks to the Trustees the
home was built on the highest ground possible and 1 cautiously laid the
foundation several feet above the water table and 1 have spent close to
$40,000 on fill and grading but 1 fear that the water table has now risen
permanently with the constant flow of runoff directed toward my property.
Obviously geology is an important factor with this situation. This property
sits at a low point on Soundview Avenue and a low point on Hortons Lane.
Apparently, the Highway Dept. has been using this property for years at its
own discretion and has neglected this area with regard to storm drains but
my home now exists which 1 have built with all of my life savings and loans.
1 need immediate relief from this situation, as 1 fear my foundation will be
undermined due to the continued neglect ofthe Highway department.
There are a few storm drains on Hortons Lane most are at the upper half of
the road and as I mentioned above there is one storm drain at the bottom but
it is of little use since the recent grading.
I have surveyed Soundview Avenue from Lighthouse road to Kennys road in
search of storm drains. There are 2 actual storm drains very close to
Lighthouse road-- which is quite absurd given the geology ofthe area. There
is a sink hole with a metal pipe going into the pond directly across the street
from my gouge that is working to collect the balance ofthe runoff-that is
not going into my property. The grading of Soundview in this area seems to
factor into the situation considerably.
Also, weather is an important factor in the situation-we have had an
extraordinary amount of rain and snow in the last few years. We are having
the worst case scenario road runoff conditions. I believe the Highway Dept.
needs to be prepared for and needs to address worst case scenario
conditions!! Sending out the street sweeper after heavy rains is not a
solution.
I would like to make an appointment with you to have you to look at my
land survey. It shows the area of collected rain water as it was in 1997 when
the survey was taken. If you compare it to the situation as it stands now
perhaps you will understand my fear and frustration. I feel that I have been
very patient with your department. When I spoke to you over a year and a
half ago we discussed the possibility of putting in storm drains in this area-
we need them desperately.
I would also like to discuss with you the need for grading Hortons lane--at
least the bottom half to its former condition before sew A water mains or to
perhaps a more logical condition. It is a well know fact that contained in
road run off is a myriad of toxins from lawn fertilizers and pesticides to
vineyard fungicides to the combustion engine toxins of automobiles. These
are all entering this protected land carelessly unchecked. The grading of
Soundview in this area I now question as I see the impact the changes on
Horton's grading has had to my property's detriment.
If Storm drains are not the answer in this area it is my urgent request to
know what can be done to address the damage that is rapidly being caused to
an ecologically delicate area and hazard to my foundation. An area that
serves to filter the pond across the street. The Department of Environmental
Conservation has flagged certain species of endangered plants in 1997 to
existing on this site nearly 100 feet from the foot of my foundation.
Last summer, when we did have a few dry weeks, you could freely walk into
that area, as there is nothing alive-just dead brown plant matter. The first
summer I tried to get into that area in 200 I it was impossible without cutting
shears, the vines and plants were so thick and lush; and there were so many
more large oaks and chestnuts for the vines to wrap around-- that had been
growing for 40 or50 or 60 years.
My attorney is aware of a similar condition elsewhere in the town of
Southold where engineers solved such a problem area. I know these
situations can be and have been addressed and solved in Southold.
