Dear Mr. Cron:
The following action was taken by the Southold Town Planning
Board, Monday, August 4, 1986.
RESOLVED that whereas a formal application for the approval
of a subdivision plat entitled "Edward D. Dart" located at
Southold, was submitted to the Planning Board on May 22, 1984
and the filing fee of $10,0 was paid on May 23, 1984,and,
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on Monday, July
14, 1986 at 8:00 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision plat
and application,
NOW, therefore, be it RESOLVED that the application of Edward
D. Dart for approval of said subdivision plat prepared by Rod
Van Tuyl dated as last amended March 27, 1986 be approved
and the Chairman be authorized to endorse approval on said
subdivision plat, subject to the following conditions within
six months from the date of this resolution:
1. No lot shall be subdivided or its lot lines changed
in any manner at any future date unless authorized by the Town
of Southold Planning Board.
2. Since this subdivisionhas resulted in the subdivision
of the original tract into five lots the map of the subdivision

shall be filed in the office of the County Clerk.
3. The existing building shall either be removed or relocated
and made conforming to the zoning requirements of the Town
of Southold.
4 The access to the property (curb cuts) and the 25 foot
access easement shall be created as proposed subject to the
approval of Suffolk County Department of Public Works.
5. No driveway or entrance road on Railroad-Youngs Avenue
shall be located within fifty (50) feet of the northerly end
of the short radius curve connecting the northerly side of
the right-of-way of Middle Road with the westerly side of the
~ight-of-way of Railroad - Youngs Avenue.
6. Ail stormwater runoff resulting from the development
and improvement of this subdivision or any of its lots shall
be retained on the site by adequate drainage structures so
that it will no flow out on tothe right-of-way of Middle Road.
7. Conditions 1,4,5, and 6 shall be filed as covenants and
restrictions in the office of the County Clerk on or prior
to the granting of approval of this subdivision.
8. The covenants and restrictions previously submitted
to the Planning Board office and approved by the Town Attorney
shall be filed in the office of the County Clerk. Copy enclosed.
These covenants and restriction were regarding the disposition
of the building, on the premises.
Upon receipt of notice that the above conditions have been
met, the Chairman will endorse the surveys.

subdivision consisting of four (4) single and separate lots,
as approved by the Southold Town Planning

successors or assigns, the steel building, as it now exists,
partly on Lot No. 3 and partly on Lot No. 4, on the minor sub-
division map above described, shall remain in its present loca-

2. That the owner, EDWARD D. DART, his successors or
assigns, shall have the right to do any of the following:
(a) Totally remove said building from the
premises;
(b) Relocate said building entirely on Lot
No. 3;

3. That in the event the owner, EDWARD D. DART, his
successors or assigns,elects to have the steel building remain

Please let this confirm the following action taken by
the Southold Town Planning Board, Monday, October 20, 1986.
RESOLVED that the Southold Town Planning Board override
item no. 3 of the resolution of the Suffolk County Planning
Commission with regard to the minor subdivision of Edward
D. Dart located at Southold and amend the Board resolution
of August 3, 1986 to also delete condition no. 3, all in
accordance with the correspondence from the attorney for
the applicant dated September 25, 1986.
When all the other conditions and requirements as per
the Board resolution of August 3 have been met, the Chairman
will endorse the surveys.

Dear Mr. Orlowski:
I have now had the opportunity to review the contents of
your letter dated August 5, 1986 relative to the final approval
of the above captioned minor subdivision.
A review of all of the terms and conditions set forth in
your letter would indicate that a problem is posed by item 93,
which obviously must be an error, in light of the agreed upon
covenants and restrictions which had been heretofore approved
by the Board and the Town Attorney, with respect to the
building which is situated on the subdivision premises. The
condition set forth by you in item #3 is clearly contrary to the
condition set forth in item 98 and for which covenants and re-
strictions must be filed of record.
In the light of the foregoing, I would respectfully re-
quest that the Board, at its next meeting, rescind item 43 of
the conditions imposed in its Resolution of Monday, August 4,
1986. As soon as we are in receipt of a copy of the Board's
Resolution rescinding said item #3, we shall immediately pro-
ceed to fulfill all of the other conditions and requirements
set forth in your Resolution.

tion and reply.

This instant date we are forwarding the original of each of the enclosed
Covenants and Restrictions for recordation in the Suffolk County Clerk's
Office, with regard to the captioned minor subdivision~
We request that the Board reconsider the requirement of Item #2 in its
Resolution dated August 4, 1986, in light of the delay and expense that
it will cause Mr. Dart in order to have the subdivision map filed in the
Suffolk County Clerk's Office. In lieu thereof, we would ask that the
Board override this requirement and proceed with the filing of the minor
subdivision map in the Southold Town Clerk's Office.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Edward D. Dart located at Southold
is for 4 lots on 3.634 acres, tax map no. 1000-55-1-10
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely tO occur should the project
be implemented as planned.
Because there ihave been no comments or objections from
Department of iEnvironmental Conservation in the alott~d
time, it is assumed that there are no obejctions from
that department..
The Suffolk County Department of Health Services has
no objection to our designation of lead agency status.
The are conditionally in agreement with our initial
determination. There is no record of an application to
that department. It appears that the project can be
served by individual subsurface sewage disposal and
a public water supply system. The Project appears to
meet the department requirements regarding lot size, a
subdivision application is required under Article 6.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

Dear Mr. Orlowski:
After our last meeting on June 10, 1985 and pursuant to
your request, I discussed the proposed Declaration of Covenants
and Restrictions with Mr. Dart, relative to any further revision
with respect to the location of the steel building shown on the
approved sketch plan map.
You can appreciate, I am sure, that a great deal of con-
sideration had been given to this matter prior to the drafting
of the Covenants and Restrictions and the submission thereof to
the Town Attorney for his approval. At this time it is impos-
sible for Mr. Dart to make a firm determination as to whether
a relocation of the building could be effectively made with
respect to Lot No. 3 or Lot No. 4. The Covenants and Restric-
tions were drafted and executed by Mr. Dart with that particular
thought in mind.
In the circumstances, Mr. Dart wishes to retain the op-
tions set forth in the executed Covenants and Restrictions, as
heretofore approved by the Town Attorney.
I trust that this will be satisfactory with the Board
and, if so, I would request that the matter be set down for a
final public hearing on the approval of the minor subdivision
map.

The Health Department's primary environmental concern pertaining
to development is that the applicant comply with the requirements of the
Suffolk County Sanitary Code especially Article ¥ and VI, and relevant
construction standards for water supply and sanitary sewage disposal.
These considerations are to be reviewed completely at the time of
application. Full consideration in placement of water supply wells
and disposal systems is given to state and town wetland requirements.
The Health Department maintains jurisdiction over final location of
disposal and well systems and the applicant should not undertake to
construct any water supply or disposal system without Health Department
approval.
Other portions of the Suffolk County Sanitary Code also apply to
com~nercial development such as Article XII. The Lead Agency is requested
to forward a copy of this form to the applicant with its findings.
Further comment may be provided upon completion of the application

The Suffolk County Planning Commission at its regular maettng on July 3,
1985, reviewed the proposed subdivision plat entitled, '74inor Subdivision -
Edward D. Dart", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to approve said map sub-
ject to the following seven conditions deemed necessary to help preserve the
traffic safety and carrying capacity of Middle Road, a county road.
No lot shall be subdivided or its lot lines changed in any manner at
any future date unless authorized by the Town of Southold Planning
Board.
Since this subdivision has resulted in the subdivision of the orig-
inal tract into five lots the map of the subdivision shall be filed
in the office of the County Clerk.
3. The existing building shall either be removed or relocated and made
conforming to the zoning requirements of the Town of Southold.
4. The access to the property (curb cuts) and the 25 foot access ease-
ment shall be created as proposed ~ubject to the approval of Suffolk
County Department of Public Works.
5. No driveway or entrance road on Railroad-Youngs Avenue shall be lo-
cated within fifty (50) feet of the northerly end of the short radius
curve connecting the northerly side of the right-of-way of Middle
Road with the westerly side of the right-of-way of Railroad-Youngs
Avenue.
Ail stormwater runoff resulting from the development and improvement
of this subdivision or any of its lots shall be retained on the site
by adequate drainage structures so that it will not flow out onto the
right-of-way of Middle Road.

Conditions 1,. 4, 5 and 6 shall be filed as covenants and restric-
tions in the office of the County Clerk on or prior to the granting
of approval to this subdivision.
The final map shall bear the following note: A Declaration of
Covenants and Restrictions has been filed in the Suffolk County
Clerkts office which affects lots in this subdivision.
These covenants and restrictions can be modified only at the request
of the then owner of the premises with the approval of a majority
plus one of the Town Board of the Town of Southold after a public
hearing. Adjoining property owners shall be entitled to notice of
such public hearing but their consent to such modification shall not
be required.
The Commission also offers the following comments on the map for your use
and consideration:
It is suggested that before approval is granted to this subdivision
that the subdivider(s) be required to submit this proposal to the
Suffolk County Department of Health Services for review to insure
that the proposed subdivision will meet the requirements and stan-
dards of that agency.
Adequate provision shall be made for properly designed and properly
located handicapped parking spaces. In locating a handicapped
parking space consideration is to be given to the nature of the oc-
cupancy of the building and the probability of a handicapped person
utilizing a specific unit within the building.

You have requested that I advise the Planning Board on the question of
whether it may authorize the relocation of the boundary line between Lots 3
and 4 on the above subdivision which would result in the boundary line
between said lots running through an existing steel building presently
located on Lot No. 3.
I know of no provision which prohibits a lot line running through an
existing building.
In the applicants attorney's letter of December 21, 1984, it was stated that
the applicant would agree to impose conditions on the sale of either lot to
the effect that if Lot No. 3 is sold, the purchaser will take said lot subject
to an easement in favor of Lot No. 4 for the continuance of the building
straddling the lot line. In essence, the owner of Lot No. 4 would have an
easement to maintain the building in its present location even if it
encroaches on Lot No. 3. It is also proposed that if Lot No. 4 is sold, that
the entire building would be part of such sale, the purchaser being given
an easement on Lot No. 3 to maintain such building.
I see nothing wrong with the proposal made by the applicant and would
suggest that perhaps these conditions should be embodied in a declaration
of covenants and restrictions and recorded in the Suffolk County Clerk's
Office.

The last time that this matter was before the Board it was
suggested by the Board that the proposed four-lot minor subdivision
plan be revised so as to increase the area of Lot No. 4. In
seeking to comply with this suggestion, the only way the subdi-
vision could be properly laid out was by running the division line
between Lot No. 3 and Lot No. 4, partially through an existing
steel building on the premises.
In a subsequent conversation with you, presumably after
your consultation with the Town Attorney, it was determiend that
the subdivision could be completed with the division line between
Lot No. 3 and Lot No. 4, running through the steel building on
the premises, with some kind of provision as to its disposition
in the event that aither Lot ~o. 3 or Lot No. 4 was sold by the
applicant at a future date.
After a number of meetings with Mr. Dart, we should like
to submit to the Board the following proposal for a resolution
of the disposition of the building with respect to the division
line that runs through a portion thereof, to wit:
It is proposed that if Lot No. 3 is sold, the purchaser
shall take subject to the building encroaching thereon, subject
to an easement in favor of Lot No. 4 for the purpose of seeking
access to that portion of the building which encroaches on Lot
No. 3 for repairs, maintenance, etc.

In the event that Lot No. 4 should be sold, it is intended
that the entire building would be sold with that lot, together
with the right to maintain its encroachment on Lot No. 3 and an
easement for the purposes indicated with respect to repairs,
maintenance, etc.
Hopefully, the Board will find this a satisfactory reso-
lution of the matter and, if so, upon the Board's advice, we
shall proceed with the final subdivision plan.

in this minor subdivision contain more lot area,
which can be done by a lot line change.
This is suggested for the following reasons:
- It is a corner lot, which should be the larger lot.
- This would provide more area for buffering.
- The increase lot area will result in a safety
factor due to the possible heavy traffic flow
in the future at that intersection.

Dear Mr. Tasker:
We are in receipt of a subdivision for Edward Dart (see map
enclosed), which was part of a previous set-off for the Long
Island Cauliflower Association. This set-off was never
finalized.
As you may remember, there was much discussion regarding
the curb within the set-off and the last correspondence in the
file is to the attorney dated July 6, 1982, (see copy enclosed).
Also enclosed are the minutes from the Planning Board meeting of
June 28, 1982 where it states the Planning Board will consider the set-
off ap~oved with conditions. The conditions ~re never complied
with and the maps were never signed by the Chairman.
The lot has since been purchased by Mr. Dart and the Planning
Board requests your opinion on how to proceed with the application
of Dart.

to the south end of the existing block building on the southeast
corner of the property, or to use the west boundary as initially
proposed by the North Fork Bank. Ms. Wickham stated the block build-
ing was no longer available and the west boundary would result in
poor security for night deposits, etc. The board questioned the neces-
sity of the third drive-in window as they felt it was seldom used for
transactions. Mr. Mullen reported being on site for a five minute
period (2:05 - 2:10) and counting 62 cars traveling east and west.
The proposed bankinq hours would be 8:30-4:30 Monday - Thursday and
8:00 p.m. on Fridays. The board will field inspect this property
prior to the next meeting.
Glover/Ressler - Abigail Wickham was asked about a right-of way on
the proposed set-off. She stated there was a traveled dirt road on
the property designated on the map as W.C. Bolenius and access could
be provided to the property to be ~onveyed to Ressler. The board
requested that the maps be amended to show the right-of-way and the
application to be revised to read 5.778 acres rather than the 23.5
acres being set off.
Moebius Associates - Gertrude Ally appeared before the board to dis-
cuss the revised maps as Richard Lark, Esq. was out of town. The
board advised her that the maps did not reflect those changes requested
