The following actions were taken by the Southold Town Planning
Board at a regular meeting held January 29, 1980.
RESOLVED to accept the recommendations and comments of John
W. Davis, Planning Board Inspector, in Report No. 112 dated
January 10, 1980 regarding the minor subdivision of George L.
Penny IV.
WHEREAS, a formal application for the approval of a subdivision
plat, entitled Minor Subdivision of George L. Penny IV was submitted
to the Planning Board on October 16, 1979 and an application fee
of $30 was paid on October 16, 1979, and
WHEREAS, a public hearing was held on the said subdivision
application and Plat at the Town Hall in S6uthold, New York, on
December 3, 1979, at 7:30 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision Plat and
application,
Now, therefore, be it RESOLVED that the application of George
L. Penny IV for approval of said subdivision plat prepared by
Roderick Van Tuyl, P.C., and dated December 26, 1979, be approved
and the chairman be authorized to endorse approval on said
subdivision plat.

Road in 25 ft. width R.O.W.
COMNENTS:
I made an inspection of the R.O.W. area with Mr. Penny on January lOth. From the
map con tours shown, this road will have to be constructed with a high rate of
grade to reach Lot No. 1. Visually the contours appear to be reasonably correct.
The subsoil in this subdivision probably has a high percentage of clay and loam
as noticed in other nearby properties.
I recommend a pavement road section 12 ft. wide made up of 6" of bankrun with high
gravel content (Say 30%) and a 2" top course of stone blend mix. Even this type of
construction on steep grades is subject to erosion from heavy rain and will require
maintenance. This roadway will have to be one way due to the R.O.W. width and
necessary side slope excavation. It will also be difficult to use in winter
wea ther.
Attached is a workup of two profiles. I would prefer the 10% profile throughout
as the RED profile on the 10% section places too much fill in Lot No. 1.
1";1'. Penny asked if the roadway construction could be deferred until Lot No.1 was
sold. T~less there is some restriction otherwise, I can see no objection.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617,Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that Southold Town Planning Board as lead agency
for the action described below has determined that the project
will not have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of George L. Penny IV is a three-lot
residential subdivision of 3.901 acres located at Southold.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
The Department of Environmental Conservation indicates
that since the property is further than 300 feet from
tidal wetlands and further than 100 feet from the nearest
freshwater wetland over 12.4 acres, it is beyond New York
State Department of Environmental Conservation jurisdiction.
The Suffolk County Department of Health Services has
indicated that an adequate, potable water supply.should
be available and provided the sewage systems are kept
over 100 feet from wetlands and surface waters, there
is no problem anticipated.
The project will meet all requirements of the Code of
the Town of Southold Subdivision of Land Regulations.

ment with this at an earlier meeting. Upon receipt of these maps

The following actions were taken by the Southold Town Planning
Board at a regular meeting held October 29, 1979.
RESOLVED that the Southold Town Planning Board declare itself
lead agency in regard to the State Environmental Quality Review Act
in the matter of the minor subdivision of property of George L.
Penny IV.
RESOLVED to grant approval to the sketch map of the minor
subdivision of property of George L. Penny IV dated October 15,
1979 subject to the following:
1. Monument be placed on the southeasterly corner of the
property.
2. Access to Lot 1 be shown as a 25 foot right-of-way over
Lot 2 rather than a flag lot.
