Dear Mr. Tasker:
We are in receipt of a subdivision for Edward Dart (see map
enclosed), which was part of a previous set-off for the Long
Island Cauliflower Association. This set-off was never
finalized.
As you may remember, there was much discussion regarding
the curb within the set-off and the last correspondence in the
file is to the attorney dated July 6, 1982, (see copy enclosed).
Also enclosed are the minutes from the Planning Board meeting of
June 28, 1982 where it states the Planning Board will consider the set-
off aplToved with conditions. The conditions 1Iere never complied
with and the maps were never signed by the Chairman.

Please let this confirm your meeting with the Planning Board,
Monday, June 28 regarding the above captioned proposal.
It was the concensus of the board that in order to qualify
for approval the curb cut in question is to be located 250
feet from the southwest corner of the property with a con-
dition that if at any future time this property is to be sub-
divided, the Planning Board will examine a single access on
interior design for circulation of parking.
Please advise this board how you wish to proceed with this
proposal.

to the south end of the existing block building on the southeast
corner of the property, or to use the west boundary as initially
proposed by the North Fork Bank. Ms. Wickham stated the block build-
ing was no longer available and the west boundary would result in
poor security for night deposits, etc. The board questioned the neces-
sity of the third drive-in window as they felt it was seldom used for
transactions. Mr. Mullen reported being on site for a five minute
period (2:05 - 2:10) and counting 62 cars traveling east and west.
The proposed banking hours would be 8:30-4:30 Monday - Thursday and
8:00 p.m. on Fridays. The board will field inspect this property
prior to the next meeting.

Glover/Ressler - Abigail Wickham was asked about a right-of way on
the proposed set-off. She stated there was a traveled dirt road on
the property designated on the map as W.C. Bolenius and access could
be provided to the property to be conveyed to Ressler. The board
requested that the maps be amended to show the right-of-way and the
application to be revised to read 5.778 acres rather than the 23.5
acres being set off.

Moebius Associates - Gertrude Ally appeared before the board to dis-
cuss the revised maps as Richard Lark, Esq. was out of town. The
board advised her that the maps did not reflect those changes requested
by the board. The map was to be renamed as Section I or Section II
and to eliminate the flag lot configuration on lot number two. Ms.
Ally said to subdivide the property in another fashion would create
a problem with a garden located on this parcel. The board advised her
to see Mr. Lark as this matter was discussed with him at a previous
meeting. The board will review this proposal when revised maps are
submitted.

The Suffolk County Planning Commission at its regular meeting on May 5,
1982, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Long Island Cauliflower Assn., Inc.", referred to it pursuant to Section 1333
of the Suffolk County Charter. After due study and deliberation it resolved
to approve said map subject to the following five conditions deemed necessary
to help preserve the traffic safety and carrying capacity of Middle Road, a
coun ty road:
1. No lot shall be subdivided or its lot lines changed in any manner at
any future date unless authorized by the Southold Town Planning
Board.
2. All driveways on Middle Road shall make an angle of at least 700 and
preferably 900 with the road.
3. Each lot having frontage on Middle Road shall have a turnaround pro-
vision, such as a T-shaped shunt, so that a vehicle leaving a lot
will not have to back out into the traffic stream on the road.
4. All stormwater runoff resulting from the development and improvement
of this subdivision or any of its lots shall be retained on the site
by adequate drainage structures so that it will not flow out into
the right-of-way of Middle Road.
5. The above conditions shall be filed as covenants and restrictions in
the office of the County Clerk on or prior to the granting of ap-
proval to this subdivision.

Dear Henry:
I have examined the Planning Board records and the May 20. 1982 letter from
Pierre G. Lundberg relative to the above matter.
You have asked that I give you an opinion relative to Mr. Luncberg's letter. I
agree with Mr. Lundberg's position that to require the recording of covenants
will impair the marketability of title to the property in question. I am. therefore.
of the opinion that the conditions should be set forth in the Planning Board's
resolution. but should not be recorded as covenants.
I recently attended a New York State Bar Association Seminar on Zoning and
Planning at which this same question was discussed. It was the view of the
municipal attorneys present that the better practice is not to require that con-
ditions be recorded as covenants.
There is another aspect of this type of Planning Board approval which I think
requires clarification. It would appear that the Long Island Cauliflower Associa-
tion applied to the Planning Board to set-off the plot in question pursuant to
Section A 106-13 of the Subdivision Regulations. Under such procedure. the
Planning Board. in authorizing the set-off. determines that the same does not
constitute a "Subdivision".
Section 1333 of the Suffolk County Charter requires that the Planning Board
refer "Subdivision Plats" to the County Planning Commission for its report thereon.

Since a set-off pursuant to Section A 106-13 of the Planning Board Regulations does
not constitute a "Subdivision", I do not believe that the referral to the Suffolk
County Planning Commission is required. As you will recall, when Section A 106-13
was added to the regulations in 1980, its purpose was to provide an inexpensive and
expeditious method to set-off a single lot without requiring the owner to follow the
expensive and time consuming procedures required for the approval of a subdivision
map.

Gentlemen:
We are in receipt of a copy of the recommendations to you
of the Suffolk County Planning Commission in respect to this
application. Initially we made this application and you granted
it, imposing a condition on access. Thereafter the contract vendee,
through his attorneys Wickham, Wickham and Bressler, Esqs., applied
to you for a modification of that condition, and you rendered a
determination with different provisions as to access.
We have been advised by Mrs. Long that, at that time, you
realized Middle Road was a county road and your resolution was
subject to review by the County Planning Commission. Although we
have never seen an amended resolution as to the first application, we
were advised by Mrs. Long that you amended your resolution to provide
that the first application was likewise subject to review by the
Suffolk County Planning Commission.
The maps submitted did not comply with the Suffolk County
Planning Commission's rules and regulations, and we thereafter
procured appropriate maps from Mr. Van Tuyl for submission to the
County Planning Commission on your first determination only, since
we had not sought any modification thereof.
We take no position as to the merits of the Suffolk County
Planning Commission's recommendations to you, except to the extent
that they require certain conditions to be filed as covenants with
the Suffolk County Clerk's Office. It is our opinion that this is
beyond the power of the Suffolk County Planning Commission and,
pursuant to the provisions of the Suffolk County Charter, any
resolution you pass should override those recommendations.

We have previously taken this same position with the
Planning Board of the Town of Riverhead in respect to the same
client, and the Town of Riverhead Planning Board has concurred
with us and only imposed a condition that we covenant not to
further subdivide without application to the Planning Board.
In this case we have an existing contract of sale which
is subject to the ordinances of the Town of Southold. We,
therefore, do not object to covenanting that the property will
not be further subdivided without further application to your
Planning Board since this is the law, and we must comply with
the law. We most strenuously object to embodying any other
recommendations of the Suffolk County Planning Commission into a
covenant to be filed with the County Clerk's Office since they
clearly affect the marketability of our title. Our existing
contract of sale makes no provision that the purchaser must take
title subject to such restrictive covenants.
It may not be viewed by some of you that there is any
difference in passing a resolution which contains conditions in
it with possible affect on a certificate of occupancy as against
requiring the applicant to place restrictive covenants on record
and thereby impair marketability of title. We respectfully
submit to you that there is a very large difference. You may wish
to consult with your own attorney rather than to take our opinion
if you are disposed to follow the Suffolk County Planning Com-
mission's recommendations as a whole.

We are sorry we cannot accept this letter as part of the referral of the pro-

I represent Mr. Edward Dart, the contract vendee of the
Long Island Cauliflower Association property on Route 48 in
Southold. You were sent a subdivision referral from the Southold
Town Planning Board by letter dated April 2, 1982.
The basis for the request that the curb cut be 308 feet
from the southwest corner of the property is to enable the ap-
plicant to subdivide two lots at the westerly side of the
property, and to provide for a central driveway to the
remaindp-r of the property. The lots would each have the
required 150 foot frontage and requirp-d area. If the driveway
is closer than 308 feet from the corner, at least one of those
lots would be encumbered by easements for the driveway, making
sale and dp-velopment difficult. If the property is not subdivided,
the proposed curb cut could provide the central access point
to the property.
The proposp-d curb cut location would be approximately 300
feet from the monument at the westerly arc of the intersection
and would be approximately 400 feet from the point formed by
the intersection of the westerly side of Young's Avenue and
the northerly side of Route 48. Thus, it would be a considerable
distance from the intersection.

Gentlemen:
Enclosed herewith is a tentative application to you for a
minor subdivision of property owned by the Long Island Cauliflower
Association, situate at County Road 48, Southold, New York.
Exhibit B attached thereto is a survey of Roderick Van Tuyl,
P.C., dated October 28, 1981. The same represents a parcel under
contract of sale between Long Island Cauliflower Association as
Seller and Edward D. Dart as Purchaser. A copy of the proposed
deed to Mr. Dart is attached thereto as Exhibit D.
Exhibit C is an older survey of O~to W. Van Tuyl, dated
November 3D, 1949, showing other premises of Long Island Cauliflower
Association which are vacant but abut in the southwest corner the
property proposed to be conveyed. Marked on Exhibit C are the
sources of title of Long Island Cauliflower Association by virtue
of four separate deeds. Copies of these deeds, showing the des-
cription only, are attached as Exhibit A.
It should be noted that title to the parcel along County
Road 48,denominated on Exhibit C as "Formerly Grattan", derives from
a deed to the Association from George H. Kaelin which was dated and
acknowledged April 3, 1947 and, for some unknown reason, remained
unrecorded until a search was made by the Association of its office
for the deeds pertaining to this transaction. This deed will be
recorded forthwith.

The premises not being sold to Mr. Dart and being retained
by the Long Island Cauliflower Association exceed two acres of
land, all of which is unimproved. The depths and lengths are
shown on Exhibit C. At no time in the negotiations between the
parties was it ever contemplated that Dart would acquire more than
that called for under the present proposed deed, and at all times
the Association intended to retain the intervening property between
Horton Avenue and that to be sold.
Pursuant to your applicable definition of subdivision, we
ask that, in your discretion, you find that the proposed conveyance
by the Association to Dart does not constitute a minor subdivision
requiring further approval by your Board.
