The following took place at a meeting of the Southold Town Planning Board on Monday, July
16, 2001:
WHEREAS, this minor subdivision received conditional final approval from the Planning Board
on June 11, 2001; and
WHEREAS, all of the conditions have been met; be it therefore
RESOLVED, that the Southold Town Planning Board authorize the Chairman to endorse the
final surveys dated April 24, 2001.
Enclosed please find a copy of the map Which was endorsed by the Chairman. The mylar
maps, which were also endorsed by the Chairman, must be picked up at this office and filed in
the Office of the County Clerk. Any plat not so filed or recorded within sixty (60) days of the
date of final approval shall become null and void.

The following took place at a meeting of the Southold Town Planning Board on Monday,
June 11, 2001:
The final public hearing was closed.
The following resolution was adopted:
WHEREAS, this proposed subdivision is for 4 lots on 10.651 acres on Lighthouse Road,
north of Old North Road in Southold; and
WHEREAS, there will be no further subdivision of this property; and
WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental
Quality Review Act, (Article 8), Part 617, declared itself lead agency, made a
determination of non-significance, and granted a Negative Declaration on March 7,
2000; and
WHEREAS, a final public hearing was closed on said subdivision application at the
Town Hall, Southold, New York on June 11, 2001; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold
have been met; be it therefore

RESOLVED, that the Southold Town Planning Board grant conditional final approval on
the maps, dated April 24, 2001, subject to the fulfillment of the following conditions.
These conditions must be met within six (6) months of the resolution:
1. A Declaration of Covenants and Restrictions must be filed preventing further
subdivision, and proof of filing must be submitted to the Planning Board.
2. The park and playground fee of $20,000 must be paid.
3. Two mylars with the Health Dept. approval stamp must be submitted.
4. All of the maps and mylars must be amended to show only one set of
setbacks. The setbacks shown with the building envelopes are correct, the
ones written on the bottom are incorrect and should be removed.

to restrict the use and enjoyment of said PREMISES and has for
such purposes determined to impose on said PREMISES covenants and

held and shall be conveyed subject to the following covenants and

lots on 10.651 acres. The property is located on the west side of Lighthouse Road,
560.66 feet north of Old North Road in Southold. SCTM#1000-54-3-26.1
Does anyone have any comments on this minor subdivision?
Unidentified Person in Audience: Yes, I'd like to read a statement, if I may.
Jean Cochran and the Republican Party are proposing 5 acre zoning to help keep the
North Fork from becoming the Hamptons and avoid over-building on every lot. She has
placed particular attention on land that is zoned Agricultural Conservation. Lighthouse
Road 26, LLC - namely Joe Sawicki - is proposing to develop this 10 acre lot which is
zoned A-C, Agricultural Conservation - exactly the land Jean Cochran is proposing to
save. To indicate to the neighbors on Lighthouse Road that the Planning Board is willing
to finalize this subdivision which consists of a cluster of four houses - Joe Sawicki's
house would be a 5.378 flag lot at the rear of the property and three houses each on
under-sized lots of 1.758 acres - because Mr. Sawicki is willing to give back 60 feet of
Open Space - this simply doesn't wash. The 60 feet of Open Space cannot be seen

from the road and the only person that is affected in a positive way is Joe Sawicki since
this 60 feet acts as a buffer between his house and the three houses on the under-sized
lots that we all get to look at.
We are asking the Planning Board to m-consider and insist that this proposed
subdivision improve the cluster to more reasonable stops. Put the 60 feet of Open
Space in front of all the houses. Move Mr. Sawickrs house to the front and put two
houses on 2 acres, not three houses on 1.758 acres as proposed. We are unhappy
about the over-building on this lot. This would add enormous noise and traffic to our
neighborhood. A minimum of two cars a house is eight cars coming and going from just
that 10 acres.
Although this is not a political issue, those of us who have supported Mr. Sawicki over
the years question the current imbalance between what is encouraged publicly and
what is practiced personally with whatever in mind and mspect for the environment now
in second place. This is a matter of right and wrong. If Mr. Sawicki were standing in our
place, he would have to, in good conscience, take the same position we have taken on
this important land matter. Thank you.
Mr. Odowski: Can I have your name for the m cord?
Unidentified Speaker: Ed Coakley. I might say something else, too. The letter of the law
and spirit of the law in sending out notices about the subdivision and this Planning
Board Meeting am not the same. My driveway is exactly opposite Mr. Sawicki's
driveway; my mailbox is on his property, but I mceived no notice. I just want to make
that point clear. Thank you.
Mr. Turner: In answer to a number of your questions, the mason why you did not
mceive notice is that the notification provisions am set by State Law which says
adjacent property ownem including adjacent property ownem across the street - you do
not actually own any of the property adjacent to the property and that is why you did not
mceive notice.
Mr. Coakley: I did say the spidt of the law and the letter of the law. I undemtand the
issue. It's still not right. I mean, as I said, my mailbox- because of the Postal
m quire merits - are on Joe Sawicki's property.
Mr. Turner: That's something that is set by State Law.
Mr. Coakley: I undem tand. I have a letter from another neighbor who owns a histodc
house and I just want to pm sent it.
Mr. Tumer: To some of the other questions - it's not a political issue hem. Mr. Sawicki
just bought the property probably a few months ago and is not the original applicant
hem.

Mr. Coakley: Right.
Mr. Turner: The 60 feet is not Open Space. It's the front yard setback. When you have a
flag lot, it's taken from the rear of the lot that is flagged behind and not directly from the
road.
Mr. Coakley: O.K.
Mr. Turner: Also, the density is the same as would be allowed under the normal 2 acre
zoning. The reason why those lots are 1.758 acres is just the way it fits on the property
and it's supposed to be a better way than creating four two acre lots.
Mr. Coakley: There, in good conscience, could be no reason that Mr. Sawicki can't take
4-1/4 acres and give ¼ acre back to each of those lots and make them true 2 acre lots.
Each lot is over 10,000 square feet short of 2 acres. That's not, in good conscience,
keeping with the law for the rules of Southold.
Mr. Turner: That is. It's called cluster zoning. Often, we need clustering to create lots
even smaller. A lot of our clusters have lots now as small as 1 acre in a 2 acre zone and
the reason why is to preserve Open Space or limit the impact of development. Now, in
this case, the larger lot in the rear of the parcel was created with a restricted building
envelope. They don't have a building envelope set by the Zoning Code but set by the
Planning Board tO make sure they didn't build too large of a house or take up too much
of the property to preserve some of the Open Space on the parcel.
Mr. Coakley: As I say, respectfully, if any of you ladies or gentlemen lived across the
street, you'd be saying the same thing that I'm saying. Thank you.
Mr. Odowski: Any other comments?
Jane Pottmire: I have a question. I heard a rumor that the development dghts for this
ten acres was sold to the Town for six thousand dollars an acre so that it would not be
built on. Is this true? And if it was, and it was bought back, was the money given back to
the Town?
Mr. Odowski: No, the development rights were never sold on this property. May I have
your name for the record, please?
Jane Pottmire: All dght. JeanPotmire. I was just concerned on an aesthetic value that
the street is going to lose its charm and I think like everybody else we are really
concemed in terms of what is going to happen, especially at the very front of the street -
are they going to maintain the trees that are there? How far back are the houses going
to be set? The aesthetics of the homes themselves - are they going to become these
huge monstrosities that the builders are going to build? Are they going to be completely
out of character with the rest of the street? Is there any information on that?

Mr. Orlowski: We don't control any of that.
Jane Pottmire: Including the tree line?
Craig Turner: Set backs we control but the set backs ...(inaudible).
Mr. Cagqiano: The trees has to stay too. They do show - in the sub-division map they
do show the trees along the street. The reason why is they are not allowed to cut all of
those down otherwise we normally have a street tree requirement in the Town that
requires one tree to be planted every forty feet or depending on different type of trees
and because they show that they are maintaining some of the trees on the property, that
did not have to meet the screen tree requirement.
Jane Pottmire: What is the home, do you know the name of the owners all the way at
the end of Lighthouse and Old North Road - they created a lovely like kind of barrier of
trees. It almost appeared out of respect for the rest of the street so they are really kind
of hidden back. You know that they are there but it is really quite private. I am not quite
understanding I guess what you just said then. Are they - is there a possibility that they
could do that out of respect for the rest of us on the street?
Crai,q Turner: They can. They can maintain the trees to however they want. They do
have to maintain a certain amount but it not quite said exactly how much as long as
meet the Code requirements,
Jane Pottmire: How far back are the homes going to be set?
Craig Turner: We don't know that is up to the building owners. The building envelopes
have been set. On the map we see sixty feet as the minimum set back to the front yard.
Jane Pottmire: Sixty feet. Thanks. Because I think some of the other homes on the
street are about one hundred and fifty feet from the adjoining properties,
Craig Turner: The homeowner would have the option of doing that if they could fit the
house on the lot.
Jane Pottmire: O.K. And then what about the buffer zone between the houses, I guess
themselves, the three in the front? I mean on the beach property line - the one point
seventy five or the two acres. How much buffer will there be between the houses?
Crai.q Tumer: The minimum set back is twenty feet on one side, twenty five feet on the
other side so that's the minimum side yard set back between each lot. Again, a lot of
this all depends on where the person chooses to place the house, how big it is, what
style it is. It's up to the individual that owns it.

Dou.qlas Stares: You had mentioned in a statement that - I believe he did - of this
clustering of houses, you know, if the lots are less than the mandated two acres, that is
a faite compile that it would fit within the framework of the Town?
Mr. Orlowski: The clustering, yes.
Dou.qias Stares: Even though there are sort of a standard set by the Town two acre
minimum, and particularly, with the Town Board now suggesting five acres.
Mr. Orlowski: I am not sure I follow you but -
Dou.qlas Stares: Well, there seems to be a double negative here that I don't quite
understand -if there is a minimum requirement of two acres for agricultural survey.
Mr. Orlowski: Well, the zoning is two acres.
Craig Turner: It is a density; it is not a lot size issue. So, even with the proposed five
acre zoning in a proposed cluster - so that if you have a fifty acre farm you are not going
to have ten five acre lots - you will have ten one acre or ten two acre lots; the majority is
preserved as farmland. That's what most of our subdivisions that say they are cluster
subdivisions - meaning is by making smaller lot sizes to preserve more open space; you
leave more areas that can either be farmed or the trees can't be cut down to preserve
the environmental barriers.
Dou,qlas Staire: Now, as the Planning Board which is appointed by the Town of
Southold, I presume you make a recommendation to the Town - is that correct -
regarding this petition? Do you make a recommendation - yes or no - and if it should
proceed, is there a vadance required or is this the ultimate?
Mr. Odowski: No, this is it.
Dou,qlas Stares: This is it. Interesting. Ok. Thank you.
Pe,q Murray: Hi. My name is Peg Murray and I live on Lighthouse Road. I have for about
twenty-five years and it's changed so much. It's really - you know, we talk all the time
about everybody wants to live out here because it is so beautiful but what is so beautiful
is the space and the beauty is of nature and we don't have art museums and theaters
and, you know, big concert halls and big town hall even. We just have this beauty and I
think we have to hang on to that. I respectfully suggest this to that, you know, putting
three houses on that little bit of land - it's not the houses. Of course, I am sure Mr.
Sawicki has good taste. They will be lovely but it means more orange peels and
garbage. It means more diapers and dirty diapers. It means more carbon dioxide from
the cars. Those are the things that we don't want and that is what you get when you
have a lot of people in one little place. Living there now is quite extraordinary. At least

twice a week I have to take a garbage bag out and go up and down in front of my
property and pick up cigarette things and Chinese food cartons and soda cans. People
just ride up to that lighthouse and throw garbage out on, I guess, all of our property. So,
I am busy being the garbage man and I do that because I care terribly about this
location and how beautiful it is. And you know that museum at the end of the road is
becoming very famous and people come from all over to see it and they have to go up
this road and if they are piling through these Chinese food cartons and the garbage and
the diapers and all that stuff and all these motorcycles, kids running up and down - and
they are not kids they are almost as old as I am - they are tearing up and down the road
and it really loses what we all wanted when we can here and we long to pass on to our
kids. Thanks.
Mr. Orlowski: Any other comments?
Pat Moore: You have not needed me here. Mr. Turner has done a fine job responding
to all the comments and the Board as well but, for the record, I am Patricia Moore. I am
the attorney for the applicant. I do want to clarify that this was originally called the
McGuinnigle Subdivision. Ninety percent of the work has already been completed. We
are now at the final stages where Mr. Sawicki has acquired the property and finishing it
up. So, it is understood that this has been in the works for quite some time. We are
really at the tail end of finishing up the subdivision. The sketch plan, the Health
Department - it's all been completed.
Unidentified Speaker: With all due respect, some of us would not know this since we
were not notified.
Mr. Odowski: This is not a debate. We are just here to gather information. Any other
comments?
Corey Donopda: My name is Corey Donopia. I live on Old North Road. I would just ask
one question to you - do you take into consideration the number of homes that would be
placed additional to what there are ...(inaudible) the nature of this .... (inaudible)
Lighthouse to Old North to Youngs. There is a situation in the intersection of - at the
base, really - of Youngs as it intersects with Old North that is quite a hazard when the
rains come and freezing. I don't know if all these people are aware of that. It will
continuously ...(inaudible) the problem if you increase the traffic. I talked to the
Supervisor and she guarantees there will ...(inaudible) this building and these homes -
the subdivision will be completed as well, otherwise, we are going to have mighty sad
people. More than we have now.
Mr. Orlowski: Any other comments?
Jane Pottmire: I just forgot to add - it is really busy on our street. People just fly down
the street they don't adhere to the speed limit. Since there is going to be a larger
population on the street, they could add possibly more speed limit signs, maybe more
stop signs, Just something to control the traffic because people fly down the street. The

woman - my next door neighbor - her partner's son whose dog got hit on Lighthouse
Road because someone was just careless and going entirely too fast and it happens all
the time. They just fly down the road without any respect or concern for kids, pets,
people. Will that be taken into consideration since there is going to be an increase?
Mr. Orlowski: That's more a question for the Town Board.
Jane Pottmire: Could that be brought up by you to the Town Board?
Mr. Orlowski: You'd have to take that to the Town Board. We just do subdivisions.
Jane Pottmire: Only because that would additionally impact the street.
Mr. Orlowski: Yes.
Jane Pottmire: O.K.

Board Member Richard CagRiano: I'd like to say something. I can sympathize with what
you folks are saying. I feel many times the same things as you do. However, you have
to understand that we are a Board that follows a Code Book and the Code Book is that
thick. And if an applicant comes and meets the requirements of that Code Book, we
don't have a choice but to grant them approval. So, if the applicant has been here and
has met all the requirements as indicated by Mr. Turner, then we really don't have a
choice. The Code Book says such and such, we have to do it if they meet those
requirements. So, although many of the points you bring up are valid, sometimes that
doesn't come into play if the applicant meets all of the requirements as described in the
Code which we're obligated to follow. I know that probably doesn't make you feel any
better but at least it's an explanation of what our job as Planning Board Members is.

As owner of an historic Civil War farm house, built in 1864, and having lived on
the North Fork for around 3o years, I am deeply concerned about anvone
trvine to push thromrh any subdivision on Lighthouse Road - certainly on
anything LESS than the two acre zoning requirement.
Unfortunately, I am unable to attend the meeting on June n% concerning the
above matter, as I must fly to California on family business. This is why I am
writing, so that I may express exactlv how very important I feel this subject to be.
I am ~ in favor of Jean Cochran's plan of five acre zoning on
agricultural/conservation land, for which, I understood (having recently spoken
to the farmer who owned the above lot), this particular parcel was designated.
You must understand, therefore, my shock and horror to hear that the head of the
local Republican party, Joseph Sawicki, is currently in the process of trying to
make 3 long and ~ lots along Lighthouse Road, with his own
constderablv lar~er fla~ lot at the rear. I have wholeheartedly supported Mr
Sawicki, in the past, for his interest in preserving open space and in keeping the
North Fork both rural and beautiful.
How, please, is this preserving beauty and flowing open spaces? It is an
unnecessary and ugly crowding together of houses. Just put the 5 or 4.something
acre parcel along Lighthouse Road, and divide the remaining land into NO IJ~qs
THAN 2 ACRE LOTS at the rear of the property.
I will return within a week, and respectfully request a personal response to this

This is a follow-up letter reiterating our conversation last week. The following items are
needed to complete the subdivision:
1. An authorization letter now that you are involved with the subdivision.
2. A cluster notation should be on the map. We suggest, "This map is a cluster
subdivision designed in accordance with NYS Town Law Section 278 and
Southold Town Code Section 100-180", or similar language. In addition, the
word "Cluster" should appear somewhere in the title.
3. "No lot may be further subdivided" should appear on the map.
4. Covenants and Restrictions should be filed prohibiting further subdivision.
5. The parks and playground fee ($20,000) must be paid.
6. Five paper copies and two mylars with Health Dept. stamps must be
submitted.
Numbers 1-3 & 6 are needed to set the final hearing.

The well contractor contends that the well cannot be deepened for better water due to a
substantial day layer with salt water beneath. Department experience confn-ms the likelihood
of this assessment.
12. Well is 105 ft. deep, groundwater is at 50 ft., screen is 55 ft. into water.
13. Public water is not currently available, but this area is on the town's map of proposed public
water expansion.
14. Applicant seeks a waiver of the requirement to provide a community water system, and
requests that individual water treatment systems be allowed instead.
15. Applicant has agreed to the creation of all necessary covenants for individual water treatment
systems.
Determination
It was a 3 to 0 determination of the Board of Review to grant the request for variance, provided the
applicant creates covenants on all of the lots, in language acceptable to the County Atromey, that
contain the following provisions:
* Connection to public water will be made as soon as it becomes available;
* On-site wells do not meet the depaanenes water quality requirements
and individual treatment systems are required to ensure potable water;
* Individual treatment systems must be maintained by the property owner;
* No further subdivision of properties will be allowed until public water is
available.

Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed, and it
was determined that no significant adverse effects to the environment were likely
to occur should the project be implemented as planned.
Residential development of the site would generally conform to the character of
the area. The site does not appear to contain significant environmental features
that would limit residential development. The proposed project will increase
wastewater generation, garbage generation and water use, in addition to
increasing taxes which would be distributed to the various jurisdictions.
However, these impacts are not considered significant. The site is expected to
increase the number of trips entering and exiting the site, although is not
anticipated to cause a significant impact to the surrounding roadways.
The applicant will have to comply with the requirements of the Suffolk County
Sanitary Code (SCSC) and all relevant standards of water supply and sewage
disposal systems. Design and flow specification, subsurface soil conditions and
site plan details will have to be approved by the Suffolk County Department of
Health Services (SCDHS).

The Town of Southold Planning Board has retained Nelson, Pope & Voorhis, LLC (NP&V) for
consulting services in review of the above referenced subdivision. As currently proposed, the
application involves the subdivision of an approximately 10.651 acre parcel into 4 residential
lots. The site is currently vacant. The eastern portion of the site consists of successional
shrubland vegetation and the western portion of the site is currently used agriculturally. A
roughly 60' buffer of trees lies between these habitat types, and extends the width of the
property. This document analyzes the site and area resources including topography, soils, water,
land use, zoning and transportation and other available information. The site has also been
inspected for environmental/planning constraints. In addition, the full EAF Part I submitted with
the application has been corrected and is attached herein.
Location and Site Overview
The project site is located on the west side of Lighthouse Road Road, 560.66' north of Old North
Road in Southold, Town of Southold, County of Suffolk. The subject property can be more
particularly described as SCTM number 1000-54-03-26.1. The property has approximately
525.00' of road frontage along Lighthouse Road. The project site does not contain any
structures, however the property has previously been disturbed. The eastern portion of the site
consists of successional shrubland vegetation and the western portion of the site is currently used
agriculturally. A 60' buffer of trees lies between these habitat types, and extends the width of

the property. The eastern portion of the site consists of old field vegetation with the western
portion containing active agricultural land. The site does not contain wetlands or significant
geologic features. This review will discuss the proposed project and its potential impact on the
land resources.
Pronosed Project
The proposed project involves the subdivision of a 10.651 acre parcel into 4 residential lots. The
proposed lots have the following sizes: Lot 1 1.758 acres; Lot 2 - 1.758 acres, Lot 3 - 1.758
acres and Lot 4 - 5.378 acres. Lots 1-3 have 170 feet of frontage on Lighthouse Road, with Lot
4 located in the western portion of the site. Access to Lots 1-3 would be provided along
Lighthouse Road, with a proposed 15 foot access way for Lot 4 extending along the southern
property boundary of Lot 3. This information is shown on the 12/17/99 subdivision map by
providing a 60 foot side yard setback for Lot 3, although the Planning Board has indicated that
the proposed access way in this location does not create a second front yard setback within this
lot. Therefore, the side yard setback will be revised to reflect 25 feet.
The Planning Board granted conditional final approval of a subdivision in the 1980's for the
subject property, which reflected four residential lots that all met, or exceeded, the minimum
requirements within the A-C zoning district. As currently proposed, the subdivision application
involves some variances, although the Planning Board has decided to treat the application as a
cluster subdivision. Additionally, the Planning Board has recognized that the site does not
contain sufficient area to contain the required recreation area. Therefore, there is no recreational
area or open space associated with this proposed subdivision.
Land Use and Zoning
The project site is located in an area that contains a mix of residential, aghcultural and
undeveloped vacant land. The dominant land use in the immediate area is predominantly
residential and agricultural, and the proposed residential subdivision is consistent with
surrounding uses. Agricultural land occurs on a portion of the subject property, extending to the
west, northwest and southwest, with residential properties adjacent to the north, south, and along
the east side of Lighthouse Road. As previously stated, the western portion of the site is
currently utilized agriculturally, with the remaining, or eastern portion of the site, consisting of
successional shrubland vegetation.
The site is zoned Agricultural Conservation (A-C) District, which requires a minimum lot size of
80,000 SF, or just slightly less than 2 acres. Therefore, Lots 1-3 within the proposed subdivision
do not meet the required lot size. The building envelopes as shown on the proposed subdivision
map meet all other zoning and dimensional requirements, with the exception of lot frontage
which was reduced from the required 175 feet to 170 feet. Maximum permitted lot coverage
within the A-C zoning district is equivalent to 20% of the lot area, with a livable floor area of
850 s.f. per dwelling. Due to the 1980's conditionally approved subdivision application, the
Planning Board decided that the layout as currently proposed would be considered a cluster
subdivision, which allows for these reductions. Therefore, residential development of the

subdivided property should not require zoning variances, and each lot could be developed in
accordance with the current site zoning under a cluster design.
A-C zoning is located to the east, west, north and south of the site, while R-80 is located farther
to the north. A-C is the predominant zoning district in the immediate area, and a mix of
commercial zoning (ie., B, LB) is located farther to the south with frontage on Middle Road
(C.R. 48). Land use in the general area is predominantly residential and agricultural, and appears
to reflect current zoning regulations.
In summary, with respect to land use, the proposed project is similar to the developments in the
surrounding area and is an allowable use within the A-C zoning district. Furthermore, the Town
Planning Board has required that, as part of the sketch subdivision approval, Covenants and
Restrictions be filed prohibiting further subdivision of the property. The land use and zoning
impacts of the proposed project are expected to be minimal.
Traffic Generation
The proposed use would be expected to increase traffic generation upon full establishment of the
site as compared to existing conditions. The future development of the land is not anticipated to
generate significant additional traffic to the area. Due to the location of the site and
consideration of area roadways, an increase in trip generation at the site would not be expected to
have a significant impact on the area roadways. The site access drive appears adequate and the
horizontal and vertical road curvature allows good sight distance.
Soils and Topography
The site is relatively flat throughout, with all existing slopes between approximately 0-10%. The
property does not contain any significant landforms or geological features. There are three soil
types on the site, which consist of the following: Riverhead sandy loam, 3 to 8% slopes (RdB),
Haven loam, 0 to 2% slopes (HaA) and Haven loam, 2 to 6% slopes (HaB). The Haven Loam
series is described within the Suffolk County Soil Survey as land which is suitable for
development, with good leaching potential. The hazard of erosion hazard is slight on HaA soils,
with an erosion hazard of slight to moderate on HaB soils. The Riverhead series consists of
deep, well-drained moderately coarse textures soils that formed a mantle of sandy loam or fine
sandy loam over thick layers of coarse sand and gravel (Warner, 1975). The soil survey lists the
erosion hazard for RdB as moderate to slight and the main concerns of management are
controlling runoff and erosion and providing adequate moisture for landscaping/agriculture. The
topography and soils on site do not appear to present severe development constraints.
Water Resources
Public water is supplied to the general area by the Suffolk County Water Authority, although the
site itself is not specifically connected to public water. There is a 12" main along the north side
of Old North Road, which terminates at an 8" main extending from the north side of Old North
Road, which services the North Road Well Field and Pump Station, located just west of the

subject property. It is estimated that the proposed project will utilize approximately 1,200
gallons of water per day and each lot will be connected to an on site well.
Sanitary disposal with in the proposed subdivision will be managed by conventional on-site
septic tank-leaching pool systems. In 1978, the Long Island Regional Planning Board published
The Long Island Comprehensive Waste Treatment Management Plan (208 Study). The 208
Study identified eight (8) hydrogeologic zones in Nassau and Suffolk Counties. These zones
were distinguished based upon differences in underlying groundwater flow patterns and water
quality. The subject site is located within SCDHS Groundwater Management Zone VI, which
according to Article VI of the Suffolk County Sanitary Code, has an allowable flow of 600
gallons per day (gpd) per acre in areas served by public water. Therefore, the allowable nitrogen
bearing flow for the site is 5,862 gpd. The sanitary design flow is computed using SCDHS
manual Standards for Approval of Plans and Construction for Sewage Disposal Systems for
Other Than Single Family Residences. The manual establishes the design flow as follows:
Single family dwelling
300 gpd x 4 dwellings
1200 gpd
Therefore, the proposed residential subdivision would conform with Article VI of the Suffolk
County Sanitary Code and would not be expected to adversely affect groundwater quality
provided properly functioning systems are designed and installed.
The elevation of groundwater beneath the subject site is estimated at 4 feet above mean sea level
(msl) according to the 1997 SCDHS water table map. The topographic elevation on site ranges
from approximately 40-55 feet above msl, based on the prepared sketch plan. Therefore, the
minimum depth to groundwater is approximately 36-51 feet. The direction of groundwater flow
is towards the northeast. The depth to groundwater on site is not expected to have significant
constraints on the location of septic systems on the parcel. A standard, three pool septic system
typically requires a minimum depth to groundwater of approximately 9-10 feet to allow adequate
depth for leaching.
SUMMARY
In conclusion, residential development of the site would generally conform to the character of
the area. The site does not appear to contain significant environmental features that would limit
residential development. The proposed project will increase wastewater generation, garbage
generation and water use, in addition to increasing taxes which would be distributed to the
various jurisdictions. The site is expected to increase the number of trips entering and exiting the
site, although is not anticipated to cause a significant impact to the surrounding roadways.
The Planning Board has recommended that covenants and restrictions be placed on the property
to allow no further subdivision of land. Once this is addressed to the satisfaction of the Planning
Board, a Negative Declaration may be appropriate.

Thc follo~ving resolutions were adopted by the Southold Town planning Board at a meeting held on
Monday, January 24, 2000:
BE IT RESOLVED that the Southold Town planmng Board grant sketch approval on the map dated
December 17, 1999, with the following conditions:
A restriction must be placed on Lot Number 4, prohibiting any further subdivision in perpetuity.
This restriction must be included in a Declaration of Covenants and Restrictions for the subdivision,
and must be noted on the subdivision plat.
The building envelope for Lot Number 4 must be revised so that it is in keeping with the size of the
building envelopes for the 2 acre lots within the subdivision. The building envelope should be
designed so that it is half the size of the building envelope shown on the map dated December 17,
1999, and it should he located on the Lighthouse Road side of Lot Number 4.
BE IT FURTHER RESOLVED that the Southold Town Planning Board start the lead agency coordination
prOCess on this unlisted action.
Sketch plan approval is conditional upon submission of final maps within six months of the date of sketch
approval, unless an extension of time is requested by the applicant, and granted by the Planning Board. The
final maps, six (6) paper prints and two (2) mylars must contain a current stamp of Health Department
approval and must be submitted before a final public hearing will be set. The final maps must contain the
revisions noted in the conditional sketch approval in addition to the following:
The proposed building envelope for LOt Number 3 was designed with a front yard setback of 60'
adjacent to the 15' accessway to LOt Number 4. The 15' accessway to LOt Number 4 dOCs not create
a second front yard setback for Lot Number 3. Therefore, the building envelope for Lot Number 3
should be revised to reflect a side yard setback, rather than a front yard setback.

A notation that the subdivision has been designed in accordance with the cluster subdivision
provisions.
As noted in Melissa Spiro's December 14, 1999, correspondence, the plaanmg Board has decided to
allow the trees which am existing within the 60 foot frontyard setback, in lieu of street trees. All
trees which are to remain must be shown on the final subdivision map for the planmng Board's
approval.
The sketch plans have been referred to the Town Engineering Inspector for drainage review, and to the
Southold Fire Department for a recommendation as to whether a firewell is required. You will be notified if
any drainage improvements are required, or if a firewell is required.
Condition Number 1 of the conditional sketch approval requires that a Declaration of Covenants and
Restrictions be filed for the subdivision. Since the Planning Board may require additional covenants upon
review of the final map, it is not necessary to prepare the draft covenants and restrictions at this time. You
will be notified if any additional covenants and restrictions are required.
The planning Board has reviewed the property and has decided that it is inadequate in size for a reservation
of land for park and playground use. Therefore, a cash payment in lieu of land reservation will be required
as per Section A106-38(e) of the Town Code. The mount to be deposited with the Town Board shall be
$8,000.00 (two thousand dollars per vacant lot in the subdivision). Payment is required prior to any final
endorsement of the subdivision.
In the late 1980's the planning Board had before it an application to subdivide the subject property. At that
time the subdivision was designed with 2 lots fronting on Lighthouse Road and with a 25' right-of-way
providing access to 2 interior lots. All lots met, or exceeded, the minimum requirements of the Agricultural-
Conservation Zoning District. The subdivision received conditional final approval, but the conditions of
approval were not met, and the subdivision expired.
The design of the current subdivision, with a flag lot to the interior lot, causes the lot widths of the lots
fronting on Lighthouse Road to be reduced from the required 175' to 170'. The Planning Board reviewed
the layout, and decided to process the subdivision as a cluster subdivision, which allows the reduction in lot
width. The Board's decision was based on the fact that the 1980's subdivision was proof that the
subdivision could be designed with 4 lots all meeting minimum code requirements. Due to this fact, the
Board has decided that it is not necessary for the current application to include a yield map.

As we discussed on the telephone, the Planning Board reviewed the above
mentioned proposal at the November 29, 1999, work session. Please find
the Planning Board's comments listed below.
The three lots with frontage on Lighthouse Road each have a width
of 170 feet. The Code requires a minimum of 175 feet. However, the
Planning Board is aware that the subdivision could be designed in a
different manner with all four lots meeting minimum requirements.
Therefore, the Planning Board will review this subdivision as a
cluster subdivision, allowing the reduction in lot width. A Yield
Plan, with all lots meeting the minimum requirements must be
submitted.
The Planning Board is requiring that the rear property lines of the
lots fronting on Lighthouse Road be revised so that the lot depth is
similar to that of the property to the east (the property known as
SCTM# 1000-54-6-5.1).
The Planning Board has decided to allow the trees which are existing
within the 60 foot frontyard setback, in lieu of street trees. All
trees which are to remain should be shown on the subdivision map
for the Planning Board's approval.
A standard building envelope has been indicated for the 4.6 acre
lot. The Planning Board is requiring that a building envelope, one
to two acres in area, be designed for this lot.

The Planning Board will be requiring that a covenant be placed on
all lots within the subdivision prohibiting any further subdivision
in perpetuity.
6. Lot numbers must be shown for each lot.
Upon receipt of maps showing the above mentioned information, the
application will be scheduled for a sketch plan determination and the
State Environmental Quality Review Act (SEQRA) lead agency coordination
process will be initiated. Please note that there is a $400 environmental
review fee which must be submitted prior to the start of the lead agency
coordination.
The deed submitted with the application materials does not appear to be
the proper deed for the property. Please submit the deed for the subject
property.
