Dear Mr. Strang:
The following resolution was adopted by the Southold Town
Planning Board at a meeting held on Monday, June 8, 1992.
BE IT RESOLVED that the Southold Town Planning Board
authorize the Chairman to re-endorse the final surveys dated
November 26, 1991.
This subdivision was endorsed on March 5, 1992. However,
as the time to file the maps lapsed, it was necessary that the
maps be re-endorsed by the Chairman.
Enclosed please find a copy of the map which was endorsed
by the Chairman. The mylar maps, which were also endorsed by
the Chairman, must be picked up at this office and filed in the
office of the County Clerk. Any plat not so filed or recorded
within sixty ( 60) days of the date of final approval, shall
become null and void.

THIS DECLARATION made this 3115t day of January, 1987, by
CHRISTOS VERVENIOTIS and CHRISTENA VERVENIOTIS, his wife, both re-
siding at 42-11 163rd Street, Flushing, New York 11358 , hereinafter
referred to as the DECLARANT, as the owner of premises described in
Schedule "A" annexed hereto (hereinafter referred to as the PREMISES)
desires to restrict the use and enjoyment of said premises and has for
such purposes determined to impose on said PREMISES covenants and
restrictions and does hereby declare that said PREMISES shall be held

subdivision or development application, the DECLARANT agrees that
there shall be no conveyance of any portion of the property unless
public water is extended to said lot or the DEPARTMENT has been

supplied with an irrevocable written contract between the owner of the

public water utility of the public water supply system to be extended
to such lot.
3. DECLARANT, their successors and/or assigns shall set
forth these covenants, agreements and declarations in any and all
leases to occupants, tenants and/or lessees of the above-described
property and shall, by their terms, subject same to the covenants and
restrictions contained herein. Failure of the DECLARANT, their
successors and/or assigns to so condition the leases shall not inval-
idate their automatic subjugation to the covenants and restrictions.
4. All of the covenants and restrictions contained herein
shall be construed to be in addition to and not in derogation or
limitation upon any provisions of local, state, and federal laws,
ordinances, and/or regulations in effect at the time of execution of
this agreement, or at the time such laws, ordinances, and/or regula-
tions may thereafter be revised, amended, or promulgated.
5. This document is made subject to the provisions of
all laws required by law or by their provisions to be incorporated
herein and they are deemed to be incorporated herein and made a part
hereof, as though fully set forth.
6. The aforementioned Restrictive Covenants shall be
enforceable by the County of Suffolk, State of New York, by injunctive

relief or by any other remedy in equity or at law. The failure of
said agencies or the County of Suffolk to enforce the same shall not
be deemed to affect the validity of this covenant nor to impose any
liability whatsoever upon the County of Suffolk or any officer or
employee thereof.
7 . These covenants and restrictions shall run with the land
and shall be binding upon the DECLARANT, their successors and assigns,
and upon all persons or entities claiming under them, and may be ter-
minated, revoked or amended by the owner of the premises only with the
written consent of the DEPARTMENT.
8. If any section, subsection, paragraph, clause, phrase
or provision of these covenants and restrictions shall, by a Court of
competent jurisdiction, be adjudged illegal, unlawful, invalid, or
held to be unconstitutional, the same shall not affect the validity of
these covenants as a whole, or any other part or provision hereof
other than the part so adjudged to be illegal, unlawful, invalid, or
unconstitutional.
9. Local Law #32-1980 - The DECLARANT represents and
warrants that they have not offered or given any gratuity to any
official, employee, or agent of Suffolk County, New York State, or of
any political party, with the purpose or intent of securing favorable
treatment with respect to the performance of an agreement, and that such
person has read and is familiar with the provisions of Local Law #32-
1980.

This office represents Mr. and Mrs. Anthony Church who are in the
process of purchasing the above vacant land from clients of William
Price, Esq. Mr. Price has suggested that I write to you to confirm
certain representations that he has made with reference to said
vacant land.
Mr. Price informs me that what we are purchasing is a legal building
plot and that a permit can be issued for a one-family dwelling for
purposes of zoning. He also stated that it is not necessary at the
time a building permit.is filed for the subdivision map to be filed
with the County of Suffolk due to the fact that the subject vacant
land was part of a minor subdivision.
Would you kindly forward a letter to my office confirming the above
so that my clients can enter into Contract to purchase this land.
mat I am most concerned about, as I care from the five western
towns, is that all subdivisions must have the approval of not only
the Board of Health but also the County of Suffolk and that a sub-
division map must be filed with the County of Suffolk. As this is

Gentlemen:
On March 25, 1991 it was brought to my attention that the
map for the subject minor subdivision had not been endorsed by
the Chairman although it had been authorized to be endorsed on
January 11, 1988 subject to the recording of a covenant. I am
enclosing a copy of your letter to Garrett Strand dated January
25, 1988 for your reference .
On April 4, 1988 the recorded covenants were forwarded to
you with a copy to Town Attorney's office . A copy of my cover
letter is enclosed herewith for your reference . The then assis-
tant Town Attorney, Robert H. Berntsson, approved the language of
the covenants . I believe that if you consult with the current
Town Attorney you will again be advised that the covenants bind
the current owners and all future owners in perpetuity.
Sometime, thereafter, it was discovered that the Board had
made a subsequent request concerning the configuration of the
minor subdivision without notifying the applicant. I make this
statement based upon conversations with Garret Strang and J.
Kevin McLaughlin, Esq. Specifically, the Board had requested a
dedication of property at the intersection of Old North Road and
Horton's Lane . Mr . McLaughlin has told me that the Board re-
lented on that position after it was pointed out that the appli-
cant had been required by the Suffolk County Health Department to
extend the Greenport Public Water main around that corner and
north along Horton's Lane at the cost of approximately 848,000 . 00
and that the property had been subject to a partition action. Of
course, the Village of Greenport has an easement for the mainte-
nance of the water main over the property which the Board had
wanted dedicated to the Town. Mr . McLaughlin discussed this mat-
ter with Mr . Berntsson and Mr . Berntsson informed Mr . McLaughlin
that the Board had relented on that requirement . Z 91991

There is urgency to this matter . One of the property
owners is selling one of the lots and it was represented to the
purchasers that the lot was a legal building lot for Town zoning
purposes . Based upon all of the foregoing, it is respectfully
requested that the Chairman of the Planning Board endorse the
map.

The following action was taken by the Southold Town Planning Board
at the regular meeting of January 11, 1988.
WHEREAS, a formal application for the approval of a subdivision
plat entitled "Vervenoitis, Plevritis, & Yianourakis" was submitted
to the Planning Board on May 18, 1983 and the filing fee was paid,
and,
WHEREAS, a final public hearing was held on said subdivision and
plat at the Southold Town Hall, Main Road, Southold, New York on
Monday, December 14, 1987 at 7:30 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of the
Town of Southold have been met by said subdivision plat and application.

NOTICE IS HEREBY GIVEN that pursuant to Section 276 of the Town Law,
Public Hearings will be held by the Southold Town Planning Board at the Town Hall,
Main Road, Southold, New York in said Town on the 14th day of December, 1987

WATER SUPPLY AGREEMENT
AGREEMENT made this /0 day of -&1-1-y, 1986nd between
the Villaqe of Greenport, a municipal corporation in Suffolk
County having its office and principal place of business at 236
Third Street, Greenport, New York, herein called the "VILLAGE" ,
and CHRISTOS and CHRISTENA VERVENIOTIS, JAMES and POTA PLEVRITIS,
and JOHN and MARY YIANOURAKIS, c/o Christos Verveniotis , 42-11
163d Street, Flushinq, New York, herein called the "OWNER" .
WHEREAS, the OWNER is desirous of securing a supply of water
for the project to be developed at the property shown on a map and
preliminary site plan; and
WHEREAS , the OWNER is willinq at its cost and expense to lay
and install- or cause to be laid and installed the water mains ,
hydrants , fittings and valves described on the map and preliminary
plan and to transfer and convey same to the VILLAGE upon comple-
tion and , if necessary, to give and procure easements for the
maintenance of the mains and the hydrants ; and
WHEREAS , the VILLAGE is willing to supply the OWNER with its
requested water allowances and the parties have agreed upon the
terms and conditions for the supply of water and other matters;
and
WHEREAS the OWNER is the owner in fee of certain premises
which premises are shown generally on a map and preliminary plan
annexed hereto, made a part hereof and marked Exhibit "A" , and

Gentlemen :
On March 25, 1991 it was brought to my attention that the
wap for the subject minor subdivision had not been endorsed by
the Chairman although it had been authorized to be endorsed on
January 11, 1988 subject to the recording of a covenant . I am
enclosing a copy of your letter to Garrett Strand dated January
25, 1988 for your reference .
On April 4, 1988 the recorded covenants were forwarded to
you with a copy to Town Attorney' s office . A copy of my cover
letter is enclosed herewith for your reference . The then assis-
tant Town Attorney, Robert H . Berntsson, approved the language of
the covenants . I believe that if you consult with the current
Town Attorney you will again be advised that the covenants bind
the current owners and all future owners in perpetuity.
Sometime, thereafter, it was discovered that the Board had
made a subsequent request concerning the configuration of the
iuinor subdivision without notifying the applicant . I make this
statement based upon conversations with Garret Strang and J .
Kevin McLaughlin, Esq. Specifically, the Board had requested a
dedication of property at the intersection of Old North Road and
Horton 's Lane . Mr . McLaughlin has told me that the Board re-
lented on that position after it was pointed out that the appli-
cant had been required by the Suffolk County Health Department to
extend the Greenport Public Water main around that corner and
north along Horton's Lane at the cost of approximately $48, 000 . 00
and that the property had been subject to a partition action. Of
course, the Village of Greenport has an easement for the mainte-
nance of the water main over the property which the Board had
wanted dedicated to the Town . Mr . McLaughlin discussed this mat-
ter with Mr . Berntsson and Mr . Berntsson informed Mr . McLaughlin
that the Board had relented on that requirement .

Purchasers that the lot was a legal building lot for Town zoning

Please be advised that while researching a matter it was brought
to my attention that the minor subdivision map has not been
endorsed by the chairman of the Southold Town Planning Board .
I , thereupon, had the file with the Southold Planning Board
checked first by the selling agent and, thereafter, by J . Kevin
McLoughlin, Esq . I was informed that the minor subdivision map
had not been endorsed by the Chairman of the Planning Board
although there had been a resolution adopted authorizing the
endorsement in January, 1988 . Apparently, all of the conditions
Precedent to the endorsement of the map had been accomplished by
April 1988 . When I inquired of the staff of the Planning Board
as to the reason why the map hud not been endorsed, I was told
that they could not discuss the matter with me until they
discussed the matter with the Planning Board at their meeting on
April 1, 1991 . I then wrote and hand delivered the enclosed
letter to the Planning Board dated March 29, 1991 . On April 2,
1991 I spoke with Melissa Shapiro, the planner with the Planning
Board . She informed me that the matter had not been discussed at
the April 1, 1991 meeting , that there were not the required
number of maps in the file with the Suffolk County Health
Department approval noted thereon , and that even if the maps were
there she could make no) representation as to when the map would
be endorsed .
I am on this date advising Mr . McLaughlin and Mr . Garrett Strang
of my findings herein . Mr . McLoughlin has informed me that he
dealt with one issue raised by the Planning Board consisting of a
as more fully shown on the Exhibit "A" attached hereto. Said
installation shall be in conformity with the agreement herein and
the rules and regulations of the VILLAGE.
SECOND. Locations of all mains , hydrants , and appurtenances
are shown on a copy of the map entitled, "Minor Subdivision on Map
of Property Surveyed for Christos and Christena Verveniotis , James
and Pota Plevritis, and John and Mary Yianourakis" at Southold,
Town of Southold, New York.
THIRD. All necessary engineering work, trenching, laying ,
joining, backfilling shall be done by OWNER and shall sometimes
hereinafter be called the "WORK".
FOURTH. The VILLAGE will supply the hydrants for installa-
tion at the locations shown on said map. OWNER will reimburse the
VILLAGE for all hydrants located within the subdivision.
FIFTH. Payment shall be made upon delivery for hydrants and
the costs of the delivery of the hydrants to the site by the
VILLAGE. The VILLAGE shall deliver the hydrants to the site at a
time appropriate to the expeditious completion of the work oro-
vided the VILLAGE is given no less than 21 days notice , and sub-
ject to the availablity of the hydrants from the suppliers to the
VILLAGE.
SIXTH. Until such time as rental for such hydrants is
assured and paid for by the Southold Fire Protection District,
OWNER will pay annually to the VILLAGE such rental for such
hydrants as is from time to time being paid by such District to

the VILLAGE for other hydrants in the District.
SEVENTH. The standards for the installation of the piping and
the hydrants shall be in accordance with the plans and specifica-
tions attached hereto made a part hereof and marked Exhibit "C" .
Any pipe and all joints and parts of the system must be able to
stand pressure of not less than 150 pounds per square inch.
EIGHTH. The VILLAGE will supply without charge to OWNER suf-
ficient water to make essential tests and to leave the system on
final approval completely sanitary, said supply to be not less
than 160 pounds per square inch.
NINTH. The WORK shall be inspected by the VILLAGE which
hereby delegates its Superintendent of Utilities or his designee
full power of inspection hereunder . OWNER will grant complete
freedom of access to all parts of the premises and the WORK for
inspection . The VILLAGE will have an authorized inspector at the
site at all proper times so as not to delay the work. No work not
passed by the inspector will be accepted by the VILLAGE. No back-
fillinq shall be done until the pipe and the work in the trench
has been approved and tested by the inspector.
TENTH. OWNER will , and by this aqreement does , upon appro-
val of the completed work, which the VILLAGE will indicate to the
OWNER in writing, dedicate the mains to the VILLAGE. The mains
and appurtenances shall be deeded to the VILLAGE its successors or
assigns . and shall forever remain the property of the VILLAGE, its
successors or assiqns .

to help gain new production supply, so as to assure OWNER of
future adequate supply. It is contemplated by this contract that
the OWNER anticipates construction of ( 4 ) Eour dwelling units.
Upon execution of this agreement, the OWNER shall deposit with th=
VILLAGE the sum of twenty-five hundred dollars seventy dollars
($2 ,570 .00 ) times ( 4 ) four dwelling units for the total of TEN
THOUSAND TWO HUNDRED EIGHTY DOLLARS ($10 , 280. 00 ) in bank or cer-
tified check, which per dwelling unit amount may be amended from
time to time, depending on findings by the VILLAGE' S consulting
engineers , Holzmacher, McLendon and Murrell , P.C. or their suc-
cessors and upon approval by the Village Board of Trustees. In
the event that the per dwelling unit cost is increased or
decreased between the execution of this agreement and the applica
tion for water, the OWNER shall pay the VILLAGE, upon application
for water , the difference between the per dwelling unit amount
specified herein and the per dwelling unit amount required by the
VILLAGE at the time of the application of water times the number
of dwelling units covered by said application. Said payment shall
be in bank or certified check and shall be paid to the VILLAGE
prior to any hook-up for water. In the event that the OWNER does
not complete the project as contemplated by this agreement or doe;
not make application for the full number of dwelling units alloted
or specified herein, the VILLAGE shall keep all funds so deposited
by the VILLAGE as the sole exclusive property of the VILLAGE and
the OWNERS shall have no claim thereon.

SIXTEENTS The WORK contemplated by4kis agreement shall be
completed within 24 months of final approval of plans by the Town
of Southold, or within additional periods of 24 months each,
however , it is hereby mutually agreed and understood that all spe
cifications in reference to materials used for the construction o
said system, the WORK to be completed, and/or water to be supplie
shall be changed to conform with the then current standards as se
by the VILLAGE of Greenport Utility Department, its successor, or
its authorized agent at each such interval .
SEVENTEENTH. The OWNER agrees that upon completion of the
work in accordance with any contract made pursuant hereto, title
to the mains , hydrants , valves, and fittings so installed and lai,
shall be deemed dedicated to the VILLAGE, and the OWNER shall in
confirmation of such passage of title, execute an instrument
transferring and assigning to the VILLAGE the title , free and
clear of all encumbrances or liens to the mains, hydrants , valves
and fittings so laid and installed and if required by the VILLAGE
shall procure from all persons having an interest in the land in
which said mains lie a proper easement in favor of the VILLAGE foi
the perpetual maintenance, repair or replacement of said mains and
fittings including the right to extend the mains and to connect
them with other mains to be laid by or under the supervision of
the VILLAGE. The instruments so executed shall be in recordable
form

laying of the mains , valves , hydrants and fittings has been
completed, pursuant to the terms of this aqreement, and proper
easements have been qiven, all as hereinbefore provided , the
VILLAGE will accept the assignment and conveyance of the mains,
valves , hydrants and fittings and maintain them thereafter and
supply water to consumers alonq the mains subject to conditions ,
rules and regulations of the VILLAGE.
NINTEENTH. Should the OWNER desire to lay the mains in sec-
tions , separate construction contracts may be let for such sec-
tions providing the extent of such separate sections shall be in
the opinion of the VILLAGE sufficient to warrant a separate con-
sideration.
TWENTIETH. This agreement contains the complete agreement
between the parties for the acquistion by the VILLAGE of the
mains , valves , fittings, and hydrants hereinbefore described and
the OWNER agrees that it will not make any claims against the
VILLAGE on account of the installation of the mains , valves , fit
tinqs or hydrants and acceptance of the terms of this agreement,
notwithstanding the provisions of any general or special law to
the contrary which may or may' not be enacted .
TWENTY-SECOND. This aqreement shall enure to the benefit a
shall bind the respective heirs, legal representatives , successo
or assigns of the parties hereto.
TWENTY-THIRD. This agreement shall not be assignable by ti

Please let this confirm the following action taken by
the Southold Town Planning Board, Monday, October 20 , 1986 .
RESOLVED that the Southold Town Planning Board re-affirm
the resolution of May 16 , 1983 and approve the sketch map
of Christos & Christena Verveniotis, James & Pota Plevritis
and John and Mary Yianourakis, lcoated at Southold for 4 lots
on 12 acres, survey dated December 21, 1982 subject to
1. Filing of covenants and restrictions, for no further
subdivision, in the office of the County Clerk.
Would you please forward a draft copy of the above requested

The file shows that although sketch plan approval was granted,
the owner/applicant never made the required application to
the Suffolk County Health Department for an Article 6 approval,
as per enclosed copy of sanitary code. Upon receipt of this
approval, the Planning Board will schedule a public hearing
and providing there are no major objections , final approval
should be granted.

DESCRIPTION OF ACTION
The minor subdivision of Christos & Christena Verveniotis , James
& Pota Plevritis and John & Mary Yianourakis is a four lot subdivision
located at Southold.
The project has been determined not to have a significant
effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection_
nor comments by that agency.
The Suffolk County Department of Health Services has
indicated its agreement with the lead agency designation.
There is no record of application to this Department.
The project is adjacent to village of Greenport well
fields . All septic systems should be maintained at least
200' from easterm property lines .
The project will meet all,the requirements of the Code
of the Town of Southold Subdivision of Land Regulations .
