FULL ENVIRONMENTAL ASSESSMENT FORM JUL 3 Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature,yet flexible to allow introduction of information to fit a projector action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially- large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the impact is actually important. As noted in my correspondence of August 25, 1995, the Planning Board is using the map dated April 27, 1992, for yield purposes only. Based on this map, the Planning Board has determined that the density for the parcel is thirteen ( 13) lots. The Planning Board is requiring that the sketch plan be designed as a cluster subdivision. The proposed cluster must include either a permanent tap to the adjacent Sage property or a tap for emergency purposes only, the lot areas reduced to a minimum of 20,000 square feet, and at least a 75' buffer around all wetland areas located both on and off site. The Board will proceed with review of the subdivision proposal upon receipt of a proposed clustered subdivision. On July 20, 1995, the Village of Greenport imposed a moratorium on all new applications of major subdivisions for the hook up of water and sewer services for a period of twelve months. When last discussed, a question arose as to whether Island View Lane at least for a distance of 400' was a private or public road. The memorandum of June 4,1992 of James A. Richter, R.A. concludes that since there was no formal dedication of the road that it is a private road-an opinion accepted by the Planning Board as set forth in Bennett Orlowski's letter to the undersigned dated June 12,1992. In the interim, I have had discussions with Raymond L. Jacobs, Superintendent of Highways, who has verbally indicated, and now indicates in writing by letter dated July 18,1995, a copy of which is enclosed, that the Highway Department has so maintained a portion of Island view Lane to a point westerly of the proposed access to the subdivision. Interviews with neighbors along said road is supportive of such fact. While the road has not been formally dedicated as a public highway to the Town of Southold, it is nevertheless deemed a public highway through maintenance and use for over the past 26 years, and presently so maintained and used, pursuant to Section 189 of the Highway Law of the State of New York. As to the status of Island View Lane, our only source of information as to its nature is from the sibdivision map of "Peconic Bay Estates" , which shows a 50-foot strip running west- erly from Bayshore Road to a point as previously indicated on the Holder map.The "public" status was also noted on a working print of ours some 30 years ago, as requested I believe by a prior Town attorney for the information of the Town Highway De- partment . Although perhaps not legally dedicated as such, the roadway has to our knowledge been open and used without conten- tion for many years, and possibly by "use" has become public in nature . Barring this, it would at least be a right-of-way in favor of Mr . Holder ' s property from the 50-foot strip easterly to Bayshore Road. As to the status of Island View Lane, our only source of information as to its nature is from the swbdivision map of "Peconic Bay Estates" , which shows a 50-foot strip running west- erly from Bayshore Road to a point as previously indicated on the Holder mEp.The "public" status was also noted on a working print of ours some 30 years ago, as requested I believe by a prior Town attorney for the information of the Town Highway De- partment . Although perhaps not legally dedicated as such, the roadway has to our knowledge been open and used without conten- tion for many years, and possibly by "use" has become public in nature . Barring this, it would at least be a right-of-way in favor of Mr. Holder ' s property from the 50-foot strip easterly to Bayshore Road. The field inspection revealed the presence of the pond , a second freshwater wetland west of the pond (primarily on the property of Sage) and a third wetland northeast of the pond (primarily on the property of Posillico) . The pond appears to be man made ( the resulting spoil was deposited to the north of the pond) and lacks freshwater wetlands vegetation around its periphery. Therefore , the wetland line is the pond boundary as shown on the sketch plan prepared by Roderick Van Tuyl last amended Jun . 12 , 1991 . The two other wetlands are either located on the property line or outside the property boundary. The wetland boundary of the second wetland was flagged in the field. The third wetland appears to be located completely outside of the property boundary. While the presence of the pond is regarded as having a regulatory effect on the approval of this subdivision , the remaining wetland areas are for the most part located off site and therefore would have no effect upon subdivision layout. However, all three wetlands will have a regulatory effect on the eventual development of lots 10 , 11 and 13.
