Attached is a copy of the tax map highlighting the subject property and giving the appxomiate site location along with a survey prepared by Peconic Surveyors, P.C. Please note, however, that this property is indeed vacant land as Mr. Hurtado is giving up his intentions of developing this parcel. This parcel has wetlands and the Town is anxious to purchase the property for the purpose of open space preservation being that the owner has offered the property to the Town at a signicant bargain sale price. The Town's intention is to allow the property to remain in its present state allowing for the natural drainage pattern to remain undisturbed in this area. It is respectfully requested that Heather Cusack in the Trustees Department be allowed to inspect the property for any visibly recognizable envioronmental conditions that may be of concern to the Town prior to a Town Board Public Hearing scheduled for Tuesday, August 8, 2006, regarding its purchase. If acceptable, please have Ms. Cusack's written report forwarded directly to my office upon its completion. If you have any question, please contact me. Thank you. As you are aware there are substantial wetlands at the above referenced property and there is a wetland delineation issue with the property that caused the initial development application to be rejected by the Town. Any change in plans to develop the property will, if it can be accomplished at all, require a substantial deviation from the initial plan. As such, all adjoining and potentially affected property owners should be notified directly of any re-submittal of a plan to develop this property. The parcel does not contain any visibly recognizable hazardous environmental conditions. The parcel is predominately fresh water wetlands, containing a red maple swamp, arrow wood, blueberry, jewelweed, and other fresh water wetland flora and fauna. The parcel is currently seasonally dry, but the condition of the soil and the trees indicate the presence of water in spring. The northwest comer contains some standing water, which may indicate runoff from the adjacent parcel. There is a disturbed area in the southeast part of the parcel where Arrowwood has been cut, and poison ivy has invaded the disturbed area. Along Albacore Drive there are a few piles of grass clippings and shrub clippings. Preserving the wetlands and the whole lot will benefit the area, and give a place for natural drainage to occur. I have two main concerns and objections regarding this permit application: 1. As you are aware, over the past few years since Mr. Glen Heidtmann began constmction of a dwelling on his property adjacent to the 450 Albacore Drive property, I have been plagued by flooding problems on my property (495 Dolphin Drive) because Mr. Heidtmann has not abided by the conditions of his building permit to properly install and properly maintain a working drainage system on his property. Each ofthe past two years, I have had to appear before the Trustees to express my frustration with Mr. Heidtmann in that he has not complied with the conditions of his permit, and this year is no different as you will witness when you conduct your site inspection of the 450 Albacore Drive property, which is essentially completely inundated with water, as well as water on my property caused in large part, ifnot all, by Mr. Heidtmann's inoperative drainage system. Recently, he filled in a ditch which was draining water from the 450 Albacore Drive property and reportedly put in a pipe, but as you will observe, the water is not draining in the area (see attached figure). Mr. Heidtmann apparently has no regard for the property of others or the conditions of his permit imposed by the Board of Trustees. Although the proposed site plan shows a similar drainage system to be installed on the 450 Albacore Drive property, there is no guarantee that it will be properly installed and properly maintained any better than Mr. Heidtmann's system. Also, is there any written agreement between J&C Holding and Mr. Heidtmann and the Town of Southold that the drainage system proposed on the 450 Albacore Drive property can be connected to Mr. Heidtmann's system as shown on the site plan? In all probability, constmction on the 450 Albacore Drive property will only exacerbate the drainage problems in the area and the flooding of my property. .- . . 2. The 450 Albacore Drive property has been flagged for delineation of wetlands which is shown on the site plan. However, as you will observe during your site visit and the extent of water on the property, the extent of wetlands is far greater than shown on the site plan. In fact, I do not see how a dwelling can be constructed on this property without seriously circumventing the wetlands regulations, including encroachment onto the wetlands. Also, it appears, based on the site plan, that numerous variances will be required in order to construct a dwelling on this property, if it can be built at all. For the reasons described above, I am adamantly opposed to construction of a dwelling on the 450 Albacore Drive property. In addition, as described in item I above, I again petition the Board of Trustees to direct Mr. Heidtmann to abide by the conditions of his building permit to properlv install and properlv maintain a working drainage svstem on his property. Perhaps the Trustees should revoke his building permit until he fullv complies with the permit conditions and impose fines for violations. Please notify me when you conduct your site visit so that we can at first hand observe the water conditions on the 450 Albacore Drive property and the situation created by Mr. Heidtmann's inoperable drainage system. It generally entails a review and authorization by a governmental agency before an activity can be undertaken. It includes laws, rules and regulations, plus executive orders. In New York, wetlands are regulated at the state and federal level, and in some locations, at the local level as well. State Wetlands Regulatory Programs The Freshwater Wetlands Act (FWA), Article 24 of the Environmental Conservation Law, provides DEC and the Adirondack Park Agency with the authority to regulate freshwater wetlands in the state. The NYS Legislature passed the Freshwater Wetlands Act in 1975 in response to uncontrolled losses of wetlands and problems resulting from those losses, such as increased flooding. The FWA contains the following Declaration of POlicy: "It is declared to be the pUblic policy of the state to preserve, protect and conserve freshwater wetlands and the benefits derived therefrom, to prevent the despoliation and destruction of freshwater wetlands, and to regulate use and development of http://www.dec.state.ny.us/website/dfwmr/habitat/fwwprog4.htm 1/17/2005 . NYSDEC - Freshwater Wetlands Program Page 2 of 5 such wetlands to secure the natural benefits of freshwater wetland, consistent with the general welfare and beneficial economic, social, and agricultural development of the state (ECL Article 24-0103)." The FWA protects those wetlands larger than 12.4 acres (5 hectares) in size, and certain smaller wetlands of unusual local importance. In the Adirondack Park, the Adirondack Park Agency (APA) regulates wetlands, including wetlands above one acre in size, or smaller wetlands if they have free interchange of flow with any surface water. (Put APA link here) The law requires DEC and APA to map those wetlands that are protected by the FWA. In addition, the law requires DEC and APA to classify wetlands. Inside the Adirondack Park, wetlands are classified according to their vegetation covertype. Outside the Park, DEC classifies wetlands according to 6NYCRR Part 664. Wetlands Mapping and Classification Regulations from Class 1, which provide the most benefits, to Class IV, which provide the fewest benefits. Around every regulated wetland is a regulated adjacent area of 100 feet, which serves as a buffer area for the wetland. The main provisions of the FWA seek to regulate those uses that would have an adverse Impact on wetlands, such as filling or draining. Other activities are specifically exempt from regulation, such as cutting firewood, continuing ongoing activities, certain agricultural activities, and most recreational activities like hunting and fishing. In order to obtain a FWA permit, a project must meet the permit standards in 6NYCRR Part 663. Freshwater Wetlands Permit Requirement Regulations and be consistent with the public health, safety, and welfare. The project must also avoid impacts to wetlands, and if unavoidable, must minimize impacts. Then, project sponsors may use mitigation to offset residual project impacts in the wetland so that it meets the weighing standards in the regulations. Filling, including filling for agricultural purposes . Draining and altering water levels, except as part of an agricultural activity . Removing or breaching beaver dams . Clear-cutting trees and other wetland vegetation . Grading, dredging, or mining . Constructing roads . Drilling a water well to serve and individual residence . Installing docks, piers, or wharfs . Constructing bulkheads, dikes, or dams . Constructing a residence or related structures or facilities . Constructing commercial or industrial facilities, public buildings, or related structures . This regulation identifies the standards for issuing Article 24 permits, and explains how mitigation may be used to help meet permit standards. 6NYCRR Part 664: Freshwater Wetlands Mapping and Classification Regulations. This regulation contains the criteria for classifying wetlands as Class I, II, III, or IV. Wetlands are areas where land and water meet. They are transitional areas between aquatic and upland plant and animal communities, and often have some of the qualities of both. Wetlands also occur where the groundwater occurs near or at the surface, saturating the soil and the root zone of the plants that grow there. Society and scientists have created numerous definitions of wetlands, depending on how they -- both the definitions and the wetlands -- will be used. Probably the most well-recognized wetland Is where surface water, such as a pond or lake slopes up to land, where wetlands develop; these are known as fringe wetlands. Riparian wetlands occur in the floodplain adjacent to streams and rivers. Another wetland type is where a depression in the land reaches down into the groundwater; these are the famous prairie potholes of the American Midwest, and the vegetated ponds on Long Island. Finally, wetlands can occur where surface water is trapped In shallow depressions by soil that will not allow the water to seep downwards. These are called depressional or flat wetlands and are common on clay soils in the Lake Plains of western New York. wetlands hydrology (such as prolonged flooding) or hydric (wet) soils. Freshwater wetlands commonly include marshes, swamps, bogs, and fens. When scientists look at wetlands, they usually look at a few key characteristics. The most relevant one is water. Water, or the wetland's hydrology, is why the wetland exists. But it also is very elusive. Hydrology changes throughout the year -- ponds get low, streams dry up, wells go dry. It also varies between years. So scientists look for signs that water was there at some recent time and for extended periods of time. Indicators of hydrology include leaves that have turned black from being in the water for a long time, or silt marks on tree trunks. Vegetation is a more dependable and useful indicator that a wetland is present. Certain plants, known as "hydrophytes," have adapted to survive with their roots growing in water for at least part of the growing season. Some of these plants, known as "obligates," require water to survive or to out-compete other plants. Typical obligates include cattails, pond lilies, and skunk cabbage. Other plants, known as "facultative" plants, are able to grow in either wet or dry conditions. Common facultative species include red maple and green ash. They can only tell you that a wetland MIGHT be present. Finally, other types of plants, known as upland species, cannot grow and survive in situations where their roots are wet for long periods of time in the growing season. Examples are black locust, black oak, and multiflora rose. Wet soils, known as "hydric" soils, develop when they are flooded or saturated for long periods of time, especially if part of the time occurs during the growing season. If the ground is wet for all or most of the year, organic, peat-types of soils (sometimes called muck) develop. When the soils dry out for part of the year, the peat material oxidizes, or breaks down. Then, other signs help indicate wetness: rust stains may develop along the roots of plants, or the color of the soil changes. When evaluated together, hydrology, soils and vegetation can indicate whether an area is a wetland. Some are obvious: marshes along the coast.
