Wickham, Councilman Joseph J. Lizewski, Councilwoman Alice J. Hussie, Town Clerk Judith T. Terry, Town Attorney Harvey A. Arnoff (10:20 A.M.). 9:35 A~M. The Board met with Reverend John Sullivan, St. Agnes Church, Greenport, who requested the Town Board to ~reimburse the church for extermination services at St. Agnes Hall, former site of the Southotd Town Nutrition Program. The Board agreed the Town is responsible for the pest control services and placed resolution no. 20 on the agenda to pay same. 9:55 A.M. For Discussion Items: (1) Appointment of Public Safety Dispatchers was ~discussed during Executive Session at 10:50 A.M. (2) Discussed proposed Local Law in Relation to Garbage Definitions prepared by Assistant Town Attorney Kiernan. The Board had asked Mr. Kiernan to further define Town Garbage Bag by specifying that it would bear the logo of the seal of the Town of Southold. The Board agreed, due to the fact there are a large number of unmarked bags in circulation, to hold discussion on this until the January 25th meeting. (3) Application of Roy A. Schelin for a Transfer Station Permit. There is a'question regarding the type Of permit to be issued Junk Yard or Recycling and Salvage Facility. The Board will invite Warren Sambach, Sr., who submitted on the application on behalf of Mr. Schelin, to meet with them on January 11th. A representative of the Plannin( Board and the Building Department will be invited to attend as well. EXECUTIVE SESSION 12:05 P.M. - For Discussion Items (continued): -(4) Renewal of the North Fork Animal Welfare League contract for Dog Shelter services was discussed at 10:51) A.M. in Executive Session. (5) Acknowledgement of computer equipment and assistance from the Town of Smithtown. The Town Clerk will send a letter of appreciation to Smithtown Supervisor Patrick Vecchio. 12:07 P.M. - The Town Board reviewed the resolutions to be voted on at the 4:00 P.M. Regular Meeting. 12:10 P.M. - Work SeSsion adjourned. 10:10 A.M. - On motion of Justice Edwards, seconded by Councilman Penny, it was Resolved that the Town Board enter into Executive Session. The Town' Board continued in Executive Session to discuss personnel, the proposed 1994 contract with the North Fork Animal Welfare League, and on-going litigation. 11:25 A.M. The Board met in Executive Session with John Raynor, Public Safety Dispatcher i11, to discuss the employment of two additional Public .Safety Dispatchers (see resolutions 21 &~22). GENERAL ~ EETI NG A Regular Meeting of the Southold Town Board was held on December 21, 1993, at the Southold Town Hall, Main Road, Southold, New York. Also, we have a..second Board in this Town, a very important Board, and that is the Board of Trustees, and at this time would John Bredemeyer III, please, come forward? Let me just mention that John has been the President of the Board ef Trustees, and has been a Town Trustee since January of 1984. John served for many years in the capacity of Chairman, no easy task [oday with many ~t~ew opportunities that have come forward for this Board to under take things like Coastal Erosion, things like Wetland Ordinances, parts of our Code '0' DECEMBER 21, 1993 that are either mandated or voluntary which has been given to your Board. Certainly a long time to be on that Board. You've seen a lot of changes take place, and I know, Henry, that you're going to do a fine job in the future with all your endeavors. JOHN M. iTUTHILL: Being a politician was kind of new to me, particularly at my age, but I 'really enjoyed the four years. Thank you very much. SUPERVISOR HARRIS: Mr. Krupski? Town Trustee. AI,BERT KRUPSKI, JR.: I'd just like to been on the Board with for the last four Br~ e been on the Board t'he set an people. and as personally thank John Tuthill, who I've years, and Henry Smith, and JOhn for the entire eight years of my 'being on showed an awful lot. They've taught me an awful lot, and they ~ld Town of the way governments work, to work for the worked together as a Board. We had plenty of disagreements, of split :votes, but after all is said and done, we always pulled together for the' benefit of the Town. I'd like to thank them for that. COUNCILMAN PENNY: In my last official act as Deputy Supervisor, I have a proclamation': here for Scott Harris, the outgoing Supervisor, who I have had the honor to work with, and been his Deputy for the last four years. The words are q' the same. There a little embellishment because Scott had some previous a-personel note I'd just like to say that I've never worked with an indi~ who is las caring, and unselfish, as Scott Harris has been during his time he town at a time of potential crisis with the Landfill litiga- tion,, and disaster that we were getting into, that was rejected by the voters, I he put us in a position where Southold Town is on top. We couldn't have done it without Scott's leadership, without his perseverance, and he probably is one of the most knowledgeable person when it comes to the DEC, and the 360 Regulations, the Landfill Law. He's just a walking encylopedia. So, if anybody thinks that 'Scot~ trouble getting a job, I think they're ~ wrong, because th~ ~s, and there are plenty of areas, that still have problems, and be ~ou.,me~ Scott is very knowledgeable. SUPERVISOR HARRIS: lltl say a few words at the close of the meeting. I think at that time would be appropriate. Thank you, George, and thank you people~from the Town of Southold for this recognition. Thank you Town Board members. COUNCILMAN LIZEWSKI: I'd like to take this oppo_rtunity to present on behalf of the Board members, present and incoming, a gift to Scott, Judge-, and George Penny. I'd like to say that it's been a pleasure to have worked with them. It's been unfortu- nate that once you get into this political arena, that you become basically a public figure to the point where it's like, an open house on everything that you own, and everything that you do, your family, your children, your business. These men have served well under an awful lot of fire, and they have been servants to this communit~ and 1 think it's underestimated on how much people give when they get in these positions. There are a lot of people, who may differ with you. There are a lot of people, who have different philosophies than you, but basically people who do this do this out of the goodness of their heart for the town. They don't do this, certainly for the monetary pleasure. It take you only a few moments of this position, that you don't do it for the power that's involved, that you really have to think for an awful lot of people in your town. These men have served so well, no self- essness, have given an awful lot. A lot has been said. A lot has been distorted. It's not always been friendly. It's not always been comfortable, but they have still served, an~l they've served to the best of their ability. I think we're going to miss an awful lot of what they've given ~his town. I'm certainly going to miss an awful lot of them on this Town Board,' a lot they've showed me about,Town government. Without much more ado, I'd like to present these gifts on behalf of the'Town Board to Scott, and George, from the remaining Board members, and incoming Board members, and the Town Clerk. This is the elect Joe Townsend, Ruth Oliva, Tom Wickham, Alice Hussie, myself, Town Clerk, and Louisa Evans. Thank you on behalf on their behalf. Scott, I present this to you. George. Let's give these guys a hand on their way out. SUPERVISOR HARRIS: My collegues, those who l've served with before, which is Ruth, and Joe, who i have not had the pleasure to serve with, thank you very much for this token, and it will be hung in a place of distinction, believe me. If not, Judge Edwards, would you like to start the first resolution, please? 1.-Moved by Justice Edwards, seconded by Councilman Wickham, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes Lawrence Healthcare Admistrative Services, Inc. to pay a medical claim of Nations- Bank of 'Virginia (Southampton Hospital)in the amount of $127.50, which was rejected by Lawrence Healthcare because the hospital failed to submit the claim on a timely basis. 1.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. LEWIS COTIGNOLA: My name is Lewis Cotignola, 195 Midway. I'm a resident here, just one year. I received my new tax bill with a new line on it this year. It's the garbage, $38.00 and some odd cents. I thought we had a. bag disposal unit, and then I understand we were going from $25.00 fee, that was going to be reduced to $5.00. To me it appears, that you're giving us one thing, you're taking away with the other hand. I was wondering i~f you care to comment on that? Also, 'at one time I was a former member of the Huntington Town Board about 33 years ago, and I can tell you, if you're going to put this ga~'bage on there, when I left last year it was $800.00 on our tax bill. Thank you. SUPERVISOR HARRIS: Before you sit down, sir, which part would you like addressed, the Solid Waste District? LEWIS COTIGNOLA: I was just commenting, I don't understand that we'll have so many laws on one thing. It looks like you're giving us one thing, and you're taking it away with the other hand. On the tax bill, which I wasn't .allowed to vote on. Apparently it was done by the Board, which I just found out about. Thank you very much. SUPERVISOR HARRIS: I would like to respond to any question, that you had in reference to that. As you know the State has many mandates on the Town, as well as the Town has to follow, and follow. As far as costs that go in reference to solid waste, and that matter has been ongoing unfortunately since the enactment of the Long Island Landfill Law, which was 1983, which is some ten years ago. In reference to 1988, the Part 360 rules and regulations, that were promulgated and enforced at that time, and put into effect, also had tremendous ramifications for all towns in reference to the State of New York, but in particularly Long Island, which was separate ligitigation to the Legislation, (tape change) JOSEPH RISTUCCIA: Joe Ristuccia. Good afternoon. I'd like to present to the Board some petitions, which were cirulated in town. The petitions relate to the action this Board took two weeks ago relating to two items, where you removed from the Planning Board the former Chairman Orlowski, and replaced him with the defeated member of the Trustees, a man by the name of Henry Smith, who was today given a proclama- tion. Also~ you granted a zone change to a Emanual Kontokosta to build a high density s~b~livisi~n. A lot of people in this town objected.to it. You certainly read about it in the newspapers, and while a few of these -here, coming in, because 'of the .Christmas season, haven,t been able to gather them, but given enough time 1 think we c.a.p get an awful lot of them, and tee reason I'm presenting these to you is because.~e~objected to t'hat strenuously. A lot of people in this. town did not like it, and th~ i~-~j~t for the record. I'd like to include one more thing~ that I want to address the Board with. and that is, one more thing disturbed me. I read in the paper, t know you passed' on, the Chief of Police's salary. It 'came to better than $82,000.00, an~t this is'juSt for the record, also. l called the Town. Clerk, and asked Some questions about it. It was relayed to me.that this was a perfunctoral thing on the part of the Board here, and I want to make sure l'm correct for the record~ that it was unanimous, when you passed that, and the reason it was unanimous was because you are diCtated :by a State law, wherein the Chief of 'Police is granted this ~f.over $82,000,00, and you compare that to some of salaries in cities Nassap County, and probably if you ted States it's highest in the United States. rther explana- tion because if this continues :it's going Ct on this.community in yea~S to come. Will be happy, and my wi~e will be happy to see me return la~ ,' priiv~te practice' of-law, and: I'm certain ~hat the rd, the new Town Board, another Town Boards will be seeing I'd like to take this opportunity, again, Scott, to you a Merry Christmas, and a Happy and Prosperous Thank you. ~ The same to you and your family. COUNCILMAN WICKHAM: I'd just like to make'a brief comment. Last week I met with the County Executive. He met with all of the Supervisors, and Supervisor Elect out here on the East End, and one item came up on the agenda, that I thought I would iust share ~with you. As you know Suffolk County has long had an effective Farmland Preservation Program, a program that basically acquires the development rights to farmland, and has helped to preserve agriculture in this town, and I think a viable and .important way. The County Executive pointed out to us a new policy of Suffolk County, that he is putting in place effective immediately. The policy calls for funds to be expended by the County for purchase of development rights would be matched by funds from the different municpalities, from the towns. What that means is, that if the County is going to be a player, or to participate in acquisition of development .to farmland in the future out here, the Town will have to be a party to it in an equal dollar amount. Some of you may know that, and I pointed out to the County Executive, that this Town has put in place a parallel program to the counties, and actually has done quite a bit of preservation of land in the same manner. In fact it was the SUpervisor here, who two years ago put on the ballot the last measure for 1.75 million dollars, and the people of the town voted it in, a bond issue, to perpetuate the Town's program in that regard. I want you to know that the Town's portion has been expended. We have used up those funds, and I think we've done quite a good job with it, Scott. This Board has actually assisted the people of the TOwn to keep it open, the farmland to keep it viable, but there is no longer any funds left in that bond. As a result, this town will not be able to participate on equal basis with the County, and it seems to me, and we had some discussion about it, that that will make it impossible for the County to expend any of it's monies in this town in the future, unless, or until the Town refinances it's program to some extent. So, the net result of the policy is basically to exclude Southold Town from further participation in the Farmland Preservation Program according to this new policy. S°, that's just one more item on our agenda next year that we'll have to address in one fashion, or another. I just wanted you to know this is the mechanism of government, and how they impact the Town of Southold. Thank you, Scott. SUPERVISOR HARRIS: Judge Edwards? 61 DECEMBER 21, 1993 JUSTICE EDWARDS: I iust want to thank everyone for twelve years of, quote, unquote, fun, and Farmland Preservation, Fishers Island contributed $140,000.00 for that program, and never got one penny back. The old island, again~ I hope I live long enough for the day when it becomes an incorporated village, and get rid of a lot of the bureacracy, that we've had. We've had good rapport With Southold, the Island has~ but there's'been a lot of voids. There are still a lot of voids~ and one thing I brought up in Work Session today, and I want to go on record regarding our Ha-rbormaster on Fishers Island, John Clavin, I,'m going to put in a pitch for John. He and I worked very close in gridding out the mooring plan on Fishers island to the.tune,, that is over ~I0~000.00 a year, that comes from Fishers Island into~the:General Fund here in Southold. We get some of that back. Town pays for our moorings. It pays for our, Bay. Constable, two Bay Constables, and the Harbor- master. '~Now, John has been very ded'cated. I hope that the Town wil see fit to keep him in this position, and I'm.going to quote from December 16th Traveler- Watchman, that Supervisor-Elect Wickham said. If people give quality service, we will support them. We will make appointments based on professional grounds. Unquo{e. 'That was right in the TraYeler-Watchman, and I hope the SUpervisor-Elect Wickham, and the future Town Board will look very highly to John Cla¥in, because he's done a beautiful job over there. He wants to continue on that job, and I~11 close with that., in saying, Merry Christmas and Happy New Year. SUPERVISOR HARRIS: Thank you, Judge. Anyone else at this time~. Councilman Penny? COUNCILMAN PENNY: I'd just like to thank the people of Southold Town for giving me the ability to serve for eight years. It has been a real pleasure, and I want to wish everybody Happy Holidays, and a Happy New Year. SUPERVISOR HARRIS: Thank you, George. Anybody else at this time? (No reponse.) In closing, ladies and gentlemen, let me just say that this is my last official act before I adjourn the meeting of today of December 21st. I've enjoyed the two ,terms, that you've provided me, the opportunity to lead this great town of ours. I'm completing my sixteenth year in government, twelv~e of which have been elected positions in this town. Those years have been great years as far as experience goes, but certainly watching government in action, and watching mandates, that have been placed upon it, as those years go on, has been no easy task. Those who serve in government today, and those who wilt serve in the future, will find it increasingly difficult to place upon their agenda what is in the best interest of their taxpayers, when those in higher authorities seem to be dictating other than what is in the best interest of those who elected them to office, it's increasingly difficult to watch what happens to townships, particularly those on the East End, as the pressures continue from the West End, including those pressures from the State of New York. Many of you here in this room vent your frustration, use the Town Board as a vessel, because of your frustration that you've had in dealing with government, or maybe just in your frustration of living, as a whole, in this great nation of ours. Certainly the last four years, these recess.ionary times have been no easy feat for anybody in government, but those on the Focal government level seem to be taking the brunt because they're out front, and they seem to be leading the charge, and taking what's handed down to them, through mandates of which they've had no participation or say in, or if they had a say it's falling on deaf ears to no avail to those elected officials, who have placed those mandates upon those elected officials in the townships, But, in serving the last four years, it's been a great pleasure. I want to thank all the people, who have helped make this a great time to serve you,. those around me, my staff, in particularly all the elected officials, who I've had the pleasure to serve with. It's been, I think, a wonderful experience for many of the people on the Board, who came and went in iust a short term, those who have been here for twelve years, or fourteen, or sixteen, and so on, have certainly seen what Southold has in front of it, what it has behind it,. and it certainly has to look forward to what is in the best interest of people, that are not even in our township yet, as it moves into the year 2000. These are festive occasions. I want to wish each and everyone of you the Happiest and Healthiest of Holidays. I want to thank you for your support over the last twelve years. 1, also, want to thank you,particularly those of you, who gave generously of your time at oar meetings here, who criticized this Board, or criticized happenings of government today, for understanding, to try to enhance, and make your life a little bit easier living in our great township of 353 years. We saw the 350th celebration of our town in 1990, a feat unsurpassed by one, and that 62 DECEMBER 21, 1993 was the Town of Southampton, who claims to be as old as we are. We in this town feel that we are the oldest town, and certainly, if you ask any resident he will tell you that Southold is the oldest town in New York State, and to my counterpart Fred Thiele, Fred, let the historians battle it out. You and I have had our time to see which town should continue to be the great town, however, all towns are great, and in the State of New York those who have been here the longest certainly have served the most faithful and serve, I think, in a capacitY unsurpassed by any other townshiP, because of the years of experience, that they've had to put forth better undertakings, by it's elected officials. With that, I want to thank you, wish you, again, and your family, the Happiest and Health~est of Hol!days, thank the Town Board members of the past; and the Town Board members of the present, and wish ti~ie Town Board members of the future, it sounds like a Christmas carol, doesn't it? It sounds a lot like it, the best of luck, because the years ahead are certainly not going to be any easier, than the years that we've had in the past. These are still, tough Umes. I don't see this township, as well as any other township, moving quickly, out of the recession that we've been in, and I think with us all cooperating and working together for the best interest for the people of this town, we, ll achieve that, when we enter the year 2000. With that God bless.
