Dear Mr. Brown:
The following amended resolution was adopted by the Southold Town Planning Board
at a meeting held on Monday, May 1, 2000:
WHEREAS, this proposed site plan, to be known as site plan for Lori Feilen/Pedwinkle,
is to convert a residence to a commercial retail store; and
WHEREAS, Lod Feilen is the owner of the property known and designated as Lod
Feilen/Pedwinkle, Main Road Southold, SCTM#1000-62-3-38; and
WHEREAS, a formal application for the approval of this site plan was submitted on
March 28, 2000; and
WHEREAS, this amended resolution replaces the resolution approved by the Planning
Board on April 10, 2000; and
WHEREAS, a single row of six foot high White Pines, planted fifteen feet (15') on
center, will replace the single row of Canadian Hemlocks, previously approved by the
Planning Board on April 10, 2000. These White Pines are to be planted this Spdng in
the west side transitional buffer as requested by the applicant; and
WHEREAS, a single row of six foot high appropriate evergreens, planted six feet (6')
on center, will replace the Canadian Hemlocks, previously approved by the Planning
Board on Apd110, 2000. These appropriate evergreens are to be
planted in the south side transitional buffer as requested by the applicant. These
evergreens will be planted in the Fall of 2000.
Periwinkle - 5/2/00 - Pa,qe Two
This planting in the south side transitional buffer will be supplemented with a second
row of broadleaf evergreen shrubs to be planted next spring, 2001; and
WHEREAS, all merchandise for sale will be placed south of the edge of the display line
shown on the plan last revised on Apd118, 2000. The Planning Board approves leaving
this merchandise overnight in the area between the front of the house and the edge of
the display line. No for sale merchandise is to be placed in the area north of the edge
of the display line and the Main Road; and
WHEREAS, this site plan, dated March 28, 2000, was certified by the Building
Inspector on April 7, 2000; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold
have been met; be it therefore
RESOLVED that the Southold Town Planning Board authorize the Chairman to
endorse the final survey, dated April 18, 2000, subject to a one year review from date
of building permit.
Enclosed please find 2 copies of the approved amended site plan; one for your records
and one to be submitted to the Building Department when you apply for your building
permit.

Hi Peter,
I've been asked by the Planning Board to follow up on an old complaint regarding the site and site plan for"Hampton
Hearth/Periwinkle" located at the corner of Town Harbor Ln and Rt 25 in Southold.
I wanted to know if you have an old complaint that was filed with Damon at the time (this was underway before you
started) in your records or if I should start a new one from the Planning Board. However I'd like to speak with you before
any documented moves are made.
The Planning Board is concerned with the display of items within 100'of the Rt. 25.A 100' set back is shown on the
approved site plan as a minimum for where sale items may be displayed; it has been observed that items are being
displayed within 10-20' of Rt. 25.
Let me know if you have any old information regarding this site and then we can go over how to move forward.

Dear Ms. Kohn:
I am writing as a follow-up to the Planning Board Work Session held on August 8, 2011
where the status of the above-referenced site was discussed. On May 1, 2000, the
Southold Planning Board approved a site plan for this location; a copy of the site plan
and the approving resolution has been included for your review. Businesses are
required to operate their sites within the bounds and requirements of the site plan
approval. In your case, the Planning Board has found that the site, in its current state, is
not in compliance with the approved site plan. Below is a list of items that were found to
be inconsistent with the approved site plan.
1. Required screening/buffer:
The required screening along the southern property line is missing. The site
plan requires an evergreen buffer along the neighboring property line. A
single line of Arborvitae evergreens at a minimum of six feet in height and
located every six feet on center is shown on the site plan along the southern
property line. This screening must be planted and maintained as shown on
the plan. You may request in writing for the Planning Board to consider some
other species for the landscaped buffer.
2. Dumpster:
The existing dumpster and enclosure were not part of the approved site plan.
They should either be removed, or a request to add a dumpster to the site
should be made to the Planning Board for their approval.
3. Outdoor display of merchandise:
Merchandise is being displayed within 100' of the NYS Rt. 25. The site plan
requires that all merchandise for sale shall be displayed 100' south of NYS
Route 25 as shown by the "edge of display" line on the approved site plan.
The issues listed above must be corrected within ninety (90) days for your site to be in
compliance with the Town Code. Any changes to the approved site plan must receive
prior approval by the Planning Board. Minor changes may be approved via letter; major
changes must be approved by submitting an application for an amended site plan.

In response to your memo regarding the proposed use of the above referenced
property, be advised that the use is Retail and is permitted in the zone. Their
desire for outdoor storage/display incidental to the proposed use is an accessory
use. However this accessory use is subject to Site Plan Approval pursuant to
Section 100-239.7 which states;
§ 100-239.7. Long-term outdoor display or storage. [Added 6-11-1996 by L.L. No.
13-1996]
All uses which seek to display or store merchandise or property on any basis

The Suffolk County Department of Health Services has informed the Planning
Board that the reasons for Health Services review of site plans which contain
buildings, such as storage buildings, that do not have potable or waste water
systems are as follows:
To have a record of what facilities exist in the proposed building. For
those proposed buildings that do not have any potable or waste water
facilities, that fact is noted in the record to insure that these facilities are
not installed in the futura without a permit.
An inspection is made to insure that there are no toxic waste materials
being used or stored on site.
Calculations for waste water flow are made using square footage of all
buildings. This calculation includes buildings that do not have potable
and/or waste water facilities.
A review is made to insure that the new building is not built over any
existing facilities, e.g. wells or septic systems.

The Board agrees with the change on the west side of the property from

fifteen feet (15') on center.
The Board also agrees with the substitution of a single row of six foot
high appropriate evergreens, planted six feet (6') on center, for the
Hemlocks on the south side. These evergreens will be planted in the Fall.
This planting will be supplemented with a second row of broad leaf
evergreen shrubs to be planted next spring.
The Board reiterated its requirement that all merchandise will be placed
south of the edge of display line shown on your plan dated April 18, 2000.
An amended resolution containing the above changes will be on the
Board's May 1, 2000, agenda at its public meeting.

Mr. Kassner,
As per our conversation today I am writing to request amendments to the planting plan on
the Periwinkle application.
Having had a former backround in landscape design~ I was asked by Rob Brown to make
a suitable recommendation for the screening plant material at the Periwinkle site. I
recommended thc Canadian Hemlock. Since then it has come to my attention that not
only are 6' specimens unavailable and if they were available, the cost per plant would be
prohibitive, but they are currently suffering from a bug born disease that requires a
minimum of 3 spray applications a year and that doesn't guarantee their survival.
Needless to say this would be a poor choice for several reasons.
With these facts in mind I would like to seek ammendments to thc planting plan.
As I have not been involved in any previous planning board application work, I would
like to ask a few questions not only on behalf of our client but also in consideration of the
finisbed public appeal oftbe project at hand.
As this was an existing retail business property prior to the sale and was allowed to
function as suck without all this screening wc ask that you as the Planning Board
consider some leniency in the time frame that this new owner has in completing the
screening required and/or thc extent to which it is required.
The proposals as they are requested are in an effort to plant both appropriately and as
attractively as possible. More quickly and less expensively are not necessarily thc best
solutions in this instance.
Proposed changes to Periwinkle screen as recommended for site plan:
For the west side of the property (+185') we would like to change the plant material to
a single row of Eastern White Pines: Planted in a single row at 15' on center.
For the southem boundary of the property, as a 6' Privet Hedge exists and provides
summer through fxost cover, and was considered appropriate for the pre-existing
business, we ask that the new owner be allowed to plant a single row of appropriate
evergreens in the fall to replace the existing & 8' Privet Hedge and supplement the
planting with the second row of more attractive, broad-leaved evergreen shrubs next
spring or fall.
Suggested Southern bounda~ to be planted with variety "Green Giant" or variety "Dark
American (Nigra)" Arborvitae ~ 10' on center. (both of which have more appealing
qualities than the common variety "emerald" which is unattractive and much over used)
This initial screen to be later supplemented with a foreground, staggered row of large
Rhodos, Hollies and Laurels, to give a softened, landscaped appeal rather than a "we
were made to plant this wall look."
If you are unable or unwilling to extend this compliance deadline, for the southern
boundary we ask that you consider a single row of the available variety of the suggested
arbor vitae at this time and the staggered, additional row of Arbor Vitae to be planted in
the Fall when and where the Privet Hedge is, that will be scheduled for transplanting off
site.
In considering our requests please take into account the fact that we wish to comply with
all the rules and regulations, and that it is the new owners wish to enhance, not just
screen this property.

Dear Mr. Brown,
The Planning Board received a letter and site plan from your client,
Lori Feilen, on Friday March 17, 2000.
In Mrs. Feilen's letter she states that the requested 15' buffers have
been described and noted on the plan.
The plan does not show the requested evergreen vegetated 15' buffer on
the south west side of the property. The 15' buffer in the rear of the
property is indicated on the plan but no plantings are shown.
This buffer was discussed at our pre-submission conference.
The previous site plan dated February 16, 2000 did not show the
bathroom addition as indicated on the present plan. It also showed the
second floor as storage; the present plan shows this second floor as
empty.
This building is listed on the Society for the Preservation of Long Island
Antiquities inventory. The dimensions, architecture and drainage for the
bathroom addition are not shown on the plan. The elevation drawings and
materials must be reviewed be the Architectual Review Committee.
The scale for site plans is 1" = 20', The plan submitted is 1" = 30'.
As discussed with you at the Board's work session on March 20, 2000, a
site plan application will be required in acordance with Section 100-250
of the Zoning Code showing the above noted information.

In response to your memo regarding the proposed use of the above referenced
property, be advised that the use is Retail and is permitted in the zone. Their
desire for outdoor storage/display incidental to the proposed use is an accessory
use. However this accessory use is subject to Site Plan Approval pursuant to
Section 100-239.7 which states;
§ 100-239.7. Long-term outdoor display or storage. [Added 6-11-1996 by L.L No.
13-1996]
All uses which seek to display or store merchandise or property on any basis
other than temporary, as described above, must obtain site plan approval for this
activity. This section primarily is intended to apply to that merchandise or
property which is too large to be kept inside, such as automobiles, boats, artifacts
of museums or historical societies and building materials.

Ms. Feilen, current owner of the Victorian Barn recently called me
regarding a conversation she had with you regarding her new site plan
for a garden furniture store. She indicated that you said she could
display garden furniture and gazebo's permanently on the front lawn.
This property is located in the Hamlet Business (HB) zone, not in the
General Business or Limited Business zone where display of garden
materials are permitted. The use most near garden furniture in the Hamlet
Business zone is "Retail". Permanent storage of material in the front yard
is not permitted in this zone as far as I can determine.
Please indicate in writing if this use is permitted so the Planning Board
can continue its review of this pre-conference submission.

above referenced property.
As new owner, Ms. Feilen intends to convert the first floor of the existing house to retail
sales for a garden furniture store, along with use of the existing retail barn structures.
The second floor of the house will be used for storage.
The site plan, enclosed, indicates proposed parking, as well as, handicap accessible
parking and romp.
Please advise if the Planning Board can waive site plan review so that Ms. Feilen can
obtain a Certificate of Occupancy as soon as possible.
