The following action was taken by the Southold Town Planning
Board, Monday, December 22, 1986.
RESOLVED that the Southold Town Planning Board approve the
amended site plan for Lynn Sciora for amending the parking area
of the existing building located at Greenport, currently being
used as a restaurant. The site plan dated August 21, 1986 has
received certification from the Building Department.
Upon receipt of the Chairman's endorsement we will forward
a site plan to you.

subject to the asphalt parking area being completed in

Gentlemen:
This site plan was submitted to our office by Richard
Gasser for our review and comment. Mr. Gasser states that
this parking location was suggested by the Planning Board
for this site developement.
Please be advised that the required certification can
not be made for the following reasons.
The parking area as shown is located within the right
of way of Rt. 25 owned by N.Y. State. Off street parking
shall be provided on the same lot to which they are access-
ory. (Art XI Sec. 100-112 B.H.)
Access to and exit from parking space is within 50'-
0" of street intersection. This is not permitted. (Art.
XI Sec. 100-112 B.D.)
It would appear that the parking needs for this use
can be met on the subjects property so that certification
can be made. Mr. Gasser has a building permit application
on file with this office and is anxious to get started with
the addition to building. A revised site plan will follow
from Garrett A. Strang Archt.

Upon application for LYNN SCIORA, by G. Strang, Box 1412,

WHEREAS, a public hearing was held and concluded on March 28,
1985, in the Matter of Appeal No. 3324, for LYNN SCIORA: and
WHEREAS, the board has considered all testimony and documenta-
tion entered into the record during the public hearing and since the
filing of this application; and
familiar
and
WHEREAS, the board members have personally viewed and are
with the premises in question, as well as its surrounding area;
WHEREAS, the board made the following findings of fact:
1. The property in question is zoned "C-Light Industrial"
and contains an area of 12,500 sq. ft., with 100' frontage along the
south side of the Main Road and 125' frontage along the west side of
Kerwin Boulevard, Greenport, as shown on site plan dated 12/18/84
prepared by the office of Garrett A. Strang, architect;
2. Existing on the subject premises is a 2,950+ sq. ft.
building set back approximately three feet from the Main Road and
from the westerly property line, and set back approximately 38 feet
from the most southerly (rear) property line;
3. Applicant is proposing by this application to construct
a bathroom addition of a size 10' by 21', leaving a frontyard setback
from Kerwin Boulevard at 51± feet, which appears to be compliance with
all other zoning requirements for this zoning district;

4. Article VIII, Section 100-80(B)[13] permits eating
and drinking establishments by special exception by the Board of
Appeals, as provided by the Bulk Schedule, and subject to site
plan approval by the Planning Board;
5. It is noted that the existing building had previously
been used as a delicatessen, however, that us~ was ~iscontinued for
at least eight years;
6. It is also noted for the record that a previous
appeal was granted under Appeal No. 2679 to Raymond and Anna Ciacia
for insufficient area and width of this parcel set off from the
parcel identifi!ed as 1000-53-3-23 and to relocate the one-family
dwelling from one onto the other;
In considering this application for a Special Exception
use, the board determines: (1) that the use will not prevent the
orderly and reasonable use of adjacent properties or of properties
in adjacent use districts; (2) that the safety, health, welfare,
comfort, convenience and order of the town will not be adversely
affected by the property use and its location; (3) that the use
is in harmony with and will promote the general purposes and intent
of zoning since it is a permitted use.
In passing upon this application, the board has also
considered items (a) through (1) of Article XII, Section 100-121(C)[2]
of the Zoning Code.
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Sawicki, it was
RESOLVED, that a Special Exception for permission to
reinstate business as a delicatessen to include on-site eating
and drinking services in this "C-Light Industrial" Zoning District,
BE AND HEREBY IS GRANTED, SUBJECT TO THE FOLLOWING:
1. Planning Board approvals as required by Sections 100-134
and lO0-112 of the Code of the Town of Southold;
2. Referral to the Suffolk County Planning Commission
pursuant to Sections 1323, et seq. of the Suffolk County Charter.

"Ann's Country Cafe" (Lynn Sciora)
Dear Mr. Strang:
Please let this confirm the findings and recommendations
of the Planning Board, Monday, March 4, 1985.
Following a field inspection of the above mentioned site
plan, it was noted that the pull-in parking off of Main Road
may best be located in front of the store and within the
right-of-way of the Main Road (NYS Route 25). The existing
gravel area between the property line and the edge of the existing
paved road is extensive and more than adequate to handle
parking; it is actually wider than the current pull-in parking
that Penny Lumber is using to the west.
It was the consensus of the Board to recommend utilizing
pull-in parking in front of the store within this right-of-way
coordinating site plan review with the State Department of
Transportation. It was also requested that the NYS DOT be
contacted for a grading plan of the right-of-way.

Gentlemen:
On January 9th, an application for a Special Exception
was filed with our office to establish a coffee-lunch service
and delicatessen at the corner of Kerwin Boulevard and Main
Road, Greenport, at the site of the previous "Ann's Deli."
As you are probably aware, Article VIII, Section 100-80-
(B)[13] permits eating and drinking establishments subject
to this application as well as site plan approval.
Prior to our scheduling this matter for a public hearing,
we would like to receive your comments after you have reviewed
this plan as to the site-plan elements of Section 100-134.
In many of our past decisions concerning business properties,
we have required barriers to prevent parking along the highway
and side streets, particularly "backing out." We also ask
your emphasis in this regards.
