Apppellants propose to locate the new metal building along the westerly yard area 50 feet from the north (front) property line, 15 feet from the existing building, and not less than 35 feet from the west (side) property line. The building is shown to overlap the deeded lot line (between Lots 13 and 15, and Lot 12) approximately 15 feet deep, and is proposed to be set back not closer than 25 feet from the wetland grass area, or "ditch," at the nearest point. By prior action taken by the Board of Appeals May 3, 1979, under Appeal No. 2541, a use variance was conditionally granted for the establishment of storage for a portable small- scale welding business at premises identified on the Suffolk County Tax Maps during 1979 as District 1000, Section 53, Block ~t.Lot tainin .458,5 "f " . It is noted that the percentage of relief requested for this requirement is 66%, or 50 feet, which is substantial in relation to the zoning requirements. It is also noted for the record, however, that the Southold Town Trustees have (a) determined the "ditch" area to contain wetland grasses as defined by Chapter 97 of the Code of the Town of Southold, and (b) conditionally approved a wetland permit March 27, 1986. This board also determines the nearest wetland grass area in this project to be within the "ditch" that extends from the waterways near Pipes Cove, although the N.Y.S. Department of Environmental Conservation has determined a further wetland boundary line as regulated by the State regulations. The nearest wetland area as determined by the Town is considered in making this determination. 10. It is the opinion of this board that the placement of a 50' by 70' building, accessory to the existing welding business, as an alternative and conditionally~noted below, will not change the essential character of the business use granted under the prior variance, and that such an increase of building area does not affect its rights to continue the present use, at the present 26,458I sq. ft. site. No expan- sion or extension of the welding uses are covered by this variance, or the previous variance, into the abutting southerly parcel (Lot 12). 11. In considering this appeal, the board also finds and determines that by permitting the construction of an 50' by 70' building as conditionally noted below: (a) the use will not prevent the orderly and reasonable use of this and surrounding properties; (b) the plight of the owner is due to unique circumstances and not to the general conditions in the neighborhood which may reflect the unreasonableness of the zoning ordinance itself; (c) that the use thereof will not alter the essential character of the locality; (d) that the use thereof is consistent with the prior use variance since there will be no change; (e) the owner would not deprived of his rights to construct and continue the permitted use; (f) the use thereof will not prevent the orderly and reasonable use of this district or adjacent use districts; (g) the safety, health, welfare, comfort, convenience and order of the town will not be adversely affected; (h) there is no other method feasible for . ~ . . Accordingly, on motion by Mr. Douglass, seconded by Mr. Goehringer, it was RESOLVED, to APPROVE the construction of an 50' by 70' building in the Matter of NORTH FORK WELDING under Appeal No. 3550, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The "welding" use must be conducted within the building at all times; 2. No outside storage; 3. No retail sales of flammable materials (such as gasoline, oil, etc.); 4. Entrance and exit driveways shall have an unres- tricted width of not less than 12 feet and not more than 30 feet, and shall be located not less than 10 feet from any property line, laid out as to avoid the necessity of any vehicle backing out across any public right-of-way; 5. Vehicle lifts, pits, dismantled or inoperative vehicles, and all parts and supplies, and similar items shall be located within a building; 6. All service or repair, except minor servicing (such as changing of tires) shall be conducted in a building, 7. By prior action taken by the Board of Appeals May 3, 1979, under Appeal No. 2541, a use variance was conditionally granted for the establishment of a welding business at premises identified on the Suffolk County Tax Maps during 1979 as District 1000, Section 53, Block 2. Lots 13 and 15, containing a maximum lot area of 26,458 sq. ft. By survey mapped April 24, 1979, the premises was improved with a barn structure and accessory garage building lsee Mitchell Pekunka survey prepared by Roder- ick VanTuyl, P.C.] The premises during 1979 also was zoned "B-Light BU,siness." Conditions placed with the board's decision are: (1) There shall be no outside storage of equipment or work that is to be completed by the applicant; (2) If the proposed number of employees on the premises becomes larger than two, the applicant shall return to the Board of Appeals for a review of this action; (3) Suffolk County Planning Commission approval. 6. Appellant proposes to construct the new one-story metal building along the westerly yard area 50 feet from the northerly (front) property line. 15 feet from the existing building, and not less than 35 feet from the westerly property line. The new building is shown to be extending into the southerly parcel, overl~pping the deed lot line. and having a setback from the most southerly line (depicted"drainage ditch") at not closer than 25 feet. With reference to the expansion of the welding business, it is the position of this board that the record is not sufficient . ': ) Page 3 - Appeal No. 3501 Matter of NORTH FORK WELDING/SCHOENSTEIN Decision Rendered June 25, 1986 .. .. in showing by dollars and cents proof: (a) that the land in question cannot yield a reasonable return if used only for a purpose allowed in this zone district; (b) that the plight of the owner is due to unique circumstances which may reflect the unreasonableness of the zoning ordinance itself; (c) that the use requested will not alter the essential character of the neighborhood. Dollars and cents proof has not been presented in this case. Also. it has been held by the courts that a Board of Appeals ~annot under the semblance of a variance exercise legislative powers. It is apparent that the variance in relation to the requested expansion of welding-shop use is substantial, and the effect of the grant of same will be circumventing a change of zone or to establish a zone district completely at odds with the surrounding neighborhood and zoning code. 8. With reference to the insufficient setback from wetlands, it is the positionof this board that the variance be denied since: (a) the reljef requested is substantial at 65 percent of the requir~ments. or more; (b) the circumstances are not unique; (c) the practical difficulties claimed are not suffi- cient to warrant silme; (d) tl1e r~lief requested is not the, minimum necessary; (e) there will ~e a substantial change in the character of the nei ghborhood or detriment to adjoining properties. Actually, I had a long talk with Merlon Wiggin who represents Schoenstein and he explained the whole project in more detail. There are a number of IFs, but it seems that the CAC could now recommend approval of the plan. We'd like to see a buffer of plantings between the property and the drain to the south; we'd like to make sure runoff from the expanded parking area is contained and channeled. Finally, we'd like to see the gear and equipment kept well within the bounds of the property, under cover and away from the drain bank, at the very least enclosed by a fence. What we're trying to say is that we would like to see the project properly "policed up" and that our approval would be contingent on cleaning up some of the problems that already exist. . It has not been granted yet. Our Conservation Advisory Council Has recommended substantial changes in the Schoenstein proposal, i.e. that the addition have a greater setback than 20 feet. This would be possible if the new building is shifted alongside the old structure and rotated away from the creek. The Town Trustees wish to discuss this with Schoenstein. In addition, both the CAC and Tustees want measures taken to prevent polluted runoff from running from the site into the creek; mitigating measures would include impervious, sloping surfaces, drains and catch basins. This should be discussed by the Trustees. We'll try to post a CAC representative at your meetins in the future, whenever one of our wetlands areas is on your agenda. The Trustees made several surveys there, one initially in response to the placement of fill on the parcel to the East of the building and then subsequently for the inspection for the wetlands permit for the construction of an addition to the business, a building, which will be placed within 20' of the stream bed that goes in behind there. The CAC presented us with comments in opposition to this feeling there would be possibly alternatives to placement of the building construction so close to the stream. I would not want to answer for the Board, as I don't know what their feelings were. Dr. Garrell: This one, we had reservations with for several reasons. First there were Town Ordinances that were already in question with the Welding Shop. We felt that it should be at least held up, with respect to the Town Board, to find out what the Variances were and what kind of arrangements had been worked out to give Schoenstein permission to use the School Building in the first place, and whether they had said anything about expanding in the first place. More importantly we felt that he had adequate property to site that shop differently, maybe it was an oversite. It just seemed that he could turn it around to at least 45 degrees and not 90 degrees and keep away from the wetlands. The third thing was the rip rap that was lying around which certainly didn't indicate the type of stewardship that you would give someone to go within a creek. This in fact, I think you will remember Jay was working on this with us the other night, the Significant Habitat Designation thi whole area is on the Significant Habitat Designation. Trustee Bredemeyer: I move that we table the application requesting additional information. In light of what Dr. Garrell said, whether he has approval for the use and for the expansion of the facilities and that possibly to request if a different configuration could be made to try to lessen the potential impact on the stream. Trustee Larsen: Dr. Garrell how many feet do you think he will gain by turning the building? Dr. Garrell: I figure he will gain 40 or 50 feet by turning it. The Nicoletti~ purchased their property of 50 Pipes Neck Road in good faith at a time when the neighborhood was zoned as light business. Subsequently, a "light business" two employee welding shop has burgeoned into a large "heavy" multi-employee industry - all this in violation of zoning regulations. The Peconic Bay Property Owners Association Inc. protests these violations and insists that town authorities put a stop to them. Although zoned light business, this is a residential neighborhood. There are four homes to the west of Mr. Schoensteins's Welding Plant with the:Nicoletti's home on the immediate east. Reference is made to the property of Joseph and Linda Schoenstein (North Fork Welding) on Route 25 (Section 53. Block 2, Lots 12, 13, 15, 172, 173. and 174). The property is presently zoned B-1 with a use variance given in 1979 for a welding and fabrication shop. The variance contains a restriction that all work is to be done indoors. Because of increased business, including work for the Town of Southold, the Owner wishes to erect a prefab metal building to accommodate same. As the Master Plan shows this property to be LB, its adoption would place North Fork Welding in a non- conforming pre-existing use category. Also. because of the proposed LB zoning, it prohibits consideration of a revised site plan by the Planning Board. You will also note (see Site Plan) that Mr. Schoenstein owns the property immediately adjacent to the East, which he agrees to be kept as a buffer zone, and all property to the South is wetlands and unbuildable.
