The Board finds it is unable to recommend the issuance of a Certificate of Occupancy because of discrepancies between the site and the plan. The discrepancies are noted below. The grate on the storm drain leaching pool on the south side of the building is too high. The grading around the grate is too rough to permit the unimpeded flow of water into the leaching pool, and it is not pitched toward the pool grate. The grading around the storm drain leaching pool on the north side of the building is not pitched toward the grate and does not channel the water into the leaching pool. The parking lot is smaller than that shown on the site plan. (It appears that sanitary leaching pools are located where northern edge of parking lot should be.) Placement of bluestone driveway between parking lot and road has not been completed. o Rear slope (on east side of property) is greater than 3 to 1. This area should be properly graded before required plantings are installed. Upon resolution of the above-noted items, the Planning Board will schedule another inspection. The Health Department in response to the Planning Board's statement that it had lead agency status has received a letter from the Health Department stating that the test wells that have been dug on the property indicated that there is an axcessible amount of Carbofuran present in the wa[er. The level that is present there does not meet with the County Health standards. The applicant has been asked to dig a deeper test well. The correspondence which we have received today, it indicates that if they can not meet, ... from the deeper wells ends up with have the same reading as the previous reading then they are going to require a community water system. Based on the information I suggest the Board should perhaps wait for the results of the test wells before moving ahead with preliminary approvals of Section Two. A SEQRA determination has not been made at this point. I don't know if you have enough information to make a SEQRA determination. RESOLVED that the Southold Town Planning Board approve the site plan for Sal Prato for construction of an electrical contractor's building located at Kerwin Blvd., as certified by the Building Department and approved by the Town Trustees, subject to the following conditions as recommended by Town Planner, Valerie Scopaz and accepted by the Planning Board, to wit: 1. The submission of a revised site plan indicating the following: a. Location of existing drainage pipe leading from catch basin across the street to the wetland at this site. b. Landscape plan for the site which meets with the approval of the Planning Board. c. A statement that there will be no outside storage of materials. d. During the discussion of the presentation to the PIanning Board and Building Department, it was suggested that the fenced storage area be deleted from the project. This was accomplished and the building size was increased by ten (10) feet in width in lieu of the fenced storage area. Informal discussion with the Trustees office indicated that a resubmittal would not be necessary, but that the approval given should suffice, seeing that there has been so little change in the project itself. The property is under a contract for purchase by Sal Prate from Daysman Morris. Sal Prate, as you know, is an electrical contractor and is one of the local contractors that has been cited for having equipment in his garage used in the performance of his work. He has gone to a considerable amount of expense to arrange to purchase commercial (B-l) property so as to relocate his business.
