As you know, we conducted a thorough review of the materials in the Planning Board's file, as well as reviewing the history of the property. From our research, it appears the property was divided into three tax parcels by deed in August, 1987. Unfortunately, this split of the property did not have the approval of the Planning Board, and the lots do not appear to be recognized for the purpose of building permits for single family residences. Southold Town Code §280-9 Lot Recognition, requires that all lots must be approved by the Planning Board or created by deed on or before June 30, 1983, or approved by the Zoning Board of Appeals or Town Board on or before June 30, 1983. It should be noted that, as Town Planning Director, I do not have the authority to state conclusively whether a parcel meets our Lot Recognition code; I can only provide the facts that I find. It appears that these three tax parcels do not meet any of the requirements of lot recognition because they were created by deed in August, 1987, and there is no Planning Board approval on record. At our meeting we discussed the process to create additional lots on this property, which is currently considered one large parcel. The process would be to apply for a subdivision from the Planning Board. Subdivision applications are typically required to include new surveys and information about the land, including its environmental features such as wetlands. Access via a road that meets the Town's Highway Specifications (Town Code Chapter 16 1) will also need to be provided on a detailed road and drainage plan (see §161-15 A. for specifications for subdivisions). At the end of the subdivision application process, the cost to construct the road improvements is required to be held in a performance guarantee until the road is completed. Southold Town Planning Board Page 2 May 22, 2018 The Town's subdivision process and requirements are outlined in Chapter 240 of the Southold Town Code. It is a three step process that begins with Sketch Plan, proceeds to the Preliminary Plat application, and ends with the Final Plat application. The process also includes a review under the State Environmental Quality Review Act(SEQRA), which examines any potential environmental impacts of subdividing the property. And the Town's Board of Trustees will also be involved in the review of this application due to its proximity to wetlands. There is a fourth step to finalize every subdivision map, which is to file the map with the Suffolk County Clerk, where it is then officially recognized as a subdivision. Costs for a subdivision will likely include the application fees, an administration fee which is 6% of the performance guarantee referenced above, and a Park & Playground fee, which is currently $7,000 per new lot created. Other costs include the fees for an engineer to draw the plans required for the Planning Board and the Suffolk County Department of Health, an environmental professional to flag the wetlands, a surveyor to add those wetland flags to the survey. At the end of the process there will be the cost to construct the road (this can be done after the map is filed, however the Town holds the performance guarantee until it is completed). Another likely cost is for the extension of the public water main, which has been extended to the parcels adjacent to this property, and is likely to be required by the Suffolk County Department of Health Services. The County also requires test holes to determine the distance to groundwater and the soil composition. These are just examples of the potential costs to complete a subdivision, and may not include all the costs to complete a particular subdivision. We also discussed the time-frame for completing a subdivision. We cannot guarantee any particular time-frame due to the many variables in the process outside of our control. I met with you personally on July 23, 1987 , to discuss this matter and, if I recall correctly, you explained that the Town Code would not permit the Board to grant any additional extensions. Your recommendation was to resubmit the original application, with the understanding that additional fees may be required. The Planning Board 's July 27, 1987 meeting agenda called for consideration of our request for an extension on the conditions of final approval, and acceptance and request for compliance with report No. 602 from Inspector Davis with regard to the right of way improvements . On September 25 , 1987 , we complied "to the letter' with the Boards 9/2/87 advise, once again requesting that this application be reinstated and the 7/14/86 approval be updated and reaffirmed. On October 27 , 1987 , a letter from the Board states that the new application has been reviewed. They request certain map revisions, and road improvements , to be bonded and constructed to Town specifications . These requests were totally inconsistent with our understanding of the Board 's position on this application. On December 11, 1987 , Mrs . Shalette and I met with you and stated our position, as follows: ( 1 ) That applicants were prevented from complying with the conditions of the 7/14/86 approval , prior to its expiration, due to the nonexistence of accepted "requirements of Inspector" ; and, ( 2 ) that, besides being inequitable due to the particular circumstances of this application, the imposition of road improvements to Town specifications would be cost prohibitive for this project; and ( 3 ) that our repeated requests that the 7/14/86 approval be reinstated, updated and reaffirmed were never acknowledged by the Board, although we had been led to believe that the Board was amenable to this procedure, based upon my discussion with you on 7/23/87 and the Board ' s letter of 9/2/87 . At this 12/11/87 meeting, you assured us that the matter would be addressed at the Planning Board ' s 1/8/88 work session and that we would have their response on 1/11/88 . No response issued from that work session. Davis Date: June 30, 1987 Re: Access road for minor Subdivision - Arshamomaque Island at Southold - Map by Van Tuyl 'dated Amended 4/ 15/86. Road profile dated amended 4/8/87. Comments: The R.O:W. for this 3 lot subdivision starts at the Lang property with a width. of 50 ft, narrows to 25 ft. in the first 90 ft. and continues at that width to the end (total length, 922 ft.±) . Present access to the house in lot no. 1 is via the first 230 ft. of the above R.O.W. and a continuation road system within the lot. Soipe of the access in the lot is paved with asphalt. The existing road, 8 ft.± in "width, in the 230 ft. section consists of bankrun and is in fair condition. Provided the alignment 'of the proposed access is approved by the Planning Board, the road profile as submitted by Van Tuyl, dated amended April 8, 1987 is acceptable within itself as shown. However, the profile O.S. elevations according to Van Tuyl on 4/22/87 are from field survey. They, differ" considerably from the contours shown from the County Topo Map. See Note 2 on plan. Do not know what datum was used in the profile survey., Provided the field work is correct the road construct'ion, can be done as proposed using the Van Tuyl datum. Two test holes at north end of the R.O.W. -show leaf mold and sandy loam for 18": One test hole at Sta 4+00± showed about the same 'infor- mation. Recommendations: 1 . Clear the 25 ft. R.O.W. for the full width. 2. Road width to be , 16 ft. centered in the R.O.W. and crowned as .shown on the profile sheet. 3. Remove topsoil, etc. in the 16 ft. width for 18" where necessary. 4. Replace topsoil, unsuitable material, etc. with compacted sand and gravel to subgrade ,for the road section (8" below the centerline profile) . 5. Road section 16 ft: wide crowned 4"/ft. - _ _ _ - —and to consist of 6" compacted bankrun containing 157 or more of 'g•ravel, 10% of loam and a top course of 3/4" stone blend. Top course width' to be 16 ft. and depth to be 3" L.M. to obtain a 2" compacted measure. 6. ' Drainage: ' The shallow leaching basins at Sta 4+50 and 8+00 are acceptable with the following: Install 3 - 4 ft.x 8 ft. diam. rings on both sides of the road at each of the stations. Leaching basins to be spaced 5 ft. apart and to be connected with 18" C.M.P. One L.B. in each set to have inlet casting, others to have traffic type covers. Details of these structures should be shown on the plans. The nat- ural drainage gutters at Sta 0+00 could be utilized for pavement runoff from the first 200 ft.f of the access road. John W. Dear Mr. Orlowski: I am writing you this letter for two purposes. The first is to ask that you and your board reconsider the requirement that the right-of-way be improved at this time. I have enclosed a copy of the boards resolution dated July 16, 1986, approving the subdivision application. You will note that the condition relating to the right-of-way was ammended to read ". . . prior to Building Permits". At that time I did not say anything or do anything about the right-of-way since I was not applying for a building permit. Now no one seems to know anything about the handwritten "prior to Building Permits", and the time is running out. I would ask that the board consider the following: 1. The right-of-way only provides access to lot number two, ,so it certainly does not lend itself to being heavily traveled or being any kind of a major problem. 2. It is far better that the right-of-way be improved prior to the issuance of a C.O., and after the building permit has been issued and construction is completed. I have had several experiences with clients who improved their access roads prior to construction, and then had the roads torn up by cement trucks and other heavy construction equipment during construction and utility installation. I believe the above to be very valid reasons not to require construction of the right-of-way at this time. I would ask that you please give this request a favorable consideration. In the event the board continues to require the improvement at this time, I would ask for an extension of time within which to comply. After speaking with Diane last week, I called Van Tuyl and was told that they would not be able to stake out the right-of-way and/or provide elevations -for about six weeks. That would bring us into January, and then by the time Mr. Davis could review the information and determine the requirements for improvements, it would be mid-January, or later, and more than six months since the board's resolution. It would also be mid- winter when weather could be expected to be a factor that could hinder any work on the site. For all of the reasons set forth herein I would ask that the board reconsider the requirement that the right-of-way be improved at this time, or if that is not possible, that I be granted a reasonable extension. I am writing this letter because I am concerned about Arshamomaque Pond in Southold. This wetland, is a valuable ecological resource which should not be exploited by developers. r. The pond and surrounding shoreline vegetation provides vital habitat for a variety of organisms., For example, during the spring and summer the pond is an:-important feeding area for many breeding birds especially herons, egrets, ospreys and kingfishers to name a few. I have only mentioned avian examples but it should not-be ignored that they,are only a part of the Arshamomaque Pond ecosystem. I have observed that the herons and egrets only forage in areas where the shoreline vegetation remains undisturbed. Iii light of this I am writing tb-`_make several requests: 1) The recent subdivision of the Ofrias property would include a covenant prohibiting disturbance of shoreline vegetation. 2) The waterfront lots of Long Pond Estates also not be allowed to destroy shorelone vegetation. In addition, the pond is very narrow in these areas. With the recent increase of boating in the pond, I fear making the width smaller by building of docks along the Ofrias' and. Long Pond Estates shoreline would be unsafe. As long time residents of Southold, my family and I both feel it is important to maintain the integrity of Sbuthold°s 'remaining wetlands. I am afraid if the shoreline of Arshamomaque Pond continues to be developed, vital habitat for our endemic wildlife will be destroyed. 'Arshainomaque Pond isLimpbrtant for ecological reasons but it is also an,Importdnt recreational and educational resource for the residents of Southold. The proposed subdivision will result in the creation of three landlocked parcels; that is, parcels that do not have frontage on an existing or proposed public road. The creation of such lots is contrary to good subdivision layout principles and creates problems as far as access by emergency and service equipment is concerned; this could result in health, safety and welfare problems for the future residents of these lots. Creation of landlocked lots also places the Zoning Board of Appeals in the awkward position of having to grant a building permit for each of these lots under Section 280-a of the Town Law as the future owners of these lots cannot be held responsible for the landlocked nature of the parcels. 2. It appears that the map is incomplete as there is no indication of the easterly and southerly boundaries of Lot 4. With respect to the first objection by the Suffolk County Department of Planning I can only state that there is a 50' wide right of way connecting Arshamomaque Island to the nearest public road. My family and I have lived on Arshamomaque Island for the last six years. During that period of time ingress and egress over the 50, right of way has never been a problem' and I do not foresee any change in the future. Once one enters onto the island itself all of these lots'are accessible by way of a 20' wide right of way which will necessarily be constructed and improved to the standards determined by the town engineer prior to the issuance of any certificate of occupancy. With respect to the second objection by the County I can only say that the question as to the easterly and southerly boundaries of lot #4,were property addressed by Robert Tasker, the town attorney, and I believe that that issue has been answered to your satisfaction. In short I see no basis for the objections raised by the Suffolk County Department of Planning and I suggest that the plot plan approval from the Planning Board of the Town of Southold was a well thought out and proper decision by the Planning Board and that final approval, when the time comes, will likewise be appropriate. It appears that the easterly and southeasterly boundary line of Lot No. 4 shown on the subdivision map is indefinite. It is " noted that this lot comprises 9.3 acres to the division line between the "woods and "meadow". It is not the function of the Planning Board to ascertain boundary lines or determine titles `to real property. This is a function of the courts. However, from a practical approach, since the lot in question contains in excess of 9 acres and the minimum lot size is 2 acres, it is hardly likely that any determination to fix the boundary would reduce the lot below the minimum size lot. Therefore, it is my opinion that the Planning Board should proceed with the application leaving the question of the determination of the exact location of the easterly boundary line to the private individuals involved. I have spent a great deal of time searching the title to "Little Island" to determine exactly where our property line lies. Going back for 100 years, it does not appear that this property line has ever been determined.
