The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature,yet flexible to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. The reviewer is not expected to be an expert environmental analyst. • Identifying that an impact will be potentially large (column 2) does not mean that it is also necessarily significant. Any large impact must be evaluated in PART 3 to determine significance. Identifying an impact in column 2 simply asks that it be looked at further. • The Examples provided are to assist the reviewer by showing types of impacts and wherever possible the threshold of magnitude that would trigger a response in column 2. The examples are generally applicable throughout the State and for most situations. But, for any specific project or site other examples and/or lower thresholds may be appropriate for a Potential Large Impact response, thus requiring evaluation in Part 3. • The impacts of each project, on each site, in each locality, will vary. In May, 1990, the Planning staff advised that a fee of $7,300 was required before any further review of the map. We were advised that this fee was, in fact, the preliminary application fee, which, according to Section A106-23A. (2) (as amended) is required to be paid with the preliminary application. In the two years this map has been before the Planning Board, I have not been granted sketch plan approval. According to the Planning Board' s regulations, a sketch plan review is to determine if a layout meets the Board' s general criteria. I have gone through extensive requirements and research and incredible ex- pense to have more detailed topography information prepared, wetlands verified, revised surveys submitted (items usually required at the preliminary stage) , and have gotten no where as far as any kind of approval is concerned. The following must be shown on the yield map: 1. The map must be labeled as the Yield map. The Board requires a yield map prior to the sketch map for purposes of computing density. The Board does not compute the density by using yield calculations. 2. The lot area for each lot must be shown. All residential lots must be at least 80,000 square feet in area excluding areas of wetlands and LILCO easements. The wetland areas and LILCO easement areas should be so indicated on the map. 3 . The map must indicate the wetland lines as verified by the Department of Environmental Conservation and the Town Trustees. 4. The building envelope for Lot 1 is to be set back 100 feet from the pond so that DEC permits are not required. 5. Because of the quantity of wetlands involved and the sensitivity of the parcel, the Planning Board is requiring that 2 foot contour intervals be developed based on actual field surveys and ground control. The proposed access for each lot in the Light Industrial District must be shown on the map. Also, the grades of Main Road must be shown. In addition, the property description, including the metes and bounds, has not been submitted. The Planning Board has received a cost estimate of $400. 00 from their Environment Consultant for review of Long Environmental Assessment Forms. This sum must be paid in full by your client before we can authorize our consultant to proceed with the review. The check should be made payable to the Town of Southold. When the consultants complete their review, the Planning Board will consider their findings in making a determination of whether the project will have a significant environmental impact. Upon submission of revised yield maps, the Planning Board will continue with their review. Upon acceptance of the yield map, the Board will proceed with their review of the cluster proposal. Project: Sundance Shores - Major Subdivision� Y � OCT ,_ 3 Z Location: Town of Southold Situate at Arshamomaque s/o Albertson Lane TOWN OF SOUTHCL7 w/o Main Road Rte. 25 n/o Long Island Railroad Tracts Description : Subject parcel contains a variety of habitats including an actively farmed field, oak woods , early successional fields , freshwater wetlands and tidal wetlands. In general , the actively farmed fields which are planted with a cover crop at this time are found extending southwards from Albertson Lane to a series of berms which are vegetated mostly with the common cane , phragmites . Also adjacent to Albertson Lane, a freshwater wetland is found. The freshwater wetland consists of a dug pond surrounded by thick vegetation including the obligate wetland plant , buttonbush. Oak woodlands are found in the eastern portion of the property and adjacent to the Main Road and The Long Island Railroad, the western portion of the property adjacent to lands now or formally Yaxa and Cassidy , and also within an area surrounded by tidal wetlands . The actual abundance and diversity of flora found within the freshwater wetlands of the dug pond is quite limited because slopes surrounding the pond are steep. Pond levels are maintained by overland runoff including road runoff from Albertson Lane. The following plant species were identified in the freshwater portion of the site: Buttonbush Cephalanthus occidentalis Northern arrowood Viburnum dentatum Common winterberry Ilex verticillatum Green brier Smilax rotundifolia The following plants were isdentified in the adjacent area to the freshwater wetland: Flat-top goldenrod Euthamia graminifolia Queeen Anne' s lace Daucus carota Ragweed Ambrosia artemesilfolia Red raspberry Rubus idaeus Blackberry Rubus allegheniensis 475 Rambler Road, Southold, NY 11971 (516) 765-4071 Tartarian honeysuckle Lonicera tatarica Common privet Ligustrum vulgare Smooth sumac Rhus glabra New York fern Thelypteris noveboracensis Groundsel bush Baccharis halimnifolia The following plants were identified in the oak woods portions of the site located adjacent to the Long Island Railroad and Route 25 and on the western prtion of the parcel and in adjacent areas to tidal wetlands : Red Oak Quercus rubra White Oak Quercus alba Red Cedar Juniperus virgininana Flat-top goldenrod Euthamia graminifolia Black locust Robinia preudo-acacia Northern bayberry Myrica pennsylvatica Red maple Acer rubrum Fox grape Vitis lambrusca Black cherry Prunus serotina Cane grass Phragmites communis Mamosa exotic Blackberry Rhubus alleghensiensis The tidal wetlands portion of the site is both extensive and contains the classic successional vegetative characteristics . Large stands of low marsh cordgrass are found along the water s edge extending inland in some cases several hundred feet . Its upland limits are sharply defined by the occurrence of slat meadow grass . Adjacent to the stands of salt meadow grass forming its upland limits are groundsel bush and phragmites which dominate the vegetative covertype. The following plants were identified in the tidal wetlands found on site: Low marsh cordgrass Spartina alternifolia Salt meadow grass Spartina patens Spike grass Distichis spicata Groundsel bush Baccharis halimifolia Cane grass Phragmites communis An effort was made to determine the presence of the northern harrier , osprey and bald eagle all of which were regarded as potentially present by the applicant ' s consultant , Dr . Robert Johnson. None of the above mentioned species were found on site. In addition , no osprey nor northern harrier nests were found on site. 475 Rambler Road, Southold, NY 11971 (516) 765-4071 Recommendations 1- The overall development concept for this project appears to be sound because the greatest intensity of development is placed on the farmland portion of the site. The farmland is considered the least sensitive habitat found on site. 2- The freshwater wetland as indicated on the survey appears to be accurately represented in terms of its size and shape. Flags have been placed in the field depicting the wetlands boundary . However , the size of the pond is essentially the size of the wetlands because of the steep slopes rising from the pond ' s shoreline and the abrupt change in vegetative covertype. 3- While the freshwater wetlands is not considered overly sensitive , it appears to contain permanent standing water and thus should be protected. It is therefore not advisable to utilize the pond as a drainage area for the proposed road. 4- I find the tidal wetlands line as depicted on the survey prepared by Roderick Vantuyl as amended April 12 , 1990 to be adequate for the purposes of subdivision design and recommend that the Southold Board of Trustees accept said line. 5- I recommend that building envelopes showing a minimum of 75 feet between the envelope and wetlands line be placed on the survey prepared by Roderick Van Tuyl as amended April 12 , 1990 for lots 9 , 10 , 11 , 12 , 13 , 17 and 18 . 6- I recommend that a building envelop showing a minimum of 50 feet between said envelop and the freshwater wetland be placed on the survey prepared by Roderick Van Tuyl as amended April 12 , 1990 for lot #1 . 7- It is recognized that lots 15 , 16 , 17 , and 18 have been zoned for Light Industrial . Thus , the eventual development of these lots will likely require site plan approval from the Planning Board. In the eventual processing of these site plans , special attention should be paid to potential runoff impacts to the wetlands because of a mosquito ditch which is located on or near the parcel 475 Rambler Road, Southold, NY 11971 (516) 765-4071 boundary to the Long Island Railroad. Any pollutants that are washed into this ditch will likely be directly discharged into the wetlands and surface waters of Arshamomaque Pond. The mosquito ditch extends onto or close to Lot 18 . It is recommended that the use of berms on Lot #18 be considered in the eventual site plan review as a means of insuring on site control of stormwater runoff . 8- Given the size of the tidal wetlands and the biological productivity of Arshamonaque Pond , the presence of the osprey is regarded as potential . Since the osprey is known to accept artificially constructed -raised platforms inwhich to build their nests , the Southold Board of Trustees may consider to have a platform erected as a means of providing nesting habitat for the osprey . The Planning Board has three stages of review for a major subdivision; sketch, preliminary and final. Banks 25 Bowden Square Southampton, NY 11968 Re: Endangered Species Hashamomuck Pond - Cassidy Lane Routh 25 in Southold Dear Mr . Banks: I have visited the above property on several occasions during the summer and fall of 1989 in regard to tidal wetland boundaries . I arranged with Mr. Charles Hamilton of the N. Y.S.D. E.C. to use the boundary as it appears on the tidal wetlands map of the area rather than go to the expense of locating the upland-wetland boundary I flagged using normal survey methods . We agreed to keep all land modifications east of the western boundary of the recently plowed potato field. We also agreed that a buffer area of bare plowed field would be free from structures and would be landscaped to be attractive to wildlife and to provide a partial screen between the proposed development and the vegetated area between the plowed field and Hashamomuck Pond. This bare field is bounded on the south toward the L. I .R.R. R. O.W. and Route 25 by old fields (abandoned for agriculture 5± years ago) and hardwood borders or hedgerows . These old fields support a diverse and rich population of deer mice, moles , shrews, meadow voles and cottontail rabbits . The wooded strips support deer mice and grey squirrels . These small mammals are a food source for various preditors including raptors (hawks and owls) that are rare, endangered or of special concern. The presence of the pond and its adjacent salt marshes and salt marsh border community add to the wildlife value of the old fields on this property and adjacent to it on the south. While there are no freshwater wetlands or even temporary ponds on or near the property and rare, endangered or species of special concern are limited to birds, some of those birds will most probably use the vegetated portion of the property. There are no habitats suitable for the nesting of birds such as the least tern or piping plover. However, least turns can be expected to feed occasionally on Hashamomuck Pond. An application form and EAF are also enclosed, along with a report from our environmental expert, Robert W. Johnson, Ph.D. We have been discussing this project with your department since May, 1989 . There were several obsta- cles associated with the development of this tract, including the presence of both tidal and freshwater wetlands, LILCo high tension lines and towers, the LIRR tracks and commercially zoned adjacent area, limited frontage and low elevations. We had originally proposed a cluster on the west- erly portion of the site in an attempt to preserve a portion of the farmland, however, due to low elevations, the development has been revised as per the attached plans. We also have been in contact with the freshwater wetlands section of the DEC. They were also concerned with an area of phragmites behind the adjacent property of Marie Cassidy to the west and a small stream running from said area out to Hashamomuck Pond. As you can see from the plans submitted, all development has been pulled back from this area. We are expecting letters from both sections of the DEC and will forward same to you as soon as we receive them. Concerning the existence of endangered species of wildlife (Section A. 11 of your EAF) , we have enclosed a report from our environmental expert. While there were findings of endangered species, all sitings were found within the wetlands area, which have been excluded from yield and all development, therefore, it is our belief the project will not have an impact on said species. Aerial photos were previously submitted which are helpful in locating the areas referred to in Dr. Johnson' s report. I have also contacted LILCo concerning the con- struction of the proposed road under their lines. We do not believe this will be a problem, but I will forward their written response to you. Due to the limited frontage (for the residential development) , we were extremely restricted as to our access point into the site. We did not wish to locate a road opposite any existing dwellings. We also agreed that a buffer area of bare plowed field would be free from structures and would be landscaped to be attractive to wildlife and to provide a partial screen between the proposed development and the vegetated area between the plowed field and Hashamomuck Pond. This bare field is bounded on the south toward the L. I .R.R. R.O .W. and Route 25 by old fields ( abandoned for agriculture 5± years ago) and hardwood borders or hedgerows . These old fields support a diverse and rich population of deer mice, moles , shrews , meadow voles and cottontail rabbits . The wooded strips support deer mice and grey squirrels .
