The following took place at a meeting of the Southold Town Planning Board
on Monday, October 3, 1994:
BE IT RESOLVED that the SouLhold Town Planning Board authorize the
Chai,,,~n to endorse the final surveys dated September 27, 1994.
Conditional final approval was granted on August 22, 1994. All conditions
have been fulfilled.
Enclosed please find a copy of the map which was endorsed by the
Chairman. The mylar maps, which were also endorsed by the Chairman,
must be picked up at this office and filed in the office of the County Clerk.
Any plat not so filed or recorded within sixty (60) days of the date of final
approval, shall become null and void.

Dear Mr. Raynor:
The following took place at a meeting of the Southold Town Planning Board on
Monday, August 22, 1994:
The final public hearing, which was held at 7:50 p.m. was closed.
The following resolution was adopted:
WHEREAS, Andrew Cassidy & Sons are the owners of the property known and
designated as SCTM# 1000-52-5-59.3 & 59.4 located on the west side of Main Rd.
(NYS Rt. 25) and the south side of Albertson's Lane in Gmenport; and
WHEREAS, this proposed set off is to set-off a 4.5131 acre parcel, located in the L.I.
Zoning District, from an existing 62.5829 acm parcel located in the R-80 Zoning District
and the L.I. Zoning District; and
WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental
Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a
Negative Declaration on April 12, 1993; and
WHEREAS, a final public hearing was closed on said subdivision application at the
Town Hall, Southold, New York on August 22, 1994; and

WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore,
RESOLVED, that the Southold Town Planning Board grant conditional final approval on
the surveys dated August 3, 1993, and authorize the Chairman to endorse the final
surveys subject to fulfillment of the following conditions. All conditions must be met
within six (6) months of the date of this resolution:
1. Submission of six (6) paper prints and two (2) mylara of the final subdivision.
All maps must contain a valid stamp of Health Dept. approval and a notation that
a Declaration of Covenants and Restrictions has been filed. The notation must
include the Liber and Page Number of the recorded declaration.

DECLARANTS.
WHEREAS, the Declarants are the owners in fee simple of a certain
parcel of land situate at Greenport, Town of Southold, County of

and to prevent the overcrowding and to conserve the ground water
resources of the Town of Southold, and
WHEREAS, the Declarants have applied to the Planning Board of the
Town of Southold for approval to set off 4.5131 acres from 62.5829

NOW, THEREFORE, the Declarants do hereby declare that the aforementioned
said premises and every portion thereof is hereby held and shall be
conveyed subject to the conditions, covenants, and restrictions
hereinafter set forth, and that every purchaser of said premises
or any portion thereof, by the acceptance of a deed thereto, covenants
and agrees that the premises shall be held subject to the covenants,
conditions and restrictions hereinafter set forth.
Ail stormwater runoff resulting from the development and
improvement of this subdivision or any of its lots shall be
retained on the site by adequate drainage structures so that
it will not flow into the right-of-way of Main Road (S.R. 25).

A buffer area in compliances with the minimum standards of
Section 100=213 of the Southold Town Code will be required
prior to the issuance of any building permit for Lot Number 1.

A landscaped strip in. compliance with the minimum standards
of Section 200-212 of the Southold Town Code will be required
prior to the issuance of any building permit for Lot Number 1.

There shall be no further subdivision of Lot Number 1 in
perpetuity.
Lot Number 2 shall not be subdivided or its lot lines
changed in any manner at any future date unless authorized
by the Town of Southold Planning Board.

That all of the covenants, conditions and restrictions contained
herein shall be construed as real covenants running with the land
and shall continue and remain in full force and effect at all times
as against the owner of the premises or any portion thereof in
perpetuity. Said covenants, conditions and restrictions shall
be binding upon, inure to the benfit of and be enforceable by.
the Declarant, their heirs, successors and assigns, and the Town
of Southold and its successors and assigns, and the failure of
any of the foregoing to enforce any of such covenants, conditions
and restrictions shall in no event be deemed a waiver of the right
to do so thereafter.
These covenants and restrictions can be modified only at the
request of the then owner of the premises with the approval of
a majority plus one of the Planning Board of the Town of Southold
after a public hearing. Adjoining property owners shall be
entitled to notice of such public hearing, but their consent to
such modification shall not be requird.
The Declarants grant the continuing right in perpetuity to the Town
of Southold or any of its designated representatives to inspect any
areas designated open space, common areas or similar.nomenclature so
as to insure continued compliance with the covenants, terms and
provisions designated herein in regard to same and to insure that
such covenants, terms and provisions have not been violated.
The Declarants grant the continuing right in perpetuity to the Town
of Southold or any of its designated representatives to enforce the
conditions and restrictions of the covenants as they relate to the
open space, common area or nomenclature and to take any legal action
it deems necessary to enforce the conditions and restrictions of the
covenants. These rights of inspection and enforcement shall be
binding upon declarants, their heirs, executors, legal
representatives, distributees, successors, assigns and transferees.

Henry Raynor: Good evening Mr. Chairman, members of the Board. My name is
Henry Raynor, representing the Cassidy's. This division set off you have before you
is basically to allow a use on the LI property, 4.5 acres, from the remaining
residential farm. This action was begun before your Board in November of 1992
and we received a Negative Declaration from your Board in March of 1993. There's
been considerable back and forth, discussion and correspondence in regard to the
covenants and restrictions on the property and finally we received approval from
the Suffolk County Dept. of Health Services at the end of 1993. In July of 1994 we
received the final approval from Suffolk County as well as the County Attorney's
office with regard to the property. I believe your Board is in possession of the
signed, stamped, working copy from the Dept. of Health. As of yet, the mylars
and the paper prints have not been returned to us; we weren't in possession of
those until last Saturday. We're aware the Board is still in need of those and we'll
probably be able to produce those within a week. If you have any questions, I'd be
happy to answer them.

The following resolution was adopted by the Southold Town
Planning Board at a meeting held on Monday, May 3, 1993:
BE IT RESOLVED to adopt the April 15, 1993 Suffolk County
Planning Coramission report with the following amendments
(numbers correspond to numbers in report):

#2. Is to be revised as follows:
As per Section 100-213 of the Town Code a transition
buffer area is required along all boundaries of a
nonresidential lot abutting any lot in a residential
district. The minimum buffer area for Industrial
districts as required by this Section is thirty (30)
feet.
A buffer area in compliance with the minimum standards
of Section 100-213 will be required prior to the
issuance of any building permit for Lot Number 1.
#3. Is to be revised as follows:
As per Section 100-212 of the Town Code, in all
nonresidential districts, there shall be a landscaped
strip in the front yard area. The minimum area in the
Light Industrial Districts is a strip twenty-five (25)
feet in width.
A landscaped strip in compliance with the minimum
standards of Section 100-212 will be required prior to
the issuance of any building permit for Lot N~mber 1.
#4. Is to be revised as follows:
There shall be no furhter subdivision of Lot Number 1
in perpetuity. (The applicant has put forth a covenant

That said proposed plat is approved subject to the meeting of the
following conditions that are deemed necessary to help preserve the
natural and aesthetic attributes of the adjoining residential area
and the traffic and safety carrying capacity of Main Road (S.R. 25).
All stormwater runoff resulting from the development and
improvement of this subdivision or any of its lots shall be
retained on the site by adequate drainage structures so that it
will not flow into the right-of-way of Main Road (S.R. 25).
A buffer or replanting area at least 25 feet in width shall be
established along the boundary of Lot No. I with the residential
property.
Except for curb cuts and proper sight distance requirements a
buffer area shall be provided along Main Road to help preserve
the natural vegetation along the road, so as to enhance the
aesthetics of the road and help minimize the erosion potential.
No lot shall be subdivided or its lot lines changed in any manner
at any future date unless authorized by the Town of Southold
Planning Board.
A fence, in accordance with zoning requirements as to height and
type, shall be erected by the subdivider along the common
boundary of this subdivision with the adjoining residential
property. The fence will help to avoid any conflicts that may
arise between the future lot owners and the users of the
industrial property.

As part of the site plan review process, a limit of 2 curb cuts
should be allowed on the property with coordinated parking if
possible to help preserve the safety and traffic carrying
capacity of Main Road.
It is suggested that before approval is granted to this
subdivision that the subdivider be required to submit this
proposal to the Suffolk County Department of Health Services for
review to insure that the proposed subdivision will meet the
requirements and standards of that agency.
According to a map that was received from the State of New York
this property appears to be located within an area that is
considered to be archaeologically sensitive. Many sites contain
material and/or buildings that are of prehistoric or historic
value. These sites should be preserved or developed with a
sensitivity for historic or cultural values that can be available
for the appreciation of future generations.

acting under the State Environmental Quality Review Act, assume
lead agency status on this Type 1 action, and as lead agency,

The set off is not expected to have a significant
environmental impact as at this time it will result in the
creation of two lots divided along the zoning boundary. Future
subdivision of the R-80 portion of the site will undergo careful
delineation of the wetlands and detailed environmental review.
The applicant has put forth a covenant and restriction on
the LI portion of the site restricting it from any further
subdivision. Any site plan submitted for the parcel will require
wetland delineation, and depending upon the use and design,
mitigation may be required.

Sketch plan approval is conditional upon submission of

or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-

The Planning Board urges the Town Board to follow the
reconmmendation of the Town's Land Preservation Conunittee that
the Cassidy property be acquired with the Town's Open Space
monies.
The Planning Board finds that this 65 acre property would
be an ideal addition to the Town's open space holdings for the
following reasons:
The scenic views of Hashomomaque Pond provided by the
property in this immediate area is argueably one that
could be enjoyed by anyone whether they be a resident
or a tourist.
o
Acquisition of this property would provide for
enhanced public access to Hashomomaque Pond. At this
time, Hashomomaque Pond is unaccessible other than by
two or three road endings, and the bridge on SR 25.
The railroad bridge is used to gain access also, but,
all too often with tragic results.
This particular property is one of the most
accessible pieces due to its ~rontage on both SR 25
and Albertson Lane. Thus public access could be
provided here with little or no impact on the
neighboring residents.
If this were to be purchased, the proposal to remove
the dikes and restore the wetlands could only enhance
the ecological health of the Pond, which is one of the
Town's most productive shellfishing areas. Given the
known impacts of development, preservation of this
parcel would help keep Hashomomaque Pond viable for
shellfishing.
In sum, this parcel is a prime example of the type of
property that the Open Space monies were intended for.
Accordingly, we heartily endorse the Land Preservation
Committee's recommendation that this parcel be purchased with
the Open Space monies.
The attached copies of the tax map and aerial photograph
have been marked for your convenience.

At our meeting of August 18, 1992, the Committee reviewed the appraisal
of this parcel by Richard A. Winters, dated July 27, 1992, which fixed the
fair market value at $500,000. The Committee voted to recommend
acquisition of this land for Open Space by the Town Board.
I am sending this report to you now, rather than wait for the meeting .
minutes, because of the concerns expressed by the Town Board during its
consideration of the Cassidy proposal at the Executive Session on July 14,
1992.

As we stated in our meeting, we believe that the Cassidy property is an ideal
prospect for acquisition by the Town of Southold. It is worthy of your careful
consideration. In light of our discussions last week, we recommend ~at the Town
negotiate a "bargain sale" directly with the Cassidy Family. '~
This potential acquisition represents a rare opPortunity to protect a property
which can pr. ovide a wide variety ofpttblic benefits:
1) the natural diversity of the pr°~e, rty (wetlands, woodlands and 6pen fields)
can provide significant benefits as waterfowl and wildlife habitat;
2) restoration of the wetland portion of the property offers the' oppormniiy to
revitalize significant tidal wetlands and provide water quality benefits to ·
Hashamomuck Pond (one of the town's most productive creeks).
3) the property lends itself to public access with frontage on a public ro'ad
and public waters;
We believe this acquisition can be justified to town residents on its own merits. It
is all the more justifiable given the possibility of acquiring and restoring the property at
below fair market value.
Please let me know-if the Trust can provide any further clarification or assistance
in this regard. We continue to be interested in the restoration of the site given the

prior to the issuance of any building permit for Lot Number 1.
A landscaped strip in. compliance with the minimum standards
of Section 200-212 of the Southold Town Code will be required
prior to the issuance of any building permit for Lot Number 1.
There shall be no further subdivision of Lot Number 1 in
perpetuity.
Lot Number 2 shall not be subdivided or its lot

That all Of the covenants, conditions and restrictions contained
herein shall be construed as real covenants running with the land
and shall continue and remain in full force and effect at all times
as against the owner of the premises or any portion thereof in
perpetuity. Said covenants, conditions and restrictions shall
be binding upon, inure to the benfit of and be enforceable by.
the Declarant, their heirs, successors and assigns, and the Town
of Southold and its successors and assigns, and the failure of
any of the foregoing to enforce any of such covenants, conditions
and restrictions shall in no event be deemed a waiver of the right
to do so thereafter.
These covenants and restrictions can be modified only at the
request of the then owner of the premises with the approval of
a majority plus one of the Planning Board of the Town of Southold
after a public hearing. Adjoining property owners shall be
entitled to notice of such public hearing, but their consent to
such modification shall not be requird.
The Declarants grant the continuing right in perpetuity to the Town
of Southold or any of its designated representatives to inspect any
areas designated open space, common areas or similar nomenclature so
as to insure continued compliance with the covenants, terms and
provisions designated herein in regard to same and to insure that
such covenants, terms and provisions have not been violated.
The Declarants grant the continuing right in perpetuity to the Town
of Southold or any of its designated representatives to enforce the
conditions and restrictions of the covenants as they relate to the
open space, common area or nomenclature and to take any legal action
it deems necessary to enforce the conditions and restrictions of the
covenants. These rights of inspection and enforcement shall be
binding upon declarants, their heirs, executors, legal
representatives, distributees, successors, assigns and transferees.
