By this appeal, appellants seek a variance from Article VI, Section 100-60 for permission to use this premises as a business office for a marine contractor, with accessory use for storage and repair of that contractor's own vehicles and own equipment. The pre~ises in question ii identified on the Suffo1kCou~ty Tax Map as District 1000, Section 52, Block 5, Lot 58, and contains an acreage of 3.5472r with frontag~ along the Main State. Road of 584.37 feet and along Albertson's Lane of 596.81 feet. This premises is located in the "B-Light" Business District and is vacant. By this application, the following improvements are proposed: (a) two 30' by 60' buildings "(b) f~ncing around the perimeter of the area of the requested use, all of-which are indicated on the survey/ amended February 22, 1984 with pe~ci1 sketch. . . ~ All of the members of this board are familiar with the property in question as well as the surrounding neighborhood. For the record, it is noted that som~ of the uses permitted in this zoning district are: (a) business, professional, govern- mental offices, (b) banks, (c) financial institutions, (d) retail stores, (e) restaurants, (f) retail bakeshops, (g) laundromats and similar establishments, (h) personal service stores/shops, (i) marinas for noncommercial boats, including sale of fuel and oil for those boats accommodated at same. It is the opinion of the board that the use requested for a marine contractor business office, with accessory storage and repair of that contractor's own vehicles and own equipment, would be compatible with the surrounding commercial zoning districts, and that the granting of this variance would not alter the essential character of the locality. Also, the board determines: (1) that the use under this decision would not prevent the orderly and reasonable use of adjacent proper- ties or property in adjacent use district; (2) that the safety, health, welfare, comfort, convenience and order of the town will not be adversely affected by the proposed use and its location; (3) that the interests of justice would be served by allowing the variance, as further indicated below. Wickham, Esq.) for a Variance to Amend Conditions 3, 7 and 8 of the 6/28/84 decision rendered under Appeal No. 3222, and Article VI, Section 100-60 in a proposal to establish business office for marine contracting with accessory use for storage and repair of contractor's own vehicles and equipment, at 67576 Main Road, Green- port, NY; County Tax Map Parcel No. 1000-052-05-058. ( The board made the following findings and determination: Appellants, under Appeal No~ 3222, appealed a determination of the Building Inspector which denied appellants' application to change use of the premises to a use permitted in a "C-Light Industrial" Zo~ing District. On June 28, 1984, this board granted a use variance as . applied with 13 conditions. On September 11, 1984, appellants applied for relief from Conditions ~o. 3, 7, and 8; and on November 15, 1984, a public hearing was held. The board members have taken all the statements of the hearing into consideration. Condition No.3 reads, "Said fencing shall be of a type that will not allow visibility from the streets and other areas 6utside of the fenced area." It is the under~tanding of the board that the applicants would prefer to provide a type of fencing similar to "anchor post" with plantings. It is-the opinion of the board that during winter months, some of the plantings may not provide sufficient screening. The board has no objection to a combination of landscap- ing and solid fencing as indicated in Abigail Wickham's letter dated September 11, 1984, provid~d'it Qrevents visibility from the exterior. It is the intent of this board that parts, supplies, inoperable or junk vehicles, whether dismantled or otherwise, shall not be permitted to be placed outside ofa building. Cranes, crane booms, buckets, snow plows, and related accessory equipment may be stored outside the buildings, but must be within the screened, fenced areas shown on the 9-13-84 site plan. { l Condition No.8 reads, "All service or repair of vehicles/equip- ment of the contractor shall be conducted in a building." The board members agree that since the contractor intends to repair or service only his own vehicles and/or equipment, that they should be permitted to be serviced outside the buildings provided they remain in the screened, fenced areas, and shall be typically placed in the areas depicted on the 9-13-84 site plan. Any extensive modification of these "service and storage areas" which may block access to these buildings in the front yard area will require re-app1ication to this board for reconsideration. One of the majur concerns of this board is access by emergency vehicles in the event of a fire. NOW, THEREFORE, on motion by Mr. Grigonis, seconded by Mr. Sawicki, it was, RESOLVED, that the Decision as Rendered under Appeal No. 3222, in the Matter of JOHN WICKHAM AND OTHERS, be and hereby is amended to re-word Conditions No.7 and 8, as follows: 7. Vehicle lifts or pits, any dismantled (inoperable or junk) vehicles of the contractor shall be located within a building. Cranes, crane booms, buckets, snow plows, and related accessory equipment may be stored outside the buildings but must be within the screened, fenced areas shown on the 9-13-84 site plan; 8. Any service or repair of vehicles owned by the cO,ntractoT for which this use variance is granted shall be permitted within the screened, fenced area, and shall not be permitted to be in any area outside the fenced areas. Doroski). The public hearing on this matter was held earlier this evening, at which time the hearing was declared closed pending deliberations. The board made the following findings and determination: This is an application for a Special Exception to permit the placement of 4' by 4' directional sign for the General Wayne Restaurant, which is located quite a distance away from the main routes in the township at Bayview, Southold. The sign is proposed to be located ( on the South Side of County Road 48, a minimum of 25 feet west of its intersection with Ackerly Pond Lane, and a minimum of five feet from the northerly property line along C.R. 48. The premises in question is located in the A-Residential and Agricultural District and contains an acreage of approximately five acres. The present use of the premises is agri~ultural sales, and a ground sign advertising the Doroski's Nursery exists at this northerly section of the property. It is the opinion of the board that the purpose of the sign is directional and therefore will be in the public's interest as distinguished from advertising and is necessary for the traveling public. It is also the determination of the board that: (1) the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts; (2) that the safety, health, welfare, comfort, convenience and order of the town will not be adversely affected by this sign and its location; (3) this proposal will not alter the essential character of the property or the neighborhood in this zoning district; (4) the use will be in harmony with and promote the aeneral purposes and intent of zoning. Comnents: The Health Department's primary environmental concern pertaining to development is that the applicant comply with the requirements of the Suffolk County Sanitary Code especially Article V and VI, and relevant construction standards for water supply and sanitary sewage disposal. These considerations are to be reviewed completely at the time of application. Full consideration in placement of water supply wells and disposal systems is given to state and town wetland requirements. The Health Department maintains jurisdiction over final location of disposal and well systems and the applicant should not undertake to construct any water supply or disposal system without Health Department approval. Other portions of the Suffolk County Sanitary Code also apply to corrmercialdevelopment such as Article XII. Each lot having frontage on Main Road shall have a turnaround pro- vision, such as a T-shaped shunt, so that a vehicle leaving a lot will not have to back out into the traffic stream on the road. 5. A short radius curve shall be provided at the corner of the inter- section of Main Road and Albertson Lane to facilitate turns at the corner and to enhance the streetscape. 6. All stormwater runoff resulting from the development and improvement of this subdivision or any of its lots shall be retained on the site by adequate drainage structures so that it will not flow out onto the right-of-way of Main Road. 8. In order to minimize the number of access points on Main Road and to insure that there will not be any conflicts between the points of access that are created, consideration shall be given to creating a plan indicating the placement of access for Lots 2 and 3 and the park- ing areas on these lots. Consideration shall also be given to estab- lishing, through the creation of easements, common use of access points and parking by these lots; that is, allowing a vehicle to pass from a parkin~ area on one lot to another parking area on a lot with- out the vehicle having to reenter the road. 9. Conditions 1-8, inclusive, shall be filed as covenants and restric- tions in the office of the County Clerk on or prior to the granting of approval to this subdivision. These covenants and restrictions can be modified only at the request of the then owner of the premises with the approval of a majority plus one of the Town Board of the Town of Southold after a public hearing. Adjoining property owners shall be entitled to notice of such public hearing but their consent to such modification shall not be required. The Commission also offers the following comments on the map for your use and consideration: 1. It is suggested that before approval is granted to this subdivision that the subdivider(s) be required to submit this proposal to the Suffolk County Department of Health Services for review to insure that the proposed subdivision will meet the requirements and stan- dards of that agency. 2. Considerable care must be taken in the manner of storage and dis- posal of not only commercial and industrial wastes, but also the disposal of stormwater runoff from impervious areas on the site which can carry deleterious substances that can have an adverse im- pact on the aquifer. 3. Adequate provision shall be made for properly designed and oroperly located handicapped parking spaces. In locating a handicapped park- ing space consideration is to be given to the nature of the occupancy of the building and the probability of a handicapped person utilizing a specific unit within the building. 4.
